Don't be influenced by what you see people from other consulates sending in - London probably won't want to see any evidence. The only things they ever saw from us were two affidavits that we sent with our original petition as we were only just married. I took a lot more stuff to my interview but it stayed in my bag. Read some London interview reviews and see what people are asked for.

All fees are paid. your $165 is with DHS or USCIS you pay online. You can pay anytime after you receive Visa up to 1 year later. It is the green card processing fee.

 

So as far as the interview yes all fees are paid through NVC. The $165 is a separate issue. No worries.

On my (now) Wifes' original K1 visa I can't figure out which of several sequences of numbers is THE "visa number" , we're completing the DS-260 online and it's a question on that online form.

 

Is it the "control number", the "passport number", the number printed in red in the lower right quadrant?

 

You would think it would be identified but?

I am trying to help my friend pay for his wife's $88 AOS fee.  He has already completed the DS-261 Choice of Agent form.  When he tries to pay the $88, here is the error message-

 

This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately.
 
His stepdaughter's payment went through fine.  He has e-mailed the NVC twice; however, they have not responded.  Should he mail in a money order with the case & invoice ID #?  He received the initial notification on February 6, 2014.  Please advise.

This new I-864 is driving me nuts!  My friend filed for his wife and step-daughter.  Here is what the checklist states:

 

In Part 1.  Basis for Filing Affidavit of Support, please correct the following...

He has a co-sponsor.  Since he is filing for his wife he marked 1a.  I am the petitioner.  I filed for the immigration of my relative.  Was that wrong?

 

In Part 2.  Information on the Principal Immigrant, please correct the following...

He typed his wife's first, middle & last name along with her mailing address, country of citizenship & date of birth.  He left the Alien Registration # blank.  She used to work on a cruise ship in the United States, but he is not aware of an Alien #.

 

In Part 3.  Information on the Immigrant(s) You are sponsoring, please correct the following...

He marked YES I am sponsoring the principal immigrant named in Part 2. 

Since his wife and step-daughter's file is at the NVC, he left #2 blank.  I am sponsoring the following members immigrating at the same time or within 6 months of the principal immigrant named in Part 2.  Do not include any relative listed on a separate visa petition.  The wife and daughter have different case numbers.  He left Family Member 1 blank.

 

In Part 4.  Information on the Sponsor, please correct the following...

He entered his full name, address, phone number & date of birth.  I am confused!

 

In Part 5.  Sponsor's Household Size, please correct the following....

1.  Enter the # you entered on line 7 of Part 3.  He put 1 for his wife.

 

In Part 6.  Sponsor's Income & Employment, please correct the following...

He included the name of his current employer and job title.

 

In Part 8, Sponsor's Contract, please correct the following...

He printed his full name, included his signature in ink and dated the form.

 

You must submit the following financial evidence:

X Proof of current employment

X A written statement indicating why you did not file 2012 federal income.

X 2012 IRS tax schedules.

X Federal income tax returns, IRS printout, or Letter 1722 issued by the IRS.

I figured he could send a pay stub.  He did not have a copy of the 2012 return; however, he now has a tax transcript.  Am I missing something?  Does this mean that only Part 8 is missing?  Is this a false check list?  HELP!!!!!!

Hi Everyone,

I am now gathering documents for my CR1 packet and process and need input from anyone who have been denied the K1 and had to go the CR1 route. Any advice would be appreciated. Do I use the same information for evidence of bonafide relationship? Joint bank accounts, property, photos, evidence of 6 trips, facebook, email, texts, cell phone records. affidavits from friends and family.

BTW the reason for denial was that they did not believe we had a "real romantic" relationship. Thanks for your responses in advances.

 

I believe you got everything! Its best to include pictures from your different visits, not just a lot from one or two. I will also advise that you include a table of contents page with your documents to list out and explain the different kinds of documentation you are using for easy review, and page dividers will also be helpful. You may have done this already but just an fyi. Dont give up the fight. Good luck!!

We did not have any documents returned to us, but our RFE was printed on yellow paper and stated exactly what was needed. The response has to have the RFE form returned with it. Maybe they forgot to put in your envelope or maybe they will send it separately.

yea my case been completed on the date I have on my signature 07/22, but this whole time no interview and I called nvc and the lady told me my husband wont even.have an intetview for november, and ive been away from my husband a year I left him in october of last year to come here and start things, and I havent seen him since, and you would think well go see him, well the tickets are.not that cheap and.we are.definitly not that rich or have the financial ability to do so like others. so im not going to hange around here for another 3 or 4 months waiting to just get an interview and then possibly another 10 months if my husband ends up in AP after the interview, so im not going to. waist our live waiting for this, the immigration system in this country sucks and not worth dealing with, I wish I wouldve known!!!

 

Haven't seen my fiance since April 3, 2011. Boy, is it hard to get by! And we have a kid together that he hasn't seen. Then, we got refused of the K1 visa just because the CO wanted to be a jerk. We haven't given up, even when we got refused. Yeah, we got discouraged but we got passed it. If he gets denied, then we'll have to try with the IR1. If it doesn't work, then oh well, then we'll just live in the Philippines.. but like everybody else said, don't give up now. It is frustrating, we all know that. We all know how messed up their system is and everything, but you got thru a year without seeing your husband, so why not wait for a couple more months and see how everything goes?!? C'mon. Don't lose hope.

My Filipino husband and I live in the Philippines.  I'm American.  We are considering moving our lives to the US someday in the near future.  Can I petition for him to come to the States while IN the Philippines?  Would I do this in Manila?

 

What is the average wait these days? 

Also, what would be the correct visa to get?  The IR-1/CR-1 visa or the K-3?

OMG. I was just about to post the same thing, good thing I came across this post! My son and I are going back to the Philippines, so that my fiance and I can get married.. but I'm not gonna come back here til Late on of next year, and was planning to file over there.

 

We got refused of the fiance visa twice, due to financial issues, and my parents just told me to go ahead and get married because they can't refused a co-sponsor.

 

I'm clueless as well of how this works, but I hope everything goes smoothly. Goodluck! :D

Is it possible to file DCF while waiting for the I-130 to be approved (NBC)?

Or do we have to cancel the I-130 filed while I was in US then proceed with DCF?

 

I looked at your timeline and your case might just be adjudicated soon. If you cancel the I-130 now, you'll have to wait for your 6 mos to do the DCF and wait another 3 mos for the approval. We'll be doing the DCF since we don't have any pending cases. :D

for 21. if there is no address you lived together, then there is not one. dont put anything. for 22. if she is here in the states, list nearest uscis office where you are at. if she is in philipines, list nearest us consulate office (i am petitioning for my husband in mexico, so i am no help which consulate you need to put, sorry) for 17. she is the alien, so list you as her spouse and any children she has also. hope this helps good luck! for the g-325, only list your actual addresses you have lived at. if you have not lived out of the country then dont put international address, it may just cause future confusion.

Hi all,

 

As my wife and I get ready to submit our I-130, one question popped into my head that I hope someone can answer for me.

 

My job only allots me 3.5 weeks of vacation per year and I have only been able to go and visit my wife for 10 day to 2 week blocks at a time, two times per year. And she's been unemployed throughout most of our relationship and hasn't been able to get a visa to come see me. So all of the face to face contact we've spent has been me going to see her, rather than the other way around. In total, we've been with each other in person for about 6 weeks and our relationship has primarily unfolded over thousands and thousands of pages of emails and chats, hundreds of hours of skype video sessions and multiple hand written letters and packages to each other.

 

So, my questions are: how important is the total amount of time spent together face to face when submitting the petition? And will the fact we've been with each other a total of 6 weeks hurt our chances? Because we've haven't been able to spend a lot of face to face time should we send dozens more pages of skype chats and emails? Or no? I guess I'm getting pretty worried the USCIS will have a problem with our 6 weeks of close contact and think it's bad or something. Any and all advice and input is much appreciated. Thank you very much!

I think you will be fine. i only get to see my husband for about a week at a time when i fly out to see him, and i can olnly fly out once every six months. so we dont see each other face to face that often but we talk on the phone, text, skype, etc all of the time and i sent all of that and our i-130 was approved. good luck

try not to stress, i know its easier said than done :) take your time putting the package together to send to USCIS. and yes Darnell is right, i the petitioner did the evolution letter. i looked at my i-130 and all of the documents that i put together, as i was wondering why i got an RFE. when i looked through it with an attorney friend i know, i realized i stressed out so much, i left out key information/detail and that is why i say, dont stress and dont hide anything, they will find out you overstayed, etc. its not a fun process and i refresh my computer to check the status of my i-130 a million times a day. i have began preparing my documentation for my waiver package when ever the time comes for us to send it off. Because my husband had to leave the country for his family, eventhough it was a decision we knew he had to do, we have been living in separate countries for two years now, but in the end it is all worth it. if he would not have left to help his family, i dont think we would live in peace with ourselves, if that makes any sense.

it is true, you will need a waiver, but this happens to a lot of people. this is a common situation. it is hard, but not impossible.

i am not sure if this helps as to your question, but I filed an i-130 for my husband last august and just got an rfe in reference to our marriage, after speaking to an attorney i ended up having to send an evolution of relationship letter because i thought it best described our strange tale of circumstances as to knowing eachother him going back home then us marrying, etc. he came here years ago and had unlawful presence, however he went home (same as you, serious illness with close famly member) and we married in Mexico so we could do things the right way, he is consular processing also. i am hoping the evolution of relationship letter is sufficient, and i think it is a good idea, in my opinion. they are going to find out you overstayed one way or another. but good luck either way

I didn't use special binding, organization is key so they know what they are looking at. A table of contents is good and tab dividers too maybe. If you decide to do it yourself who knows if you get your money back, I wouldn't bet on it though unless maybe a portion of fee since it hasn't been filed. I think some attorneys send the least evidence at first to see if they can get by with just that bc an rfe is not as big of a deal to them as it is for us. When my petition went to the nvc I read the same short cut pages and they were extremely helpful. The 6-9 months sounds about right, mine took 10 1/2 months almost to be approved then about a little over a month at nvc.

Hi, Everyone here is right. I sent my i130 with basic evidence not very much and I received an rfe with an intent to deny based on lack of evidence and we have been together a long time. I had to submit more evidence which was no problem at all along with an evolution of relationship letter also and then I was approved right after I sent it. I had originally just sent my marriage cert and a few photos. So everyone is right you need evidence. My take on attorneys is that there are some that will try to get documentation sent in ASAP because they understand that the wait is very difficult and there are others that know there is for example 90 days to submit documents and they procrastinate until the last minute not taking in to consideration that although they are following legal procedure, they are prolonging your case unnecessarily. I work with attorneys so I see it all of the time. Good luck :)

Hi everyone,

 

Our I-130 Petition is currently pending at the Nebraska Service Center. I am trying to get some of the docs that I will need for the NVC/Consulate stage lined up beforehand and have a few questions.

 

(1) I see that a "long" birth certificate for the petitioner and beneficiary is required. I assume this may be the one that has both parents on it and is not an abstract right?

 

(2) Original or certified copy ok for long birth certificate. (I have my original birth certificate from approx. 30 years ago). Do I need to get a certified copy as well just in case this one is too old? May sound dumb considering they say "original" is ok but I still have my doubts. I don't want anything to get in the way of an approved visa (optimistically speaking)!

 

(3) Police reports. In Tijuana, MX, I have been told that they are processed same day and others say it takes weeks/months to obtain. Does anyone know how long they are good for (according to the consulate)? I want to see if I can order now and have them before I-130 is approved (wishful thinking!).

 

(4) Address change for beneficiary. My husband is moving to another home that we have rented jointly but I have no clue where to change that address with USCIS. Does it affect him if I change? Don't change? Per the notes I have read, he is going to receive a package from the NVC if the I-130 is approved and I don't want him to miss it b/c he moved from residence. Any suggestions?

Mexico doesnt require a Mexican police cert unless he has been arrested in Mexico while he has been there. as for the birth certificates, my husband just went to the registro civil, civil registry where he was born and got what is basically a certified copy there, and i the us citizen just took a certified copy also. you need to use his correct address in Mexico dont put that he is living in the US when he is not, that can complicate things, with NVC, each country is a little different on requirements, etc but with Mexico at the NVC stage, they do everything via email with you and your spouse. you scan in and send the documents they request and then just take the originals/certified copies to the interview. as far as the address change form, not sure what form no. it is but they are on the USCIS page to download and send in. I dont know how to paste links of other threads on this site, but look for the NVC filer threads here, they have tons of information and others that are at the same stage as you and how to guides, it makes it so much more easy to understand. good luck.

Not sure if I am posting in the correct place however, i am confused and just need clarification on something. My husband had his waiver approved on 3/28, he is going tomorrow to update his medical exam and send in his passport to the consulate. they then mail him his passport back and he can now enter the US. We will have been married for two years June 8, 2014. If we wait and fly in to the US on June 9, 2014 can he get a 10yr card instead of the 2yr card? i guess my confusion do they go by the date stamped on his passport that gets mailed to him or do they go by the date of his first POE? thanks!!
