Just in case any VJ's have young children, (UK)
the law changed on 1st December 2003.
Any births prior to this date are not affected, so therefore, even if the fathers name is on the birth certificate, he has no automatic parental responsibility, unless married to the mother.
He would have to apply for this in court.
For births after the date of change however, the father has automatic parental responsibility, even if never married to the mother.

If you do have difficulties with the father of your children, then my advice is to see a solicitor for more information, regarding the Hague Convention, as theres a lot more to it than this.


I saw mine, and feel better that Im aware of the laws regarding taking children abroad.

In the Uk, is it not true that you only need the fathers permission, if you were married?
As far as Im aware, if you were NOT married, the father does not automatically have parental responsibility and therefore has no say.
This is what I was advised by my lawyer.
any information on this?
My daughters father ( we were unmarried), was abusive, we parted company when I was pregnant and
he has no contact, pays no maintenance and has no desire to do either.
However, if consulted regarding our situation, would definetley NOT sign, purely from spite,
If anybody has been through the K1/K2 and was not married to the father of their children,
please offer some advice,
Im starting to wonder if my lawyer is wrong about this?

Id send one anyway, but we got approved without a letter of intent from me (UK Fiancee).
We were unaware of this site, when we initially filed, so just included a letter of Intent from my fiance (USC) and statements from 2 people who know us, regarding our relationship.
This is what my fiance was told by USCIS, prior to filing.
Though, it seems info changes, depending on who you get through rto.
We were approved without a RFE, but Id send one anyway, to be on the safe side.

I sent off my AOS package the same day as you sent your I-129F and my money orders were only presented for cashing on Friday, still no NOA1.
With the increase in applications, they are just taking a lot longer.
Hopefully you should hear something soon...

Either is fine. IIRC, there is no directive on any government immigration website or form that requires one over the other.

We always use blue ink for all legal documents because being able to easily tell the original is very important and is contractually required by most of our corporate clients. However, a very small minority do insist on black.

I know some lawyers who will use a different color for every witness on a will just to emphasize the originality of all initials and signatures.

Black or Blue, it's up to you. biggrin.gif

I hope my SO will be there in July. Mexico has an open appointment schedule for K-1's which is good for four months after you receive your interview pack. So you in essence get to pick your date, as long as they are open. star_smile.gif

Hopefully, one of the forum guru's will give you a detailed answer. From my practical view, just find a neighboring state that does not require a SS#. I know states such as Nevada and Tennessee do not require SS# to get married. While this would not solve your SS# problem, it would preserve your AOS status.

You need to create a new page, and on that page make sure you title it very specifically as to what it is. Like, "I-129F Supplement: Part B, Question 18". Then, on the place where you needed more space, say something like "see supplement, <supplement name>".

I would do an attachment per page of the G-325A, since I believe they get sent to different places (based on the footer on the pages). Worst case you printed out a few redundant pages ;)

I also signed and dated my supplement page.

I'd recommend not getting too carried away on the details of your wedding or honeymoon until you review the visa types available. For instance, if you go with a K-1, you aren't going to be able to honeymoon outside the US or its territories. This is one of the things we had to give up that we'd wanted to do.

the instructions also suggest when writing the name on the picture, to use a pencil as to not dent the photo by pressing too hard.


I tried a pencil first but because the backs of the photos are a funny paper, the lead wouldn't show up without putting pressure on it, which showed through the other side of the photo. So I bought another set and used a felt pen. It worked Much better.

It goes the other way, too, USCs! Last weekend I needed to submit proof of ties to the US. Granted, I travel to see my fiancee about five times a week. Although, when I voluntarily went to the immigration office on my next reentry with that proof, the immigration officer couldn't figure what and why I was there, as primary didn't give me a "yellow ticket" and tell me to go there.


So is it possible they would deny entry to a random Canadian who was just here on vacation for a week? Or does the word "fiance" just send the POE officers into a frenzy to make our lives harder?

Just make sure that you bring proof of ties to Canada, such as a letter from your employer stating that you are on holidays and intend to return to work, bank statements, school schedules, etc. We also received our NOA1 a few days ago and I'll be heading to the States on Friday (YAY!).

I've never had any problems travelling there and back, so I'm sure it'll be alright for you too. Have a good time at the wedding. :)


Out of curiosity, why do you guys think this is necessary? Does an additional level of questions come up if you say you are visiting your fiance compared to just saying you are visiting a friend? My GF has only been over twice, but they never ask her anything. Now I'm worried about trying to bring her down here during the K-1, but I really need to so she can help approve wedding stuff.

Plus we don't wanna get a letter from her employer because we aren't going to tell them she's leaving until we get the visa. Otherwise she might get laid off =/

Ok, its finally time that i file the K-1 package for the love of my life that lives in india.
I have a few questions though about supporting evidence about an existing relationship

We talk on the phone every single say since i met her in december 2005, only thing is though is that i used calling cards to call her. She has no internet access, and we havent sent any cards or anything to each other. How can i show the USCIS that we are constantly in touch with each other if the only method of communication i use with her is scratch off calling cards? I do dial the 1-800 number from my cell phone, and those records are available, do you think that will be substantial.

also another question i have is that i am planning on filing on oct 1, 2006. I will be going to see her in india from november 22, 2006 and will be returning on jan 16, 2006 (2 whole months YAY!!) Will it be a problem with my k-1 filing process if i am over in india 2 months into the filing process? (meaning will i need to be here in america getting other documents signed and notarized like the i-134 etc.) and also should i send my airline iteniary in with my original k-1 packet showing that i will be going to see her again in a few months?
Please help and thanks in advance about your comments.

Thanks Tom and Lisaf. The first question in the interview was "is your exhusband in the USA?" My fiancee answered that he was in China and has always been. The next question was "why did we not get married in China?" She answered that I was recently divorced and we wished to do the K1. Actually we never expected these questions. They only looked at our pictures (we had 74) and refused to see anything else. The officer asked her how many times I had come to China. My fiancee told him 2 times and gave the dates. She wanted to give him the boarding passes but he refused to see them. The officer asked her about my job. She told him that I worked in printing and I also was a musician. The officer did not understand the muscian part. She tried to show him a picture of me playing and my tax forms were with her. But still, he refused to look at the evidence. She said his chinese speaking was very poor. My fiancee speaks little english but she understands writing. She had in her possesion 400-500 chats and emails but he did not want to see them. Obviously he had his mind made up before the interview. And yes I am in the process of selecting an attorney at this time. It is my mission to get this K1 mess legally cleared up before pursuing the K3.

Hey Chilton,

My fiance Bala, and I also are going thru the exact same thing you are. Our petition was sent back to the states in July after Bala had his second interview. The reason was same as yours and we also had lots of proofs of which they were not interested in seeing.

All I can tell you is that I contacted a lawyer, and we are expecting to recive a NOID (Notice of Intent to Deny ) letter which I have heard can take anywhere from a few months to even a year or longer. So I would suggest contacting an attorney for at least some advice on how to proceed. I do know of one other petitioner who didnt reply to her NOID letter, instead she opted to marry and now they are in a mess of trouble.

Apparently the way I understand it, is that if you dont respond to the NOID letter then they will deny you and it can be seen as fraud, which we all know is not good.

You are welcome to PM me and I can give you some more information that I have received on this situation.

Can't wait on the US gvt.


What was the reason for the denial? We really need more info if you expect some help....


The paper that was given to her said that according to INA 5(A), we do not have a bona-fide relationship. This couldn't be further from the truth. She had tons of evidence with her but they did not want to see it.
I also know that just having 5(A) on the paper is incomplete. but this is what it said.

Okay I have read some others I797 notice that said that their case was approved and forwarded to the NVC. Is this an old form of the letter because the one I received today stated that my application has been forwarded to the listed consulate. I read the back of the form and it said if your application has been sent to the NVC that office will contact the person you filed the petition for directly with information about visa issuance. So does that mean that possibly I did go to straight to the consulate. I am applying for the K1 visa; however I am a little conused now. Has anyone received a letter that said it was going staight to the consulate and not the NVC like others?

Deal with the I-134, just before the interview. It's too soon now. State your current income and occupation when the time comes and provide documentation of the income, along with your last three tax returns. If the income documentation looks weak to you, provide the asset information.

Supporting documentation needs to be as current as possible, as does the date you sign the form before the Notary.



I know I was checking ahead of schedule to see if I need to get a job to avoid any future delays.
