I agree with the other posters. There is nothing wrong with going to the USA to get married, so long as you return afterwards.

My husband was visiting me in England when he received the email. Perfect timing.

You're very welcome. We are going to be filing for ROC this year so I am collecting everything I can think of for that.

I agree with Nich-Nick; London is different. Our I-130 was approved with nothing more than a couple of affidavits from friends, we sent no evidence to NVC and, although I took plenty to the interview, they were not interested in it at the embassy.

You will need a CR1 visa. See the guides at the top of this page. You can certainly get married in the USA as planned but you should return to China at (or before) the end of your permitted stay. Your spouse can file the I130 petition while you are still in the US to minimize the time that you will have to be apart.

Does the checklist have a letter beside each item? Mine from London did and one of the letters corresponded to 'Received at NVC'.

I've read that about London a number of times, which is a big part of why I want to send things in early -- I feel like if I don't get them out there now, they'll never matter. Your timeline is really encouraging! I'm hoping hard that if I cover every possible base we'll be living together for our first anniversary. Fingers crossed!

I hope you're lucky. We did it in under 8 months from filing to visa in hand and that was with a minor delay because Trevor was not a citizen when we started out and a major panic at the end because of an issue at the medical! We were ready for the next submission at every stage.

Send whatever you feel comfortable with but I agree with Ryan, they do not expect or need to see financial evidence at the filing stage (and London will probably never want to see it). However, when you come to ROC they will want to see evidence if financial co-mingling over the course of the marriage so it will be worth adding him to your checking and credit card accounts as soon as you can. The bank may want to see his ID so try doing that while he is here. Bank of America added me to Trevor's account with just my British passport and DL - no SSN required.

Also, just as an FYI, it might be worth him taking out an American Express credit card in the UK if he can. Provided he has held it for at least three months and is in good standing they will transfer it to a US card when he moves which will help him establish credit in his own right.

We also filed a few weeks after our wedding and we didn't send any relationship evidence other than three affidavits from people who knew us as a couple. We were approved with no RFE. We sent nothing extra to NVC. I went to my interview with plenty of evidence but London did not ask to see any of it.

The purpose of the I-130 is to establish that you have a "petitionable relationship"; your marriage certificate does that.

Congratulations on your forthcoming wedding and best wishes on your visa journey.

Section 212(g)(2)(B) of the Act which authorizes the granting of a waiver when the civil surgeon certifies, according to HHS regulations, that it is not medically appropriate for the applicant to have one or more of the required vaccinations.

(B) Automatic Waiver Authorization under Section 212(g)(2)(B) of the Act Due to Widespread Unavailability of Certain Vaccines . As stated in paragraph (A) of this section, all vaccinations are generally considered to be available in the United States. However, due to various difficulties encountered in the production of certain vaccines, an insufficient volume was distributed to communities to meet total demand. Per the agreements reached with CDC, shortages of the following vaccines should be handled in the manner described below. Continue granting the waiver under section 212(g)(2)(B) of the Act per the streamlined procedures, if the civil surgeon certifies that the vaccination is not medically (age) appropriate or is medically contraindicated, or, in the case of the flu vaccine, the vaccination assessment was not performed during the fall (flu) season.

IR-1 / CR-1 Spouse Visa Process & ProceduresNew I-864 RFE Part 6

I think it figured it out.  Even if there are no other sponsors, you have to put 0.00 in Part 6 (Questions 6c, 7c, 8c & 9c).  Then transfer the figure (Question 5 individual income) to 9c (current income & 10 annual income).  Don't let the mistake happen to others.

I am horrible with pictures also. :) I think you will be fine. Penguin did have a good idea, also. Bank account info is good too; letters, phone records all speak just as loud as pictures. it proves you are together.

i THINK it means that someone is working on our petitions, they are just doing the necessary verifications, background checks, etc. I know those take a couple of weeks sometimes to get them back depending on what they are, so in conclusion i think we are being worked on now. But i understand the wait is horribly difficult. i feel like my life is at a "stand still" until my husband gets here.

i found out what it is i think, that date November 10, 1986 was when laws went in to effect in reference to marriage fraud. i dont know what else to submit to them, i gave everything we had, i go to see him every 6 mos, we talk like 20 hours a day. this is crazy.

IR-1 / CR-1 Spouse Visa Process & ProceduresStrange RFE help please

Hi everyone- here's my story- let me know if i need to ad more info.

i submitted my i-130 in august 2012 and finally got an RFE today. problem is that i do not understand what exactly it is asking for. long story short i met my husband years ago as friends in about 2000. he came here illegally. no criminal record ever but in 2011 he got caught and was given voluntary departure and went back home. i went to see him in mexico a few times and we realized that we both always wanted to be more than friends since 2000, and we got married in june of 2012. i filed i-130 with all of our supporting documents we have as a couple. we have a joint bank acct, a will, tons of emails, chat logs phone records, pictures, my five plane tickets for when i have been to see him, we have nothing to hide so we submitted everything. my rfe says it is not enough information for all of the time we have been together.... then it proceeds to say that since we married on or after Nov 2, 1986, he s not elegible due to the fact we married while he was in removal proceedings. in 1986, we were 5 yrs old so i dont understand where that date ever came about. then it says that my i-130 will be denied unless i submit a request for exemption under grounds of me being able to petiton for an alien under proceedings. i am a us citizen and he had voluntary departure in 2011, i dont understand what the letter means. i spoke to one atty today, and he said that i will need to hire an atty for this type of letter and he was confused as to what it meant also. can anyone give me any insight..... something.... i am just without words as to my confusion. thanks

IR-1 / CR-1 Spouse Visa Process & Proceduresuk police caution

hello all respected members, i really need some help and ur opinions.im a pakistani citizen and lived in uk for 4 years on work visa and come back to pakistan in may 2012, coz my wife filed i 130 for cr1 visa and i came back to pakistan and had interview in sep 2012.in short during my stay in uk i got a police caution from west midland police, reason was i applied for a job on gumtree website and got a job online than end of the month they posted a pay cheque on my home address when i put in my account than bank called me and i went there bank officer told me its a fake i explained everything but bank called the police they took me to police station and kept me for few hours and released me with a caution.that was in 2009,in may 2012 when i got my ACPO police certificate it states that caution reason is to put others on risk.during my interview in embassy CO asked me about it told him the detail and i told him its a caution i never been to court or prision.then he said ok.

Now iam in AP for almost 3 months.what do u think its a big issue to deny my cr1 visa or it will be ok...please help me with your opinions......thanks in advance...

A caution will be fine, most only get refused with prison time of a year or more.

Greetings all!

I have come here as a last resort after the discouraging prices of Imm. Lawyers.

I will soon be filing my Nigerian husband's i130 and such. I need someone who has gone through this process and is willing to dedicate time to helping me. I am willing to pay for this blessed help! I really do not want to mess up in any of the steps.

Please do forgive my hurry in explanation.

Goodevening all!

I have yet to get to the affidavit of support, but wanted to get this nagging question out of the way.

I have been an on and off cash student since 2011, even up to last year besides the time I stayed with my husband for three months. Never really carrying a real taxpaying job, but rather making it as a Nanny.

As a result of that, I have been many mother's dependant on taxes since 2010 thru 2012.

My question is, can I be my husband's sole sponsor if I show three months of sufficient income along with my horrible tax returns?

Thanks!
