Well, over the last 8 weeks that I have been wrestling with this, I have spoken to NVC about 4 times and each time I get a different person and the answer is consistent. Your BC was rejected as it was deemed that it's not the original. The BC should be issued by the local municipality and not by the hospital or an attested copy from the Ministry of Health. It must bear the seal of the municipality. In Pakistan, BCs for foreign immigration purposes are attested by the Ministry of Foreign Affairs and not the Ministry of Health, but I have been unsuccessful in getting my point across to NVC. I have even sent written requests that have been reviewed and then rejected and just placed in my file.

I am really hoping that someone has already traveled down this road and is able to guide me.

Hi everyone!

I am really hoping someone can help me out. I am a U.S. citizen and my wife is a Pakistani born Canadian Citizen. I submitted the DS-230 packet for the CR1 and my case is on hold as they rejected my wife's BC. I had submitted her original BC that was provided by the hospital at the time of her birth and it was in English; additionally, I submitted an original attested BC statement that was attested by Pakistan's Ministry of Foreign Affairs. These two documents were used by the Canadian immigration a few years back while my wife was obtaining Canadian immigration and had no issues.

Does anyone has any advice for me. I am not sure what else I can obtain and submit. I called NVC and the agent told me that I need a copy that is attested by the Pakistani Ministry of Health or by the local municipality where my wife was born. Neither I nor my wife have any relatives in that area of Pakistan anymore - I really hope I won't have to spend $2k to go there to extract an official copy of her BC. This is just frustrating!!

I was born and raised here, and have no clue how I can go about obtaining this record. Any advice as to what I can do or submit in lieu of the document that U.S. immigration is requesting? Any advice you can offer will be appreciated as our case has been on hold for 8 weeks now and I just don't know what to do.

have been unemployed for the past three because I was living overseas and my father-in-law was primarily supporting us both (husband and wife) there .
On my I-864, I would simply put zero's where ever there is income questions.Since I have not filed any returns for the past three years, I am submitting a notarized letter along with past three years of IRS publications page 17 that indicates who is required to file taxes with clearly showing minimum income amounts in the table. I am by the way including my 2008 tax transcript since that's the last one I filed before leaving for overseas along with my wife. ( My wife overstayed her Green card required stay limit)
Also, just to show that I was working before we had left for overseas, I have decided to include our 2008 last tax transcript--Is this alright! ( My wife overstayed her Green card' required stay limit outside US)

OR

Should I not bother sending that?

I need some advice on this!

My joint-sponsor is submitting all the required documentation with his I-864:
Photo copies of last three years with all the pertinent schedules ( Owns Business)
Business License with his name.
Latest Bank Statement
Photocopy of Naturalization Certificate.

Hello Talented Bunch
I have a question put to me by my friend who I am helping her file for her husband who is at overseas right now.
My friend has worked for and has obtained 40 quarter hours from SSA. She is unemployed right now. During her work in previous years, She was receiving food stamp benefits for her son from her first husband.
Her X-husband failed to provide any support for the child and fled the country before she could track him for child support payments.
My question is that while she was receiving food stamp benefits, she worked and supported herself and her son who is 16 years old now, Can she still file I-864 waiver under her circumstances.
Also, Can anybody recommend the best guide to follow for filing and quickly going through the process for CR1 visa for her spouse.

May I ask what I-864 version did you use?

I-864 - Affidavit of Support

And it expires on Sept. 30, 2006.
Is this the same form that you used?
If not, what I-864 version should I use. I would like to try Jamie's shortcuts in submitting the I-864 and I-864A.?

same here, we used james shortcut w/ no problem and things flew thru nvc even faster than we had anticipated. i did use the heaviest plain white paper i could find just so it wouldn't be so flimsy. good luck

I'm from the Philippines. I asked NVC directly who schedules the Manila Philippines interview.

For Philippines, (NVC operator said), NVC does the interview.

Hello All,

Anyone knows whether the NVC schedules interviews for K3 visas for countries in these category "Turkey, Albania, Canada, Philippines, Lebanon, UAE and the continent of Africa". I observed mixed responses, anyone went through this consulates with K3.

On the State Dept. website it stated "Approximately one month before your scheduled interview
appointment with a consular officer, you will receive an appointment letter containing the date and time of your visa interview along with instructions for obtaining a medical examination."

Any help, I aa a little confused.

I have a question. I recently send in my IV package, but now a sudden trip comes up for my spouse. She is planning on visiting India for 4-5 days. She is going to acquire a VISA for India (her first visit there). So my question is - will there be any problems at the interview time when the consulate checks her passport, because the passport photocopy we send did not have an Indian visa?

I don't think it will be a problem. As long as the husband wife have correct names, it should be fine. If you already sent your forms, nothing to do but wait, but if you haven't, attach a note to the marriage certificate saying the name is misspelled with your father in laws birth certificate copy.

hey guru80, same thing happened to me. They send me a RFE checklist with DS230 on there right after I had send it. It takes a couple of days to put the DS230 packet in their system. They didn't have the DS230 when they send that checklist, so it asked for it. You shouldn't send it again. If you want to make sure they have the right stuff, just check their automated system for when it says received checklist info. Otherwise, call and ask them if they have received the DS230 you send on the 3rd.

Thanks Sonia, I don't know about Savar yet, but if my wife got an interview, he should too as his completion date is the same as mine.
I would have loved to have gone with her to the interview, but I am here in the States and won't be able to go.

Yeah though my case is not complete but I m pretty much interested to know how the things go with Dhaka Embassy... Well, one more thing, I never heard anything from Embassy regarding my K3...is it a norm for DHK consulate..

This is what I know, but double check if possible -
Once you get your green card (should be in a couple of weeks after you get to US), you can go back to your country. However, you will need to fill out naturalization forms and stuff within 2 years of getting green card. You can work at home because you still will have a passport from your home country

If you go to states under K3 visa, you'll have to file for adjustment of status there and that'll cost around $1000

You won't have to do i130 again, just gotta do the NVC procedure and then you'll have a CR1 interview

Our AVR recording was up dated over the weekend. I checked it on Saturday afternoon Philippine time which is Friday night in the US. and then again on Monday morning Philippine time which is Sunday night US time and the message had updated from our case number assigned to our DS 3032 and AOS bill has been generated. We had emailed our 3032 on the 3rd and I called a live operator also when they opened this morning (Monday US time) and the operator told me the 3032 was received so some one had to be working over the weekend.

Similar thing happened to me. After I send in my AOS package the AVR said they received a package 3 days after I actually sent it, but by then my IV fee was also generated, so the AVR changed soon to IV bill generated. They never said whether my AOS was reviewed completely or not. I am pretty sure your AOS was received and is fine. If it wasn't the AVR would have said that documents are missing.

But to be 100% sure, call and talk to an operator tomorrow.

As far as I know they don't work on weekened, as a amtter of fact they have LIFE too after NVC...hehehe! And of course if they don't work on the weekened, you will not get any operator, just the AVR.

Well you never know. It says on the AVR Monday - Friday but could be they had people working overtime on the weekends if they are behind on their casework.


Ya that's what I was thinking, they have no operators at that time but maybe people still work on the cases and only the AVR is updated??? It's highly unlikely, but if someone got a new AVR over the weekend, then its true smile.gif

Hey Savar, congrats on the completion. The interview notice will go to both the petitioner and beneficiary. The agent receives a copy, and the beneficiary needs one to take to the embassy and for medical report. Also, my wife hasn't received a thing back in Bangladesh yet. I really hope to get an interview date for March.

Looks like mine is similar to yall's timelines as well. Hopefully all our cases gets approved soon. Can't wait for my wife to get here.

BTW, I am asking my wife to take the medical exam now, so I can talk to the consulate in Bangladesh when her case gets approved in order to see if there is anyway for them to give her an earlier appointment date.
