Would be great if there was a thread devoted just to coming on a VWP while processing I-130/I-129. Thanks for your feedback! Looking into it!

 

VWP here, just like your husband. Though we haven't filed the I-129F, just the I-130 I have travelled twice since we filed our petition. Our PD is 08/14 and I visited my husband in Sep 2013 for 3.5 weeks and again end of Jan 2014 for 12 days.

 

Never had a problem at POE, (Washington Dulles). I live with my parents also, the the paperwork I carry with me is:

- Letter from employer with dates of my leave

- My work schedule ( I work shifts)

- Mobile bills, bank account statements, car insurance account as they all show my address in Greece.

- Travel Insurance for the days I am staying.

- Photocopy of NOA1 

 

And i have yet to use any of it and I've generally made 2-3 trips a year to the US since 2011.

 

I say give it a shot!

Just updated my timeline..    "Based on timeline data, your I130 may be adjudicated between April 19, 2014 and May 13, 2014*. "

 

I almost threw up when I saw it sad.png

 

 

But, who knows what will happen. I have really high hopes for this new NBC

 

I wouldn't pay too much mind to the dates. There are too many uncertain variables right now for those dates to be rock solid. I'd say be alil patient till Overland Park Centre starts working, then we will have a better idea of whats happening.

They are playing with the numbers. By approving petitions over the 5 months, March, April, May, June and July they are trying to lower the average processing time which is at 8.4 months now if I'm not wrong.
They are not allocating extra resources to churning out faster approvals and thus lowering the waiting time just approving random cases over these months to achieve it.
And the only reason they are still saying they are working on Feb 13 files is that they don't want to be flooded with service requests. They know they are done with Feb 2013 filers, it's why they are sticking to that date.
It aggravating because they are treating us like we are morons and have no intelligence to figure out their little ploys.

Gosh reading all these cases makes me feel more anxious about the time frame... I'm gonna have to stop looking at stuff on VJ for a bit.

 

I detoxed from VJ while was visiting my husband.. and tried not to log on when i got back.. but I still find myself here almost every day!

Glad you had no troubles! As with the rest of this process it seems to be a bit luck of the draw in terms of entry experience, so we'll over-prepare and hope for the best. I would be heartbroken if one of us were turned away.

 

I'm hoping for the best too. Flying to the States on the 19th. Im taking with me evidence of any ties that I can get my hands on. Better to lug around an extra kg of paperwork than be denied!

wow, just read the last few pages of the Febraury post and it's really, really depressing.

 

I'm really angry at myself for not researching things well enough, I could have applied at the London embassy which from my understanding would not have taken as long. Is it worth it to try and cacnel our application and resend it to London?

 

You can cancel your application, but that will mean refiling, as Ivy mentioned, another filing fee and you get in the back of the line. May DCF filers still haven't received their NOA2s, at least the ones on VJ haven't. Right now you are ahead of the game by 2 months.

Hey guys,

I had originally posted on here when the threat originally began, but for personal reasons, me and hubby decided to wait a couple of months. Finally filed in Aug and we already have our NOA1.

I have been scouring threads and posts all over VJ to try and find out more about the new NBC service centre they have created in Kansas. From the information I was able to gather, it seems that May 20113 filers' petitions and onwards are sitting prettily in at the Kansas service centre, in Division 8 waiting for the end of september so they can begin working on them.

Anyone heard anything new or different?

I'm pretty sure that if USCIS wants access to your POE records they will get it. I don't think they have direct access, but I could be wrong there. In the I-130 instrustions, it doesn't specifically say to send copies of passport stamps, it falls under the other evidence category. Its just another way to prove actual visits with your husband/wife. I haven't only included my passport entry stamps into the US, but my husband's entry stamps to Greece as well.

Thanks for the advice. I do know that 65 pages is alil much for Greece, and I have included the passport stamps. Even if I take out the boarding passes, that's only going to lessen it by 5 pages. The bulk of it is really things that are necessary. My husband's passport scans and divorce decree, are a big bulk of it. And after dating for 3 yrs, to give a decent timeline of our relationship and try and keep it minimal was a challenge. 20 pages worth of evidence of pics, stamps,boarding passes, 2 hotel receipts, one example of chat record, one email, and 5 month interval screen shots of skype was the best I could cut down too.

Reading here on VJ..they categorize boarding passes as primary evidence..since we are newlyweds..12th of june it will be 2 months for us..we don't have any co-mingling of finances evidence yet..so I'm trying to make up for it with everything else! Lol!

Trust me..little by little it amounts to that! Husband's passport alone in 20 pages! We use blackberry messenger to chat all day long..one history file of 2 days is 7 pages long! Plus pictures..boarding passes..hotel receipts.. That's how we got to 65 pages!

We are planning to send off ours this coming Tuesday. I'm the one that got the package ready and mailed through to my husband in the US. He is more than capable of doing it himself, but I had alot more free time (free time meaning working on the package for hours at work!)

It is about 50 pages long when I sent it to him and he is adding another 15 pages to it. I hope thats not considered too big! The last thing I want is a USCIS human seeing it and rolling their eyes at the amount of evidence they have to go through!

I am the beneficiary and yep we can call. It is easier for me to call them rather than my husband. Plus, i don't have the patiance to wait for my husband to get off work and call them from home.. thats after 05:00pm EST.. midnight my time.. when I can be on the phone calling them a minute after they open up! :rofl:

We got our case number on April 1st, our case was received on February 27th, although the person my husband didn't tell him the IIN, saying we would have received an email with that. But so far nothing so he's gonna try and call again today!

 

Definetely call back.. i called them today and they gave me our case no.. I had to ask for my IIN and the BIN. Lady on the phone gave it to me without hassle and also told me that an email will be sent to us with the information on it.

Also i was able to submit the DS261 today :joy:

ehh.. i dont want you to stress out about my sheet entry.. not right now at least.

 

 

there are two august entries who have been granted their case numbers within ~ 10 days of their case being received at the NVC correct ? 

 

i am guessing that they were both expedites and/or dcf filings. 

 

I was under the impression that DFC don't deal with NVC. Everything after the I-130 is done at the embassy. I could be wrong though.

Did you get any email from uscis about your case shipment?
How about your case status for I-130 as of right now? What does it says?

 

No email from CSC on my case being ship. Case status has been the same since NOA2 update.

'On February 20, 2014, we mailed you a notice that we have approved this i130 IMMIGRANTPETITION FOR RELATIVE,FIANCE(E), OR ORPHAN.

 

Only thing that we got that mentioned anything about our case being shipped/tranfered was the NOA2 hardcopy

Called NVC today at 07:03am.. on hold for 8mins.. they received our file on Feb 28th.. and to wait 30 working days for case file number..

And now back to what I have done for almost 7 months... waiting!

But I just have my opinion..

 

you will save lots of time if you do by lawyer. ( my friend told me and I think it's true)

I asked same question to him.

lawyer can send both packages together and pay fees together..

do not do it yourself..

if you have lawyer when u submitted I-130 than get help from him..

it's not hassle but it's about saving 2 to 3 weeks.

This is what I know..

You can ask some others too.

Does our service center inform us if they shipped or not our approved files to NVC. I am approved on March 06 and know that it might take two to three weeks to reach NVC but is there anyway to know that? Thanks for your help!

 

 

got the re affirm email that my case was shipped from tsc to nvc... so im going to start the 20 day clock now... the call everyday...

 

Not all service centres send that email, for example I know CSC doesn't because we never received one nor was the case status updated. Only thing that we got that mentions that our file will be shipped to NVC was on the NOA2 hardcopy.

 

I know that TSC and NSC send the shipped email, I just don't know if that means that it has actually left the building.

Only sure way to find out is to call USCIS and speak with a Tier 2 and specifically ask for the date your case file was shipped to NVC and then keep calling NVC till they report they have received it.

 

And start your 20 working day countdown after you have confirmed that NVC has your file. Even if it takes NVC 3 weeks to receive your case from TSC, you will still have at least 20 working days to wait out for a case file number.

Sorry for being late to the party with an answer!

 

By using a lawyer, you have probably gained a couple of weeks at NVC. Basically, and most of the time AOS and IV are available for payment at the same time when you are using a lawyer. Which means that as soon as both are paid you can send off both packages.

For people that didnt use a lawyer, like myself, first we get AOS available and then we submit the DS-261, wait for that to be processed then IV becomes available.

With a lawyer, you don't submit the DS-261.

I see. How do you know CSC is so fast at sending them? I mean i know they are fast at approving them!

 

I used the 2 centres as examples. But CSC is averaging about 2 weeks for NVC to receive files from them. Look at Saylin's spreadsheet, focus only on CSC filers and you'll see.

I think Lisa y Miguel posted on here that NVC has received her file on Thursday or Friday and see got her NOA2 on Feb 20th from CSC, thought don't quote me on that!

 

Edit: Lisa y Miguel file was received on 03/04. Just saw one of her posts. 12 days after approval

Thats what I am doing? 8 weeks to case number - 2 months to case complete (especially as i have everything ready now pretty much) then around 2 months for interview?. If i could have my visa in hand by mid September I will be happy - thats 6 months from now so I don't see why not...

Yep.. very much the cautious side. And I have the same date in my head for visa issued by mid Sep.

So for NVC, I think they are much more consistent in working them in order of receiveing them, Nothing like USCIS! The only factor that they might not be moving in line with NOA2s is how long each respective service centre is taking in forwarding approved files to NVC.

So for example, someone with a NOA2 on 27th Feb from CSC might get a case number ahead from someone with a NOA2 on the Feb 20th from NSC.

I see, 20-40 working days.. oh well. Once there is a case number can you pay the required fees and send the packages soon after?? My IV is ready (i got my police check this week) and we have all the other documents. We are just waiting for my wife's (she did earn in 2013 tax year) and her moms tax returns to be done then the lawyer can do our AOS?. this will be end of March early April?.

 

To be honest, my NOA was 26th Feb, if i can get my case number by 8 weeks after (so the 23rd April) I will be pretty happy. Its not ideal, but i am trying to be realistic.

 

Once you have a case number you just start checking as to when the fees become available online. First is the AOS payment and then the IV. Take into consideration that they do take a while for things to be processed in between the AOS and IV.

As far as I know as soon as the AOS becomes available for payment and you have paid it, you can send the AOS package. Same goes for the IV too.

Our NOA2 was on Feb 20th so a case number by mid April is what I am hoping for. I don't think that NVC will be picking up speed anytime soon.

With USCIS having approvals flying out of most service centres at the moment, the backlog at NVC will not likely decrease.

I would be happy for a case complete at NVC by late Jun.

Maybe I'm low balling my dates but I would rather be suprised by something earlier than start stressing if the imagionary date in my head is not met!

 

Edit: Sorry! I just remembered that you guys have used a lawyer. Both the AOS and IV fees will become available for payment at the same time!

Hey Lisa, has the NVC even got your file yet? I am seeing a 6-8 week timeframe to get a case number from NOA2? sad.png

 

That is about right, from I have seen CSC usually ships files and NVC receives them in 2 weeks. After that it is a toss between 20-40 working days for a case file number.

Im calling NVC on Monday to find out if they have received our case.

Right now all I am doing is just gathering information. Most of the documents we require for AOS and IV are in our hands or will be in a couple of weeks.  And with NVC taking so long, we are not pressed for time.

All I am doing now is reading the NVC threat, cutting and pasting posts that might help me in the future rather than manically looking for them in 100 pages!!! content.gif

Yep!, Although strangely, I was more excited about my Transfer than my NOA2!

 

Receiving the NOA2 hardcopy was the best for me.. seeing the look of pure happiness on my husband's face.. (through skype of course) was the pinnacle!

I thought.. we are own our way now! Then I started reading the NVC thread and realised it will be a MONTH and a half for case number to be assigned..

I felt like one of those test dummy that had just crashed into a brick wall!

My issue is that I actually need a letter from the NVC to be able to get my police check from Hong Kong.

They say I need a letter, from the relevant authority, stating that a police check is required for the vida (although this I hear can be a print out from the website). It is not like the UK where I can just apply for one without any proof I actually need it, plus they will only send direct to the NVC.

 

Ok, your case has that exception, In a couple of weeks when you call NVC to confirm they have received your case file I would ask them on the phone if such a letter can be provided by the NVC.

 I would like to hope that they have some sort of procedure for such a situation. Just clarify to them that you are no longer in Hong kong and thus your PCC cannot be sent straight though to the US embassy there.

Thanks B&G?.. I am just wondering, do you know what letter I get from the NVC (referring to the documents needed)? i thought it was all done on e-mail?

 

Most of the communication with NVC is done by email. Im not so sure what you receive as a hard copy in the mail though. 

As for the documents you need, I would not wait for NVC to actually regenerate checklists for the AOS and IV packets, you can actually send them off before you receive the NVC checklist.

As soon as both AOS and IV are available to pay online, pay them and then send off the respective packets. That way you will avoid time lost in waiting for NVC to regenerate the checklists before you send the packets.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

OK folks.....just so you have an idea of how fast some of the petitions are moving, this is what has happen for me this month:

 

Feb 5th - Transferred to CSC

Feb 11th - Petition Approved

Feb 20th - NVC received my case file

 

Called NVC today and spoke to Todd.  He said to call again 20-30 days from receipt for IIN

 

 

 

I have been reading and reading  and reading post and flow charts regarding forms and evidence to send to NVC.   Trying to get everything ready but there are just some things that still are confusing to me.  Everyone else seems to have a good grip on what to expect and to do......starting to feel like an idiot !!!

 

Well tell us! Im sure the collective clever minds of the Aug I-130 filers thread can help you!

Wish I could answer all your questions Lisa. . However only one I can answer is.. other than gatheting all the evidence you require for the AOS and IV packages.. There isn't anything you can do other than wait for the case number.
As for the PCCs. . Find out when they will expire. If they are good for 3 months and up.. i think you should go ahead and order them..
