Hey-oh hello,

 

When we filed for our fiancee visa, we hardly included any evidence. If I remember correctly we had 

1) pictures of us together (only 2 in total)

2) copies of 2 letters I wrote her (how romantic!)

3) a copy of my passport with only 1 stamp in it, because my other stamps were in my old passport

4) copies of the initiary receipts (or however you spell that word) of all my flights there

5) written statements by witnesses who have seen us together. I haven't read about any of those in this thread yet, and I think that's a very important one! And fairly easy to get. We got about 6 of them from my parents, her mom, and some neighbors and other family. Most of them weren't signed but just prints of emails I asked them to write. Worth the shot for sure in my opinion!

 

They didn't ask for any more evidence, and in our case it only took them a week to process all the evidence we had given, after a request of evidence (our first application was just the application itself, before I found this website). 

 

For what I can see, I think you have plenty of evidence to support your relationship!

The version I got was in Dutch, and it worked. I can't recall if they send in an English version too, but seeing as you specifically apply for it with the intention of getting a Visa, I think the version you'll get will suffice. 

 

I'm not familiar with 'covog'! But if that's what it said, it sounds like that's the way to do it.

At section 1.1 it says to pick between male and female. And behind female it says 'vrouw (indien gehuwd, dient u uw meisjesnaam te vermelden)' which means 'when married, you're required to also mention your maiden name'. So you're probably safe when filling it your current name first, and your maide name behind it.

 

 

I'm not familiar with the process of filing for a VOG from outside the Netherlands, but I can imagine there is a way. I only know how to apply for one while being present. If it tells you to send it in through mail it seems to make sense though! I can't help you with processing times for that.

Yes it is you who applies for it. I believe requesting a VOG for Visa purposes is the only instance you are supposed to apply for it yourself. 

 

You're going to need to fill in the 'VOG NP' which stands for Verklaring Omtrent Gedrag Natuurlijke Personen. I'll try to guide you through the form. (https://www.justis.n...m123-418661.pdf)

 

1.1 -> Fill in your personal information (if you need help with what to fill in where say so, I'm going to assume you know a little dutch for now)

 

1.2 -> Sign the form

2.1 -> Fill in your own name

2.2 -> Check 'overig' 
 




2.3 -> Check '06 Visum en Emigratie'

 

2.4 -> Skip this part

 

2.5 -> Check 'nee'

 

2.6 -> Sign with your name

 

3 -> Will be filled in by the gemeente (county) you're registering it. 

 

 

I'm not sure where you are right now, I'm assuming you are in the Netherlands. If this is the case, you're supposed to bring a letter from the US consulate website. I looked it up for you, this is the page you're supposed to print and bring (http://photos.state....VVOGAPPSUPP.pdf). When you print out your form and your letter, you're supposed to bring both with your passport. And about 30 euro's to pay for the fee's. I believe you'll get your VOG in the mail within 2 weeks.

Hey, I'll try to help you on this subject even though I'm not familiar with your exact situation. 

 

I just went through the process of getting a K-1 visa, and I'm from the Netherlands. I also had to get a police report (police clearance). I believe it's the same form that you need to file, we call it Verklaring Omtrent Gedrag (VOG), and in the case of a visa application, you can apply for it yourself with a letter from the US consulate. The application form is very long, but you don't have to fill in a lot of things. They devided it up in different sections, and you only need to fill in the section that's applicable to you. For instance, you can apply for the VOG if you are going to work with children, or if you have a lot of financial responsibility. But you're filing for a Visa application so you don't have to fill in a lot (I believe you only have to check a box that says so). 

 

I know it's confusing if it's just in dutch, and from what I understand the only thing I can do to help is offer you my translation services! My English is pretty good and my first language is Dutch. I don't know if this website lets you send private messages, but if it does, send me one and I'll try to remember to check it. You can ask me to translate things if needed. 

 

I don't know if you are in the netherlands right now, but if you are, you could try to go to the place that issue's these sorts of forms (every 'gemeente', or county, has one) and ask them to translate it for you. They're usually very helpful with this sort of stuff. I'm not too sure how to help you otherwise!

I'm sorry if I am posting in the wrong section, I have been reading through VisaJourney for a long time, but only new to posting.
Initially, I did have a lot of hope and excitement at filing for the CR-1 visa, or marrying within the US and doing the AOS.. 
But looking at all of the fine print, there are so, so many delays, and so, so many reasons why you can be denied...
I'm starting to lose hope.. and I havent even started this..
We have a lot of things that can be used against us, such as our age difference, he is 19, I am 29.. I have been married and divorced once, and have young kids.. he doesnt work, nor has he, he is very close with his family and still lives at home.. I have been told their home is mine and I am always welcome, and I do have others who are close US friends of mine who would gladly sponsor me.. but I'm beginning to realize that all of this seems so negative and will be frowned upon.
If I'm living at his family home with him, and his parents are not going to be sponsoring me, are they still required to provide all of their income, earnings, mortgage, tax info? The reason I dont want them to sponsor me is because they are very private people and I wouldnt want them to feel violated.
Or would it be best to live with one of my friends who is going to sponsor me?
Sorry for all of the questions..
I feel so sick to my stomach with stress and worry thinking that this is all an impossible dream...

hey, thanks for the replies!

 

So it was a telephone conversation I had with the USCIS.  The lady representing the USCIS went through a computer based template to see what the possible routes for raising an I-485.  On this template the VWP was stated as an option for entry for the I-485.  but this is contradictory to everything I have sen or heard so far.  Hence my confusion!

Hi All,

 

First post, so please bear with me.  I hope you can help.

 

I am married to a US citizen, we have a daughter together.  We have been married for 5 years. 

 

We have decided to move to the US, having been in the UK up till now.  My wife went to the US with my daughter in January, and I am to follow.  

 

We were going to go down the Consulate route, but whilst we were together in the USA last time (May) we learnt that spouses can come to the US and file the I-130 and the I-485 from within the states.  As such i returned to the UK to finalise things here before making the move... however...

 

I am now concerned that while it is possible to file for Adjustment of Status whilst in the US, it is all dependent upon how you enter.  I have searched this forum, others and spoken to the USCIS about how I enter with the intent to stay (which is what it will be).  The answer is mixed, but I am am concerned now that the answer isnt simple.

 

Being a UK citizen, I believe the only way I can enter is on a VWP.  However if I do that then I believe I cannot file the I-130 and I-485 because the VWP states I must leave the country.  However USCIS state that I can do this.  I am sooo confused....

 

Can anyone offer any advice here please?

I did my POE at Alexandria Bay on August 31, 2013 for my CR-1 Visa.  My SSN arrived in the mail this week but I have still not received my green card.  I had to do a change of address at the POE and the online form.  The SSN was sent to the OLD address but forwarded to the right one in the mail.  Does the SSN usually come before the green card or do you think the green card delivery was attempted at the old address?  Any advice would be greatly appreciated.

This is a nonstarter.  Using the VWP or a Tourist Visas with intention to immigrate is fraudulent and the consequences of such fraud are severe.

 

If you cannot meet the financial requirements on your own, then you will need a joint sponsor.  This is not dealt with until the file reaches the NVC, so you can file your petition as soon as you are married and have photocopies of the needed documents that have to be included with the I-130 petition form.

Thanks for this, I actually just read about this on the FAQ for the I-130 before I saw your reply. About having a joint sponsor, does it have to be a family member? Can it be a family friend etc?

I posted a question about this before but I need a little clarification. I am getting married to my British gf this month in the Philippines where I have been living for the last 3 years. I have not had any income for the last 3 years nor have I filed any taxes, and after the marriage I will have exhausted my finances to basically nothing so I will be moving back to the US sometime between April - June to get my finances together. I would like to bring her over as fast as possible but don't know how this is possible given my current financial situation. When in the states I was self employed doing freelance web programming and design work and hope to get back into doing this upon arriving to the states, but looking for the requirements for filing for a CR-1 I need last years tax return making X amount, which I do not have. I don't know how any of this would work being self employed for work after arriving and not having income for the last 3 years. I talked to a friend that was living in the US that brought over his fiancee from Vietnam and they got married there in the US and he was unemployed at the time of marriage and she was able to stay in the US on the conditions that he just got a job. Will I have to go get a job at an employer to bring and keep her there? Would getting a friend or family member to sponsor her be a better route? Also she will still be in the Philippines when I get to the US, is it better for her file stuff there for a CR-1, or come to the US on her 3 month tourist visa with her British passport and we start filing here? I am just looking for the fastest possible way to get her in the states with me, any advice would be appreciated, thanks.

You will hear time and again that they only schedule in the first two weeks of the month but there are many more people who will tell you that their interview was scheduled at some other part of the month. Mine was scheduled at the end of the month - four days after my CC.

You almost certainly won't be asked to show any evidence in London but I know that I would not have wanted to assume that before my interview, despite hearing it over and over from others on here. Keep the most precious items with you, send a few to him along with some colour photocopies or scans.

Trust me once you file you will feel so much better and relieved because your journey will be really starting. Than you can be a VJ addict like us all. Wacko I think is a requisite of being here. But here at least we all understand, rants, raves, states of panic (I sure had one last week). We all understand even when friends and family don't. I think you should be able to pay the cheques into your account even with both of your names on them.

Welcome to the wait. My best advice is to keep busy. Take the time to get things sorted for your departure. Spend time with family and friends - you will miss them. Make short term plans - it helps time to pass. This wait will soon be a dim and distant memory.

I think you are right that you will probably have to do the I-130 for the children first since if they cannot claim citizenship through their father, I guess they will have to do it based on residency in a few years. But I found this:

Just as an aside, the children will not lose their UK citizenship when they become USCs. The US does not officially recognize dual citizenship but it tolerates it (if that is the right word). My husband became a USC lousy over a year ago and he went through some angst before we clarified that. He still holds two passports and remains very proud to be British.

Your husband will have to file the I-130 petition for you, only a USC can file to bring an immediate relative to the US. He would file for the children at the same time and in the same package I believe.. However, if the children have a claim to US citizenship through their father they will not be issued visas but will need to establish their citizenship and then apply for US passports.

It looks like you do and it says return it with the OF-230. I haven't checked but if that is the same as the DS-230 then it is normally submitted to NVC so maybe do that but also take another one to your interview.

No, they will just issue an RFE. They might even just tell you to take it to the interview - it depends what it is. Just make sure you send the original documents to NVC. They will be returned at the interview.
