Ohh and sorry. Yes you are right there is a different way that you have to do it when the USC is in the military. I received a papers explaining both ways. If the USC is military or civilian. If he is in the military it is even easier because you dont have to show all the proof ...just some documents from the Military. She should be able to do it without her husband being present. Like I said with us it was no issue with my husband not being here in Germany at the consulat.
Ohh and Dylan's wife. I saw your journey and timeline. HOpe your daughter is ok and you received your interview date. Its horrible when children are involved and especially if they are sick. good luck

Normally, the USC needs to appear before the Consulate to claim citizenship for the child. With the USC father being in the Military and currently deployed is there a different protocol?

no my husband is in the us and he didnt have to show up at the consulst. they sent him 2 papers to fill out in front of a notary public in the US, given me permission to get our sons passprt etc. and he had to prove his citizenship by providing me with a certified copy of his birthcertificate and US passport. he also had to prove he lived in the US more than 5 years since the age of 18. tax returns or college transcripts and letter from his company how long he has worked there. i went to the consulat with our son with all the papers. no problem he was not present.

Yes he can. I have a 9 week old son and he received his american birth certificate ABROAD and US Passport when he was 4 weeks old. You have to have a lot of paperwork ...call your consulat and they tell you what you have to bring. Once you bring all the paperwork to the appointment WITH YOUR CHILD to the consulat it took them 10 mins to look it over and 1 1/2 weeks later I received his us passport and us birth certificate abroad in the mail NO ISSUES. He will have no issues getting his american citizenship.
Now we are just waiting for my I130 to go through. Ask if you have any more questions. We have 2 children and I have been through it

I was in your situation and just gave birth to our son 9 weeks ago here in Germany while I am going through the visa process. My husband did not have to be here in Germany when I received our sons american passport and filed for a birth certificate abroad. Maybe it is different by country. Ours was very easy. Had to bring german birthcertificate...proof of my husbands us citizenship (certified birthcertificate) ..he had to fill out 2 forms that the consulat sent to him in the us and had to sign and fill them out there in front of a notary public and i took them to the consulat with proof that he has lived in the us more than 5 years since the age of 18 ....and my info...got our sons passport in the mail 2 weeks later...now we are just waiting for my visa...but we are almost there...
the birthcertificate aboad and american citizenship for our son was a very easy process
call the consulat in the philipines and ask what you need...it was better for me to talk to them personally...they told me on the phone he did not have to present in germany...on the website it said he had to

This might be a stupid question. I have heard that when your C1 Visa is approved at the consulat that they will provide you with the airport of entry. That the immigrant cant choose the Port of Entry, but the consulat chooses it for you. Is that correct?? Please let me know

Our laywer just emailed us yesterday, stating that even after our case was complete at NVC they needed more papers from me (immigrant). NVC wanted my police report from Germany, German birthcertificate, marriage license and my divorce papers from my first marriage.
Our lawyer told us that NVC requests now the Package 3 and then makes the interview appointment at the consulat in Frankfurt and from them we just get the package 4.
It should go faster then. Just wanted to give heads up...I am not sure if that is now the procedure for every consulat, but just in case get all your documents ready if NVC should already ask for it.

Good luck...I think this way the interview should go faster our lawyer said, because the consulat will not sent out a package 3 anymore just the package 4 with the interview date and medical exam, which you can already do 1 year in advance.

I agree ith Paris on this one guys. The Ombudsman hasn't done 'Jack' to get anything really changed in the past .... they've been wanting the I-130's processed as soon as they arrive .... and USCIS said 'NO'!

Bombard the acting Director of USCIS .... he's new and will obviously want to make a mark for himself in his position ... maybe he will see clearing the I-130's as just that.

have two petitions pending with the Vermont Service Center: I-130 and
I-129F. My husband is the beneficiary. I have read your reports on the
DHS website and have a few questions I thought you could answer for

I have been waiting for over 5 months for any information on my I-130
case. This amount of time is short in comparison to other petioners
who have waited close to 1 year for their approval. Therefore, I have
no assurance that my petition will be approved within the time frame
of 6 months as advised by USCIS when I initially filed.

I understand that there is a backlog of petitions that have to be
worked through. However, this reasoning is not acceptable to me for
the following reasons:

1. I-130 petitions are not approved in a first-in first-out method.
Some petitions are not approved as the one year mark is approaching
while others are approved in 1 month with no expedite.

2. I-129F petitions are being bypassed at the Vermont Service Center
but not at the California Service Center. How are these two government
agencies able to make decisions on how I-129F petitions will be
processed independent of each other?

3. K-1 fiancé petitions are approved at Vermont Service Center in a
more timely manner than K-3 spouse petitions. Why is there priority
placed on K-1 petitions?

4. I also understand that I-130 petitions are given least priority at
the Vermont Service Center, while tourist and work-related visas are
approved in a timely manner. Can you address why this is the case?

5. It is my understanding that some I-130 petitions are being
transferred from Vermont Service Center to California Service Center?
Can you address how Vermont petitions will be prioritized at the

Dave, when you say your second touch was an RFE, how did you know? Did you get an email? Status change on the USCIS website? My I-130 was touched on 5/4 and 5/5, and nothing today. Online status still says "Case received and Pending"...
I'm wondering if I got an RFE...

One thing I noticed about my NOA1. I went home and looked at it after we had that discussion about which date VSC uses. I showed a "received date 12/29/08" One day after my package arrived at the service center. BUT then again the date of my NOA1 and the date online showed 2/19

Yep, I think Sarah may be on to something. I am a VSC filer and have never posted because I always see the all elusive 02/24 date when I check the USCIS site. But today I checked and saw a new date, 05/04/2008.. I was blown away.

After I saw Amastar approved, I started to get hope... and now hopefully something is happening. I hope for all of us, we start to see the floodgates opening at VSC... especially those who have been waiting since Oct/Nov last year and before...

This happened in the US. My friend's cousin married a guy from Morrocco who was in the US but his visa expired. The marriage was a fraud becuase she was going to get paid. I don't know all the details but agents did go to her mother's house because that was the address they listed as living there. My friend's cousin has not been heard from in 3 months because she knows that immigrations is looking for her. I'm not sure what initiated that visit but it could possibly happen.

Getting an approved expedite means that USCIS believes the reason is valid (in your case for medical reasons). It DOES NOT necessarily mean that they will approve the petition. Basically an expedite takes your case from the bottom of the pile & puts it on top of the pile. As for an expedite at NVC you have to request a second expedite (NVC and USCIS are separate entities). You could certainly use the approved expedite from USCIS as supporting evidence, however.

I got an approved expedite at USCIS based on National Interest/ Military Reasons. I could have requested an expedite at the NVC but didn't because you often don't need to (most cases are at the NVC two weeks or less).

I'm not sure if being present for the interview helps, but if you can afford the trip & feel it's necessary for moral support then by all means do it. As for denial at the interview I'm thinking at that point all of the paperwork has been checked & rechecked, so the only reason I can think of is that they don't believe the relationship is legit. For example if he's pushing 60 and she is in her mid 20's they may question that. You can "what if" yourself to death, so just be very careful filling out the paperwork & make sure your fiancee/wife brings everything she can think of to the interview.

After the USCIS approval the file goes to the NVC (National Visa Center) for a background check. Generally files aren't at the NVC for long, maybe a week or two, and after that it moves on to the embassy. To answer your question yes the case can be denied at any point in the process... at USCIS, NVC, during the medical (e.g. communicable disease) or at the interview. There are many reasons why a case would be denied and lack of verifiable finances to support your fiancee could be one of them.

I hate to sound pessimistic but its a long, difficult process and a small, seemingly insignificant misstep can set you back for months (I tell you that from first hand experience). I wish you luck and my thoughts to you is to research the process very thoroughly and learn as much as you can.

HOHOHO is just being a butthole, ignore him. Like others have stated to request an expedite you call the service center (have your case number in hand) and request an expedite. They will contact you within a week and request proof to back up your claim. You then mail and/or fax (I did both) the proof to them & within a few days you will get a decision.

I got an approved expedite (national interest/military) and it took 44 days total to get USCIS approval on the 129F. Good luck!

My expedite was approved within a few days; the 129F approval took 44 days (from submittal). I think a lot of you misunderstand what a Senator can and can't do for you. They can bug the bejesus out of USCIS to get off their butt and do something, but they have no authority over them. Senators are not magicians and enlisting their help will not magically cause USCIS to approve your expedite and/or your case.

USCIS has a list of categories that a case can be expedited under. I can't seem to find the list but it includes such categories as National Interest, Humanitarian Reasons, USCIS error, etc. I know the process is long and painful, but expedites are rare and even if you get one you are talking weeks (not days) for a case approval.

Yea probably her best (only?) chance is the same way your wife got here... K1 or K3 visa. A student visa is the only other option I can think of & do that it takes a lot of money (something like having the tuition, room & board money for a year available up front if I recall correctly). If she tries for a visitor visa she will be denied and besides you can't work while on a visitor's visa anyways.

Does my wife has to carry her huge X-rays to the POE and all time on the plane? Do they ask for X-Rays? or do they just ask for Passport and the BROWN Envelope? Or she can just put the X-RAYS in her checked in luggage?

I was also not asked to present the X-rays. That being said it really is not that big a deal to take them with you just in case you enter and just happen to have that one Immigration officer that would like to see the x-rays.

I was out of the country when they finally sent it, so I actually got it before. They also had sent an RFE so I had to fly back to send them that info. Either way, the approval went pretty fast after they got the requested info.

Hi all.

I recently sent in the I-864 package for my spouse to the NVC.

I also have a cosponsor and sent in their tax info and form also.

I just called the NVC and the automated system said: "awaiting the return of the biographic forms from the petitioner. Once this packet is received, allow 6-8 weeks for the reviewing of all your documentation and you will be notified of the outcome of the review."

What biographic forms are they requesting?

I am assuming that it could be the DS-230 part 1 and part 2. My husband has sent those to me by DHL and they should be arriving soon.

Other than that, what could it be??

By the way, should this case complete by the end of october, what interview would NVC possibly give?

That is sooooo true. My husband will argue me UP AND DOWN over how things work here in the U.S.

He's NEVER even been here and has only travel out of his own small country one time (6hours away to neighboring country) just to pick me up from the airport.

I get so frustrated when he says "I'll find me a job within 1 day of being in the U.S.

Hellllooooo, has anyone seen the new unemployment rate?? It is high.

I keep telling him to bone up on his computer skills and english.
He says "my english is fine". hahaha I have to tell my sweety that just because I understand him, that doesn't mean an employer will be as patient.

Go figure.

Hi all.

I received an expedite for my husband from NVC to the Dakar embassy (he is in Gambia).

I am wondering what is the process now? I called NVC and they say that since it was expedited, they don't handle it anymore and I need to call the state dept or the embassy in Dakar.

I also check the NVC payment page for clues...I have found that my case is not even registered with NVC anymore through that site. I also did the DHL check and found that 2 cased were sent off on the 22nd of Oct 2008 to Dakar.

Anyway, I looked online for the embassy website & called to schedule the interview. Got an automated message that said something about buying a phone card to speak with an operator??? blink.gif

Huh?

Anyway, just sent an email to their consular requesting some info or atleast an interview date (included all pertinent info & case #).

Anyone have a clue as to what could be going on here? I'm almost wondering if I should have requested an expedite. I requested one at USCIS and got it and naturally requested the same (with the approval letter) at NVC and got it also. But now that they are through and my case is complete, I seem to have been thrown off the "NVC Ship" unsure.gif . Don't THEY usually schedule interviews and medicals? Hmmm.... whistling.gif

everything has already been sent to NVC. NVC sent everything to embassy by DHL.

I just keep seeing on other forums where it says the spouse must bring original documents. I don't get why the spouse must give the consular the exact same items that NVC already sent in the packet by DHL.

Any idea's?

Hi all.

My hubby is scheduled for his interview on thursday and I'm wondering what he needs to bring with him.

I already sent the originals to the marriage, his birth certificate and his police certificate to NVC and they sent it DHL express to the embassy in Dakar. Soooo, since THEY have the originals to everything, what exactly would he need to bring with him?

Also, my case was an expedite all the way through, so when would he possibly get his visa to travel here?

Thanks for any info.

FYI: if I have to give anything to my husband, i would have to scan everything and email it to him. (due to the interview being so fast). Would they possibly accept the scanned and printed version of whatever they might need?

actually, some CO's just "say" things are missing when they really are not.

They sometimes do this to test the individuals to see if the person immigrating will just give up.

If they come back with the requested info (even though it may have been there the whole time), then they will grant the visa with no more questions.

Its just their tactics.

This happened to me. They asked for the I-864 again, said my co-sponsors info was COMPLETELY missing (though when I called by phone i inadvertently heard info that was only on the co-sponsors form...their income amount), also they said we were missing the medical...though that was the only thing my husband really brought with him by hand.

So, don't give up, its just a test.

This time we are throwing MASSIVE amounts of paperwork at them. hahaha

Well, over the last 8 weeks that I have been wrestling with this, I have spoken to NVC about 4 times and each time I get a different person and the answer is consistent. Your BC was rejected as it was deemed that it's not the original. The BC should be issued by the local municipality and not by the hospital or an attested copy from the Ministry of Health. It must bear the seal of the municipality. In Pakistan, BCs for foreign immigration purposes are attested by the Ministry of Foreign Affairs and not the Ministry of Health, but I have been unsuccessful in getting my point across to NVC. I have even sent written requests that have been reviewed and then rejected and just placed in my file.

I am really hoping that someone has already traveled down this road and is able to guide me.
