For some reason, I'm really not feeling the urge to call today at all!

Something inside me is really calm today! Stange, very strange! So not like me at all! What the heck happened to me???????????????

Only reason why I am so impatient is because I have a trip planned on June 5th to fly to the US! I need to know if they will assign me an early July date or not! If its after July 15th, I am good! But if its before, I am going to have to go into the process of changing it for a later with the embassy. So the sooner I know, the better!!

Anyone give me ideas? If i already have transcripts for 2013 2012 2011 ..itr and w2 is not needed anymore..am i correct? Cause the transcript itself shows that ur tax was accepted and filed at irs with complete documents?.

 

That is correct. The IRS transcripts if confirmation that your taxes have been accepted and processed by the IRS. Taking just the transcripts to the interview is fine.

OK, what about calling the embassy here in Nigeria to reopen my  k3 since i already have an interview date for June 9th but it was administratively closed along the way do you have any idea if that is possible.

You can email the embassy and request that, however I don't think they will reopen it. Even at this pace NVC is still steadily working through cases. Because of the backlog they are swamped. I don't think you will be waiting much longer for the process to move along.

 

Visit the NVC May thread. There are plenty of members in the same stage of the process as you, and following their timelines and reading the posts might give you an estimated idea of when you might have case complete.

Yes, but I also received my case number almost 2 weeks earlier than you. Since then NVC has slow down alil for some reason.

If things keep moving at the rate they are at the moment, July filers should really not be hoping for a transfer or approval before end of Feb - mid March at best.

Sorry to burst any bubbles guys, only thing you can do is hope that USCIS will start to approve petitions a hell of alot quicker than what they are now.

I found this article today. It just got me more confused about the whole situation: it lists processign times for I-130- USC filing for a spouse.... as 5 months.

 

am I reading this correctly?

 

 

They are literally just posting what the national goal is for USCIS when it comes to I-130 petitions.

About multiple 90 day visits (which is my plan with my wife, and appears to be your plan with your husband): I've spoken with a lawyer about how long a foreign national must wait outside the US before returning for another 90-day visit.  There are no clear rules about that, which is not to say that the US government does not care.  Port of entry officials have discretionary authority to re-admit a foreign national or not, and their decisions cannot be appealed to a US court.  So, I am hoping that if my wife goes back and stays with family for 30-45 days, the port of entry officials will deem that enough waiting time, before she comes back again.  I've heard of some foreign nationals doing what you are planning to do - cross the border, hang out in a hotel, and come back for another 90 days.  That may be less risky when you are coming from Canada, so maybe you can try it. If it doesn't work, perhaps you can put together a plan B, in the event, however unlikely, that a distrustful PoE official turns you back.  In my case, the consequences of being turned back are too difficult, so we will just plan ahead that she'll stay over there for 30-45 days between 90 day visits, to play it safe.   

 

 

From what I have read on the VJ, and my experience working for an airine, the rule of thumb when it comes to visits to the USA on VWP is more time out of the US than in it.

 

I don't think your wife will have a problem coming in for 3 months on the first visit, given that she can prove ties to her country, but exiting the US for a month and then trying to enter for another 3 could be a problem. The CBP officer will see that she is trying to spend 6 months in the US and only 1 month in her home country.  

 

I am not saying it can't be done, I'm sure it has be done before, just keep it in mind that second entry might be problematic. Your wife should be armed to the teeth with evidence of ties to her home country.

Ours is in Kansas too. NOA1 on 08/20. I'm going to be keeping a close one on the May filers come October. As you said we are in uncharted waters.

 

What scienceworks said does worry me alil. I don't want Kansas to be a repeat of the summer 2012 fiasco.

Something you say alarms me:  "Since the beginning of May though, all stand alone I-130 petitions have been sent to Kansas City, to the brand new NBC service centre that will be opening up end of September." 

 

Are you saying that since the beginning of May, all stand alone I-130 petitions that would have been processed by NBC in Missouri + field offices are accruing - and are not being worked on - until the Kansas City service center opens in the beginning of October?  If I'm understanding you correctly, and your information is correct, that's five months' worth of applications just sitting there until they resume work in Kansas City in October.

 

That would be scandalous, if true, and would add 1 to 5 months to our waiting period, assuming that all else is equal.

 

I wonder where you got this information.  Would you please let us know?

As there is no NBC official processing times available online, actually no information is available about what is going on with stand alone I-130s, I have been reading May-June-July filers threads to try and figure out if there is some kind of trend.

Here I would like to correct myself, that I am not 100% sure if all May petitions have been sent to Kansas Service Centre. But reading on the May 2013 thread, almost all of the VJ members have had their petitions sent there.

Calls to USCIS by May VJ members have been told that their casefiles are at NBC, I don't think any have reported been sent to a local field office. Same goes for the June filers as well. In Jan and Feb members had reported an average of 2 months before NBC transfered their cases to local field offices. Thats not the case with May filers, they are beyond the 3 month mark and closing in on 4.

 

So it does seem as if, the I-130s are been held back for the moment, be that seeming extremely scandalous, but not surprising. If you read mid 2012 threads on waiting for well over 5 months for an NOA2. As soon as USCIS started transfering case to field offices, there were people that had their NOA2s in as little as 2 weeks.

 

The good thing is that Division 8, once operational at the end of Sep, will only be dealing with stand alone I-130s.

In trying to estimate when NBC will send the NOA2, I used Excel to calculate the following:

 

Based on data from VisaJourney timelines, NBC approved 287 applications that were filed with them in November and December 2012, and January and February, 2013.  The median number of days that they took to approve these applications (50% applications approved in less time, 50% applications approved in more time) was 91 days.

 

Here's how it further breaks down:

Probably the really quick approvals are the "expedited ones" like our friend onek above.  (Happy to give way to you, for your service to the nation, onek.)

 

What % are expedited?  That's hard to tell, but among our group of 27, onek is the only one we know, so maybe only around 3-4%.  

 

That means that about 1/4 of us should have already seen their NOA2's in the next few weeks.  And in the next thirty days after that, 1/2 of us should have already seen their NOA2's.

 

Well, the table above speaks for itself. 

 

If this seems a bit like over the top analysis, my pleading is that I miss my wife!! - as I suppose you all miss your spouses, too.

 

It shall be a race to see whether we can unite with them by Christmas.

 

August filer here, you guys are my target group to watch! When you start getting good news, means I'm not far behind!

 

Interesting analysis Alaskanfan, and fantastic work! Trust me, I get the whole obsessing thing, its what I do to make the time go by. Though I don't think that it applies to anyone that's filed after the first of May. All petitions before May, were sent to NBC in Missouri and then transfered to local field offices, or approved at Missouri.

Since the beginning of May though, all stand alone I-130 petitions have been sent to Kansas City, to the brand new NBC service centre that will be opening up end of September. It would be interesting to watch the first couple of weeks of October to get a sense on how fast Kansas will be moving. Maybe then we can have a better prediction date for approvals. Till then, we just seat tight!

My status was updated to RFE today. Any idea what they could be asking for? We already submitted our birth certificates as well as both the translation and the original marriage certificate. So depressingggg.

You wont find out till you receive your RFE hardcopy. I hope its something completely easy to sumbitted back to them. On the bright side, someone is looking at your file! People have reported back an approval just days after USCIS receives the RFE paperwork.

Yep,  its a huge relief knowing its almost done... 19 days til our interview !!!    My husband is on his way right now to get his police certificate.  Then he has to drop it off for a friend to translate it.  I was told it  needs to b translated and I was told it does not need to be translated...  Its a "one liner" and is not a big deal but I wish they would get their story straight.

 

I thought that any documents in the native language of the country do not need to be translated... :blink:  goes to show that even if you read something from an 'official' source doesn't necesseraly means its what 'officially' needs to be done!

 

At least you know about the translation before you arrive at the interview, its better to be prepared for the worst-case scenario rather than hope the worst-case scenario doesn't happen!

 

Only thing I have learnt from this whole process is that nothing is as its seems and 5 different people will give you 5 different answers to the same question!

Just an update on our case. Embassy emailed back on Monday to confirm that they have recieved my Greek police certificate (phew!) and I had the medical done on Tuesday. My arm is still killing from the damn tetanus shot!

Now only thing left is to gather together our evidence for the interview.. I'll be a nervous wreck it it gets done.. 20 days to go!

Back in Greece! Spent 12 lovely days with my husband in the US and now back waiting for my interview date. I emailed the US embassy here in Athens to check if they have received my Greek police certificate ( there is no way to track it) still waiting for an answer!

The phone just rang. She gave the news I was waiting to hear. Visa approved. The interview itself was only about 2 minutes:
a. Who is calling you?
b. Love or arranaged marriage?
c. What does your husband do?
That's pretty much it.
The total time inside the consulate was less than 2 hours.

Medical booked for June 24th and Greek police certificate finally ordered after 7 phone calls of misinformation and a trip to Citizens Services to angrily argue with the employees there. They don't even know their procedures that are in place! I swear Greek bureaucracy is the worst!

 

 

Also I called NVC to clear up the 'AOS fee rejected' debacle and was told all is good. Apperantly with are having lots of problems with the new website and their payment portal ( quoting customer rep ).

 

Also asked if my case file has been shipped to the embassy in Athens and was told that they will most likely send it off end of the week.

My wife's interview is scheduled for July 21 and her international passport expires in October of this year.  Does she need to obtain a new passport before the interview, or will they still give her the visa even though the passport expires 3 months later?

 

 

Her passport must be valid for at least 6 months from the date of her interview. She will need a new passport or an extension of the expiry date (if Russia does extensions that is).

I think you should be fine.

The funds were debited from your account and you have case complete and an interview date. your case is closed and will be in its way to the consulate/embassy shortly.

They are not going to waste time looking a completed cases.

Worse comes to worse, they will ask you to pay AoS fees again at the interview if it is not a glitsh in the system.

easy said than done I undeerstand. I would freak out also! but I think you are ok!!!!!!

I am waiting for a case # so i am starting to gather my papers. ( I have printed Saylins  WIKI and i read it every night before i sleep. My temporary bible :wow:  )

 

I am going to do the 864 EZ .  I have filed taxes for 2012 and 2013 (1040)   I received the tax transcript for 2013 .

2011  unemployed therefore i will put 0  . correct ?

2012 & 2013   i will put whatever #  is on line 22 on the 1040  correct ?

 

Last question . 

 

Since i was unemployed 2011 and do not meet the poverty line (of 4 members) on 2012 but over exceed the poverty line on 2013 and my paystubs this year almost reached the amount required so far . Do i have to have a joint sponsor ?

Hi Tino.. If I remember correctly, you mentioned in a previous post of yours that you are filing for your wife and child? If that is the case then unfortunately you cannot use the I-864EZ.

 

One of the conditions to be able to file the I-864EZ is that you are only sponsoring one person.

 

As for the 1040 line 22 is correct you need the Total Income figure.

 

Since in 2013 you are making more than the poverty line for 4 people and your 2013 IRS transcript reflects that then you don't need a sponsor. You also do not need to include transcripts for 2012 and 2011, it is your choice. So you either send just 2013 IRS transcript or 2013, 2012 and 2011. The choice is yours.

  

However on the I-864 form, Part 6, Section 13 it does ask you to confirm (by checking the box) that you have filed Federal tax returns for each of the three most recent years. (This is regardless if you will be sending the tax information for the 3 most recent years or not)

Since you hadn't filed in 2011, you will have include a letter of explanation as to why you were exempted from filing that year.

I am a May 5th also and as of Friday they still hadn't completed my case.

 

Question: on the CEAC portal, did your AOS payment change from "Paid" to "N/A" when you got CC? It seems as though that is the rumor on here but I am not sure if that is only happening as a glitch in their system. If that is the case, then I don't have a CC yet because nothing changed on my portal. 

 

AOS does change, its a glitch in their website. I cleared that up today with them. Alot of other people have reported the AOS fee showing N/A and all have CC.

My AOS fee went as far as showing rejected... not just N/A.
