If I remember correctly, the processing time is 7.4 months. However all service centers are also posting that they are working on Feb 2013 petitions. Which means that they will not accept a service request from anyone that has filed after Feb. Based on USCIS, only people in Jan 2013 can file for a service request..

Go figure!

Honestly, with Christmas just around the corner, I would not expect to hear anything from them till after the 27th Dec or 30th Dec. Though the good thing is that alot of people that have gotten an RFE have been approved within a week of the service centre receiving it.

Well I am sorry to tell you that your wait is not uncommon and should be expected to wait a while.  I have been waiting 5 months since I got my reciept.  Perhaps you might want to consider doing a K-3 visa for your spouse which has a 5 month waiting period instead of a year or more for the I -130.

 

The K3 will not be approved faster than the CR1. It will basically hang around till it finds the I-130.

Janelance is right, approvals aren't necessarily based on country but they are influenced if the petition involves a high-fraud country. 

Unfortunately though, approvals are not within 4-6 months. More like 6-8 months for a NOA2.

I wouldn't bet on an approval this month, or in February to be honest.

You have filed in September and USCIS has yet to touch and start transfering August filers.

 

Patiance is a virtue that alot of us are starting to lose. IMO relax, lay back and wait, for this is going to be very long, very slow and painful.

There you go... now the National Visa Center is an average of 12 months and California is 7.7 months ...

 

My spouse is overseas and my case starts with MSC.. I sent my case to California, but the NOA1 says Overland Park. Which timeline should I be paying attention to?

 

Right now you are at NBC. There is no timeline you can follow right now as the only petitions being approved by them are either DCF or expidites, and those are coming from Lee's Summit.

USCIS are in the process of transferring April filers. It is reasonable to assume that May filers will be transferred to service centers as well, probably in Dec.

 

 

I would go by the NoA 1, and look at Overland Park, unless you get notification that it's been moved somewhere else.

 

There is no Overland Park to look at. There have been no approvals coming out of that place. Any approvals from NBC have been from Lee's Summit.

This is the reason why petitions are being transfered to other service centers. USCIS's shiny new toy "the Division 8 in Overland Park" was supposed to be operational end of Sep. Its not.

My petitons (I-130 and I-129F) were approved on 26-Feb-2014.

An update from USCIS said both petitions were shipped to NVC for visa processing.

 

I called NVC today and the operator told me that usually USCIS don't send files when they say they do, but rather it takes them couple of weeks to send them.

 

So, which one should I believe? NVC operator or USCIS update?

 

Believe NVC.  USCIS might have updated online but unfortunately that doesn't mean your file has actually left the building. To get an exact date of when your file was shipped to NVC you'll have to call USCIS.

 

Check out Saylin's NVC spreadsheet and look at NSC approvals date to case received by NVC date to gauge an approx time for the file transfer.

Hey guys.. just want your input in regards to the PCCS for the IV package.

 

I require 3 PCCs in total. The ones from Australia and Cyprus, will be sent directly to me so I have no problem with that, they will be included in the package I send to NVC.

However for the Greek PCC I need, that gets sent straight through to the US embassy in Athens. I wont be able to sent it to NVC.

On the NVC website, under  Additional Embassy or Consulate Instructions, there is a PDF that states:

 

For residents in Greece, A PENAL RECORD FOR JUDICIAL PURPOSE is requested

 

NOTE: Penal records for JUDICIAL USE will be sent directly to the U.S. Embassy in Athens-they will not be sent or given to the applicant. Please do not obtain the penal record for General Use as it is NOT acceptable by the U.S Embassy.

 

 

Is it a good idea to print this out and include it with the IV package? Trying to avoid an unnecessary checklist!!

No. That timeline is not for the whole process. That's just to get an NOA2. Even though it seems you have been waiting for a long time.. you really haven't. As NLR stated.. you are withing normal processing times. USCIS at the moment is almost done transferring and approving aug 2013 filers.. they just started to transfer sep 2013.. i would expect some movement for Oct 2013 filers that where sent to NBC, some point in the last 2 weeks of march.

Follow the sep and Oct 2013 threads to start getting an idea of when you might get an approval.

Firstly.. best thing you can do is ignore the processing times on the USCIS website. They contradict each other to no end.

 

You will get a better idea of the approx processing time on the VJ forums. Since you are a Oct filer, if you haven't join the October 2013 I-130 Filers thread http://www.visajourn...3-i-130-filers/, do so now. You will find fellow VJ members that have all filed their I-130 petitions in Oct just like you.

 

If I had to give you an approx time its anywhere from 6 to 9 months. There are members that have filed in June and July that are still waiting, 8 and 7 months respectively and then there are members like myself that filed in Aug and got an approval in 6 months.

 

Also keep an eye on the Sep filers thread, they are right before you and USCIS has already started their transfers, October is not far behind.

No offence, but you sound like USCIS official. And yes it's true K-1 visas are processed quicker. I think that it's absolutely unfair!


It's still unfair! I wouldn't mind to be in the States while waiting for green card.


 

K1 visas will always be processed quicker than a CR1/IR1 visa. The reason behing it.. a CR1/IR1 visa is required to file the Affirdavit of Support at the NVC stage.

K1 visas skip that step because they submit the Affirdavit of Support after getting married, when the file for Adjustment of Status.

 

Comparing or expecting K1 processing times to be equal to CR1/IR1 is unrealistic.

Depending on how long it will take to issue a new passport, I would do it right after NOA2 and before sending in the IV package as including a copy of biometrics page is a requirement.

No need to notify USCIS, as including a copy of the biometrics page with the I130 was not needed smile.png

Another question, is this where we have to include pictures to prove that is a legitimate relationship?

 

You don't have to included any additional relationship evidence at any stage of the NVC process. 'Side-loading' as its known, is mostly a must for MENA countries, where the consular officer could have very well have made his or her decision of whether to approve or deny a petition with just by looking at the case file.

With that been said, if you feel that you want to include more ongoing relationship evidence, send it together with your IV package.

Can anyone tell me if my husband has to do the fingerprint police check or just the name one? I've looked at the country specific documents but haven't seen anywhere it said which one.

 

Alot of people here on VJ will tell you that you need to get a fingerprint one done. However, in my extensive research on this I found nowhere were it officially states that a fingerprint check is required, they just mention name check.

Also, I have spoken to another vj member that sent in a name check only certificate from Aus and it was accepted by NVC.

I recieve an RFE august 12th, i was a little bit confused as it said i only sent Tax, Bank statements, and Photos. I knew i did send more. So, i resend the other documents again. After my trip to the east coast, i went to check my case and it said it couldn't be found. I was worried and i called them this morning and i was transferred to a 2nd degree agent, and he told me my application was approved last august 29th, i said i couldn't find my case online, and he said not to worry. I got home and actually got my I-797 NOA and it said i should get my card within the next 60 days. Hopefully it gets here before the 14th, because i am moving to the east coast to start a new life. smile.png

Yeah, that's what I thought: usually you get an RFE and then an interview appointment if your response is not satisfying.

Harpa, that is what i don't understand as well.  unsure.png you have 2 years to at least save up for the ROC fee (if money is tight) but leaving the country and spending airfare cost more than paying for the ROC fee. and there's always the waiver fee available for everyone who needs it.

Oh, if she doesn't get back into the country before a year is over (sounds like she has one month left), then she will abandon her residency. 

 

She may have already abandoned it, but I think there might be a chance if she could get her act together and get a transport letter and a NOA1 for ROC (which would mean they accepted the late filing).

 

If they got to an interview it'd be way too long by then.

 

This whole story is just so odd, too many bad decisions along the way.

gotcha! so, she needs an NOA1 to get a transport letter (that you can only get for a period of 12 months) with an expired GC.

Btw, they can accept late ROC applications.  it appears the OP filed the wrong check in May, and then only in September sent in a new application.

 

It is possible that this application will be accepted.  You can also file ROC from abroad.  But it sounds like the husband filed the ROC.  If the wife didn't sign it or anything then it will be rejected too.

 

 

 

 

but what if (just what if) they get an interview? how is it going to work out? is it legal to let them know the petitioner is out of the country? and abandoned her residency.
