Btw, they can accept late ROC applications.  it appears the OP filed the wrong check in May, and then only in September sent in a new application.

 

It is possible that this application will be accepted.  You can also file ROC from abroad.  But it sounds like the husband filed the ROC.  If the wife didn't sign it or anything then it will be rejected too.

 

 

 

 

but what if (just what if) they get an interview? how is it going to work out? is it legal to let them know the petitioner is out of the country? and abandoned her residency.

what i don't understand is - you left the country, paid airfare, when you could have filed for your I-751 at that time. and waited until you get your 10 year green card before leaving the country. (that is your responsibility) i'm sorry but i think everyone is right.

 


A U.S. permanent resident card holder whose card is lost, mutilated, expired or never received from CIS, may be eligible to apply for a Transportation Letter issued by the DHS/CBP.  The Transportation Letter will only allow you to board a flight returning to the U.S. but does obligate the U.S. Government to admit you once you have landed.  In order for CBP to issue such a letter, you must demonstrate to DHS/CBP that you:

  1. Are a lawfully permanent resident of the U.S. at the time of departure from the U.S.;
  2. Maintain residence in the U.S.;
  3. At the time of departure, had the intention of returning to the U.S.;
  4. Have not formally abandoned your resident status (by filing Form I-407); and,
  5. Have not been outside the U.S. for a continuous period of one year or more unless authorized by the U.S. Government.

welp, mine was approved august 29th, i already called and talked to a level 2 agent twice. updated my new address. still, i can't track anything about my new card. it hasn't been printed. when may filers already got theirs. i am a little upset that the level 2 agent i spoke today was a little rude. i just told her about it and said, well, my new employer would probably wanna see the new GC (and some of them don't accept uscis letter) i just have to try and bring all sorts of letter and my expired GC.

I dont think I did anything special.  I only asked for the status of my case and I told the IO that a Tier 2 IO from the 800 number had said I needed to come in on an InfoPass to get an update.  I think it was just lucky timing that my case was assigned to be worked the same week as my appointment.

It turns out the RFE concerns my step kids - I sent multiple I-130s together in one packet.  My wife's was approved.  My local office is only 30 minutes away so I should get the letter by Tuesday.  I'll see what's up with the kids in a day or two.

I just returned home from my Infopass appointment and I feel like it was a good one.  My case is on the I-130 unit's supervisor's desk to be worked by her. It was there already which is very rare according to the IO that was assisting me.  She said that the supervisor usually doesn't work cases.  My IO spoke with the supervisor who said if there's nothing wrong with my case it should leave her desk soon.  The IO couldn't offically say how long, soon would take, but she suggested that I start checking with the NVC and also for online updates in about a week.  She also said if I didn't have an update by four weeks that I needed to call the 800 number or come back on another Infopass appointment.  I'm making an appointment now to be sure that I have it near the four week point just in case.

On May 6th, I spoke with a tier 2 IO who informed me that my case was in the queue at the Dallas Field Office.

 

My case is at the Dallas Field Office and I was mailed this update after my inquiry:

 

"Your case is currently in queue to be scheduled for an interview. An appointment notice will be mailed to the address on file."

 

Do they usually queue interviews at the local offices and any idea why they would want to interview me?

My case has sat at the NVC since June 3rd and they still haven't given me a NVC number.  When I called today the agent suggested that I had at least one more week to wait.  I asked him why they stopped working and he said he didn't have that information.  He could only say that it's taking approximately 8 weeks to do the initial in-processing.

Yes, they approved my wife's I-130, but they have reconsidered our kids I-130s, which they initially approved.  Evidentally, they decided that they weren't satified with either the birth certificates or the translations of the birth certificates.  They sent an RFE to have originals with translations resubmitted.  Note:  I submitted originals with translations to begin with.

Anyone here aproved yet on thier I 130?? Mine been at nbc since fenlb 25 2013. It been 3 months now. Is this normal??

 

 

Yours was probably transferred to your local office about a week after they received it.  You'll need to call the 800 number and ask for a Tier 2 Immigration Officer to confirm that.  Then, if you want an update, you'll need to schedule an Infopass appointment at the local office.

It's been 90 days so far - with no word other than the initial I-797.  So, I called today and spoke with a tier 2 IO who informed me that my case was in the queue at the Dallas Field Office.  I asked if he would expedite our case as my wife is living in a dangerous situation due to her government job, location and the unrest in Southern Thailand.  He agreed that that might warrent an expedite but of course the decision isn't his.  He submitted the request and advised me that someone would get back to me within the week.  I have little hope that our case will be expedited but there is a slim chance.  Maybe we'll be lucky...

I just finished a conversation with USCIS customer service. They assure me that my case is being processed at the NBC and has not been reassigned to a local field office. I don't know if I can trust this information but I suppose it's good if true considering my local office is Dallas.

I dont know if you read the thread by a former adjudicater, but he did say that group petitions (spouse and children) got approved faster.

Ha!  Yes, waiting in peace is nice smile.png  I had no idea how much waiting would be involved when we first decided to get married.  I'm not a very patient person, so it's been a hard process for me already, and it's only just begun.

 

I'm a federal employee working for the National Institutes of Heath.  My particular institute does research into diseases of aging -- Alzheimer's, Parkinson's, etc. -- pretty interesting stuff.  My education is in Biology.  How about you?  What are you studying?  Do you have an idea of what you'd like to do when you're in the States?

 

Thanks for the information on the passport renewal.  I'll pass it along to my husband.  He's been so busy lately with preparing to release from the military.   I'm planning to go up to visit him at the end of April to attend his departure ceremony and then to visit with him and his parents for a week or so afterwards.  I can't wait to be in the same country as him again.  This whole process sure puts things into perspective, eh?

Same here! I was so sure I'd be able to move once I graduated or maybe a month or two afterwards. Now I'm just hoping to be out by October :(

 

NO WAY. I actually do Alzheimer's research right now! I study Neuroscience and work in a neurology lab looking at salivary tau phosphorylation sites and their potential as early AD biomarkers. Small world! I'm planning on doing a PhD, maybe MD-PhD joint, hopefully in Georgetown. I'm also looking into some positions at the NSF, since I have a couple of contacts there from working in Arlington last summer. I went to a couple of NSF neuroimaging workshops during the summer and would love to be involved in that branch of science for a while. It's good to know there are opportunities outside of pure laboratory research.

No problem. It's really simple, especially if his last passport renewal application was after he turned 16 (which I assume it is), in which case the application form is super short and simple. Maybe you can help him take care of it when you go to visit :P Definitely does. At least I know I'll never ever take my husband for granted after this cause I'll always remember how much this process hurts. I swear, everytime I see him, it's like seeing a celebrity; that's how physically distant I feel from him sometimes. Anyway, enjoy your visit :D

And back to your original post -- my husband needs to renew his passport, as well (his expires in November 2014).  Did you say it only takes 10 business days?  He might just go ahead and do it now if that's the case.  In the US, we have to mail our passport in and it takes a month or so, if I remember correctly.

It depends on if there's a passport office near him. He can look on: http://www.passport....x.aspx?lang=eng. If there is, he can take the application in himself, apply, and the passport should be ready for pick up in 10 business days. I think if there aren't any nearby offices, he'll have to DHL it in or something and that takes 20 business days, with an option for expedite (you'd have to pay extra) if you're planning on leaving the country (you'd need a copy of your ticket). It's pretty simple :)

I just looked, and there seems to be an office in Kingston on Clarence street. I don't know how close that is to him, but that's promising!

Yes, the commute is 60 miles each way, about 1 1/2 hours with traffic.  Thankfully, I do get to work from home two days a week, so that helps.

Another D.C. area resident saying hi!  I grew up in Southern Maryland (Waldorf) but now live in Old Town Alexandria and work in Baltimore (terrible commute -- I know!).  

Met my Canadian husband when he was working at the Canadian Embassy in D.C. -- can't wait to have him back.  Nice to know there are others in the same area!  Cheers!

Depending on how long it will take to issue a new passport, I would do it right after NOA2 and before sending in the IV package as including a copy of biometrics page is a requirement.

No need to notify USCIS, as including a copy of the biometrics page with the I130 was not needed smile.png

That's a good idea! It should take 10 business days, so if I do it right after we get the NOA2, it should be done long before we even receive a case number. 

 

I can't seem to find it, but am still not sure: do they ask for your passport number on the I-130?
