IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsSeptember 2013 I-130 Filers

Just last week, when September transfers started. None of the other 'months' were transferred to VSC. (You can find the link to all the spreadsheets in my signature)

So there is no data for this center.. we have to wait and see what happens.

This is USCIS data on VSC (as of Dec 31) dashboard.uscis.gov/index.cfm?formtype=4&office=6&charttype=1

This does not include the transfers, as VSC has only just now started receiving them.

Ah you're right. There seem to be cases that have directly gone to Vermont since ~May 2013 that haven't been approved though.. So I guess they're working on those? (but I thought they didn't send petitions directly service centres prior to ~Oct 22nd?). I thought I had a pretty good grasp on this process, but VSC is completely throwing me off sad.png

EDIT: Looking through timelines again, it seems like a lot of people haven't touched their timelines in months, which confuses me even more ranting33va.gif

(Btw, sorry about your NSC transfer. I get how difficult that can be, but please stay strong and don't let it damage you! You and your relationship are far more important than anything else. Plus, someday you'll look back and this'll all be a vague memory in the big picture of things smile.png

Well, the pace at which each service center works often changes, so it's hard to tell what will be happening with our transferred cases.

But so far CSC has been the fastest, then TSC, NSC has been the worst.

No data for VSC as this center has just now started receiving transfers.

EDIT: Would you like to be added to the spreadsheet? I don't see you there

About VSC, exactly when did they start getting transfers? I can't seem to figure out their trends, nor where the VJ processing time dates are coming from for Vermont, since there are barely any approvals when you look at individual timelines :/ Thanks!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsSeptember 2013 I-130 Filers

Im not sure. I read about the $1000 fee back in September when I was just starting the process. I was even more confused then than I am now. I was sitting in my living room in Florida, filling out the I-130, the day before flying to England, so I brought the form to England and mailed it to (I think) USCIS in Arizona. Why I did that is anyones guess. I should have just applied at the embassy in London. We did consider applying for a K3 so maybe it was during those thought processes that I read about the $1000.

I really hope USCIS keeps on working hard to get a lot more September filers transferred as quickly as possible. The waiting is awful sad.png

Let me help you further avoid the corn cob :D

The $1000 fee form relates to those already in the US who are applying for a CR1/IR1, as they have to file I-130 and I-485 to adjust status from whatever visa they have to a GC. So if you're in the US on a work/student/K3/K1 visa and you get married, you'd be stuck with that huge fee. As for those filing from outside the US, it's $420 (I-130) + $88 (AOS) + $230 (IV) + whatever the medical costs.. and then there's the whole removal of conditions thing etc etc but that can apply for both groups. I hope that helps! I've been reading up on this whole process far too much (which is why I'm thoroughly unprepared for my exam tomorrow) -_-

Thats it! Thanks a lot, you've saved me from a sleepless night. I knew I'd read it somewhere

You're welcome :D Happy to contribute to another night full of USCIS-fuelled nightmares (not really)

Tala202FemaleCanada2014-02-26 20:24:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsSeptember 2013 I-130 Filers

Hmmm. Im sure there was one step that was around $1000 on its own. IIRC, it was a fee for 'something' that came to just under $1000, then you had to add another small fee for 'something else', maybe biometric data, that took it to just over $1000. I dont mind paying it, obviously, its a small price to pay in the grand scheme of things, but I just dont remember what it was for or where I read it. Maybe it was part of one of the Nebraska-related nightmares Ive been having. Maybe the one where I was being beaten to death with an oversized corn cob by someone called Betsy-Sue because I used blue ink instead of black.

I think you're referring to the I-485 for Adjustment of Status:

"$985. (Add $85 biometric fee for a total of $1070, where applicable.)"

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAug 2013 I-130 filers

Hi guys,

I filed a petition for my wife and my mother back in August. They already approved my wife's petition and it is in NVC now. My mother's online case status says RFE sent on March 14.  I think I did something wrong in section C and below is question for that section.

C. Information about your relative

17. List spouse and all children of your relative

             (Name)                                                                                              (Relationship)

Name of my mother's first child                                                                       Sister

Is this correct? As you can see I put sister under relationship, but when I see it now it should be child because it asks relationship to my relative. The question is not relative to me. In short my question is: What should be the answer for relationship? That is relationship to whom? Any one who filed this for parents or has some idea please help. Thanks!

I'd say they're asking for whether the entry is the spouse or son/daughter of your relative, so their relationship to your mother, not you.

When I checked status of both 130 and 129f, it said that both petitions were approved. What does this practically mean? Am I still on the K-3 visa path? I would prefer not to go through the AOS process and would rather opt for the IC1/IR1 visa. Is it possible?

Since you have an approved I-130, your I-129f is going to be automatically closed (either by the consulate or NVC, I'm not quite sure.. but it will definitely get closed.) so you're basically on the CR1/IR1 path regardless of your preference.

The original documents (I'm pretty sure) need to go first to the beneficiary - as they will be doing the next stage of the application. Then the beneficiary will send them to NVC and NVC will forward them to the embassy for the interview.

I'm also nervous about sending originals - I'm hoping that because Canada allows you to file almost everything at NVC electronically that I'll be able to send copies of everything and just bring the originals to the embassy at my interview for verification.

With the way USCIS seems to lose things, (and then send RFEs for things you've already sent) I'm justifiably nervous (I think) to entrust my original documents to NVC!

From what I've read, you can just send high quality PDF scans of all your original documents (being a Canadian beneficiary), so you don't have to mail them any physical documents whatsoever. Just hold on to them for the interview. I was also nervous because it'd be hell for me to get another certified translation of my birth certificate, but my fears have been put to rest :) For more info, look at this: http://www.visajourn...ew_Online_Forms

[Not an August filer, but I've been stalking this thread obsessively. Good luck guys!]

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - March 2014

Hello guys, i am Jaba from Europe Georgia, Tbilisi. My wife is Vivian from TX, USA. Obviously i am beneficial, we are PD 21 October 2013 filers. Based on statistics provided by spreadsheets we will get our approval (NOA2) at the end of the current month or at the beginning of the April.

Why i got here ?

Because of approval is soon and i am not ready for NVC procedures i decided to start researching information and making papers ready to meet NVC procedures and not lose time after. i am sure all of you did on your certain time. BC of you already are on NVC procedures i believed you would know everything much more than people from October filers who are waiting approvals by USCIS like me.

Huge thanks to Saylin who does a lot for all of us and without her VJ would be less effective and clear.

I read almost all link provided at the beginning of the forum and a lot information caused confusion in my brain smile.png So i am here with hope you guys will help me for my NVC procedures, bc of i am from Georgia i think Georgian beneficial can provide more accurate information for me. All respond is appreciated !

----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------

What i know well it is:

1. When NVC will receive my case after 1 week i need to call and provide My wife's (petitioners) and mine (beneficiary's) Email dresses to them. Also ask for NVC case # and IIN (invoice identification number).

2 weeks after your NOA2, call you NVC to see if they have received your case. Once they receive your case it will take 6 to 8 weeks for them to assign you a case number.

2. When i have Case # and IIN i can enter in system and make DS-261 (choice of agent in my case agent will be my mother-in-law who has US mail address and i will get fast mails without losing mails and delays as i experienced with NOA1 hard copy).

Once it becomes available, yes.

3. DS-261 is already submitted electronically i must check if bills are made if yes pay both or separately depending how fast they will appear.

Correct

4. i got bar code cover sheets so now i need to start work which i don't know certainly (Making AOS and IV packages and express mail).

Once AOS and then IV are paid you print out bar coded cover sheets and once they show paid then you send off packages

Guys please confirm if way i see process till 4 is right and help me to figure out about below issues.

Please guys someone give me actual check list of AOS package which you guys sent and works i am worried about not send  package with missed papers or not proper bc all my knowledge is based on much forums and less official instructions which i barely collected and still confuses me.  (for i-864 purposes i want you to know that my wife lives with me in Georgia since April 2013 and therefore we need joint sponsor who is going to be my father-in-law, so i want guys you to put joint sponsor requirements at checklist too. and also i am not sure which form my father-in-law must fill, i-864 or i-864a, my wife and i are going to live with my brother-in-laws and father-in-law after arriving in USA)

Read post 1 and 2.

Also please give me IV Package checklist. I want to make ds-230 not electronic one (ds-260)

I don't think you can mail the DS-230, you will have to do the DS-260. thought I am not sure.

List of documents for both AOS and IV are both in posts 1 and 2 of this thread.

Don't think guys i am lazy to research forums just i read so much it made me more confused and just i want to know from people who actually did it without any doubt about checklists and so on. Any respond will be highly appreciated ! Thanks all

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - March 2014

Hi, we got our NOA2 on Monday. It says the case was approved and shipped to NVC, but our online status says that they mailed us a notice that they have approved our case; there is nothing about shipping the case. For some case numbers, I have seen the online status changes when they mail the case to NVC. Does it necessarily change for all cases? Another thing if my husband is now filing taxes for 2013, how long will it take to get the tax transcript? We had gotten an RFE from the NVC for our marriage record booklet and its translation despite sending the copy of marriage certificate. Do I need to send in the original marriage record booklet and its translation in the IV packet?

Some service centres send a shipped email and update the case status and some don't. We didn't receive a shipping email and case status has not change since our NOA2 which says that same as what you wrote in your post. We were approved at CSC.

On that note, if you do get a shipped email, that does not necessarily means your file has physically left the building.

You can call USCIS to find out the date that your file physically left but it is easier to wait a couple of weeks from your NOA2 date and call NVC to find out when and if they have received your file.

I am not sure when IRS transcripts become available for 2013 taxes. If memory serves me right, I have read posts on this thread that they are available about a month after IRS has accepted your taxes. Though don't take my word for it. Hopefully someone else that knows for sure will chime in.

As for the IV packet, all the documents you have to include MUST be originals. That includes your marriage record booklet and translation.

Any February 20 NOA2 here. Wondering how long it will take ( asking fir a friend).

Feb 20 NOA2 here from CSC.

Haven't called NVC to see if they have received our case yet. However Lisa y Miguel who also has an NOA2 on the 20th called and posted that her case was received on Mar 4th.

B&G I got case received on 3/4...havent been here much. .get anywhere?
Also..what do you do if you never saved your old w2s?? I only have this years sad.png

I haven't called them yet! Will do so on Monday, but since we both were approved on the 20th and at CSC, it is likely that our files left the building in the same bundle... we will see come Monday.

I don't think my husband has saved his W2s.. but since we will be sending tax trasnscripts, I haven't bugged him to look for them! You don't need your old W2s if you are sending IRS tax transcript..

Guys,

I just need a confirmation here. I am 99.9% sure of the answer but Im on 4.5 hrs sleep and have done so much reading that I think my brain is on the verge of shutting down.

For AOS, my husband can use the I-864EZ as:

I am the sole beneficiary

He is not using co-sponsor

And will only be using his salary to meet the poverty guidelines.

Correct???

Thanks!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsDenied I-130

okay lets go back to my original post.. Im aware spouse visa's can be denied.. what I am looking for are stories from people who experienced this and what steps they took afterwards..

Questions

Why was is denied

What did you do about it

What can be done anout it

What was your final outcome

The reason why not alot of people have answered your questions is because approvals far exceed denials and on VJ you wont find very many of them.

Firstly, the fact that your fiance was denied a tourist visa will have no bearing on your visa petition, whether its a fiance or spousal one.

A denial can be for a thousand and one reasons, from (the most common) the consular officer not believing the marriage is bonafide, to misrepresentation by the applicant, certain criminal history etc.

Also it is a good possibility that you wont ever find out the exact reason why a spousal visa was denied.

Your other questions cannot be clearly answered because each reason of denial has a different path of action to follow and the outcomes vary.

My question to you is why are you so worried about a visa denial? Is there any certain red flags in your fiance's life or in your relationship history that could factor into you receiving a denial?

If you are worried that you will get denied a spousal visa because he was denied a tourist one, your worry is for nothing.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2014

I filled out the 230 for practice, but everyone has to do the online DS-260 these days.

There also seems to be some inconsistencies in the required information as per posters in the last couple of weeks. I had absolutely no education history nor prior work sections to fill in, I even checked it several times to be sure, but it only asked for my current place of employment/school.

Prior addresses were by month/year, to and from.  Prior visits to the US (x5) were day/month/year, to and from.

You'll find much over the last few weeks about EP in this thread.  I simply chose to avoid the hassles that others were experiencing, and did snail mail... yes Canada has the option for either  (but once you choose EP, then you must do EP) :)

Had the same thing happen with my DS-260. No section for education or prior employment. I completed as is. If they want it, they can ask for it and i'll provide it.

B & GFemaleGreece2014-04-19 07:27:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2014

Yes, I believe this is the screen you saw after you completed current work. It only asks about military and gives

no option to input Work / Education history. Once you complete all available portions of the form you will be able

to save it and submit it as complete. Once everything else is accepted you will get Case Complete. It is then in

the hands of the Consulate and any additional information if required can be provided at the interview.

military.png

That screenshot is exactly what I'm getting. I'll just go ahead and just submit it. IF they want something more.. they can ask for it!!

This has only been mentioned once on this thread that I remember and no one picked up on it or responded to it.

It seems to be an issue on their end that does not effect everyone. The +add additional that was available in the

previous address section is missing in the Education and or Work Section. This may or may not be an issue

depending on the consulate. Prepare this information and have it available for the interview should it be required.

Thanks Changnoi.. I'll just submit it as is and have a list of previous employment and educational institutes with me at the interview. Hopefully it wont cause any issues.

And congrats!

Ok.. Im confused! Filling in the DS-260 as we speak and I have reached the Work/Education section.

Fill in the present occupation section, which I did and the next question is do you have any other occupation? Which is no, Im currectly only working at one place.

Clicked on next page which is additional Work/education and the only thing it is asking for is if I have ever served in the militatry.

I have been reading on here that they require employment history for the last 10 years.. but for the life of me.. there is nothing on the DS-260 for me to fill in the information.

Has anything changed that I am not aware of??

Got IV invoice email last night and IV fee is now payable on CEAC! Yay!

Is it me or are things moving faster at NVC? Our case # was assigned on the Apr 03. I wasnt expect to be able to pay IV and submit the DS-260 for at least 2 weeks after we received case #.

Edit: Also, to find out if DS-261is accepted, do we have to call NVC or is the email we received last night proof of it? Email states that my husband has been chosen as agent for me.

Hi Saylin,

Sorry if I am posting this in the wrong thread, but needed your help.  My spouse has her interview on April 11th with POE expected around April 18th.  We would like to go to Mexico May 3rd and 4th.  I don't think she will get her green card by then.  Can she travel with the Visa that's stamped on her passport?  What kind of Visa is that?  Is that just for POE?  Or can she use it to enter Mexico?

She can use the I-551 stamp (which she gets at POE) in her passport to travel in and out of the US. The I-551 is basically a temporary green card valid for a year. She can use that as proof of perminant residency till she has actually has her green card.

I sucked it up and ran to the court house and got it. Just took an early lunch. Court house is only 24 minutes away....The whole process only took 6 minutes including when I paid for it. It took me longer to park and put all my nickels and dimes in the kiosk.  LOL LOL   The way my luck is going..... they would send a checklist. I am not willing to take a chance.

Its my divorce decree that she wants to send. He was never married. I did send a copy of it in the USCIS package.. But I was divorced way back in 2005 and I don't have the original. I don't even remember where I came up with the copy and my second divorce decree and translation was included in the package  too. I do have those originals. I guess they will both get shoved in an express mail envelope and mailed out this afternoon . She said she would work on my file and get back to me this afternoon.    Its amazing what little $3300.00 gets you these days !!!! and we still have another $2000. to pay when the interview is scheduled.  PLUS we pay all fees .   WHAT  A FRIGGIN RIP !!!

My god that's frustrating! I do hope they get their act together faster than they already are and give you your money's worth!

UGH  nevermind, I wasn't able to open the links on the wiki page up til now.. I am at work and they block that...

I guess I just delayed my stupid papers now. Dang....  I have my last divorce papers but I have to get another divorce decree from the county where I live... OMG this is annoying

Ummm.. why in the world is she telling you that you need your divorce decree?! That was supposed to be included with your I-130 not your husband's IV package. All of the paperwork pertains to him and nothing to you. If your husband is divorced, then he will need his divorce decree. Not your own.

It will be a good idea for him to have a certified copy of your divorce decree with him at his interview, but it does not have to be included in the IV package.

How long has it been taking lately for a case #? for some reason, I can't access Saylin's spreadsheet at work!!!

Mine took 23 business days... NVC receive: Feb28 Case # assigned: Apr 03.

If I remember correctly, i saw a member Eastyo  had case received on March 7 and case # Apr 04.

Keep calling daily.. preferably late in the evening.. I think you might just have your case # by end of week

The IV fee is unrelated to the AOS fee and or package. The IV fee will be invoiced once the DS-261 form has been reviewed and accepted. (Case in point, if one has a lawyer during the I-130 process AOS and IV fee are invoiced together. SInce the DS-261 choice of agent form isn't needed, as the lawyer is selected as the agent by default.)   After the IV fee is paid and it's updated in their system as PAID after a couple of day the DS-260 will become available.

Essentially there two paths at the NVC; which are independent and don't depend on each other:

1) AOS FEE -> AOS Package review

2) DS-261  -> IV FEE -> IV Package review

-> DS-260 (as soon as fee shows as PAID

Thanks waiting__.. thats a relief.. at least the whole process wont be delayed too much!

Ok.. quick question guys.. if anyone can help.

We are waiting for the horrible triangle to disappear so we can pay the AOS fee. However what I was wondering is does NVC wait till they receive your AOS package before they make the IV fee available and then the DS-260?

There is a good chance that we might have to delay sending our AOS package by a couple weeks.. (long story).

thanks guys!

I just called back.. talked to Abbey. Nice lady !

She gave me the IIN number but told me I can't do anything with it until I receive the bills. But she told me I can do the AOS.

She also told me I got a case number for my I-130 so fast because they got my K3 first and did a search in the system and found the I-130. They assigned the case number to the I-130 and then CLOSED the K3.   So I'm sad that the K3 was closed but I am happy that I didn't lose any time waiting for the case numebr for the I-130.  UGHHH can't concentrate at work today !

Can't concentrate either! Just submitted the DS261.. and I am very glad even though they did close your K3.. you have a case number for the I-130 and can start moving it along! Hopefully you'll have a case complete by end of April.. fingers crossed!

should I have asked for an IIN number when I was online with the NVC???

I asked for all three.. case number, IIN (Invoice Identification Number) and BIN (Beneficiary Identification Number). Lady on the phone gave me all three.

I don't think you will need the IIN if you are still hoping your K3 will make it to the embassy. Though the next time you are on the phone with them ask them for both the IIN and BIN so that if the worst happens and they close your K3.. at least you will have all the info to start procesing your CR1.
