I sent my I-129F application to the Texas Service Center as I was supposed to, but I received the NOA1 from the California Service Center. Did I send it to the right place, everywhere I looked said that since I live in Atlanta I should send it to TSC. I also notice that the TSC has no processing times for I129Fs, what's up with that?

Hello All,

I recently received an RFE from the CSC requesting me to sign a form confirming that I did not use a marraige broker and have not been convicted of a felony or something like that. I will have more details in a day or so when I receive the email from my friend. I actually haven't received it myself, a friend opened it for me and read it to me on the phone when I called him after receiving the email from the CSC. My problem is I am currently working in Australia and won't be back in the US for several weeks, he can scan the forms and send them to me via email. My question is will the CSC accept a form that is signed and scanned by me and emailed back to my friend so he can print it out and mail the stuff from the states? I don't trust the international mail that much, things have been lost before.

Chicago is only scanning in apps. They are not cashing anything or approving anyone's petition. Their job is to get you in the main system for the officers to see, not necessarily for us to log on and see our case's progress. Also their second job is to get you a receipt notice. But remember, as USCIS has actually stated, They are not in the business of issuing receipt notices.

I called Delta to get a record of my flights when I go to see my hubby. (For possible questions on our future interview- I am preparing early to avoid problems that I have seen others go through.)

By the way, if you don't have them on your Skymiles account, you can write to the following address that I was given:

Hmmm...maybe I'm slow,...but their is no G-325 in the I-130 packet. Though the forms I filled in look like the same info requested on the G-325.

Anyway, if this form is required, WHY was it not in the official packet or even mentioned?? Not blasting anyone, just want an opinion.

And since others say it is needed, should I send it in now with a copy of my receipt or wait for an RFE?

Hi all.

I sent in the I-130 packet way back in December (dec.11, 07) and also have a NOA1 and I'm also showing online as pending with my receipt number.

My question is, I keep seeing posts about the G-325 forms in the 1-130 packets.

I didn't fill these out because they were not in my packet so naturally I didn't fill these out. Only filled out the two forms that say Petition for Alien Relative (for my husband).

Does anyone think I'll get a RFE for this considering they were NOT in the packet and also don't show ANYWHERE in the downloadable I-130 forms on the USCIS website?

So far, I haven't received anything from them and everything looks to be ok,...but still I wonder.

Also, I am not sending the I-129F because me and my hubby don't want the hassle of that compiled with him having to wait months to get a work permit. He is African so you all KNOW we CAN'T be sitting around twiddling our thumbs waiting on THAT CARD! We have family to support. hahahaha


Any comments on the G-325 forms?

Hi all.

I posted about this before (not including the G-325a because it was not in the I-130 package on uscis). My mistake for not getting the forms off vj, instead of the "official", -never updated- USCIS website.

Anyway, my petition (I-130) was received at Chicago Lockbox Dec.11,2007 and then received at VSC Jan.31, 2008.

I have a NOA1 that says received dec.11, 2007.

My check was cashed feb.2,2008 and received hardcopy NOA1 Feb.5, 2008.

Does anyone think my package may get sent back and I must start completely over and pay another fee or will I get an RFE? I am seeing my case online as pending since it was entered on feb.24, 2008.

I'm looking for personal experiences of others and general, educated guesses on this.

Trying to see if I should preempt with sending info or waiting for a RFE (risking possible outright denial -horrors upon horrors.

I filed the I-130 in Dec.07 to the lockbox. It was finally received jan.31 to vermont and I received a noa1 feb.5th, 08.

Now that this process is taking so long (not what I originally anticipated), I am possibly thinking about filing the I-129F (possibly).

Since I filed so long ago, does anyone think it may hold up my case if I go ahead and file the I-129F at this time?

Again, just a thought right now.

Most petitions can be approved within a few minutes of hopping up onto someone's desk,...yet it takes months and months to even get pulled from "the Box". Yuck.

I couldn't be refused entry because I live in the U.S. and was born here.

And I wouldn't be going on a tourist visa because I from the U.S.

Once I receive the NOA2 (which I don't have yet) and my petition get's sent to the NVC, will I be able to relocate to my hubby in his country to wait it out for his interview?

I have read that after an approval, the whole case is out of USCIS's hands.

Any idea's on this is greatly appreciated and I will be doing my own research as well.

That's exactly true. My post wasn't typed to be a personal attack on anyone.
I am simply trying to figure out something that makes absolutedly NO sense.

For example-

Here's a fake scenario

A unborn child is having complications and may die.

A newborn child is having complications and may die.

The doctor can only treat one at a time.

Guess what? The doctor WILL treat the child that is already here.

This is not an attack on anyone. It's just common sense.

Now, I know that we all chose our specific visa routes. What I was getting at is...Why does one process supercede the other. It should go in order of natural progression.

Again, this is not downing the K1 filers.

Think of it this way. What if the government decided to enact a law where those that are single with no wife/husband/kids,etc would get paid $100 more per pay period, and those that are married would get the same....just at the end of the year.

Would that make sense? You would think that the one's with dependants would need their $ now to take care of their dependants now instead of the end of the year.

Again, this is just a scenario.

My question is simple and to the point:

Why does the K1 Fiance visa get processed faster than the CR-1 or the K-3?

I'm not hating on the fiance's, but it would seem that if your already married, that we would have more of a priority. A fiance visa is not a guarantee and the person could possibly decide not to marry the person anyway once they get here. With us married folk, we are stuck (not in a bad way hehehe) and would have to go through divorce, dividing property, etc...

I just don't get it.

I even heard one guy say that he was going to divorce his wife just to apply for the fiance visa and get her here faster. That is a crying SHAME to even have to go that far. Though I personally doubt that they'd get anywhere with that idea. But who am I.

Anyway, any comments?

Hi all.

I am wondering about something...
(here's the background first....)

I filed the 1-130 (ultimate CR-1) for my husband on Dec.11, 2007.

It went to the Chicago lockbox until it ultimately ended up at slooooooow Vermont where it is still languishing. I only have NOA1.

When I filed, I hadn't changed my last name from my ex (simply due to time issues of work/DMV long lines, SS office long lines, etc).

I had planned to just get it filed first, then change my last name when I could wrangle a day off from my ####### retentive boss.

Anyway, here's the skinny:

My ex is deported and also wanted by the FBI for international parental kidnapping. (took our two boys through his cousins when he left).

Anyway, his name is obviously (I assume whistling.gif ) in the immigration system as a "booted out" person wanted by the FBI.

I am wondering if I could be getting the runaround because I filed for my husband when I still had my ex's last name (which may pop up red flags whenever my file is opened).

Each time I call and actually get a real immigration officer, I am always asked "who are you". When I say my name with that last name as my petition shows. The person then says "are you sure?"

It is strange to say the least, which is why I wonder if immigration is running some sort of long and drawn out background check just because I was once married to a deported person who is wanted.

If that is the case, is that legal to do? I am not related to the person (only by previous marriage and by nature of my kids). He can not come back to the U.S. Also he still has my kids and an active FBI & state dept. case cause of my kids.

The embassy who will eventually give my husband his interview and his visa know me personally from traveling to the country so many times regarding my children (which is how I met and fell in love with my present husband).

So I also wonder if this will hinder or hurt his interview when it comes since he is also from the same country. (he doesn't know my ex personally and never met him). and I wonder if the consulate would deny my husband (out of bias towards the natives & due to the issues they know about already with my case already their involving my children.)

I know no one but USCIS will ultimately give a straight answer on the questions I asked, ....just looking for hypothesis from others. 50 heads are better than one. lol

I am now in the process of doing my security checks and waiting on fingerprint cards.

They ask for EVERYTHING about your past and it is lonnnnnng.

I was looking online and saw that many people don't continue the process after getting the tentative job offer letter and the security package. It said that the process is so thorough that it can be VERY intimidating to say the least.

I think that is true, as I am still looking at my package and cringing.

I once called and said I was thinking of withdrawing. (didn't mention that I was going to do a direct consular filing while staying with my husband in his country). They will give you ALL KINDS of information on how to cancel and even where to send it to. SOOOOO Enthusiastic about it too. That is a SHAME!

My husband laughed his head off when he heard this. He's in favor of me doing it so I can leave the U.S and we can file from his country while living together, but I just won't let them STEAL our "hard waited" 6+ months of time. We are past the 6 month mark and I've seriously considered moving to my husband and scrapping the whole petition. However I applied for a position with USCIS awhile back and got a tentative job offer recently. I figure I can do more good to help by being employed with them.

Either way, something has gotta give. I may just call them back and tell'em "no husband no job". hahaha.
I scored a 100% on the screening test and they just about beat my door down trying to reach me to offer me that job. Soooo we'll see if that helps move them along.

I filed our I-130 Dec. 11, 2007 and am still waiting. Filed 2 expedites. One was denied due to my not being the "affected party"...even though I am the petitioner AND they had my first and last name completely wrong.

The second "expedite" I filed was only listed as an "other" request. They didn't even list it as an expedite because they said I couldn't file a second expedite within 30 days of the first one. But the first one was denied without the file being opened to see that they had my name COMPLETELY wrong and THAT was how the MAIN expedite got denied in the FIRST PLACE!! ARRRRRG!

This is designed to make us all give up. I will not go away on this. Trust.

But from what I have been reading, people have been submitting both forms together at the VSC and the CSC without rejections (with the exception of one case I read about on the forums). That's the only reason I ask. If it can shave off 2-3 months by filling simultaneously, then why not!

No there's not much that she needs to do, but in Canada the toughest thing to get changed is the Citizen's Card that Canadian Citizens carry. I have read online that it takes quite a long time to get that changed. Obviously the passport is also another important legal document that would need to be re-issued with her new name.

Btw, how much did the new passport cost? Did you have to pay the full fee or was it cheaper? Just curious. Thanks!
