K-1 Fiance(e) Visa Process & ProceduresCheck Returned in Royal Mail!

Was the cheque filled out correctly? I would send all the documentation back again and pay the extra to have it rushed through. You can also call them to find out what went wrong, whether they even received her details.

Cheque (check, chek) was fine. Called & fine it was just a machine error because the BC got there just fine. So they're holding the app until sends another cheque. Thanks.

To be honest, I doubt that it has arrived at ACRO - I accidentally sent my request with the cheque but forgot to sign the latter and they rang me up around the time they said it would take to process to let me know that the cheque wasn't signed and that they would void it and for me to send another cheque, so I'm sure they would have been in touch with her before now about the application without payment :(

K-1 Fiance(e) Visa Process & ProceduresCheck Returned in Royal Mail!
My fiancee' sent off her application for the police certificate to ACRO a couple weeks ago, then set her medical interview date for Aug 5th. But, Saturday, she received a letter from Royal Mail notifying her of damaged/opened mail and it only contained her uncancelled check! Don't know if the personal information requested has been lost/stolen, or if made it to ACRO without the check! It appears that the Post Offices run in the UK are privately operated, versus the U.S. Govt run P.O. here, so ANYTHING could happen. HINDSIGHT says, she should have sent it registered mail! We'll see what happens and hoping identity theft is not involved.

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate & Medical Examination
My fiancee' has been told that she could not make a medical exam appointment until she rec'd the police certificate, than later told that she could make the appointment before receiving it, but had to bring the police certificate with her. The instructions on the Knightsbridge Doctors PDF file mention, passport, pictured DL, passport photo, but nothing about bringing the police certificate. Do the clerks know what they're talking about? I'm trying to help her avoid postpoining the exam, needlessly since it may not arrive by her medical exam appointment time. Experience advice, anyone?

NOA2 probably won't come as quickly as you plan. If you're a freshman/sophomore in college, why try to get married now?! Parents cool with that sponsorship? Speaking as a Daddy, take your time, get your education on track fisrt to hopefully make the money to beat the poverty level! K-1 Fiance(e) Visa Process & ProceduresRequest For Evidence

Just checked status online and said they are requesting additional evidence. Has anyone had this happened to them, and if yes what is that they usually request for? Feel more nervous than ever... :help: Thanks!

The best answer is, "...It depends!" I received a RFE due to: 1) My legal name change (two diff last names on my records) 2) proof of divorce from my first marriage (only gave proof for the 2nd). I gathered the info and returned it to them via express mail, in less than 4 days after I received it. So it extended the NOA2 by about 3 weeks. - No Sweat. :bonk:

K-1 Fiance(e) Visa Process & ProceduresSo frustrating!
If you set the date for November, let it go 'cause it isn't going to happen, at least legally! You can have the "faux wedding" or a Blessing ceremony as suggested to go through the pomp & circumstance and just wait for the visa process to complete to do the legal thing in America at the courthouse. But you may only have the NOA2 by November, at best and that's just half the distance.

There is also an "Employment Verification Letter for the U.S. Department of Homeland Security and Foreign Government Agencies & Embassies" (literally), that can be printed from the worknumber.com website after YOU long in as an employee. It gives a summary of your calendar work and pay history. That's what I used in place of the company composing a letter which most WON'T do because they've subcribed to worknumber.com to "do the work" of income verification.

K-1 Fiance(e) Visa Process & ProceduresDifference of Age

It not common but it's not an issue. My fiance and I got 29yr difference and I've seen a lot that got May-December afar that made it. Just focused on your compatibility and you not being her family's ATM machine.

 My comment leans more on realness of the relationship on a social level rather than the visa-legal level. Sounds more like the parents are pimpin' their young daughter who may be quite naive herself, EVEN at 21. Personally, more than 10 years is not for me, but that's me. But even Stevie Wonder can "see" that this appears suspect. So she'll get here, give grandpa a heart atttack in the bedroom and get it all, not just "HALF!"

If anyone is offended, I don't take this seriously. No, I don't. In all seriousness, the key to these "successful" relationships that have tremondous differences in ages is COMPROMISE, not "compatability." It is IMPOSSIBLE to be from to two different cultures and generations and be compatable. If is working, there is a LOT of compromising taking place.

"CONGRATULATIONS" for finding out on THIS END versus later on after the process would be further down the road. Also agree with not focusing so much on the visa process. I empathize with the desire to be with your love-bug after experiencing loss. I loss oldest son two weeks before I was to meet my fiancee for the first time in 2009, then lost my next son the morning I was to return to see her again, just last Nov. Both of my sons (24 & 26) had sickle cell disease. She was able to come for the 2nd funeral and that was a blessing. Meanwhile, I stopped "watching the clock/calendar" 6 mths after filing the petition. It was finally approved, last week and delivered TODAY. During the process, watching and waiting became too frustrating!

I think her actions prove enough that it's "over" - whether the infidelity was true or not. As others have stated consider yourself better off finding out on THIS end rather than after going through the additional expenses of traveling, AOS, etc. There are a few stories on here that go into the horrors of divorcing someone after their arrival, worst yet after a child is involved. Let it go and move on. Further contact may just add salt to the wound. There are STILL plenty of women here in the ole US of A, including those from other countries where you don't have to get a K-1 because they're already here! - Legally, hopefully!

I left 7 days ago to visit my fiancee and her family for a scheduled gathering in the UK. It was a good time and opportunity for me to meet family members that had not met me and only "heard" that she was getting married and moving to the USA. After a beautiful weekend, we left Tues morning for the USA, together. We were separated for the different processing of Visitors & Citizens in Customs for our POE in Boston, MA. Continued on for the final leg of the journey to Atlanta, arriving about 8pm that evening.

Yesterday, we went to the County courthouse to get the license and will be going to the Magistrate on Saturday for the legal wedding. A informal Covenant Ceremony will be at my church on Sunday and a formal Blessing ceremony is planned for Spring in the U.K. It feels quite surreal for her to actually be here and for longer than a vacation, but it's real! Her sister and brother in-law arrived last night to represent the family and give support. HOPEFULLY, the airline will find their luggage by tonight!

K-1 Fiance(e) Visa Process & ProceduresRough costing

Hey there. me and my girlfriend are aiming for marriage in about 2 -3 years time. and we know that the k-1 visa is the one well need.

but my question isnt what i need to do, but more how much it'll cost.

so far ive got

she files the I-129F - thats $340

then when thats approved, i apply for k-1

application for k-1 - $240
DS-156 - cant see anything as far as this costs
Medical - im not sure as i live in UK and we have NHS
Extras - how much do i set aside for all this? the police records, and other literature?
then the I-485 - $985 + $85 Biometrics

can someone hopefully give me a better idea as im going to need this on top of my travel money to get over there

*** The medical is not covered by NHS and you'll have to pay. My wife's was 210 pounds, back in the Fall (2011). You'll also have to get regulation passport photos for your interview to be processed onto the K-1 visa, after approval. So there's another expense on that side of the Big Pond. Certified copies of birth record, immunization record, along with the police record, also. DS-156 is does not apply because the K-1 IS a non-immigrant visa. THIS side of the Pond, the work permit (EAD) and travel document (AP) are free when you apply along with your I-485. But you'll need MORE passport photos for each. Ka-CHING!****

This process is not for the faint of heart or money, but worth every penny and gaining a wonderful spouse and life.

It's not for the impatient, either!

K-1 Fiance(e) Visa Process & ProceduresGetting Married what happens if my visa doesnt come through in time???
All of the above replies are good and applicable. The number one "mistake" is setting a date because "Murphy's Law" can always mess things up. I filed the 129-F in January of 2011 and we weren't approved until late October. It also included an RFE which delayed things for just a week. I sent the reply by FedEx to make sure it got there ASAP. We ended up just going to court, here in the U.S. and are planning a Blessing ceremony in the U.K. this Fall, AFTER going through the AP process! Just as a watched pot never boils, a watch visa won't come quicker! Peep other time-lines to get an idea of what the scenario will be.

K-1 Fiance(e) Visa Process & ProceduresInterview Question

I know we haven't gotten our NOA2 yet but I'll have to start thinking about putting aside extra money if I need to fly out for his interview. I see some people saying you should definitely be there for your fiancé's interview and that in some cases it can make or break your approval. How true is that? I'd prefer to save the money since he would be coming right over after, but if it could sway our outcome then I certainly want to be there.

It's unanimous, SAVE YOUR MONEY! The biggest interview will be the AOS to get the green card. Between the U.S. & the U.K., all other stuff is preliminary red tape that gets in your pocket enough!

K-1 Fiance(e) Visa Process & ProceduresK1 visa cancellation during initial review

I would really like to do it the soonest, so I (beneficiary) can travel to the US if needed, but my ex-fiance (petitioner) wants to wait until we get the NOA2, he is saying that's the best way, because he can send a letter making reference to the NOA2. At this point, I just told him that I would let him do the things the way he wanted, but I don't know if me (the petitioner) can do something to be sure that the petition will be away from my record and I will not have any problems with CBP the next time I would travel to the US.

This two parts of your post are going to be confusing to those trying to help you......are you 1) the petitioner or 2) the beneficiary. You have stated in your post that you are both?????? Or am I completely reading your post wrong? :bonk: :bonk:

thanks but it is CR1.
The NVC says:
http://travel.state....195.html#police
if I lived in a different country for more than 12 months....

however 12 Months consecutively?

The DS-230 form asks for residence over 6 months & although you didnt live 12 months consecutively, I would still supply the police certificate. You will have to provide the information that you have lived at another residence so include the police certificates for it so there will not be any more delays.

K-1 Fiance(e) Visa Process & ProceduresStarting Visa Process - Also wants to study English here!
Hey Dan,

Looks like we have very similar situations. I'm in Atlanta now but I am originally from Boston good.gif
From what I've been reading, mixing the student visa with any type of visa is a bad idea. The student visa is intended for foreigners who show true intention to return to their home, and if during the interview they sense any intentions of getting married in the US, she will get denied. I'm not sure but this is what I have gathered from reading this site.

A similar question: Can the fiance travel to the US on a tourist visa while she is waiting for the K1 visa interview?

Thanks,
Drew

QUOTE (NyDan @ Aug 7 2009, 03:34 AM) <{POST_SNAPBACK}>
I'm facing a similar situation. Can't believe I found this site and this post. God bless the internet

Brazilian girlfriend and I recently got engaged. She's planning to move up here permanently in December/January and wants to take university classes starting in January (university here has indicated that application shouldn't be an issue - she's currently at a University in Brazil with good grades, good work experience, her family's wealthy and I make a bunch of money as well). We haven't figured out the immigration issues yet.

She currently has a valid tourist visa. She has not yet completed the university transfer admissions process and does not yet have a student visa.

If she hasn't yet applied for the student visa, can she apply now for the K1 fiance visa and then while that is processing obtain a student visa and enter the US in December on that, or does an open fiance visa application prohibit her from obtaining a student visa and using that to enter the country?

One post indicates that she could apply for the K1 fiance visa while she is here on the student visa and then would only have to return to Brazil for the interview. Do we have to go that route and wait to file for the K1, or can we apply for it now?

If she were here on a student visa and we got married, would there be any way to just change her visa status or something so that she can stay permanently? Returning to Brazil for an interview is okay, but we're set on her moving here at the end of the year.

Thanks in advance for any advice! Sorry for the wordy post.

-Dan

K-1 Fiance(e) Visa Process & ProceduresStarting Visa Process - Also wants to study English here!
Hi everyone,

I just got engaged to my Brazilian girlfriend and I'm new to this forum, looking for answers.
We are debating getting married here via a K1 fiance visa, or getting married in Brazil via a K3.

My question is if the following is possible:

My fiance wants to take an English course at a university here in the US from January-March 2010. She will either need a student visa, or already have the fiance visa to do this. If she is still waiting for the fiance visa to be sent from the NVC to Brazil, is she allowed to travel outside of the country? Or, is it possible that if I begin the process now, she will be able to get the fiance visa, come here and take this course?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresG-325A, do all copies need to be signed?
I am starting the K-1 Visa process, and my fiance just sent her signed G-325A from Brazil to me. I just read on the homepage that ...

"VisaJourney would like to remind all petitioners that are required to file a USCIS G-325A Biographic Information Form to submit four copies of the Biographical Information page (page one on the newest form). In the past the G-325A form contained four pages that automatically printed out (with the same information on all pages). The new form only has one page however petitioners should still submit four copies of the Biographic Information page with their petition."

My fiance only signed and sent me 1 copy. Should I make copies of this form? Do I really need to send 4 of this form?

You dont need to handwrite anything... Use the typewriter from Adobe Reader.

Open your g-325a.pdf file

click on Tools

drag the mouse to Typewriter

click on Show Typewriter Toolbar

that tool allows you to write over any part of the form
and you can change the size of the text , spaces and font.

Good luck! good.gif

2) Type everything I can, print, and then hand write where an address wouldn't fit?
3) Use abbreviations (for example, "Av." instead of "Avenida")?

K-1 Fiance(e) Visa Process & ProceduresVisa Denied under section 221(g)

Which places are those? Can you elaborate?

How about if the father snatches the child away from the mother without a court hearing, would you be in favor of that?

The point is that there are bad mothers and fathers, and the law is there to protect what is best for the child. It's not about getting approval from either parent, but allowing both parents to have a day in court and an impartial third party listening to both sides of the story. Thank God that laws have been enacted to protect the rights of the child , and not simply treat the child like a prized possesion of either parent.

Youre right, and this is not what I want to do. But, if my sons biological father really cared about my son...he would at least TRY to be around. I mean he has contacted my sister AND my cousin trying to have sex with them...he even told my cousin "Ah, forget the kid...I have always wanted you!" He has all of my email addresses, and he has me blocked on facebook. I know...you said go to court...not here. lol! Im working on it =)

K-1 Fiance(e) Visa Process & ProceduresVisa Denied under section 221(g)

I do not think that the custody had a bearing on the case as much as the lack of knowledge that the beneficiary may of had of the custody arrangement. My husband was asked if my children came to visit him. I had to have my sons biological father sign the passport application and he also provided me with a notarized statement giving me permission to take my one son this past month on an international trip to Morocco. I was up front with USCIS during the NOIR process and provided them with documentation to that affect. They are looking for the bona fides of a relationship, certain things must be discussed in detail to be prepared for an interview. Even if the beneficiary has the right answer, they look for other physical indicators as well. Morocco is diificult on every level becaue of the stigma associated with Moroccan men. I suggest that you start to prepare a rebuttal now as if you were going to present it before a federal court. The wait now will be hard, but you can overcome this in time.

I wish you the best.

I agree. The subject of my son, and his biological father is a very touch subject for me. We didnt speak much of it. I didnt think the custody of my son would have anything to do with my fiance visa. I guess I was wrong lol. Yes, I have read so much stuff about Moroccan men, but not all of them are bad. :crying: What do I need to include in the rebuttal? Do you know what is going to happen next? What should I prepare for? Im so lost... Thank you so much for your help!! It is greatly appreciated!

K-1 Fiance(e) Visa Process & ProceduresVisa Denied under section 221(g)

I have sole legal custody of my children from my first marriage. I was able to get them passports without my ex-husband's "permission". I simply presented a copy of the court papers outlining full custody when applying.

I did, however, need his permission to legally move them out of the country. Interestingly enough, I did as Boiler suggested and negotiated a bit by forgiving all the unpaid child support, joint debt and lowered monthly child support. He gave his permission, my lawyer wrote it all up, everyone signed off and I moved my kids to Nigeria.

Although I always carried a copy of the new custody paperwork with me during our varied international travels, I was not once asked for proof that I had permission to travel with my children outside of the country. Not by any airline, immigration or customs in any country. So, I would argue that you can travel with your child outside of the US without the other parents permission on Vacation. Permanently relocating them is another matter entirely.

You probably want to talk to a family law attorney in GA. Most states have organizations that offer free or reduced family law services if you cannot afford a private attorney.

Just my personal experience.....

Ive heard so many different things. Ive read so many different things. I have no idea which way to go first. My sons father has never paid child support. He evades the system some how, and to be completely honest...Im terrified of this man. I still have nightmares about what he did to me. Thank you for your help...it is greatly appreicated.

Im so sorry to hear that! I really hope things work out for you two. I know the pain you are feeling. Yes, from my understanding they did send it back to the USCIS. A quick second interview obviously isnt a good sign =( So there hasnt been a second interview for you yet? Maybe thats a good thing! Maybe it will be approved! Keep your head up...things will work out!!

Although I do not know enough to give you any advice, I can feel your pain from what you posted. I wish you and your family the best of luck.

Thank you so much! Same to you and your family (L)

yuck! What a terrible predicament! Like others have said, if you were able to obtain sole custody of your child, that would be one way to move there. I too would have moved to Morocco if my circumstances were different. We just recieved noa2 so the interview will be coming up and i try not to dwell on the negetive but it gets a little difficult when you read about more denials than approvals from Casablanca.

Yes, Im going to try. Oh, wow!! Yes, do not dwell on the negative. Just make sure you have alot of proof. Visit him often... Good luck with everything!!!
