Applying for a visitor visa and applying for a fiance visa are 2 separate things. One does not usually affect the other.

The risks are involved only if the person attempts visa fraud by applying for visitor visa with the intent of settling down in the Country.


I totally agree... applying for a tourist visa (and having it denied) and then applying for a K1 visa doesn't imply fraud. I know because we tried for a tourist visa & were denied (the thought of waiting for 9+ months for the K1 to make it through the system was unacceptable). The wait was horrible, but the K1 was eventually approved & my fiancee is here in the USA now.

The moral of the story is (like many have stated) that if the relationship is worth the wait then wait! If you are looking for a short cut you will probably just find dead ends or even a U-turn (i.e. if you try to beat the system your fiancee may end up deported later on).

This discussion is going all over the place. IMBRA is about informing the immigrating K visa applicant about certain US citizen criminal records. Petitions are not denied based on IMBRA. Crimes of moral turpitude are an issue for immigrants, not US citizens. A convicted murderer on parole can get a petition approved as long as the crime didn't fall under the Adam Walsh act.

There are two kinds of IMBRA waivers.

1. Waiver of the filing limitations for multiple beneficiaries. (not applicable here)
2. Waiver of reporting the crime to the intending immigrant. (that's the applicable one here)

Unless the petitioner wants to conceal the record from the fiance(e) or spouse, the second waiver category isn't needed.

thanks for all your responses so far and i will tell her about it. The actual charges we plead nolo to were called (affray) a lesser misdeminor charge defined as "a scuffle" but still falls under domestic violence.

Yea it was probably called "Simple Battery" or perhaps Assault in the 3rd Degree. Nolo is considered a conviction but it's not an admission of guilt & it usually protects someone from a civil suit on the same charge.

He's right... if you plead guilty your claim that it was in self defense is null & void. Although domestic violence can be a misdemeanor it is considered more serious than most other misdemeanors (much like driving under the influence). You may need a lawyer's advice on this one.

It more than likely comes under the umbrella of "moral turpitude", which would require a waiver. http://definitions.u...moral-turpitude. Again you really need to get the advice of an attorney on this one.

The bottom line is that unless someone has unusual circumstances there is no need to consult a lawyer. The caveat to that is that the process can be confusing & it's easy for someone to make a minor mistake that will delay the reunion with their significant other (been there, done that). After someone has completed the process you can look back and say "anyone can do this" but it can be intimidating at the beginning when you don't fully understand how the K1/K3 process works.

They've already agreed to expidite it. That bits done, its the next part im wondering about.

I am in the Army and we got our petition expedited based on the probability of being deployed (based on the type of unit I am in). To request an expedite call the dedicated USCIS Military hotline (1-877-247-4645). Tell them you want to request an expedite of the petition based on "National Interest/ Military Reasons". You will need to have the case receipt number USCIS gave you in the NOA1. They will ask for proof of the deployment, so be prepared to get a letter from the commander and a copy of the deployment orders would be helpful too.

Obtain a fax number and fax the requested info to them. I got an approval in 3-4 days & the petition was approved something like 44 days after they initially received it. Good luck & let me know if you need more info.

I TRAVELED TO MEDELLIN COLOMBIA ON MARCH 1ST 2009. I PLANNED ON ONLY STAYING FOR 8 DAYS RETURNING ON THE 9TH. I ENJOYED MY TIME WITH HER AND EXTENDED MY STAY UNTIL THE 16TH OF MARCH. I WAS IN MEDELLIN FROM MARCH 1ST TO THE 16TH AND SPENT THE WHOLE TIME THERE WITH HER AND HER FAMILY. WE SPENT 8 DAYS IN AN APARTMENT WE RENTED IN LAS PALMAS, AND THE REST OF MY STAY THERE WAS SPENT EITHER AT HER PARENTS OR GRANDMOTHERS HOUSE IN ANZA. Did you get a receipt from USCIS? Usually a few weeks after sending in the application you get a notice from USCIS that they received the application. If it has been 4 months w/o a receipt and/or cashing your check there is definitely a problem.

no I do have noa 1 I got that 5 days after I file back in december , is been 4 months waiting for eather noa2 or request for papers

The NOA1 is the receipt I referred to. If it were me I would have sent in the missing info as soon as I realized I forgot to send it (with a copy of the NOA1 so they could link up the missing info with the packet).

If you have it expunged it won't be in your file for life... the purpose of having a record expunged is to erase it. However some offenses cannot be expunged (e.g. domestic abuse) so you really need to consult a lawyer on this. If you are eligible for expungement it should be a relatively quick & inexpensive process (if your sister is really a lawyer ask her about this).

We got an expedite based on national interests/ military reasons and here's the deal...

1. You call the USCIS hotline set up specifically for the military members.
2. You ask for an expedite based on "national interests/ military reasons"
3. They WILL ask for proof... either a deployment order or a statement from your commander. If its from your commander use the unit stationery & proper military format (for the Army consult AR 25-50).
4. I don't recall if I got an RFE first and then faxed the proof, but I do recall that my request for expedite was approved very quickly (3-4 days).
5. Don't confuse approval of an expedite and approval of the petition (two different things). It took 45 days for the petition to be approved (could be faster or slower for others).

In Canada, there is some wrinkle in the law (which a Canadian member might better explain) wherein officiants are forbidden to perform a ceremony without legally recording the marriage.

Actually I tend to agree with Gary... the OP wants to have his cake & eat it too. The OP is looking for some secret option that would allow him to have a christian marriage & still be eligible for a K-1 visa. I'd like to not pay taxes & find a zero calorie beer too. Problem is none of these things are going to happen.

an applicant does not need a compelling reason to come to the USA (wedding) they need a compelling reason to GO HOME.

This really depends on the applicant's country. My friend's fiancee is German & she has been back & forth to the USA many times to visit. My filipino fiancee (now wife) applied for a tourist visa & she was denied.

Yeah, that make sense that individual statements are needed. Do they need to have originals? I guess I can call them and ask.

Here is what the instruction form says:

"Provide original statements from you and your fiancé(e)
whom you plan to marry within 90 days of his or her
admission, and copies of any evidence you wish to

I was hoping she could sign and fax me a statement which I could include with my letter. I will call them about it.

It says "original statements". A fax by definition is not an original statement. Can you get by with a fax? Maybe... but why chance it?

If you marry its a K3 visa, not a K1. If you do not marry your fiancee is eligible for a K1 visa. There are forums specific to the K1 & K3 process so please look there for more info.

I want to know if the petitioner is the only one who can cancel a visa application. I have a friend who wants to cancel his application. He had a K-1 application filed for him but him and the woman did not work out he contacted the EMBASSY to cancel the application and was told that only the petitioner can cancel the application. What can the beneficiary do to cancel the application? He wants to apply for a vistor visa but it will get denied if there is a open visa application in his name.

I'm sure most of us have been through the "Tourist Visa" denial drill. To add my two cents I have a friend who tried not once but twice to come to the U.S. on vacation. She is 38 years-old and her documentation included:

Her work record of 20+ years at the same hospital
A letter from her employer stating that she is a great employee
Proof of ownership for two homes (A condo in Bangkok and another in Udon)
She owns a car
A bank account with a substantial sum of money in baht.

Even the above was not considered strong enough "ties" to Thailand.

During the second application we included a letter from my congressman on her behalf.

I've always considered it incredibly unfair that I can show up at the airport in BKK and I'm given 30 days no questions asked. I think Thai citizens should be given the same treatment.

I'm going to give you slightly different advice. The requirements ask for the I-693A if you have already had the vaccintions. I would strongly recommend you give them what they are asking for. Call Civil Surgeons in your area and you can get one to fill in the appropriate info for about $50. You have to call several. You certainly do not need the exam again just the shots moved to the I-693A form. This is also supposed to be sealed in an envelope by the civil surgeon and included with you application. Please don't take the chance. I would be very surprised if you can get away with the from from Thailand.

2 Birth Cert for both of us plus passport w/ I-94
3 Tax Returns
4 all the NOA's
5 Copyies of I-485

Well, my interview is Wed Aug 9th. I'm a bit nervouse and I have no idea why. Thisa will be 6 months pregnant at the interview so that should be more than enough proof. I have put together two books. One with all the originals of everything I filed in the original AOS application and another with copies of everything from the first book. I've updated my bank statements, payroll stubs...blah, blah, blah. Also note they ask for bills/bank accounts, insurance documents with your wifes name. I would suggest you bring those along as it is stated on the AOS appointment letter. I'm also taking pictures from several trips taken after her entry into the U.S. Bottome line: Take everything you can so you have nothing to worry about.

Just a quick update:

We are on AOS limbo. Processing dates have finally been updated for our local office, and now state they are processing applications with receipt dates from Feb 1, 2006, our Receipt date is December 29, 2005. Today we'll be customer service to try and find out what the holdup is, will keep you all posted.
