Emigration Requirements

The only reason I ever knew about this because of one of those ads of lawer like people to help speed up the process for rediculous amounts of money... so.. how do we get NSO documentation of our marriage certificate, birth cert (I think she may actually already have an NSO birth cert)? Is there a specific office she has to go to or something? Wife is filipina in the southern part (Mindanao? I think that's the spelling) The guy on the phone suggested she gets her NSO documents before going to Manila so she doesn't make wasted trips, but might still have to stay up there for a week or two while waiting on appointment(s) or something.

Guess I'm asking at the NVC stage after sent to the embassy and she's been notified of an appointment date where she must then get her medical and go up there. I'm already preparing her for I guess the earlier stages of all those boring documents we have to fill out and helping by explaining to her what some of the stuff means, lol. Not that she needs help, but it makes me feel better to continue being active in this and all excited to get my wife over here :P But anyways, so yeah, where and how do we get all the NSO documents for her interview? and what all does she need to get them?



Your wife needs to go to NSO Davao at J.P. Cabaguio St. Its pretty quick to get the marriage NSO copy and just wait like 20 mins if your marriage license is already forwarded from local civil registrar to NSO. Hope its already available online.

Anybody who has any idea about the validity of South Korean Police Certificate. I have my police cert from South Korean Embassy in Manila and dated July 2010. Is it still valid for using visa purposes? How long is it still valid?

Need some clarification about passport size picture. Well, we mislooked at the guide because it says there just to write the complete name at the back of the passport photo. But sad to say that my wife write her birth-date and signature also. Would this be acceptable?

I didn't notirize mine. There is nothing said in the instructions about having to do so. Just be sure that all information asked for such as name, date and place of birth, address, and relationship to you is in there.

In my opinion you would be better off contacting those who attended your wedding to write a brief statement witnessing and approving of the marriage. The instruction form gives details on what to include in the affidavit. As for the finances, my wife and I do not have any to show either. I have just recently had her added to the cable and water bill.

I had the same question before beginning my process for my wife and I (before we were married). We decided to go with the CR1 visa for the sole purpose of her being able to work and being a permanent resident upon entry. We just got married on Feb. 15th. We worked on her package and got the I-130 package in the mail last Monday. It has been received by the USCIS 2 days later. So now we wait for the next step.

If you want to be together then get a tourist visa if you do not have one already. You can stay together as long as you obey your stay limit and leave the country before it expires. If you get multiple entries then you can go visit home for a weekend and come back and stay with him again.

Just my two cents. I agree it is a tough decision to make, but in my opinion the CR-1 is the way to go.

Well we went to the appointment and found out she DOES need the letter. Also, there is another packet of forms that needs to be sent in. One catch...they can't be sent in until we have a case number for the I-130 packet which has been received but not processed nor check cashed. So, I would recommend this to anyone with questions on here.....go to your local immigration office and talk with an immigration agent. I should have done that the first time instead of using info on here. The checklist for the I-130 here says she doesn't need the birth certificate needed anymore. Well on the official instructions for the I-130....it is still required. So thanks to that, there is a chance of the package coming back.


SO my advice and recommendation to anyone and everyone....goto the officials with your questions. It will save you wasted time and money.

Part of me knows why the Agent doesn't have to meet the legal requirements for "probable cause" but a big part of me says "look we are legal, we are within the law, so just let us go on with our lives." <sigh>

An officer can deny entry to the US at their discretion. So she needs to bring evidence of her ties to her home country with her that are strong enough to suggest she wouldn't just abandon her house, job, etc. Mortgage statements, letter from boss, pay stubs, utility bills, etc. are good evidence.

There is nothing to hide or lie about. It just doesn't make sense to me that you get so many conflicting results from each Customs agent you speak to. I wrote my Congressman also. So between that and the appointment on Thursday morning, we will see what comes of it. There are so many gray areas that even the ones enforcing them don't know what to make of it. One thing we are going to do at the appointment is see if she indeed needs one. If so then we will do it. If not, then we will ask for a certified letter stating so with Agent name and number. That way she will have that to carry with her.

My wife and I were married on the 15th of Feb. The I130 packet along with the G 325A was sent Feb. 25th and received on Feb. 27. The check still has not been cashed. So, as far as I am concerned the process hasn't started yet with customs. She has a tourist visa that is good until 2014. Shortly after filing she went back home to Venezuela to work and plan the religous wedding in Dec.

On March 8th she came back to Atlanta and we flew to Miami for our honeymoon cruise. Customs in Atlanta did not give her any trouble at all. Asked some questions and that was it. We arrived from our cruise to the same port we left 7 days earlier in Miami and Customs makes an issue saying she needs a Parole to travel after filing the I-130 package. They told us she can not leave the country without it or she will be denied entry when she tries to come back in. They said she needed that with the adjustment of status. So I asked do I need to file that too? They told me I already did with the I130 package. Nothing makes sense from what I have read on this site, USCIS site, and talked with others who have gone thru the process. There is a separate adjustment of status form to be filed. The I-485. They also stated that the customs guy in Atlanta must not have been very sharp.

We made an appointment in Atlanta for Thursday morning to speak with an immigration officer to get everything straight. I called USCIS customer service this morning and explained everything to him. He said we do not need a parole to travel but can do so at our discretion. He also stated that Customs can deny entry to her anytime they want for whatever reason they want. This doesn't sound right to me and has me not only frustrated, but very confused.

Has anyone else had this happen? We are trying to do this thing right and thought we were. Now we do not know what to think! So, any help would be appreciated.

Yes found the info on the USCIS site and talked with another officer that cleared things up. Since she is in the US now we need to do the adjustment of status. Once it is filed she must stay here until the Parole is issued. With the I-130 it is for people not in the country and does not affect their coming and going. Although their visa allows them to travel to the US it is up to the customs agent to allow them in. We will continue with the rest of the paperwork and wait for the I-131 to come back to us before she goes back to finish her work.

From the words of the Immigration officer I spoke with. Leaving the country after filing an I-130 will have no effect on the process, but leaving the country after filing the I-485 without a Parole letter to travel will be considered abandonment and the process revoked. So, if you have filed an I-485 and do not have the letter it would be wise to get one. You use the form I-131 and it takes 30-90 days to receive it.

We just had an issue like this coming back from our honeymoon cruise. After the process is started your tourist visa is no longer good because you are not entering as a tourist but one that intends to stay long term (permanent resident). As we found out from customs in Miami, you need a Parole to travel letter for him to travel back and forth. It takes 30-90 days to receive the letter. The form needed is the I-131 and I-485 (?) adjustment of status if not already filed. If in doubt...as your local immigration office. We have to wait to submit everything because the I 130 was sent in IAW the guidline on this site and it was only half of the process we were supposed to do. Now we need to wait for the I-130 check to be cashed in order to get the case number to put on the I-485 form. Wish we knew this earlier. Would have saved us a lot of time and heartache with customs.

There is a chance of him being allowed in depending on the customs agent, but also a chance to be denied and deported. I wouldn't take the chance if I were you. Just my two cents.

Your wife can travel on her visa to the US while the I130 is in process, but it does not guarentee her entry into the country.

Why not use Skype and setup a UK phone number? I'm sure you can avoid a lot of fees that way. He'll basically be calling you with a local number. I currently have a HK phone number so my fiance can call me with no problems (it's still a little expensive but not as nearly as expensive as calling USA). Just my $.02

Hi, this is Gabriel. Well I thought it was just us, but now I see it happens to everyone, we also fight a lot and sometimes over the dumbest things ever! so this is what we do when we fight, and I guess it kind of works out for us

First... dont go to bed till you talk things over --- dont keep things inside, open up because sooner or later they will come out in a different fight and make it even worse (if you know what I mean) -- sometimes it is good to just leave and talk after a few minutes of breathing in and out, I've said so many mean things when I've been upset so it's better wait until things cool off and you are back into ur sense and can actually talk without being hurtful and be able to thnk things through...!

About trusting your spouse... aaah that's something hard for me.. I do love my girlfriend and I do trust her !!! but when I hear some guy's name I just freak out and I can't help it, I don't know WHy and I can't comprehend why it happens but it does happen! counting to 10 and then thinking SHE Loves me, helps me to calm myself down... hahah I have told my girlfriend sometimes I wish I could put her in a box so nobody can hit on her haha (that's jsut a joke I'm not a psycho!)

NOw something that help us to get closer to each other is finding things to do together, such as reading a book, watching a movie together (we play the movie at the same time and then we watch it while we're on the phone and we make comments about it, it's actually fun), we also play games like pool, we TALK a lot on the phone, we dont like talking on the computer cuz We are SICK of being in front of computers, so I call her using this plan to call to the USA with Multiphone, it costs me $41 a month and I can talk as long as I want for a whole month, so I can spend hours on the phone! I know Multiphone is in other countries so you should check out their plans, I think it's great cuz you dont ahve to worry about minutes!

And one last thing!!! Always keep in mind that this hard time you guys are going through is gonna pass, and when you finally are together, it's gonna last forever!!!!

First off, get control of yourself. If you have a bona fide relationship you made the decisions together. you didnt say which visa you were going for, is it a K-1, K-2, H-1, if you state which one i might be able to share one or 2 experiences or send you a link as i know how nervous it can be to go there without knowing what to expect.
