I did not apply for a spouse visa, but I totally understand how she feels. while I waited for my visa, I kept saying bad things about the future to my husband who was back to America, and I was also very negative. I know there is not much you can do, but you should keep encouraging her, talking with her about your wonderful future together as much as you could (not about the visa!!!).

While she stays in Korea, she should make herself busy. I think that is the best way! For me, I signed up for some language classes and cooking class. She also could take short trips during the weekends. 

 

I know it is really difficult to both of you. Waiting for the visa is a pain in the ###....  But it is almost over! Keep stay positive and busy. I wish you the best!

YES you need to get  a CEMAR couz that's the requirements in interview but based on my experience i went in my interview yesterday they didn't ask me maybe it depends in the consul goodluck!!!

 

Isn't CEMAR the Certificate of Marriage that was forwarded to NSO by the LCR? Because we got the NSO Copy of that. Then last year we submitted a CENOMAR so can't they just look into that? IDK. It's two days away and I don't think we'll be able to get in by Friday morning! :(

Yeah.. I thought they were. Now, I don't know what this CEMAR is. It's pretty ridiculous that Philippines have all these kinds of forms. OMG.

Good day, VJers!!!

 

So I thought that we've completed the required documents for the interview, which is on Friday.. but when I searched the web today, I read something..

 

that we needed a CEMAR other than the Certificate of Marriage/Marriage Contract.

 

Is this true? Because we don't have enough time to get one. And I just realized that we had a CENOMAR submitted last year on K1 and submitted a CENOMAR again when we got married (civil) before June 10, 2014. So.. how is this going to work?

 

Please help.

We scheduled the interview on the 12th of September at 6:30am, exactly a year and a day when my husband (boyfriend at the time) was interviewed for a K1 visa.
 
05:30am - We arrived at the embassy.
06:15am - They started to let the people in with the 6:30am appointment. All you need is the front page of the appointment confirmation and passport. They asked who I was, and told them that I'm the petitioner so they let me in as well.
07:01am - We actually got inside.
07:35am - Husband got called for biometrics.
09:16am - Got called for the documents. We got called in inside an interview room, which got me real nervous, but the Filipino guy was awesome. He was so cool. He told me to pay the fee, which by the way increased by $95!
09:30am - We got out of the isolated interview room.
10:13am - Got called for the ACTUAL interview. My husband took the oath. The consul asked him who did he marry. Then, he asked me where do I live and who do I live with. Then, he asked me where do I live in the states. Then, he said, "You have to establish your domicile in the United States.." and then I told him, "I have my bank statements here.." he interrupted and asked if it was still open, and told him, that yes, it is. I also told him that I have my ticket going back to the states, he asked when is the departure date and I told him. I was trying to give it to him and he didn't take it and said it was okay. Then he said, "ALL YOUR DOCUMENTS ARE COMPLETE, PLEASE TAKE YOUR SEAT AND WE'LL CALL YOU BACK."
10:24am - We sat back down. 
10:45am - Number got called to line up on Window 69. 
11:00am - We were finally at the window, and was just told to go home, that the visa will be delivered to us.
 
Few advices..
-for those who ARE NOT with their petitioner, it is best to bring a lot of pictures and evidence. We weren't asked for any of those. No evidence or anything, but it's still best to bring a lot of those.
-Be alert! The numbers that are called are not in order, and some numbers that are alike may be called at the same time.
-Listen carefully for the instructions. People at the embassy, do NOT like repeating themselves, as they already do everyday, at different appointment times.
-Just take your passport and appointment confirmation out when entering the embassy. Like I said, they do not like repeating themselves.
-If you're not bringing your petitioner with you, DO NOT bring any cellphones or electronic devices. There are vendors that will tell you that you can leave your phones with them, but I wouldn't trust them.

hello guys..we are at nvc stage now.waiting for our iv fee to be available..i just want to ask if it is a red flag during the interview. we became a couple 2010.met him in person 2012 and got engaged..married 2013.is it a red flag if i havent seen my husband n person for more than a year now?.but we do call each other everyday on skype...we talked everyday..im a bit worried..thank you

 

Bring as much evidence as he can. Including phone bills or Skype screenshots. If you call him thru a third party company like Owtel or so, bring the bill for that and highlight his number. :D 

 

Also, bring a lot of pictures, no matter how old the pictures are. :)

ok, yes my waiver was accepted and approved. I am not sure why by the information you gave they would think you would need to submit a waiver more than once, they must not be that good of a waiver attorney if they cannot stand 100% beside their work. on the other site there are a lot of good waiver attorneys if you want to use an attorney. and from what I have always heard the main reason for a denial of a waiver is lack of evidence of hardships, so just make sure to back up every argument you have, not necessarily a lack of hardship is an automatic denial, however, lack of argument of same is worse. As far as NVC, yes they asked me for any court documents relating to his traffic ticket and any court orders from immigration when I disclosed it on the immigrant visa application it asked for any document back ups.

Hi, ok assuming that you are not in the states right?, it sounds like you will have to file an I-601 waiver (however, one cannot be sure without knowing how you entered the states, and how many times you crossed or attempted to cross). the form the attorney is talking about probably is a g-28 form, which gives attorney permission to "enter the case and or find out case specifics from uscis and receive notices on your behalf" pretty much. My husband had to do a waiver also, not for dwi but for driving without a license and was also given voluntary departure. with NVC just make sure you have the voluntary departure order from the judge and the sentencing documents for your dwi because they will ask for those at nvc and the interview also. if you want more info on the waive process, you should check out the site immigrate2us.net however for NVC info, this is the best site, it helped me through step by step just read the guides and read them again.

Actually, I really am trying really hard not to succumb to the temptation to lash out, cry, and do something stupid. My husband and I are not really patient people but we're here and we're trying. If you notice from my timeline, we didn't file the petition until after 1 year of being married. Our initial plan was to find alternative living arrangements - a neutral country where we can both find work and start our married life - but that plan didn't pan out. His frequent trips to the Philippines has become very expensive and detrimental to his career so we thought, you know, we have reached the dead end and will need to file for the visa. A few months into this and the gathering of the documents alone, drove us nuts to the point of us always fighting and so we thought, we need a "shock absorber" - we hired a lawyer. laughing.gif Now whenever we need to vent, fire up at something (someone), then there's the lawyer - at least me and my husband don't fight about this "great" visa process anymore out of frustration (sexual and everything else).

There's always that thought in our heads that maybe he can just move to the Philippines, unfortunately, his profession will not allow him to move here and get the same pay here as he is getting there. It's just not an option for us. It's financial ruin.

I feel for you. And I just have to say, that you're very lucky that you have the option to move out of the US and join your wife. I have to agree that that in itself is BEING POSITIVE. I wish my husband and I can also do the same. For now, all we can really do is try not to count the months that we haven't been together and instead count the months lesser that we will be apart - that way, it's easier to bear.

The IV Bill is the immigration visa fee which is required from petitioner/beneficiary. You can not make this payment without the NVC generated invoice.

The fact is that you need either a SSN or a ITIN for the foreign spouse. I know I did this last year and will do it again this year. It is the law according to the IRS. Yes Sunshine you two can file married jointly no problem as long as you have an ITIN which is obtainable with the form W7.

Form W-7. You can download it from the internet. Just google it. As a matter of a fact, it is a requirement!

The USCIS has many problems with the amount of petitions they received. They are not up to speed. Hang tight and you will hear something soon. And as for me and the way my luck goes, I only wish they get to it this year.

I received a letter from NVC that my case has been forwarded to the embassy and that same letter said that
an interview has been scheduled for us at the embassy so I guess they are now doing the scheduling. What
is confusing is whether or not we still need packets 3 & 4, because it looks like all those documents for the packets

My husband and I filed a few weeks after our marriage so we had none of the things you mention either. All we sent were three affidavits written by friends/co-workers who knew us as a couple. We were approved with no issues. I took a lot of evidence of our ongoing (long-distance) relationship to the interview but I was not asked to show any of it.

With respect to the other posters, I do not think that the OP is currently living in England so DCF is not an option. I do agree that the spouse visa is probably the better option.

K1 applicants take the AOS forms to the interview. Yours will be sent to NVC. I was lucky that my husband happened to be with me in the UK when our NOA2 arrived so I got all the NVC stuff ready and he took it back with him to post when it was needed. I'm not sure I would have wanted to trust my original documents to international mail. I still went through it all with him again before he actually sent it off.  

 

I took a copy of everything to the interview but I wasn't asked for anything.

It has been done in London. When I am on my pc I will find the thread in which it was discussed at length and post a link. It was around the summer of 2011 when I was waiting for my interview date.
