OK - so she not hold a German passport. Got it.

They need to finish up on the CRBA, consulate record of birth abroad, soonish, get the baby a USA passport.

He needs to determine the status of the I-130 (not the visa application) . If it's still viable, he will file the I-824 to get the I-130 sent on to NVC. If the I-130 is no longer viable, he needs to file the I-130 again to the lockbox address in the USA.

Ok I just went to the web site and spoke with my daughter-in-law. She went all the way past the medical interview. They sent the paperwork to my son who is in the states(who is in the field at the time of receipt) 30 to fill out and return. When he got them filled out and sent back to her she sent back and they denied the paperwork saying it was not received in time. He sent $600 to reopen the file. They refused to reopen the file said he would have to start the entire process over in Germany(which is impossible since the Army will not send him back).

she is Thai national, the wife? or does she hold a German passport?

Thia national has lived in Germany the past 13 years

just assure her everything will be alright. I am too is separated from my husband. same thing 3-4 months together as married couple too. our baby just turned 1 and her dad is not here. we were not together on our 1st anniversary and perhaps 2nd anniversary. Just tell her to hang on.

does germany has any policy regarding tourist visa.. vwp or something.. or better consult a lawyer..

she can travel to USA on a visit visa just to be together. just to bridge the gap :D

It's possible that the visa application just dropped on the floor due to time and timing,

however ...

This stuff about getting translated into German is BS, for the US Embassy in Frankfurt.

i assume he was trying for a DCF'd I-130 at the time, in Frankfurt (please confirm, I-130 filed to USCIS office in Frankfurt or no) - smells like - They did get the paperwork started at the Consulate in Frankfurt

There's a military helpline for this stuff, but they might not be so well versed with the minutiae of his case.

Can tell us if the I-130 was approved, or no?

The other doc intake was for the DS-230, the visa application itself.

It may be that he simply file a new I-130 and ask for an expedite due to USCIS error on the prior I-130, all to the lockbox address in the USA, and finish up with NVC processing .

can tell us more, with dates and form #s ?

I will get with him today and find out what forms he filed. We were considering getting her and the baby a visiting visa to get them over here then start the process again in the USA. He is worried that the first interview will be past her 90 visa. Any ideas?

You son has access to legal/lawyers on base with the Army that can possibly assist him with this.

His biggest issue he is having is he just came out of a month long class with long hours. He is going into the field for the next 2 months it just seems that everything is working againist him when it comes to being able to see them. I will tell him Thank You

with the CRBA, even if the parents are not married, as long as you can prove the legitimacy of the baby. there should be no issue. you can have the passport issued as well..

The baby is just taking time to get everything taken care of. Kitty is loosing hope of every being with her husband again. There year anniversary is this month they have only spent 2-3 months together as a married couple. What do we do to get her over here once the passport is complete on the baby.

I am the mother of a US Army Solder. My son was shipped to Germany from what was supposed to be 3 yrs. Not long after getting to Germany my sonn met his wife. He went to Afghanistan for his tour, half way through on leave went back to Germany to be with his girlfriend Kitty. They called each other and Skyped the entire time he was in Afghanistan. When coming off the tour of duty he moved into her home instead to the barricks lived with her for 6 months then got married in Denmark with the approval of the Army. Not long after the marriage he got new orders to be sent back to the states. In this time they were still getting her paperwork set up with the Army for benifits and such(we also found out they were preg.). Son comes back to states without wife. They did get the paperwork started at the Consulate in Frankfurt. Kitty has supplied all paperwork asked for untill the baby came. Since the baby has come we have found out that they need her first marriage and divorce certificate sent to Thialand(her place of birth) to be registered and then sent back to Germany to be translated to German. Then she has to send her marriage certificate for my son to do the same thing. We are having to do this just to get a international birth certificate for the baby. In the past 12 months they closed the case due to no activity(because the baby was not here yet) my son paid to have it reopened $660.00 for them to deny it to be reopened. He has contacted them with no success. Germany has told him that he has to be in Germany to start over. We do not now what to do at this point the Army will not send him back to Germany for another tour of duty. We need help to figure out what we need to do. I am watching my 5month old Grandbaby grow up on Skype and my son has never held his son. If anyone has any information we would greatly appreciate help or knowledge.
