K-1 Fiance(e) Visa Process & ProceduresTax forms or letter of employment ok?
I have two jobs and combined make about 18,000, I also have a savings account and stocks/bonds.

This is the first year I have hit that income and NONE of my tax forms say that I made anything over 2,000 because I was a student.

Also, I will, but have not declared of one job, because it was a nanny position (but my employer will write a letter)...so there is no evidence of my income other than the letter of employment.

Will this be ok, or should I get a co-sponsor?

Just extra info: I have no real estate. I am unsure about my life insurance policy (my mom made it).

THANKS!!!!

K-1 Fiance(e) Visa Process & ProceduresHow long was your paper to answer quesiton 18?
Your supplement should NOT be more than a page (according to my lawyer). Remember that these officials have thousands of cases to read and they just want the facts. Mine was exactly and page. I bolded the important dates and two sentences: "We met and began a friendship (December 2004)" and "We entered a romantic relationship (December 2005)"

Just keep it short and to the point!! Good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 or K3?
Hey everyone!

My fiance and I are trying to decide whith route to take. We were set on doing the K-1, however with the AOS taking so long, we are starting to look at the K-3. What does everyone suggest? What are the pros and cons of both? Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresEngagement while in Divorce proceedings
I was engaged to my fiance before the divorce was finalized. We were engaged this July and we JUST got the final divorce decree and just filed today. My lawyer told me that it is not a big deal, we just need to be SINGLE in the sense to be able to legally marry at the time of filing. People have relationships while divorces are in process all the time.

No worries!

K-1 Fiance(e) Visa Process & ProceduresHow to check status?
Hi everyone!

I just filed and I have noticed on some timelines that they know about their NOA1 before they receive the hard copy. How do you do this? I was checking on the uscus.gov website and it asks for your receipt number to check your status...I am confused.

How can you check without your receipt number (I was under the assumption your receipt/case number is on your NOA1)??

Just looking for some support or comfort before I get too worried...

I just looked at my photocopied petition that I sent in last week and I noticed that my letter of intent says "and intend to with my arrival into the US" but see it isn't MY arrival into the US it should have said "his arrival". Will this be a big problem??

Also, on the actual I-129F form I did not put my birth certificate number, I just checked birth certificate for U.S. Citizen option. However, my birth certificate IS included later in the packet....will this be a problem that I didn't fill it out on the sheet?

K-1 Fiance(e) Visa Process & ProceduresSocial Security Number
I read somewhere, I think it was on the USCIS website, that K-1s are allowed to get a SS number upon entering the USA. It was a bulletin and it suggested printing it out and taking it to the local office with you just in case they were unaware of the fact that k-1s could get their SS number. Has anyone read this or know where it is? Let me know!!!!

Hi everyone!

Happy Friday! I was just curious to know if anyone has had an interview conducted at an Embassy different from where the beneficiary is a citizen of? Or has any information on this?

My fiance is a Dominican national but living in Jamaica on a work permit and we are hoping that the interview will be in Kingston because he does not get vacation time and it would be a financial burden to go back to the DR.

Thanks in advance.

K-1 Fiance(e) Visa Process & ProceduresI need your opinion about 90 days....
No. They are strict about the 90 days and if you file for the AOS and they see that you were married after your visa expired they will most likely deny your permanent resident card. Go get married in the court in your city!! Have your fiance take a morning off work and go to the courthouse, it will be worth it!

Good luck!

Hi ...
Best way to track ur case is to call up the visa centre u have filed after u recieve ur case no.. u can check on USCIS website ... but USCIS site is not at all reliable..it will show only few updates in the beginning ..
Dont worry U will get updated through mail or post by the consulate every step u go fwd with the case... Thr will be an option of agent after ur case has started ... then the letters will be posted depending on the agent chosen by You or your wife?? agent can be you .. ur lawyer or ?? u will get rest of the information on the letter
which is the US consulate centre in india your case is gonna be fwded ?? ONCe the case gets fwded to india u have to start callin the US consulate in india..

Goodluck and congrats ...

My fiance will go to the consulate in Chennai. She lives and works in Bangalore. I already have all the phone numbers in my check list. I actually spoke to the consulate while there and gathered some good info.

Hello again. I had a great time visiting India and just returned on Monday. Happy and blessed to say that my beautiful girlfriend and I decided to get engaged. Had a wonderful engagement ceremony with her family and friends. This site was so valuable in helping us get together all the documents we needed so when I returned I could quickly and easily get my I-129F package together. I can't thank everyone enough for your input prior to my leaving for India a few weeks back.

So, here we go...the waiting begins. smile.gif

What is the easiest way to track the status of my petition?

Thank you and best wishes
Mark

That's a very good question, Mark. A very good question! What most people do, is go to the USCIS website and create an online account. You'll need your service centre receipt number to do this (which you'll get via email/snailmail when they've cashed your check) and once you've set it up, you can check back as and when.

However, be warned that the website far from reliable: I was granted NOA2 on 23rd July, but it's still showing as pending!! The first I knew of it was when my OH called me to say that it was in her mailbox. You might also want to start an "August Filers" thread on the sub-forum. That way you share your journey with other folks in the same boat, at the same time. And that helps. Really it does.

Thanks so much for the info. I'll start the August thread if it isn't already created.

QUOTE (Nicoxcx @ Aug 9 2008, 02:39 PM) <{POST_SNAPBACK}>
It is completely Legal, since you are the USC wanting to spend those couple months in the UK it will be easier to get over here, if your Fiance decided to visit you in the USA whilst the process was going on , he would have to show ties to the UK, to prove he will go home but both ways is legal, many people wait this process out together and the plane tickets/photos etc for your trip after filing your I-129F will prove usefull when he has to show evidence of a continuing bonafide relationship at the consular stage smile.gif .

So, to understand this better, my fiance could come to the US on a visitor visa while my K1 is in process? I realize I can go to India, but how can she come here while we wait for the K1 Visa to get approved?

I realize that most all of you have handled this process on your own, but for me, I just feel more comfortable with having a lawyer manage this process for me. I'm curious if anyone has hired an immigration attorney to handle a K1 visa and how did you go about choosing an attorney? There are number of "national" firms that seem to specialize in this field, but I'm not sure if I should go that route or deal with someone local here in Atlanta.

Any advice/input here would be appreciated.

Milo and Mark -
I love this forum...Thanks a ton. Am new to this just like most of you..Will PM you - dont know how to do that - but for now my ?s are getting answered. It's only folks who are going thro' this who understand how stressful the whole process could be personally and on top of it to take care of this visa issues..!!!

Mark and Milo - I still don't understand where in G325 instructions do they ask for your information. How did you know that you had to fill out your information in G325A..I might be missing something very basic here...

I referenced the completed sample that they have listed here. If you can't find it let me know and I'll send you the link. I'd be glad to chat with you on yahoo or MSN messenger sometime and walk you through it.

The PDF for the G325 is easy to use. You need to know both your parents dates of birth and birth places. You need address for where both of you have resided for the past 5 years. You names and addresses of employers, job titles and dates of employment for both of you for the past 5 years. If either of you were unemployed for any period of time in the past 5 years note that in form. Do not have gaps in employment time. If you need extra space, you can put the info on a separate sheet and simply notate in the form to reference the attached document. This is all off the top of my head, but that is important info you will need to gather in order to complete the form.

I'd be glad to walk you through it if you need help, but if you reference the sample form available you should have no problem filling it out correctly. The key is having all the info you need before you sit down and fill it out. Each of you will need to sign and date all 4 forms with your individual information. I hope this helps.

Mark/ Milo - I think our situations might be similar.

a) I believe I am going to take the K1 path. We plan to get married here - legal ceremony/ registration. I will be careful about the religious wedding in India.

cool.gif Mark - I am also not planning on using any lawyer. I am hoping that I could go thro' the forms on my own.
I have a question. Can you please let me know if there is any documentation that I am missing in the ones that I stated.
c) How do I fill out G325a - I have a fillable form. When I filled information in the first page it automatically populates the 4 pages. It says, one needs to be filled by the petitioner - the other by the beneficiary. Do I need to put my information in the G325A form for the petitioner or do I need to just sign for the petitioner with her information. The example G325A here was very confusing as it is pretty much the same details for both the beneficiary and petitioner. Thanks. I have follow on ?s w/ G325A but that is for a later time.

Mark/ Milo - stay in touch. I will let you know how things take shape. Good luck to both of you. I am going to read the rest of the relevant forums.

Regards,
Dilbert

I followed the step by step check list when I submitted my forms. Here is how I put my package together.
1) The cover page - signed and dated by me
2) the I-129F completed, signed and dated by me
3) Letter of intent to marry my fiance, signed and dated by me
4) Letter of intent to marry me signed and dated by my fiance
5)A G325A - all four pages with my info, signed and dated by me
6)A passport sized photo of me in a small plastic bag, labeled correctly and attached to a sheet of paper
7)A G325A- all four pages with my fiance's info, signed and date by her
8)A passoport sized photo of my fiance, labeled correctly and attached to a sheet of paper
9)A copy of all pages of my passport
10) Supporting documentation of having met in the past two years and our engagement that included color photos labled and in a bag attached to a sheet of paper, copies of airline tickets, boarding passes, hotel receipts, engagement ring receipts, etc.

Oh yeah...can't forget the check for $455.00 that I attached to the cover page. I didn't staple anything together, just used paper clips.

That's all off the top of my head, so I hope I didn't miss anything. But there are more experts here than me, but the guide is very easy to follow and very helpful. ...Drop me a PM if you want to talk further.

I too wish you all the best to you and your fiance.

K-1 Fiance(e) Visa Process & ProceduresK1 Questions and India
I also just recently submitted for a K1 Visa for my fiance in India. This site and community was a huge help. I decided K1 over K3 because of the alleged time difference, and I wasn't sure if getting married in India or the U.S. would make the process easier. Didn't want to guess or rush things either.

Our plan is to get married in the U.S. once she comes here on the K1, then get an early parole so she and I can travel to India and have a wedding there. May not be the ideal situation, but for me it makes the most sense and limits potential problems from arising. The most important thing to me is for us to be together as soon as possible. The wedding ceremonies and traditions will come 2nd..but will happen because they are significant to us both.

Good luck to you and your fiance.
