Right now, Gary, it looks as if it's varying a good deal. In April the wait time was about three weeks before Packet 4, but there was at least one exception of a couple who waited nearly two months. I haven't been able to find anyone who sent back Packet 3 in late April or May who has received Packet 4 yet. Looks like the London embassy is a bit crowded this summer and we're probably in for a wait of at least 4-6 weeks for Packet 4.

Of course, every time I make a prediction about such things, I'm dead wrong!

Wow!!!! no wonder y we have to go through a hard time. I mean we go through long distance relationships for so long and when we decide we want to be together, the process is so tiring both mentally and physically. After reading this I can't blame USCIS or NVC or the consulars any more for the hardship they make us go through.

Anyway, I am not going to judge you, but it is odd that you have a bf here who filed the petition and maybe you had some problem with him and somehow you find another single guy ready to petition for you 'here'. I mean what are the odds, you meeting 2 guys ready to petition you (must've been quite a search). Anyway sorry for the vent, but if your new guy petitions for you, you will be labeled as 'fraud'. Whoever your friend is, that tells you they'll pick the most able guy or something, is horribly wrong. You will have a ban from US entry! (fingers crossed)

When i first apply for I-130, october 2007 it took a couple months to clear. Then i applied for I-485 in april 2008 and it took a couple days. The first time we applied for something though we didnt do a mail confirmation or anything, so the whole time we were hoping they didnt get our papers lost or something like that.. the second time we applied for something we made sure to get ALL KINDS of USPS delivery confirmations, signatures and what not... this time we got our NOA-1 even before we got the delivery confirmation....

so you never know.. it just depends on how far in the stack you are!

I'm in agreement RJ, I don't think the answer to "do I need a lawyer?" should automatically be no. My personal opinion is that it will wind up being "no" in the vast majority of cases, but I also recognize that there are times when a lawyer is either necessary or at least provides a service that the filer is willing to pay for instead of doing it themselves. I also believe that the vast majority of immigration lawyers don't screw up to near the extent that is claimed on these boards. However, I think the onus is on the OP to provide the necessary details of his case if he's asking for the advice. Granted, repliers might want to ask about what those circumstances are, but posters need to understand that answers are only going to be as helpful as the information they provide.

So...having said that...OP, what are your special circumstances? smile.gif

This post made me laugh... probably a lawyer!!! I've had several dealings with lawyers and most were negative. I know that they are necessary in some situations but honestly if you have attention to detail and do your research it is highly unlikely that a lawyer needs to be involved. blink.gif

Yea no offense to the OP but I think he's leaving out some crucial information. For the petition to be valid you have to be divorced when you file it... there is no requirement (that I am aware of) that states you have to be divorced when you meet your fiancee.

Pushbrk is right... get a good immigration attorney (and I am usually the last person who would recommend an attorney). The burden of proof is on you to overcome the reasons for the denial, so you will need a good attorney to examine the case & advise you on what to do. Based on what you've said I can't say if you have a fighting chance or not to get the denial overturned. Good luck!

My lawyer had me provide the following:

-Photos of the two of us in front of country specific landmarks.
-Plane tickets/boarding passes.
-copies of my passport pages.
-letters/emails between the two of us.

The translation had to be done by someone who could certify the translation. That means they had to stamp the document and sign it. Not sure if your S.O. can do that.

That did the trick.

I think you first should do some research on your girlfriend.

Though you may know her (or so you think);...to have been to the point of being engaged to another person not even a good 7 months ago then getting into another relationship (with you) and already at the wedding gates sorta speak is HIGHLY strange. And it could look that way to the CO.

A CO will most likely think that it could be fraud on her part. It takes time to form a meaningful relationship on it's own merits. And to go as far as wanting to marry someone is even more so.

Sooooo, for her to have "related" with the ex awhile,... then chose to marry.....THEN dumped him or got dumped, met you, "related" with you some more AND chose to marry YOU....all in that short amount of time...well,...shall I say - - Sumting looks vehty vehty feeshy here --

At the beginning of the process I lived 20 mins from my fiance. I lived on the US border and he lives on the Canada border. I visited daily due to closeness. It was a pain to go through the Canadian customs all of the time but nothing came up during the entire process about my visiting Canada everyday! :P

I don't have much advice, sorry. WHy don't you try asking people who will be going through the same consulate. Ask if they needed to present a copy of thier NOA2 in thier interview. If they say no, then you don't have to worry about it much right now simply print out what you can and present that at the interview stage. Now, for AOS, that will be another issue. I'm not sure what's required at AOS. But maybe you can try submitting the same print outs and see if this will suffice. If it's not enough, won't you get an RFE? I'm not too sure, best of luck to both of you. :thumbs:


My fiance went to the interview and the NOA 2 is not needed for the interview. The NOA 2 is needed for the AOS packet.

So, I never received my hard copy of my NOA2. It was mailed November 1st. My case already been through NVC, to Montreal, and forwarded to Vancouver.

Alright, so after spending 30 minutes pushing buttons on the USCIS main line, I finally got through to a real, live person at CSC. He was very nice to me. I asked him what the deal was (in more comprehensive fashion). And he said I should wait a few more weeks. Which I will do. Then I asked him what should I do then if it doesn't arrive. He then said to me, "Well, you don't need it anywhere else in the process." And I politely corrected him and told him that I'll need it at the AOS stage. And he said, "Well a print out of the email and online case status should work." Is this true? Anyone gone this route?

I asked him if he could reissue me one anyways, and he said that they only reissue them if they get returned to them. So I asked him what I had to do to get another, and he said file the dreaded (and expensive) I-824. He was shocked by how much it cost. He expressed his regret that there was nothing more he could do and...tada.

So, I'm left curious if the NOA1, print out of the approval email/case status, and my NVC letter will be enough to compensate for my lack of NOA2?

Bah! Just when this whole visa thing was starting to go our way, the USPS decides to eat our NOA2!

I would love to hear the response from this because I am in a similar situation. I moved and never received the NOA 2. I have requested to have the NOA 2 sent to my new address but I have not received it! The woman told me to wait 45 days and it is very close. I requested the NOA 2 in mid October. I hope that an email of the approval would be sufficient. I don't want to spend $200 on a copy (especially if I never got the first copy!)

I moved to a different state before my fiance's interview. He simply called and told the embassy of my move. At the interview they asked my fiance, why I moved to a new state? I moved due to a job opportunity. It was not a major issue.

I thought you don't need medical or see a civil surgeon if you have the vaccination record? I thought the vaccination record is sufficient enough for the AOS?

I'm so sorry this is happening to you. The delay in Washington might be that not you but someone with a similar name has gotten in some sort of trouble before. It's so hard to make plans only to have them shattered, but what can you do but wait. I wish for you that it's speedy so you can make that wedding date after all.

No problem, if you dont get it soon enough, you can get married in NOVEMBER, when all of the family will be able to come.

That means if I get approved lets say March 17, my wedding plans will be long-canceled, and all of my family won't be able to make it to the wedding until november.
Hooray .. and they hold my international passport in hostage ... means I wouldn't see clara for almost a year unless she came here again but thats hard considering her families situation (remember her dad got shot in september?). Talk about cruelty :(

The thing is I may now get a marriage without all of my family :\ And If I get married between april and june my brother won't make it due university & exams.

I totally understand your situation. Some people can be heartless on this board! Somehow individuals forget the long painful journey. I will say that you can't plan anytime during this process. I learned that the hard way. I made so many plans but my visa took longer than expected and I had to cancel my plans. It was earth shattering at the time. It will get better and you will rejoin your love one. Don't take some of these people seriously on this site. There are a few people on here with major negative vibes! Ignore them!

I have now learned from a friend that each sheet is to be printed on different color of paper (white, green, pink and blue). I am ready to submitt the I-129F and not sure now if the white signed copies will be accepted? Do I need to reprint the G-325A on the colored paper and sent it down to Jamaica to be signed by my fiancee?

This is a difficult question-so I appreciate ANY advice.

My fiance was previously married. His divorce is processed and we have a letter from the lawyer saying it is processed and a certificate showing that he is SINGLE. However, the divorce is not finalized because no certificate has been made yet and it will not be made until November 27.

Do I submit the I-129F with the lawyer's letter saying the divorce is processing and he is considered single in his country and legally able to marry although the certificate has not been made or do we wait until we have the actual divorce certificate??

My Fiance is living outside of his country and my lawyer said to contact the embassy in the country where he is residing. I emailed the Jamaican consulate (where he is living at the moment) and they replied that they would take our case. I saved the email and I am putting it in my visa application to make sure the interview will be scheduled at the Jamaican consulate.

I guess I would recommend emailing the US embassy in Scotland. smile.gif

Ok ok, I am reading and reading and trying to understand, but I think I need some help.

After I send in my I-129F, what should I start preparing? What is teh NVC packet and when does it come? What do they need from me? I see that people list that they get their NOA2 then the NVC packet and send it off like days after they receive their NVC packet. How do they compile everything in days?

I would appreciate any understanding or any breakdown of the process in details please! Thanks!

I have two jobs and combined make about 18,000, I also have a savings account and stocks/bonds.

This is the first year I have hit that income and NONE of my tax forms say that I made anything over 2,000 because I was a student.

Also, I will, but have not declared of one job, because it was a nanny position (but my employer will write a letter)...so there is no evidence of my income other than the letter of employment.

Will this be ok, or should I get a co-sponsor?

Just extra info: I have no real estate. I am unsure about my life insurance policy (my mom made it).
