IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - June 2014

I am a May 5th also and as of Friday they still hadn't completed my case.

Question: on the CEAC portal, did your AOS payment change from "Paid" to "N/A" when you got CC? It seems as though that is the rumor on here but I am not sure if that is only happening as a glitch in their system. If that is the case, then I don't have a CC yet because nothing changed on my portal.

AOS does change, its a glitch in their website. I cleared that up today with them. Alot of other people have reported the AOS fee showing N/A and all have CC.

My AOS fee went as far as showing rejected... not just N/A.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - June 2014

anyone able to pay IV bill.....I have been waiting for two weeks now and still can't pay IV bill....what is going with NVC???

I think I might be able to shed some light to your question.

I called NVC this morning because for some reason after we received case comeplete and IL all of a sudden our AOS fee shows as rejected on ceac.

I didn't catch the customer rep's name, but once I told him the problem, he said interesting and put my hold. Came back to tell me that everything is fine, AOS is paid and I shouldn't worry.

Then he said, that they have been having problems with their website AND their payment system ever since the launch of the new website.

It could be why people are waiting so long to be able to pay their fees.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - March 2014

Hey Saylin,

Quick question about filing taxes. I've been reading that if you get married after Dec. 31st, you file as single for your taxes. Do you know anything about this? I ask because we got married Jan. 30th and I just don't get how we could file as married for 2013.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reportsrequest for Expedite under financial loss

Well if they asked u for evidence that means that will approve it :) so just give them the damn info they want and relax.... Try again and again dont give up
I wish u luck and everything will go right ... :*

That's what I thought when they requested more evidence from the congressman.. but I do feel that it's different this time. I'll try to take your advice though :) Thanks.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reportsrequest for Expedite under financial loss

Now u will see 3 approved..
Cause our expedite for financial loss was approved on Monday
And yesterday may 8 we got OUR NOA2.

Know that i love u! Haha u are my lucky charm.

Guys! If u want to expedite ur case... Just try again... And again... It has to do with the person u talk in the beginning and if he is on mood to write the case down. Someone of them they say u cant expedite sorry and they hang up the phone. Some others they just type few lines and they really dont care some others they say we ll do the best we can for u im so sorry for ur situation wish to ur fiance to stay hold and wish u guys all the best. That was our guy on the second time we requested an expedite,
Wish i could know this guy to give him a huge hug.....

Try guys! Maybe u can get expedite and get ur papers really quick. Here when u try to ask about expedite ur case and most of them they try to eat u alive. They say NO U CANT. and thats it. Like u are going to cheat their position or something. But when u have something really important and u need an expedite... Well yes! Then u must expedite!!!
They only care about Philipines that get expedite and they are always sweet and kind when they talk about those expedites.
But when someone gets expedite and is not Philipines they hate u and be like "no u cant expedite blah blah'

Well.... Uscis found serius that my step father kick me out the house and i have no a place to stay and no money cause im unemployed and that greece right now has 24% unemployed ppl and they expedite us!!
Maybe ur case is more important than this! And uscis will approve it! JUST try!!!!
Each one of u are special individuals and what u have deep inside ur heart .... Will never no one will understand!!
What i learnt since 7 years old is that i had to start take care of myself and that nobody will fight for u more than urself.
Even ur parents! Get up all of u here stand up and fight for ur rights!

I've been through hell and back with our expedite request in the past 2 months. We have both severe financial hardship and medical reasons with letters from my doctors and all, and they denied it even though we sent it through a senator and congressman. Now they're telling us there's no record of an expedite request on file at all. Sooo we filed directly yesterday and got the email asking for evidence today. That'll be out next week and I'm hoping for good news. I feel so absolutely scared and desperate at this point and I can't believe they can be so heartless, but your case gives me a bit of hope. Wish me luck, and share any tips/advice you may have :)

Congratulations, by the way.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsCase Status Change

its just acknowleding your correspondence. You will get a snail mail with the response.  It usually takes 30 days

It's a start :) I hope it doesn't take that long.. Why wouldn't they just email us??

How could you file an expedite for financial hardship if you could afford within this year the trip to Europe and the trips across the US?

Wow.. obligatory "in-my-face" response -_- Not that I should have to explain this to you, but the Europe trip was paid for by his parents with whom we've now had a serious falling out. The US trips are $120 and I'm allowed to be seriously frugal all month and allocate my money for trips to see my husband. AND it's not just financial hardship. Satisfied?

Our case status just changed to:

On May 19, 2014, we received your correspondence for your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN . You will receive a notice in the mail when further action is taken on this case.

We sent in an expedite request last week and they received our backup documentation last Friday.. I'm assuming it's just acknowledgement of receipt of evidence, but a part of me is also very excited that it means more :) Anyone else get this in relation to an expedite or know what it means?

For any Canadians (particularly in Montreal), I just got in my PCC application at 200 Rene Levesque (Complexe Guy-Favreau). $40 and they're even going to mail it directly to my husband in the US for no charge.. they also email you a digital copy the next day.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

Right now EP is optional for Canadians. Myself and one other VJ member have called to inquire about our EP confirmation emails and the operator told us both that we no longer have to wait for it. They told us just to send in our documents and we will be automatically enrolled in EP.

There have been discrepancies in the past with operators telling people different information so I would suggest that you call yourself and ask what is the best option for you. The only disadvantage I would see with snail mail is sending originals and the cost of sending packages. Good luck!

I opted for EP and I am waiting over a month for Enrollment confirmation.  I called NVC last night and the representative told me "they have changed the procedures and there is no need to wait for EP enrollment confirmation" so you could send your documents right away.  I suggest to call NVC and confirm that before making any decision.  If is true then I suggest send it EP (safer to email than sending documents) .  Just a suggestion, good luck! :)

I'd be in serious trouble if something happened to my birth certificate originals (not born in Canada, so it'd be hell to get a new one), so that's a huge advantage for EP.. but it seems to be taking so long. We'll confirm with NVC about the enrolment email once the time comes :) But doesn't it still take longer for them to review your AOS & IV packages by email than it would by snail mail?

It's optional, and I went with snail mail.  You can compare my timeline/signature to others who went with EP.

Wow that's a huge difference. Thanks!

Is EP mandatory for Canadians? Given how long EP seems to be taking right now, would there be any disadvantages of snail mail other than having to send originals?

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reportshow long does it take to get NOA2?

I feel very lucky.... I mailed my 129F on May 24, they received it May 29, and NOA was June 3 (at Vermont).  Then I was transferred to Texas on Aug 6, and just got approval last night.   All in 3 months!  We have a lawyer pull the packet together and send to the processing center, but I'm not sure that had anything to do with it.  Everything in our case was pretty clear-cut I.E. plenty of proof of several visits, photos, and all required certificates.

Good luck... it appear if you get transferred to Texas, most people here seem to be approved within 21-28 days after this transfer.

Luck is on the K1 filers side for the moment. OP though is talking about a CR1 visa, which at the moment are being approved at a snail's pace..

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI-130 Processing Times-Should I be worried?

Can you explain to me that T-26 days till Overland in Kansas means?

NBC is opening a new service center in Overland Park Kansas on the 30th of September 2013. Their division 8 will be dealing with I-130 petitions. -26 days is a count down to when the center opens.

Its a game of waiting to see how fast I-130s will start to be approved.

You are right stevie b. Usually they are processed within 4 months. But everything is up in the air when it comes to I-130s right now. Its T-26 days till Overland in Kansas opens. Maybe the first week of October we will start seeing some long awaited approvals.

Canada doesn't offer DCF. Any I-130 petitions from canada are treated as normal. OP's lawyer is correct, right now unfortunately, it is within processing times.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWhats wrong with USCIS?

I am not going to argue which visa should be given priority over the other. Regardless of the visa K1 or CR1/IR1, they are both filed by a USC, they should be treat and approved at an equal rate.  Someone previously commented that CR1/IR1 visas should been given prioriry over K1 especially when children are involved. Just want to point out the a K1 filer can have children just as much as spousal couple.

And I agree that petitions involing children should be given priority over everyone else. I wouldn't mind waiting an extra month, for example, because a petition that includes children in adjusticated before me... whether its a K1 or CR1/IR1 filer.

How about we stop bashing each other, it is not a K1 filer's fault that their petitions are approved in such little time. The burden of the blame lays squarely on USCIS and their complete lack of organisation.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWhats wrong with USCIS?

Have a look at the March I-130 filers topic, if you haven't stumbled on it already. You might find more info on the whole wait as you filed in March.

And yes.. the wait is ridiculous!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI-130 Processing time and phases

My wife and I were married in March this year. She is a UK Citizen, I'm a US citizen. I hired a lawyer, filed an I-130 and now we wait. The USCIS received our I-130 on July 23rd, and it still says "Initial Review" on the site. What are the phases it goes through after this? Any estimates on how long each will take? My lawyer is now recommending submitting a K-3 Visa because those are being processed quicker lately. Thoughts? Words of encouragement? The waiting process sucks and it only seems that the wait times are increasing.  crying.gif

I do feel your pain, we filed for our CR1 a month after you so we have not been waiting as long you but the wait is just as hard nonetheless.

Right now the processing times are ridiculously long. Half of the Feb filers and almost all March filers are still wating for approvals so I don't see either you or me receiving approvals by the end of the year.

As for the K3 visa, alot of other members have filed for them in hopes of getting their spouses faster into the US. Unfortunately, from reading through all the CR1-IR1 forums, it seems that the K3 is attached with its respective CR1/IR1 visa and they both get adjusticated at the same time. So it doesnt seem like filing for the K3 will bring an approval around faster.

That being said, there is no filing fee for the K3 so it might not hurt to file it and see what happens.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI-130 Processing time and phases

I would suggest as she is UK citizen, she should come to USA on visiting Visa, once she is here then file Adjustment of Status for her, it will take hardly 3 months and she will get Conditional GC,

Thanks
TA

It is illegal to enter the US on the visa waiver program for the sole purpose of adjusting status. She will be attemping to enter with the intention of staying and it could end up hurting them in the long run especially if she lies to the CBP officer.

Please refrain from advicing someone to do something illegal. It is against VJ TOS.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI-130 Petitioners: Be heard!

The possibility exists that if your campaign reached the Big Shots you targeted, they may mention it to those who report to them. It then goes down the communication chain all the way to the processing clerks or even the mail-receiving clerks. The time these clerks may have looked away from their jobs to whisper about the campaign,or read a memo from the bosses about it, ultimately figures into a delayed petition.

BUT, I may be very VERY very wrong, and your campaign may be doing quite what you intended it to - ultimately resulting in faster service. In such a case, you would find no supporter stronger or more enthusiastic than yours truly!

The scenario you are describing is office gossip, which could very well happen. Though I highly doubt that more than a couple of hours will be lost due to USCIS employees gossiping about the fax machine going nuts on the 19 Nov.

For people that have months of waiting ahead of them, like myself, the loss of a couple of hours is nothing if the campaign has no affect on the processing times.

But if it work..well..i get to be with my husband quicker.

In a nutshell, you are slowing down USCIS with a coordinated version of a Denial of Service attack. That application that got slowed may actually have been yours.

How is did it slow down USCIS? The people that received those emails are not the ones working on petitions.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAPPROVED AUGUST FILER!!!!!

How funny we are moving to puyallup, my husband is from there and I lived there too while studying abroad. We are living in Sweden, and I believe that we are very lucky and that somehow USC who are living abroad gets approved faster sometimes.. Was another august filer from France Approved a month or so ago too.. It got transferred to the NBC after lockbox Chicago and approved there, never got transferred to any other place.. I'm very lucky and happy and don't take this for granted, I hope everyone will be approved soon, they are moving us up on the list of priority now though, USC filing for spouse, they want to bring families together, so I hope they manage to keep their almost 4 months shorter processing time as it's now 7,4 months instead of 11. Cross fingers nvc will be painless now!

Since you are filing from overseas, living in Sweden, that is the reason why you got approved faster. I am not 100% sure if Sweden does DCF, which means Direct Consular Filing, but it seems that way.

Oh! Sorry - yeah I did not read closely enough.

When I looked up feb filers at NBC not transferred that have thier NOA2 there are a few, but I have no idea if they are expedite or DCF.

Going through the Feb filer thread, only ones I have seen is DCF and expedites. Anyway.. just sucks for people that having waited for longer than the 7.4 months. Lovemytico tried to put in a service request and was told no because NBC states they are working on Feb 2013. Her file is still at NBC.

here are some march people who have been approved - also check the timeslines and you will see Feb filers are also being approved

I wasn't asking about approvals in general. But specific to Feb 2013 filers that received their NOA2 from NBC either Overland Park or Lee's Summit and weren't either a DCF or an expedite. Because for the life of me, I have not seen any on VJ here.

Another small lie by USCIS. Most Feb filers have been transfered, how can NBC be adjusticating them if the files are not even there??

I am very happy to at least see a more realistic processing time for our petitions. The 7.4 months does ring true. However I do not trust the NBC working on Feb 2013 petitions.

Has anyone heard of any Feb filer being approved by NBC either from OP or LS if it wasnt a DCF or an expedite?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI130 processing time

I never said I sympathise with USCIS. Nor did I ever say that I am pacified by their words.

What I did say was that it is understandable as to why they have stated a Feb 2013 processing date. I understand the reason behind their actions. I never stated that I agree with it.

What I wrote above were facts, and a statement of hope that USCIS keeps their word and works to achieve their promises.

B & GFemaleGreece2013-12-03 11:01:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI130 processing time

Due to the natural disaster in the Philippines, all files with a PH beneficiary have been expedited. It is only natural that things will slow down for the rest of us.

As for USCIS processing times, they made a mess of things and right now they are trying to rectify them. They are trying to process files by the 7.4 month mark, but right now they are still off.

The reason for the Feb 2013 date, is also understandable. For if everyone that is over the 7.4 month filed for a service request, they will spend more man hours trying to processes those service requests, taking away from actually processing and approving cases.

Filers that are being transfered right now, with the exception of PH expedites and DCF, are essentially getting a service request.

Do we wish that they worked faster? Yes.. Should they hire more people? of course.. but training someone takes time. That new recruits wont be our saving grace. If anything they could delay us even longer.

I just hope they keep doing what they are doing and try and get closer to the 7.4 month mark. Maybe by the end of December, we will see a better processing date of 7 months or 6.8 and a May 2013 processing date.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI130 processing time

If I remember correctly, the processing time is 7.4 months. However all service centers are also posting that they are working on Feb 2013 petitions. Which means that they will not accept a service request from anyone that has filed after Feb. Based on USCIS, only people in Jan 2013 can file for a service request..

Go figure!
