I would agree with the Postmaster, you have two guys which are from country whereby marriage fraud is rampid, Nigeria and Ghana. I cannot speak for the state of Illinois, only for the state of Texas. In Texas you can get re-married the same day that you filed for a divorce. I am marrying my 2nd Filipina. I divorced my 1st wife (who was Filipina), and the day that I got my divorce papers, I sent off my K-1 Visa paper work for my 2nd desire. I believe what I have read that USIC will begin to frown and investigate on the 3rd K1-visa petition. So, you may be good however, "MAKE SURE!!".

I learned a lot from my 1st marriage, and became very wise the 2nd time around. So, go for it, provided you apply within the scope of the laws within the state of Illinois. But please put your emotions asside and be certain, else you will find yourself being used again. Men from Nigeria and Ghana are natorious for scamming American women. My 1st wife was 99.9 percent of what I wanted however, she didn't want to work, so that changed the dynamics of our marriage and I filed for divorce, some people may call the cruel, I call it being realistic and sticking to the agreement. It wasn't personal it was about the business of having a successful marriage and I'm not one of those men who just need a woman in my life.

So, proceed with caution, be skeptical, and do your research about the person. I actually hired a Private Eye to investigate my 2nd choice, sound creul but I learned my lesson from my 1st marriage. So, BE CAREFUL!!! and since he is male, TEST, TEST, TEST, TEST, TEST Him for he may already have a gf in the U.S. or he may even just want what the 1st guy got. I don't know too many men who would accept such a mistake, men are just not that patient by nature. I'm sure that's not what you want to hear but I'm very pragmatic.

I have one comment for you to think aobut;

 

marriage doesn't change much in a relationship (although some people may disagree with me), whatever problems you have prior to marriage, you're going to have the same problems after marriage. I don't understand why you are the one who is pouring all the energy into the process for if he has to prove his income, then that means he's the petitioner and you are the petitionee. If this is the case then his inability to handle the business of doing what is necessary to facilitate the process is a red flag that you might not want to ignore. One of the attributes of love is ?action? which is executed in the speed of ?above and beyond?. If you were my daughter (because you sound young), based on his lack of interest, I would say to you ?Baby Girl, Really??????

 

 

In terms of his tax returns, he can get copies of them from the last place he filed his taxes or by requesting a copy of them from the IRS (provided he's in America). however, I would be consered with his income (if he lives in America). Considering that "Finances" is the #1 cause of divorce in America, you should also be concerned.

I would agree with kitthekat however, I went to Walgreens and had 10 pics printed and put them in a picture binder. i didn't add any caption to the pictures or dates.

raven52 I think you mis-read my post. no one was referring to trying to deceive anyone. I was just trying to equate how important her passport was in this process. I have a passport myself that I only use when I travel outside the U.S. I don't use it as my main form of ID. So, my question was geared towards identifying the validity of the document in reference to this process. I am fully aware of the sensitive nature of this process and have no intention of deception. My fiancée (Filipina) and I (American) are in the midst of filling out the D-160 (an online form that a part of the k1-visa process). She has her passport which will expire in 3 months. According the one of the criteria, in order to complete the D-160 there are points in the form that ask for her passport information. The passport information must not be less than 6 months in terms of the expiration date. We are taking the necessary steps to renew her passport however; this process will cause a minimum of a 2 week delay in our objective to complete the D-160. Patience is definite a virtue during this journey and we really don?t mind waiting the two weeks. However, since my fiancée is from the Philippines and their government business process is not always a science what would be the ripple effect if we did not provide that information and proceeded process the DS-160 without acknowledging that she has a passport?

My question is that I have lost my job from the Sequester. I made over the poverty level already for this year. However I am now on Unemployment and I also get VA disability that put me over the current poverty line. I am just concerned that this maybe an issue since we are filing the documents this month. I think if the job change information is mainly relevant the sponsor rather than the beneficiary. However if you already have the information before you send in the form on the G325A then it would be easy to update it. However if it after the fact i do not think it is a big deal. You can always send it in just to have the records updated but the Sponsor income and job information is what really matters. Hope this help

Gotcha I don't have the kind of paper trail that you have for my trip sadly.  I didn't look up K-1 Visa applications until after I returned from the trip.  I'll see if I can dig up any hotel reservation confirmation e-mails and I also have my flight purchase confirmation.  I think that combined with my passport stamps from my trip and my fiance's trip to the US and maybe even her credit card statements too should do the trick.  I also have a ton of correspondence I can dump from gmail.  Thanks for all the info!  I have a pretty good idea of how I want to write out the answer to my Q18 now.

First time post here and I first wanted to say you folks have a wonderful site and community and I really grateful for all the information you have provided.  I'm beginning to assemble the I-129F packed and I have a couple questions regarding primary evidence for meeting in the past two years.
 
First of all, like a doofus I have already thrown out my boarding passes when I went to meet my fiance in her home country(japan.)  I do have a digital copy of my flight reservation though.  Will that suffice instead?  I also have my passport stamped.  Would I need to make a color copy of the whole passport or just the reservation page.  I am also planning on making a copy of my bank statement with transactions in Japan once it's available next week.

Thanks for the advice! I am barley under the required income as I work in the service industry. With tips I hit the requirement, just have no way of proving my added income from tips. For liquid assets I just have my old '97 Mercury Tracer, been living out of my suitcase for a while. I was planning on visiting my fiance in March, maybe I'll plan on holding out and heading down for the interview. Is being present really helpful in getting the Visa granted? I have heard mixed stories about it. Hopefully with a steady income and a well-to-do sponsor this all goes smoothly. Thanks again for the advice!

Hello Everyone, I have been browsing these boards for about 6 months and have decided to become active. A little back story first.

I met my fiance, Max, while traveling through South Korea back in 2011. She was a singer at a hotel and we were introduced by a mutual friend. We started dating two days later. I ended up working and staying in Korea for six months. After which we decided to move to the Philippines (Max is Filipina and was working in Korea). I met the family, had some amazing adventures, and even proposed while in the PI. Little did we know the nightmare that is the Visa process was looming ahead of us. We studied the process and I reluctantly returned home to the US while she stayed and worked in the Philippines. I hadn't been to my home state of Washington in about three years. I landed a job and got to work filing the Visa. It was recorded as arriving on Sept 17th at California Service Center and we are now just waiting for approval.

As for the the dilemma, though I have been working nonstop since my return, minus a trip to visit for three weeks, I am finding out that Manila is a bit harder to convince for the visa due to my income. My last two years of Tax records show me under the poverty level. I was traveling and just making enough to get by. I of course am using my Father as a cosponsor and have been steadily working since July of 2012. I just hope this is enough to convince the Embassy. I am willing to move to the PI, but my family and friends never getting the chance to meet Max would be devastating for everyone. Even with my new job, I still believe at the end of a year I will be just under the poverty level still. Take care and good luck Everyone!

My wonderful fiance also hates paper work and there is no reason we shouldn't be finished except he gripes about having to fill out all the paper work. We had to get a Certificate of Good Conduct from the Netherlands because he lived there for more than a 1 year. After pushing and pushing from September when we got the NOA3 til November he finally sent off the request to the Netherlands, COVOG government branch. We didn't get anything back from the COVOG in the Netherlands so I asked him to call them, he never did until I went to visit him for New Years and they the COVOG said "Oh yes we are mailing it out today you should receive it in 2 weeks".When I am with him he gripes about how long the process is taking so I tell him get the paper work done,ha ha, and we are both ready for him to come home to Dallas.

My point is some guys just hate doing paper work and I believe are worried that if they put all this effort in to the process and it doesn't work that all is lost and they will feel helpless and devastated.

Just reassure your man and keep nudging him and as one previous poster stated this is a Visa journey for him also and he may be showing you his fear in other ways like avoidance.

 

 

My husband HATES paperwork. I also don't like paperwork and during the whole duration of our K1 I would ask a lot from him such as the I134 and even just that he HATED it. He would whine about how stupid it is that we had to prove our relationship and why at times I would ask him to write stuff or compile things. I hate it when he gets annoyed for the simple stuff but I had to lengthen my patience and do things and I told him what to do next in the nicest manner I could and gave positive reinforcements every time he finishes something for the petition. I think he has carefully understood the need for paperwork and how meticulous it can get because he did not make as much of a fuss as before when we filed AOS. Of course I did most of the stuff but I explained to him the importance of each document each time I would ask for him to produce it and answer his questions as much as I can.

 

True enough that you are asking for all the things and are compiling and organizing but don't forget that he is going through the immigration journey also. I don't know how he sees it and you should ask him how he sees things not only now but in the future after the K1 process. He may be the same lazy person when it comes to filing or an unorganized guy after you are married. Would you be able to live with that? Are you going to think of divorce because he gets annoyed of having to wait for you to shop? Those are overly exaggerated questions but really something like compiling things is a mere bump on the road of being married. You are yet to go through the different terrains. 

 

Re-evaluate your feelings for each other especially yours as what others have said. In a third party's view (my view for example), it is a sign of unpreparedness and somewhat immaturity because you are quitting because of frustration and to think you have gotten so lucky with the speed of the petitions. It does not create a good image for you just because you are the one who wants to cancel the petition and not the other way around. This is how the things are appearing to me and that's just me but with that just consider how would a consular (who's prolly a counselor or psychologist) see it. I say that because sometimes even if we don't want to say these things, they just have their ways of getting to it.

 
TALK, TALK, TALK. You will argue at times because that's hard to avoid. Think whether it still is healthy for the relationship because the frequency and intensity of arguments can affect your life dearly. These are just standard procedures for immigration and not even the meat and potatoes of your life "together"

im a newbie here but ive been reading so many experiences and i must say vj members have helped me all along this way... my interview is a few weeks away and im so nervous..ive been so long away from my fiance i dont want us to be dissapointed.., i would really appreciate any tips and guides for my interview..  thank u in advance.. and good luck to all those whose putting up with this distance thats keeping us apart from our sweethearts.

 

I am assuming you haven't had your interview yet.We just had ours in June and I posted a review.

Just make sure you have everything the Embassy request as far as paper work,that is so important.When I got to Georgetown the night before the interview I was up till 2 am making sure we had everything in order and easy to find because I had it all labeled as per the wonderful advise from other VJ members.
Don't forget to take all your evidence of a on going relationship they did look at that and they asked us questions about it.

The questions asked were not like they were trying to trick us or anything and the lady was friendly.

Good luck and feel free to ask me any questions.

Don't forget to celebrate after YOUR VISA APPROVAL !!!

I am just about to go stir crazy with the conflicting information I am getting about an Australian National Police Certificate. Maybe someone here can help me clear it up.

I am an Australian citizen thats been living in Greece for the past 14 years. Now I know that I require an Australian Police Certificate but which one do they really want.. name check or fingerprints?

 

Almost every post I have read on here says that they require a fingerprint check, but for the life of me I can't find that actually being stated on any official US website.

 

The reciprocity table for Australia http://travel.state....5.html?cid=8957 states:

 

"Police certificates are required for each visa applicant aged 16 years and older. Applicants are required to apply for a Police certificate ensuring that the certificate addresses all known names and/or aliases.

For information on how and where to apply, please refer to the table below according to your current place of residence.

If you are applying through the New South Wales or Queensland police, your police record will be sent directly to the U.S. Consulate in Sydney. The Criminal Records Section of their offices will notify you that this has been done. If you do not receive this notification within 4 weeks of your application, we strongly recommend that you ascertain the status of your records by checking at the police station where you initially made your request



."

" What type of Australian police check is required?   

Depending on which Australian state or territory in which you reside will depend on how to apply for the Australian police certificate.

You only need to apply for 1 Australian police certificate and it can be based on a name or fingerprint check.

A police check based on name check only must contain all aliases previously and presently used. Failure to provide a name check certificate with all aliases may result in the consular officer refusing your application for a police certificate based on a fingerprint check."

 

So which is it? the reason why I am asking is because the procedure to get fingerprints done in Greece is hugely complicated!

Great.  I got everything ready.  Last question I forgot to ask, how do I do a credit card payment?  Somehow I couldn't find anything when I searched this on google.

 

You can't use a credit card to make the I-130 form payment. It has to be either a money order or cheque drawn  from a bank on US soil.

What name did she use to apply for her ESTA?

If its in her maiden name as is her passport, then you have to issue the ticket under her maiden name.

What the CBP officer wants to see is that the name on the ticket is the same as the name on the passport.

 

If she wants to travel under her married name then she will need to change her passport and apply for a new ESTA. Name on ESTA and passport must match, or else the airline system will have problems matching your wife's ticket to her approved ESTA.

 

The last thing you need is to have an issue with the ESTA at the airport when she is departing out of the UK.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling for a CR-1 Visa from Japan - HELP NEEDED

Thank you again for your responses. 

 

Now I regret not applying for the K-1 Fiance visa several months ago when we got engaged. The CR-1 seems better for us, but the longer processing time really makes things difficult  Our plan has been to get legally married in Japan this month (Dec.) and have a small wedding in Japan. We have begun planning a large wedding celebration in the US in January of 2015 and to begin our life in the US around that time. But it seems like it may be difficult for her to get her visa via the CR-1 route before January 2015. 

 

I guess that leaves me two questions. First, would it be better to change my plan? That is, file for the K-1 (Fiance Visa) since it is currently quicker and hope it can be completed by January 2015? We've been pretty set on getting married in Japan and have everything arranged to do it next week. Although inconvenient, it is possible to change our plan now by holding off our marriage and pursuing a K-1. But ultimately, getting her visa by January 2015 so we can have a US wedding and start our life in the US is the top priority. 

 

Second, say if we were to do either the K-1 or CR-1 and it was not finished by January 2015, would she be able to enter the US on a tourist visa to attend the US wedding ceremony? She has a tourist visa because Japan/US have a VWP. However, I've read how it can be difficult to enter if you have an immigration papers filed and pending. Is there any difference between the K-1 and the CR-1 in this regard? Does she have a better chance of not getting denied entry with one of the two visa options? 

 

Again, thank you so much for all the answers. Any further advice/input would be greatly appreciated. We will have to make my decision and pursue our visa course very soon. 

 

It is not difficult to enter on a VWP as long as your fiancee can prove strong ties to Japan, such as a job, an apartment lease, bank accounts and so on and so forth.

We filed  our I-130 in August and I travelled to the US for 3 and a half weeks in September with no issues at POE. The evidence of ties to Greece that I had with me was:

A photocopy of our NOA1 to prove we are in the process of filing for a CR1 visa.

Letter from employer stating when I start my leave and when it ends and that I am expected back at work on so and so date.

My work schedule showing my leave.

Bank statements showing my address in Greece from 2 different banks.

Mobile phone statements again to show address.

Travel insurance for the days I would be in the US

And of course, a return ticket.

CBP officer did not even look at any. Was more concerned as to why I was bring towels as a gift to my husband. I told him they were a wedding present. He laughed, stamped my passport.. welcome to the US!

Yes,he asked if i work or study i said no but i look after my Family and help my father in our shop every now and then (Women Cloth),how long i planned to stay i said 2 and half months,he said my answers were confusing him cause i told him i was with family in Germany before arriving to the US when he asked me about my trip ,so he was like you have Family in Germany now? you just said you live in Morocco with yout parents,i told him i was visiting my Brother and my Grandmother before my flight to the US so i have Family in Morocco and in Germany since i`m half German half Moroccan,he kept on saying wait wait a minute after almost every answer,so he said you have no job no nothing ,you cannot do that! i told him i never over stayed or broke a law,he said i know but you just cannot do that,he did not warn me or tell what specifically i cannot do, when we were almost done i started crying ...he said don`t you cry on me now! i already had someone cry today ...,and gave me a kleenex ,then he said okay and i asked him if i can go,he said yes you can go.
 
I did not know i was not supposed to visit for almost 90 days and go back and do it again,first time i stayed 2 month but the ticket we first got was about 85 days but my sister passed away one week before the flight so it was 2 month instead of almost 3 :S so now i know why they interviewed me !
 
I would like to stay 2 weeks around late February to mid March more or less.
And i apologies for my English, after all this time on VJ i`m still learning new things about this Journey every day ... !

I think you should be ok for a 2 week trip. Just have as much evidence as you can. Even ask your dad to writean emplyment letter that you work part time. CBP officer doesn't have to know its your dad's business.
It is also a positive sign that the officer didn't warn you not to come back on the vwp. It seems his issue was with how long you were staying in the US and the back to back trips.




 

My husband will come pick me up he can carry those documents for me :D he will visit me for a week before in Tangier so even if i get sent back i will still have had some time with him :(
 
If by any chance i don`t get denied at the POE but my Visa gets denied,will i still be able to use the VWP? this whole thing is really confusing me ..., if i get a ban on my VWP will i still be able to come on my Visa once i get it right,but once i get my Visa denied i wont be able to enter on my VWP ? if yes i would just do it ,risk getting my VWP removed and visit my husband for a few weeks ,my husband is the only reason i come to the US anyways.

You mention you husband will be picking you up and he can carry the docs for you? How will he be able to do that? When you go through POE, that area is restricted. Unless your husband works for the airport and has security access to the area, he would not be able to join you there.

About the VWP and CR1visa denials:
1. You are allowed in at POE but eventually your CR1 visa gets denied.
I am not completely sure, but lets say your CR1 visa gets denied in aug 2014 and your current VWP expires on oct 2014. When you next apply you have to state that you have been denied a visa to the US and because the visa tgat was denied was an immigrant visa, it stands to reason that your next vwp will also be denied.

2. Denied at POE, VWP invalidated but CR1 visa approved.
A denial at POE has no barring on youf CR1 visa. You will be able to enter the US with your cr1 visa without problem.

If you have a strong case of a bonafide marriage, I dont see why you would be denied.

Yes. Your husband will need your police certificate for NVC.
Maybe im being too cautious or overreacting, but I wouldn't take any official documentation with me if I was you. I once had a person sent back because he had his birth certificate with him at POE. In the eyes of the cbp officer, if your plan is only for a visit why do need to be carrying such documents with you?

Im planning on visiting my husband end of jan and have afew such docs I would like to bring with me. But honestly I do not want to give anyone any reason to doubt my intentions of returning back. So im sending everything to him before I fly out, rather than have it on me at POE.

Thank you B & G your answers are very helpful ,its good that it will have no effect on our CR1/IR1 but i`m still very afraid of getting denied,according to our timeline it will be until March or so just for our NOA2 so no NOA2 print,I have bank statements showing my address, i will have my return flight and our USCIS pending.
 
My visit to the US took 2 month, after 3 and half month of being back home i visited my husband again for 85 days ,and then the last visit at the POE they questioned me sending me to this room the officer was not very nice the least i can say but did let me go after 15 minutes,i have not been to the US 5 months now and until i plan to visit again its going to be 7 month ,should i still risk it?ClockWatch2.gif

Since you have been through a secondary interview already at POE, do you remember what the CBP officer said to you? Were you warned off? Eg. Dont come back on a VWP have the right visa next time?
I think the fact that you stayed away from the US for 7 months is to your advantage. Of all the denied entries I have heard on vj and at work most where because of back to back 90 days trips or because of no job at home country and a length stay.
How many days are you planning in on staying this time around?

Everything will be sent to your husband. The only paperwork that will be sent to you is after NVC has approved the petition and thats a ways off still. Everything before and during the NVC stage will be sent to your husband in the US.

If she gets denied at POE it has no affect on your CR1/IR1 petition. The only thing that will most likely happen is that she is be unable to use VWP to travel again.
Unless you are on the flight with her, unfortunately you will be unable to access the border control area.

My best advice to you is since she has no job or lease in her name, have her carry documents that show her address in morocco. Bank statements, phone bill etc. And travel insurance for the time se there. Also if it can be done, ask if her name can be add to a utility bill at her parents place.
Have a copy of the NOA2 and a print out of the processing times for USCIS. if she is questioned further, her main argument is that the process is taking so long she just wants to spend some time with her husband while you both wait for an approval.

If she is denied at POE then the most likely scenario is that the airline she travelled on will be the one she is traveling back on. Airline will use her return ticket to accept her on the flight. I work for an airline here in greece. We have plenty of people being denied entry in the US and being sent back. Return ticket is always used. When we have a passenger denied entry here in greece as an airline we are responsible on sending them back. If they have a return flight.. we use that.. if they dont.. we ask for payment.. if they dont have any money.. we charge it to a budget. All airlines have some type of budget for situations such as this.

I did not want to make a new topic since this one kind of addresses my concern. I (US natural born citizen) married my wife in China in August 2013. She is still in China but will be arriving here on a tourist visa in 3 weeks. She will go back after a 5 week visit. I would like to file my I-130 before she gets here so i do not have to check the box that asks 'Is she currently in the U.S?'. Should I wait 2 months to file? Or get it sent in before she arrives? OR send it while she is here? We have absolutely no intention of her staying here but I am a bit nervous now about sending it while she is here.


I say file immediately. We filed our I-130 in aug 13 and i flew to the US end of sep 13. Had no problems entering. Just make sure your wife has proof of ties to China when she enters the US in case she needs to prove that she will be returning back.

On my trip in Sep 2013 my conversation with the officer revolved around why I was bringing towels as a gift to the US! I told him they were a wedding gift and my husband has more use for them than I did in Greeece.

He was more concerned in tellling me that they have good quality towels in the US!! Lol!

And in April 2013 I get to the desk, officer looks at me and says, do you have any fruits or vegetables with you? I said, I have nothing edible on me whatsoever. He stamped my passport and that was it!!

Sometimes CBP officers can be weird!

I just got back from visiting my husband in the US and this is my second trip since we have filed the I-130. I always carry with me proof of ties to Greece but so far I have not needed any of it.

Last POE was on Jan 24th at Washington Dulles. Officer asked me purpose of my visit, I said vacation. Then he proceeded to start to read his screen... for at least 5 mins!.. I dont know what was on there, but it seemed like alot. Finally he stamped my passport and I was off.

It is clearly asking for  maiden name, so in that section you put your wife's previous last name, yes, her last name at birth.

I haven't been in that situation, but I wouldn't worry about it.

Your wife's and stepson's passports will be stamped with the temp green card stamp, the i-551, which is valid for a year from the date of them entering in the US. Even though they are still in the UAE, as soon as they go through US pre-clearance, it is as if they are standing on US soil, if that makes sense.

 

If the flight is cancelled, and they are placed on a flight that departs the next day for example, and they need to enter back into the UAE and then the next day have to go through US pre-clearance, they will be processed as permanent residents.

Hi I wanted to ask. In order to make copies of passport stamps to show that a married couple was at a certain place for a honeymoon, are copies of the bio page necessary as well? I'm sorry if you feel this is a stupid question. I just want to make sure. Thank you.

 

This is what we did for I-130 petition, but I think it will work for your AOS too. I don't think it hurts to added the bio page.

 

I spit the info and evidence into dates of trips. eg Heading: B & G's trip to London Jan 2013, pics of us on the trip, copies of our boarding passes, and a copy of B's stamped passport page, (I didn't get a stamp as Im a European citizen). 

 

You can do the same and under the heading Our honeymoon, added a copy of  both yours and your spouse's stamps and other evidence you want to include. That way it will be easy for them to relate the stamps to your honeymoon.

Note number 3 states:

 

"Note 3: Provide both the receipt notice number and the A-Number as an identifier, if they are available."

 

Ok.. got it.. the receipt number is your the number you will be assigned by USCIS after they receive your I-130 packet. There is no need for it now as you don't have it yet.

Including your receipt number is more for if you receive a RFE (request for additional evidence) so that USCIS may know what file the additional paperwork is meant for.
