Im so sorry to hear that! I really hope things work out for you two. I know the pain you are feeling. Yes, from my understanding they did send it back to the USCIS. A quick second interview obviously isnt a good sign =( So there hasnt been a second interview for you yet? Maybe thats a good thing! Maybe it will be approved! Keep your head up...things will work out!!

yuck! What a terrible predicament! Like others have said, if you were able to obtain sole custody of your child, that would be one way to move there. I too would have moved to Morocco if my circumstances were different. We just recieved noa2 so the interview will be coming up and i try not to dwell on the negetive but it gets a little difficult when you read about more denials than approvals from Casablanca.

Then go to court and have his parenting right re-voke. This is going to be your only way around this not here on this board, but in the court of law. You have enough evidence if what you have printed above is the case. Then move on from there,you need a family lawyer.

My post was not to indict you as a mother, nor was it to condone the fathers actions if they are as described. Honestly it was not your post that bothered me as much as some others that painted a wide brush about the validity of "father's rights".

About a decade ago I participated in several groups that lobbied against the inequalities suffered by fathers in the family court system. The goal was not that "fathers" should win, but that thier contribution to the child's life be considered on an equal par with the mother. The policy prior to that point was based on a 'tender years' concept that the child is ALWAYS best served as the mother being sole custodial parent. Family court systems are starting to slowly bend away from that concept and to the benefit of the child. The system is not only meant to protect the child from what you describe, but also to protect the child from a scorched earth attack by the custodial parent in order to demonize the non-custodial parent.



I definitely understand where youre coming from! I dont agree that the mother should always have the children...sometimes that isnt in the best interest of the child. Im glad that these laws are in place...especially for the parents who DO want to be a part of their child life.

The fathers does have rights.... In cases of children born out of wedlock really neither parent has rights.... This is why one needs to go to court to obtain a custody order in these cases. You can petition the courts for permission to travel with your child...



How do I file this petition? I went to the courts, and they told me I would have to have an open court case in order to talk to a judge. Is there a specific form that I need to ask for? Thank you so much for your advice =)

ROFLMBO!!! He hasnt paid since my son was born. He evades the system some how. The child support case has been open since 2004 and the only thing he has paid...came from his tax return ($100 in almost 8 years). Now, he doesnt file tax returns. He is working now...and NOTHING. I was told he is taking care of his new girlfriends kids...

Which places are those? Can you elaborate?

How about if the father snatches the child away from the mother without a court hearing, would you be in favor of that?

The point is that there are bad mothers and fathers, and the law is there to protect what is best for the child. It's not about getting approval from either parent, but allowing both parents to have a day in court and an impartial third party listening to both sides of the story. Thank God that laws have been enacted to protect the rights of the child , and not simply treat the child like a prized possesion of either parent.



I understand where you are coming from, but first of all...this man does not contact me to see my child, he beat me in front of my child, he threw my son across the room one day while I was at work and locked him in a room (this is what finally opened my eyes and made me leave!), he doesnt pay child support, he is a drug addict...I could keep going! I WANTED my son to have a relationship with his father...because I didnt have one as a child. I never met my father! But, Im NOT going to chase him down or contact him just so he could possibly hurt my son AGAIN! I put up with the abuse just so he would stay around for my son...but there is a cut off point!! When you put your hands on my child...ITS OVER!!! Yes, there are 2 sides to every story, and youre right hes NOT here to tell his side...HES NOT HERE FOR HIS CHILD EITHER!!! Yes, there are both bad mothers AND bad fathers...but I work my butt of to provide a good life for my son. All I wanted was to be happy for once too!!! I am far from perfect...but neither myself nor my son deserved what that man put us through! I WANT my day in court! I dont want to just snatch him away...I WISH his father would get himself together and be there for his son. while i cant give you any advice i do sympathise and understand how you must be feeling right now. jenni is from GA and has two young children and their father is an #######. he wont let them leave the US to visit me on vacation, we have no other option than for me to move to the US if we want to be together, and it seems like he has far more say in things than he should have considering the reasons for jenni and his divorce. some of GA's laws seem very biased towards the man if you ask me.

I think the bigger issue is getting stronger proof of a bona fide relationship.

Regardless of what rights your son's father may or may not have, your son is not leaving the US so I don't see how this has a significant bearing on the application. Your son's father's existence doesn't prevent you from marrying or getting engaged or bringing your fiance here.

After a denial, some people choose to build a stronger case and refile while others choose to fly to the beneficiary's country to get married and go the CR-1 route. Either way work on your evidence.

I am not sure what the CO was talking about as far as my son goes. I wish we could move to Morocco! That was our plan to begin with. I already had a job lined up, an English speaking school for my son, and we already have a home there. My sons passport is the thing that is stopping us. It is very hard... Do you know what I need to do next as far as the Visa goes? Or should I just reapply? Im so confused... Thank you for your help. :thumbs:

I am sorry, Morrocco is a high fraud consulate, regardless if your fiance does not fall under that.

Perhaps in the state of GA the child's father doesn't have any rights (I am from GA and actually do not believe this to be true) but you are dealing with federal law. If the child's father is on the birth certificate, then the father has rights, hense the situation with the passport.

You do have the option of cancelling the fiance visa, marrying and then petitioning for a spousal visa.

I heard horror stories about the Moroccan Consulate. :crying: The new legitimization law was passed in 2005, and since my son was born in 2004, the deadbeat would have to file papers to have him legitimized. That only works for the state laws though. I definitely understand the federal laws, but it is so unfair. I mean if I wanted to take my son on a vacation I wouldnt even be able to do that. Why do the laws protect people like him? He has no interest in my child...he just wants us to be miserable. My fiance had his second interview today. The visa was denied. The CO told him that it was because of my son and the proof of a bonafide relationship. (The CO didnt even look at the proof that we sent and she asked questions about my brothers father and my mothers occupation. Two things we never talked about so he didnt know the answers) She told him that because my sons father still has rights to him this would cause a problem with the visa. In the state of GA my sons biological father has no rights because we were never married. My son was not legitimized, but since his bio father signed the birth certificate they claim he has rights. I cant get my sons passport because of this. The deadbeat doesnt pay child support, he was abusive toward myself and my son, he does drugs, and he NEVER contacts me to see my son. Of course he blames me, and says that I wont let him see him. He gets to be with whomever he wants to be with, go where ever he wants to go, and do what he wants to do, but I cant do anything. He is still controlling my life!! I want a family! My fiance has spent more time and done more for my son over the past year then his bio father has ever done for him! As far as our relationship goes...yes, Ive only been to Morocco once, but money and reliable child care (since I cant take my son with me),and my job, keeps me from going again. I am far from a gullable person, and I do not fall for BS...I know all about the fraudulent marriage stuff...but I know in my heart that this man is NOT doing this. I have never seen such a sincere man. He is there for me whenever I need him! He has sent myself and my son gifts, he even sent me money one time when I had some unexpected expenses. He is very well educated, and his family is not poor. He doesnt even want to come here! He wanted myself and my son to live in Morocco, but since I cant get my sons passport, we cant go. I contacted the USCIS, and the senate today after the interview. I dont know what else to do. I love this man!! Please help!!!

Ok, I just went through this this month. Here is what I did...

On 4 Feb, I call the USCIS military helpline and talked to a person. I explained my situation (upcoming military deployment). She told me that if I would wanted to she could submit an expedite request over the phone. I agreed. She asked a few questions (receipt number, etc...).

The same day, I received an email from VSC asking me to fax them a copy of my orders and a letter signed by me with my official rank stating my reasoning for requesting an expedite.

On 7 Feb, I faxed all the documents to the fax number provided by the email.

On 22 Feb, I received a letter in the mail informing me that my request to expedite due to military deployment was approved and that I will hear fromtheir office soon.

On 23 Feb, I received an email from USCIS stating that my petition had been approved and that they are forwarding the case to the NVC (State Department).

It worked great and very fast. What I gathered from the process is that it can't hurt to ask. The worse they can say is no. Good luck!

Yeah this seems a little extreme. I even called another state where I had been married previously and the lady on the phone prepared the docs while I was on hold. Certified and signed with the Gold seal from the clerk of courts office. Then within an hour after she prepared them I had Fedex pick them up there and overnight them to me. I then fedex'd them to my fiance' and she had them in her hands in 2 days. So from phone call to Fiance' USA to Argentina 4 total days. Good Luck with everything.

Do you think if we contacted the Embassy they would let her come there and take the papers and make the necessary copies of the originals that they already possess and give them back to them so that she has all of the originals for the interview??? Congratulations to you both! Don't worry about the meeting once. My Fiancee' and I met online exactly one year ago next month, we talked for several months on line and over phone but knew we were in love almost from the very beginning. We met physically for the first time in February this year and spent 3 fantastic weeks together. As soon as she went back home I immediately filed the I-129 Petition. It was approved within 4 months (check our time line) and we're now awaiting the consulates notification for her interview date. Don't worry about the one meeting, if you have nothing in either of your backgrounds to interfere or cause conflict your process should go rather smoothly. Like the Tom Petty song says however, "The Waiting Is the hardest Part", especially when you're in love and want to be together. But it's worth it all to be with that person. You're lucky too on the replies you've received on here, they seem to be in short supply on here for certain topics. Good luck with everything and if you have any questions don't hesitate to post them.

Just a few things where people trip up: Did you include all of the pages of the G-325a? A lot of people just send the first page accidentally. Is everything signed in person, not e-mailed or faxed? Did you remember to sign the check? Did you make a photocopy of the packet for reference? Were you able to fit your "how you met" onto the I-129f? I didn't see that included, but some people can get it to fit on their forms. That's all I can think of right now. Good luck!

Hello everyone!

We are just about to submit the K-1 application to the Vermont Service Center, and we just wanted to pick the brains of those in the know to make sure we have everything we need before we send it off.

So, here is what we have so far:
1. I-129F - Fully completed, signed, and dated.
2. G-325A - Biographic information...one for each of us.
3. 1 passport-sized photo of each of us.
4. Proof of having met in the last two years - we have included the following:
- Several email printouts from various points in our relationship
- Five photographs of us together
- Photocopies of passport pages showing entry into each other's countries
5. Statements of mutual intent to marry...one from each of us, plus the following proof:
- Photos of us together with me wearing the ring.
- Copy of the ring purchase receipt
6. Check for $455.

We have plenty of forms downloaded in preparation for further steps, any hints/tips/advice on the above or future steps would be greatly welcomed. Thank you so much, look forward to hearing from you. This process is a little nerve-racking, but it's really great to know that there are others like us out there. smile.gif

only you can know how you guys are when you are toghether. If you are having this many second thoughts about it then you really need to search within yourself. How does he treat you when you are visiting him?? has he ever talked about family in the US?
I dont think that he has any legal rights to the child if he stays in Jamaica. To his defense, is he maybe just stressed out about the whole process?? anxious about starting a new life in a few weeks and so on..... these are all things you need to consider. Nobody else can decide that for you.

It's very rare to get a I-129F processed in 45 days... without an expedite it's damn near impossible (I got an expedite & it took 44 days). Like I said & others have said approximately 4 months is common (maybe not the average, but probably the median).

Every case is different, but I would make an educated guess that the average time from NOA1 to NOA2 is about 4 months (so the 138 days is pretty close).

This process is awful and long for every couple going through it. Everyone of them would be willing to give out a little more money than they already are if thats how expedites happened. NO!
As other posters have said, expedites are only given to Armed forces personel who are about to get deployed, for medical reasons, humanitarian grounds or financial hardships.


I got an expedite based on National Interests (military reasons) & I can tell you that it doesn't mean "instant approval". What an expedite does is move your application from the bottom of the pile to near the top. It still takes something like 30-60 days for approval (mine took 44 days) & the petition has to be valid (an expedite doesn't fix any issues that would normally cause the petition to be denied).

True, but the approval I was referring to is approval of the expedite. The petition still needs to pass the smell test to be approved.

Applying for a visitor visa and applying for a fiance visa are 2 separate things. One does not usually affect the other.
Applying for a visitor visa with the intent to visit the Country and go back does not raise a red flag (whether you get it or not) for a K1 because the purpose of both is different. It does not make the K1 look suspicious.
The risks are involved only if the person attempts visa fraud by applying for visitor visa with the intent of settling down in the Country.


I totally agree... applying for a tourist visa (and having it denied) and then applying for a K1 visa doesn't imply fraud. I know because we tried for a tourist visa & were denied (the thought of waiting for 9+ months for the K1 to make it through the system was unacceptable). The wait was horrible, but the K1 was eventually approved & my fiancee is here in the USA now.

The moral of the story is (like many have stated) that if the relationship is worth the wait then wait! If you are looking for a short cut you will probably just find dead ends or even a U-turn (i.e. if you try to beat the system your fiancee may end up deported later on).
