Hey! I'd like some help if you don't mind. I'm filling out the I-134 for my fiance and do not know whether I should include my W2s and tax returns for last year as they are not required (I was not self employed). I have a letter from my employer stating my income and benefits (my income is above the 100% and 125% poverty line this year) and the assets I have in the bank. 

 

Last year, I only made 100% above the poverty line for a 2 person family but was shy of the 125% percent line. I do not to include my w2s and tax returns and have this count against me. I also have nobody willing to be a co-sponsor. I should not need a co-sponsor this year anyways because my income is much higher than it was last year and I have the supporting evidence to show that.

 

My fiance lives in the Caribbean. Any advice? Leave the W2s and tax returns off? Attach them and pray it will be okay? What should I do?

I got that message when my I-129F was approved. My NOA2 followed shortly after. I BET tomorrow you'll get word that it's been approved and is then being transferred to the NVC.

 

I called USCIS about this and they couldn't tell me what address had been changed. An hour later I got another email saying it had been approved. Come to find out, they meant the address location of my I-129F petition was being changed... it was being transferred. Lol.

I'm not familiar with China. I was worried that because in 2012 and all years before, I hadn't met the income requirement, they would accept my I-134 for 2013, even though I was currently meeting the requirements. I had a letter from my employer, paystubs (6+ months), a bank letter, and a letter from my supervisor. I was going to get a co-sponsor because I was worried that my 2012 income wouldn't suffice. I ended up submitting the I-134 by myself and I took documents for a co-sponsor to the interview with me just in case they said we didn't qualify. I'm glad I did that route because we qualified. It's based on the income you make NOW and the evidence you submit to show that. Some countries don't allow co-sponsors either. If you're in the clear, I'd send her to the interview with the co-sponsorship documents instead of submitting them both all at once. Whatever you're doing for those documents, give them as much support as possible. Better to be too thorough than not thorough enough. For personal property, he can have some evaluate/appraise the market value of his home less his debt, I believe.

I believe you have to put all your addresses from the last 5 years and if any one of them was overseas for more than 1 year, you also write it in the section that says "Address outside the USA for more than 1 year" or whatever that says. If it was less than 1 year, I believe it still has to go in the top section.

 

And her employment should be included also.

 

I didn't have all of my plane tickets (who, before they enter this process, keeps plane tickets for years and years? Not me.) I luckily had just a handful. Do you have email itineraries? Or the email that says "It's time to check in"? If so, you can include those. I also photocopied my entire passport because I had so many stamps in and out of the country my husband was from.

Yeah, I would amend those tax papers... and... check to see if you actually have to submit 2010's tax returns at that consulate. I only was required to submit 2012's but I threw in 2011's because most other people in my fiance's country were doing that (it's what the cool kids were doing).. but they never required 2010's... and in the adjustment of status you don't HAVE to submit the last three year's returns, although they can request those at any time. Just know what you have to submit and what is option/beneficial.

All, 

 

 We are in great confusion about our situation and thought our fellow VJ'ers can help us. My fiance's visa got delayed due to passport photo not being latest. So, if he comes here by Dec 1st 2013 and we apply for I-765 (EAD) and I-131(Advance Payroll), we need to visit India in March 8th for a family function. The other option is to stay back in India till March. But fiance visa if we dont go to port of entry can create problems correct? 

 If we apply in Dec, does it create a problem for getting Advance Payroll in March? How long does it take for it? Please help!!

My fiance got a '221g' white slip as his passport photo was too faded for the immigration people!protest6wz.gif

He had sent it last Friday. All they need to do is 'stamp' the visa. Thats it!

 

Does anyone know how long it takes? I heard people get 221g for also missing documents. But we had everything.

Just his passport needs to be looked and stamped.

Hi all, 

 

We know from the Visa Journey K1 guide checklist that my fiance will need his original birth certificate for the interview. However the VJ K1 guide later states:

 

4.3.6)...What should I bring with me to the interview? 
A...You need everything from the checklist, of course, but you also need originals of everything that was originally submitted as a copy, even with the I-129F petition (except the US Citizens passport and the original I-797 approval notice). Original birth certificates, divorce or death decrees, and originals of any documents to support the I-134 fall into this category. The Consulate has the right to ask for the original of any document, so best be prepared.

 

Since I included a copy of my birth certificate (I'm the US Citizen) as required in my I-129F packet, the guide seems to suggest that my fiance is going to need to have my original birth certificate at the interview as well.  Can this be right? I've never let my original birth certificate leave my possession, let alone mailed it to another country. Can someone answer definitively whether the US Citizen's original birth certificate needs to be sent to the fiance for the interview?

 

I've tried to search for this answer on the VJ forum, and seen people ask this before, but the answers were unclear (didn't differentiate between fiance and USC) and in some cases contradictory. Unless my original birth certificate really needs to be mailed to my fiance, I'd rather not send it.

My fiance was arrested last 2007 bcoz he was beyond child support but he paid it all and case was dismissed. However, he didn't mention it in his 129f form. USCIS did background check and found out about it but still USCIS approved his petition.  As long as u r not fraudulent, ur not a threat to national security and u have a clean record after that, i guess there's no reason 4 u to get denied.

The number of shots needed at the medical will depend on the medical history and vaccination record. You beneficiary may want to get a copy of their vaccination records and bring them to the interview. Often times most applicants will require 2-3 shots at the time of the medical exam. Costs will vary.

Go to that site to retrieve and print out your I-94 info after you are in the US. Use the printout of your I-94 info for getting an SSN and filing for AOS.

Hey my husband was able to get this form filled out for him when he checked in with the airlines before he boarded in Mobay so he didn't have to worry about anything on the plane.

  

Yep the same forms, and then one additional form for his I-94.

Yes, your fiance will be given a Customs form to fill out.  The same form you have to fill out when you return to the US.

If it looks like a wedding and smells like a wedding it is a wedding. And if the visa isn't issued how will your fiancé get here. A k1 is to get married in the US within 90 days of entering the country. Time after time we have seen people denied for having an unregistered wedding. It is never ever a good idea to make final arrangements until the visa is in hand, and why risk a denial?

 

This is confusing to me. My fiance and I are planning to have a symbolic ceremony in his country (Czech Republic) after we receive our K-1 visa, just a few days before we fly to the US to get married at the courthouse. We are about to attend his medical exam and the embassy interview, then wanted to have the symbolic ceremony (without signing any papers or getting married in a church) at the end of May. This is for the sake of his family and friends in CZ that can't make the costly trip out to the US (not to mention that I'm not interested in having a wedding in the US). I'm not a fan of taking unnecessary risks, but at the same time if the marriage is not legally recognized in CZ and there is no evidence that we had a "ceremony" right before entering on his K-1 visa, is it really something I should be worried about? I read some of the examples you posted but they seem a little different that my situation.

I am just wondering why you refer to him as just "petitioner" instead of fiance or bf. Im sorry to say this but it sounds to me as if there is no feeling at all but I might be wrong that is why I said sorry.

 

On the other hand, I thinks some of VJers will agree with me that during the course of paper preparations there are always arguments and delays considering of time difference plus the work that your "petitioner" have. Doing one job is tough what more having two thats even tough. That means he has only few minutes for himself and all he wants to do once home is to eat and sleep ( my husband is like that and he only has 1 job) much more to do paper works. Plus since he works two job that means he needs to find time off to go to federal offices on work days to request the needed papers which is very hard to do. (you  will understand what I am saying once you are here). I understand your situation, yes it will be stressful sometimes but be patient. It really takes time.

 

My husband hired lawyers to do all the paper preparation but we were still the one will secure paper proof they needed and it is stressful but we did it successfully. Others dont have lawyers and they did well in the end. Patience and endurance is needed here. Remember Love choose no boundaries.

 

DOnt be too hard on him. You need more patience. In a relationship you need that. Instead of thinking  it as a stressful journey, think of it as just one hurdle that you both need to undergo because Im pretty sure there will be more :-) (thats my unsolicited advice)
