Yes, that is EXACTLY what they told me. Wow, amazing.

They do that (the waiting game) to give the intending immigrant who is considered a fraud time to get frustrated & tired of waiting and just take off.

I don't know how I feel telling you this bit of information because I know that you would obviously tell your wife and if she is a fraud, she will undoubtedly keep on for the prize.

You also mentioned being from the same country and knowing your wife.

I lived in my ex's country off and on since 2005 and I thought I knew him also. I traveled back and forth from the U.S. to Senegal, traveled into Gambia by bus (6 to 8 hours) by myself every month and eventually learned the language just to keep from getting lost. I am the same religion (muslim), I am a black person (same as my ex), I have children from a previous person who is from the same country AND same area, have met (several times) the whole family, etc etc.

Say all that to say,....it doesn't matter.

If your case ends up in review, something is amiss.

No one has time to review cases months and months at a time and perform extra interviews on a whim.

The reason the case went to this department is because someone in that unit thinks their is some evidence of fraud going on.

Mine went through this unit and also a few others that I know of.

Guess what, they were ALL turned out to be fraud AFTER they were approved for their visa. In my case, they did everything but sit me down and plainly say "uh, your husband is a fraud and you need to stop your petition right this moment". Naturally I wouldn't have believed them and would have did everything humanly possible to prove them wrong (which I did). Well, they were right.

All I can say is, if your case ends up in this unit, start looking long and hard at your situation to see why they feel it is fraud.

These people actually live in Dakar and know all the customs, language, idiosyncrasies, ....everything about what fraud looks like.
I personally thought, "hey, they are American just like me. They don't know my marriage". Well, turns out they did but can not, by law, force you to abandon a petition if you can prove that YOU THINK your marriage is real and legit, even if it isn't.

I think they will just approve the petition and take a "I told you so" stance after the fact.

Nothing will happen. Once a green card is issued, that's it. It's like a trip on a train ticket. Once you have rode on the ticket, the "experience" can't be taken back and neither can that affidavit. The only way it can be voided is if the wife dies, permanently goes back to her country and gives back the green card or she works 40 credit hours (basically 10 years) in the U.S. Also, in SOME cases, if the wife is convicted of marriage fraud or any other immigration violation and is deported, the affidavit is voided. (in that case, it's not TECHNICALLY voided until the wife is convicted, no remedies, judge gives deportation order AND she physically leaves U.S. soil through that deportation order. In effect, the government will wait until the last possible second to let anyone off the hook for that affidavit of support. Good luck, you don't have much to worry about unless the wife starts selling drugs and get's caught or some as heinous as that.

You need to send the original long form of the birth certificate. I thought I could get away with photocopying at Kinko's the long form, but ohhhh no. They wanted the original so go figure. Just make sure you get it all back at the end of your process. And keep a copy for yourself.

I am new to this site! I have been dating an awesome guy from canada for a few months. I haven't given much thought to immigration issues until a wedding proposal on my birthday. I live on the US border and he lives on the Canada border. We easily commute back and forth to visit without problems but the issue of marriage comes into play and we want to live together. He eventually wants to live and work in the US. I would not mind acquiring Canadian citizenship. What would be the best process for us? How long does it take to receive proper papers? Thank you! We received a CR-1/IR-1 and my husband did not have to get finger printed once he enter the US. The only thing we had to do was wait for the green card to arrive. However I would post this question on the CR-1/IR-1 forum. It is possible that the process has changed since we were approved in Sep 07.

Hey guys hopefully I ll be able to get some right advice from here. Please help.

My husband's interview is on Feb 17th in Islamabad embassy. My uncle is a co sponsor with me. I have had enough with him because my case my stuck in NVC since July 2009 cuz of his laziness. NVC scheduled the interview date for my husband and asked us to take the newly filled I 864 to the interview. At this point the status of my I 864 was still 'incomplete'.


So at this point what if I change my co sponsor. My husband's sister living here in states is willing to be a co sponsor. and things are not good and smooth between me and my uncle. If I change the co sponsor in new I 864 along with all other documentation. And be able to send it to my husband in Pakistan before the interview. Is this going to create any problem at the interview or may be later on during Administrative processing. Guys please help, its urgent.... I have such a little time to do this and send everything to Pakistan. :crying:

Guys if you could help me advice, i would really appreciate it.

Due to errors made by my lawyer filling up I 864, NVC has forwarded it to the embassy, Now my husband needs to take I 864 to the interview next month.

I was filling up the forms and wanted to keep it mistake proof...

I have never worked before and have not filed tax returns. That is why I have a co sponsor. All is set. But How do I fill up Part 5 question 21 regarding household size.

Currently I am dependent on my uncle and do not earn anything and have not filed tax return. After filling up 21a and 21b (Person you are sponsoring, and yourself) I am coming up with total household size '2'. Is that alright. Am I making any mistake any where?

I know its all in here somewhere - but would still very much appreciate an answer on this forum.

USC daughter (19) married Canadian citizen (19) in December. He arrived on a visit 10/10/09 and they married 12/12. There was no intent to marry when he came.

I am helping them file.

The newlyweds live with us in NJ.

Daughter has -0- income at this point (she helps me care for her Alzheimer's grandma at home).

I want to be clear on proper filing:

Daughter files the I-864 even though she has no income or income 2009 (she was student)
Her father files the 864A (rather than the co-sponsor I-864) with his financial info because we share the same house.

The medical exam should accompany our concurrent filing of the I-130 and I-485.

Is this correct?



ahhhhhh..... I just got back arguing with the lawyer and then she apologized for misinterpreting the information. Our case was stuck with NVC since August 2009. This was only because my lawyer thought that me and the co sponsor dont live in the same household. I dunt know how did she think tht since the adresses were even same. She filled the wrong forms... I 864 for the co sponsor.

Everything is clear now... If co sponsor is in the same household, the fill I 864 A and I 864 for the petitioner.
If co sponsor lives under different household then he/she fills another I 864.

Ok VisaJourney pros, we're about to take the big leap and want to make sure all of our I's are dotted.

My fiance and I met in June and like so many good love stories we knew pretty quickly that we were perfect for each other. We're getting married Wednesday and I'm hoping we've got everything together.

My fiance currently holds a J-1 Visa (2 year residency NOT required) that expires 8/31.
We will be married on 8/12. An official marriage, not a wedding ceremony yet. I think we might go to her home country after all the status stuff settles to do this.
Her nationality is Russian but she was born/raised in Uzbekistan.

We plan to file:
I-130 with proof as Join Tenancy and several affidavits from friends and family.
I-485
G-325a (for me)
G-325a (for my fiance)
I-864 (Me supporting her)
I-764 (for work while application is being processed)

Question: The link for the I-693 on Visajourney did not seem to go to the PDF. Does she need a medical exam BEFORE we file the paperwork or is this something that necessary? Is it required if she is already here on the J1?

Question: The I-601 - What is this for exactly? She doesn't have and has never had TB. Is this the only issue the document covers? I couldn't find solid info on this.

Anyone have experience in our situation recently? Russan-Uzbek J1 -> Marriage process?

we have a lawyer working for us. So we dont receive a DS320...he automatically is our agent. So instead of sending the agent form out ...they send out both bills at the same time.
Hope it is moving for you soon. It took our bills to be generated 1 week from getting a case number, but I heard it takes 2 weeks on the average.
Always check Tuesday...they update their automated systems usually on mondays

There really is no need for a lawyer, but it certainly can't hurt if you get a consultation (free one would be best), at least once.

There are many VJ members that have Thai fiancees and spouses, so you have a very large support group here. Please check out the "SAWASDEE2" thread. Also, introduce yourself to the members on that thread. We are lucky to have a very knowledgeable member who's screen name is "Yodrak". His wife is also Thai, and can help a lot.

Thanks, It is a little difficult she is a Widow and I am divorced?

We have done it without one. If your case is not too difficult (divorce, childreen etc.) you do not need an attourney.
