They most likey won't send out another extension, so when it gets to about two weeks before expiry make an infopass appointment and get a I-551 stamp in your wife's passport. The Stamp will be good for travel and work. Hopefully you won't have to to do that

Yes and No My AOS was sent to CSC It added another 8 months of processing but I didn't have an interview. So as it goes, it is anyones guess as to what will happen, until we see some of transfers beening approved.

That one did update the correct version. There is at one more person that filed at VSC that got approved in six months thats not on the list.

I am assuming that he applied for Advance parole before leaving the US seeing that he was out of the US for nearly a year. I would suggest that you get him to go or contact the local US embassy or consulate as soon as possible, They may be able to extend his advance parole until your father is better. If not he risks being turned way when he returns to the US. They would consider it abandoment of his permanent resident status.

You will be be fine with your passport and your extension letter, to get back into the US. If your husband is going with you for only two weeks, when he returns to the US he can watch out for any RFE or possible interview dates in the mail. Now if an RFE arrives he is able to send the extra info, especially if you can gather up some info before you go. If you get an interview date there is probably enough time to either call and have the interview date changed or you get on the next available flight home.

Hi there
On feb 27 I recieve an email saying that on feb 26 they mailed mailed a notice of approval. I haven't received it. I have receive my Green Card but not the notice. I haven't moved, so they haven't sent it to the wrong address. Has anyone else had this problem? Should I be worried?

This is good news. lets hope that they can clear some of the backlog. Let's also hope that CSC uses the recieved date at VSC to start the approval process. Not like they did with my AOS Application where they started all over again. wacko.gif

TSC is the Texas Service Center. All Filers now send their I-751 Vermont, they changed where to send the applications sometime last year.

I also got same email notification, last Updated 02/13/2008. They changed message instead of saying: transferred to VSC " to Case is now pending at the office to which it was transferred."

How does getting a stamp if you never received an extension letter work?

My wife and I realized today, while she was getting her driver's license renewed, that her green card was set to expire at the end of the week. I'd already been working on the I-751 package, and we got it in the mail today, but the DMV won't renew her driver's license until they have proof of the extension.

I realize that we'll probably get the letter in the mail in a couple weeks, but since she doesn't really want to drive to work on an expired license, is there any way to get the local USCIS office to give her something in the meantime (i.e. a stamp like mentioned above) so she can get her driver's license renewed?

Yeah, I know we should have just gotten it in before now, but the expiration date kinda snuck up on us...we just bought our first house together (Yay!), then had it broken into (boo!), and the anniversary/expiration date kinda snuck up on us while everything else was going on.

Spoke to my attorney today and she has suggested the route that was suggested here.

Which is to write a withdrawal letter for the original I-751 and begin a new one based on the fact that I am now divorced (I-751 waiver)

This would mean another year of waiting for VSC to process it and another $545 to get it going. With no guarantees. I am more inclined to spend the money than be kicked out.

I'll post again with what advice I get and what results happen just in case other end up in the same situation.

One thing I will say is that no one can ever tell what will happen in a marriage unless you truly spend time with some one. Its two different worlds. Please be most careful in who you choose.

Hey everyone hope you are all well!

Me on the other hand is all mixed up and unsure of what to do.
The story is that i filed my I-751 jointly with my wife back in December 2007 to which was all going smoothly until we divorced! ARGHHHHH!

So divorce was finalized in September and after reading around the interwebs I saw I should of filed another I-751 stating the divorce and withdrawing the original I-751 application. I never knew this and didn't do it!.....#######

Now it is February 2009 and I have a RFE sitting here on my desk based on the original I-751 etc

My question is to the good people of VJ do I submit the evidence as though I am married and hope I get the 10 year GC.
Or should I submit a new I-751 with divorce decree and everything?

I know what the right thing to do is....I know what the best chances of getting a 10 year GC is. but what is the best way to do it?...

On a side note I now live with my new girl friend who I am very serious about and also a great paying and fun job to which I do not wish to lose all of it. I am scared and lost to what I should do. A critical point in my life I think I can admit to you guys.

I just need opinions and advice but as I said I have a feeling I know what you guys are going to say.....I just need the support.

Yup I agree with last reply. You don't really need a lawyer for the I-751 just prove that the marriage was in good faith. This would mean showing official paper work with your names at the same address. I say this because I have done it.

In fact I filed my own divorce papers too!

Don't need lawyers unless its a very complex situation involving children and other issues. I wouldn't consider this complex just time consuming!

This can be found in the "General FAQ's for Removing Conditions" part of this forum. Below is the answer.

7.3) ..Okay, when do I file the I-751 to lift conditional status?
A..Option #1: If your passport is stamped with the I-551 at the adjustment of status interview, the stamp has the AOS approval date written on it. Your 2 year conditional period begins with that date. Ninety (90) days prior to the end of the conditional period, you and your US Citizen spouse will apply together for a removal of the "conditional" status by filing form I-751 together as a married couple.

Option #2: As is more likley the case now, the I-551 stamps are not automatically given at the conclusion of an AOS interview now due to namechecks and files moving around. Green Cards are routinely mailed to the beneficiaries within 4 weeks (if approved) or delayed by months due to name checks pending. The accurate date of your PR is printed on the front of the GC as 'Resident Since:".

I called USCIS and they said that the new application extension letter does add another year to the GC based on the original extension letter. If I go out the country I would need to take both letters of extension as well as the GC.

Though just to be safe I will make an Info Pass appointment to get the I-551 Stamp in the passport. good.gif

Any of you guys had an extension on an extension before or heard of it? I say this because I think thats what I got right now because I withdrew my original I-751 and put in a new one. My green card was extended from March last year to this year based on the original application. Now that I have another application accepted does this extend it based on the first extension....... blink.gif yea.....work that one out!

Already called the number yesterday and according to the person on the phone that its OK. I got approval and I don't have to worry about anything.

The original application was sent in December 2007. The new one was sent with the withdrawal letter in February 2009. Like you I thought I would be placed to the back of the line since I started the whole process again.

I think I got something to worry about especially something so important that mistakes can't go unquestioned.

You would think I should be excited right now. Half of me is half of me isn't and here's why!

This approval is based on the application when I was married. Back in February 2009 I put in a letter withdrawing this application and paid an extra $500 for another new I-751 with the divorce waiver which was approved and I got a second extension letter.

It worries me because I hope they didn't approve it because they think I am still married which I clearly placed in my withdrawal letter that I am not any more and sending a new application in for processing based on the fact I am now divorced. I don't want them to think I am lying through this whole mess.

So my question is what the happened?

Two things I thought might of happened
ONE: They used the information from the new I-751 I sent to amend the old I-751 application
TWO: They ignored my cover letter saying I wanted withdrawal and approved it anyway based on my marriage

Any thoughts or similar (if any) situations before I make an infopass appointment?
