Yeah who knows! I did not realize that would be the case. I was approved on 4/11 at VSC and so far have been able to do Ds261, pay the AOS, and send in the AOS packet. Still can't do IV though, not available. However, I am sure everyone will have their visa in hand before me anyway because of the time it seems it takes to get an interview scheduled in Cairo. But for now trying to think positively :)

I'm sorry, it must be so difficult waiting that long for an interview. Do you happen to know why it takes so long? Either way, chin up; you're at the home stretch! Good luck :)

Yes- that's what happened with me. I had filed a K3 alongside and I got case/IIN right away. I don't really know why it makes a difference though?

Really makes me wish I had filed the I-129f as we'd originally planned. O well.

I have a theory that it's because they try to fast-track K3's through NVC, as they likely used to back when K3's weren't systematically closed, so they immediately issue the relevant numbers to the K3 visa applicants and, because it's paired up with your I-130, the same account can be used for the IR1/CR1 visa.. then they close the K3 and all that remains is the CR1/IR1 and you're good to go. That could totally be wrong though :D Either way, lucky you!

""Whoa! Lucky! I also got case number Monday but still can't log in! Did they just tell you that you had one? Or did they actually tell you it had been assigned that day? ""

I want to get some timing. For the people who have a case number and INN. How long did it take to get them? from the time the NOA2 was approved.

I believe it's taking on average 6 weeks

I haven't gotten either yet, but based on spreadsheet data, it takes approximately 10-14 days for NVC to receive it.. Then almost exactly a month for the case number and IIN (I've seen a lot of cases where it's been either exactly a month or one/two days around that). Some people who also had K3's that made it NVC got their case number and IIN immediately, but that's a gamble.

This winter we got down to minus 47 some mornings. I can't wait to get the heck out ta here.

I managed to escape most of the winter craziness here by running to DC/Germany.. -47 is crazy though, we usually max out at -40ish. By the way, is it just me, or do other Canadian's also skip the "negative" when speaking about temperature? I always assume it's negative so I never say it and my international friends always get confused :P

The problem with getting idea about Vermont is, we have very small data set. Barely 3 transfer to Vermont in August, all of which are approved already; and 2or 3 in September, one of that is approved. 22nd October onward filers are basically majority of i130s there.

That's very true. I just hope they have a plan, because they've been doing so few applications up 'til now and it worries me how they'll handle the boatload of I-130's they'll have to adjudicate soon. *fingers crossed*

Yes, let's hope so!  I'm getting pretty desperate after waiting for 5 months.  I'll take any service center (even Texas or Vermont) as long as it's not Nebraska.  LOL!

Meanwhile, I really hope NSC has hired additional staff to process applications faster.  I don't know what's going on with NSC.  It's just a total gong show.  headbonk.gif

Isn't Vermont even worse right now? At least Nebraska is making moves.. Vermont approves like 2 applications a week :(

Hahaha well it's quite a problem! it just pains me when I'm walking through snowstorms and rejoicing over -25C (it's better than -35! :D) and my husband complains about how it's 0C in DC. I just hope we all get out of here before we suffer another winter...

Yea it's "only" -17C here right now, but it was way lower and snowing all day yesterday.. and will be again soon. Yet another reason I can't wait for this whole process to be over. I never wanna spend another winter here.

Keep in mind, they're probably going to release the "new" numbers at USCIS next week. Last month it was on the 17th so likely the same this month. There's often a bit of a slowdown the week before they post. Don't know why, but it's happened the last few months.

They seem to release the numbers the 3rd Tuesday of each month, right? You'd think they'd speed up right before they do :/

After an hour and a half wait I got through and was told it was a processing error that resulted in that. My case is still in the "Initial Review" phase after being transferred to the TSC. No worries, I was nice to him and he was nice to me. smile.png I'm just a bit disappointed about the false hope of an expedited process.

On another note, does anyone know how long my Canadian spouse can visit for while we are in this process? Thanks.

What a tease! I hope you get your approval soon.

As long as he can prove enough ties (e.g. job, school, etc.) to get past the border, he can stay for 180 days (although it may be difficult to get cleared for that many days, since most jobs/schools aren't out for that long). And just as a tip I just picked up during my last visit, the CBP officers seem to like it when you know exactly how long you'll be staying, so if, for example, he'll be visiting you for 2 months and 5 days, tell him to say that instead of "o about 2 months". I don't know why, but doing that seemed to really reduce suspicions in my case. Good luck!

I just say to visit my SO and in laws, alternatively you could say just to visit family but don't lie if they ask who. They don't seem to bother me visiting once in a while. From what I have heard, they start digging in deep if someone is visiting too frequently without good reason. It all really is subjective and everyone has different stories. I just don't bother thinking abt "what If" scenarios. If you have never over stayed or done anything illegal, there's nothing to worry abt.

I was just debating between whether adding "my husband" is giving too much information or not. I'm definitely over-thinking though as I've never had issues crossing. Thanks :)

I was there couple weeks ago. It was a breeze going through. Just usual where/why/and how long you going for questions. Just answer what they ask and don't lie to them and you should be fine.

Just wondering, when they ask for the purpose of your visit, what do you say? I've always said "to visit my husband", but maybe there's a better way to answer that? E.g. what if you just say "to visit"? (I'm being so paranoid right now)

Actually it was my immigration lawyer who scared me and told me that there might be a possibility for a denial. Canadians belong the to visa waiver program which entitles us to enter the US for Non immigrant purposes only. What I was told was that the border agent might think that I have intentions to 'visit' my wife till I get my application approved (upto 6 months), which technically is visa fraud.
My lawyer said that he has many clients who have been denied entry at the border and it makes the whole process a lot longer and harder. Just playing it safe I guess!

1. Canada isn't on the visa waiver. It's in a weird different world all in its own right. I like to think of it as something like an auto-B2, because they stamp it as such sometimes. Either way, it's different from the VWP.

2. Your lawyer is needlessly freaking you out. I've visited my husband 4 times since we filed without any issues. They questioned me a bit more than before, but they asked for my return ticket and letter of enrolment and I went through just fine. Only in one case was I asked for anything related to the I-130. In any case, they don't care if you stay up to 6 months, because that's what Canadians are allowed. They care about you going to the US to adjust (i.e. stay indefinitely); as long as you prove you're coming back, you have a good chance. BUT if you do get denied, it won't affect your visa at all. Nothing to lose really. O and try to keep your visit short.

I am already gathering information and documents for NVC even though it could be several months before I am approved.  I have already been waiting well over a month for a long form birth certificate and my military records.  And now I have to carefully time applying to the German government for a certificate of conduct, as I lived in Germany for three years.  Who knows how long that will take or how long it is good for.

Anyway, it is always good to be proactive in this process and working on getting all this stuff together makes me feel like something is accomplished, like we are moving forward.

That's a really good idea, especially since electronic processing lets you send in the documents the second your fees are invoiced. By the way, do you happen to know what exactly is required to be on the birth certificate?

Out of curiosity, where in Germany did you live?

Haha I wish I did try having finals and dealing with a toddler all while trying to study and checking your email every 5 minutes I closed facebook this is my fb now xD
Maybe at the interview if we are married 2 years because don't they send it via dhl?

Ouch. Good luck!!

Well once you're approved, they'll take your passport, send it back with your visa or whatever, then when you cross the POE, you'll let them know that you've been married for over a year and that they should issue a 10 year green card  (which'll be mailed to your US address later). This is assuming you pass your 2 year anniversary between the interview and POE.

(sorry if that sounds a bit confusing, I'm really tired)

Also the longer the process the better because someone told me after our second wedding anniversary he won`t have to file adjustment of status but I am not 100% sure???

FOCUSING ON SCHOOL IS IMPOSSIBLE :( How do you do it?

It's removal of conditions, not adjustment of status, but yea. :) You save a bunch of money.

I wish I could stick to my guns on that one Tala, but at least I am trying to keep it to once, maybe twice a day...lol!  And...when I got home I attempted to log into my account on the USCIS site and it worked.  I am guessing something was temporarily hinky between my work computer and the app.  I am on my Macbook at home now and it seems fine.  The problem only happened when I installed the paid app, so I uninstalled that also.   I will get email and text updates from the site anyway so the free app will do just fine.

Yes, I am praying that we can be out of here by the time this coming winter hits.  This one has been particularly hard..

Hahaha yea it's tough. There's always this little glitter of hope that says "I know it's too soon, but maybe, JUST maybe we're approved but didn't get the notification".. but of course, that's always to no avail :( Happy to hear the problem's solved though.

Definitely. I just can't do Canadian winters anymore. They have until late September, tops, to get me the hell outta here.

Tala202FemaleCanada2014-03-13 17:53:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsI-130 feb 2014 filers

Gee thanks!  Yet another thing to check that's gonna drive me crazy...lol!  Just kidding.  Just downloaded it to my Droid, but like someone else on here mentioned I think it is best to back off checking too often.  It won't make them go any faster and it only frustrates us and drives us batty.  I think I will check once a week (just to make myself feel a little bit of power...yeah right!) but aside from that, I am signed up for email and text notifications so what's the point of stressing myself out unnecessarily?  And now all the I130s that were fast tracked through USCIS are starting to stall and backlog at NVC.  Just my humble opinion here, but if they do not hire more people to weed through backlogs, the backlogs will just be shuffled around from one step in the process to another.

All this being said, I am an eternal optimist with high hopes that everyone here will be processed fairly and expeditiously.  Just my two cents worth on a chilly Thursday morning in Winnipeg!

If you can stick to checking once a week, you're my hero. I told myself that I won't even begin checking until June... then immediately refreshed the app 32523 times.

I agree with what you said about the backlog though. And once NVC clears, there'll be a backlog at the embassies for interviews. How difficult is it to send out an email to each centre/embassy along the way and have them implement changes for this new goal?! sleep.png o well.. Let's just hope we get outta here before the next Canadian winter smile.png

Okay, I just set this app up, then I tried to log into the actual site for USCIS and it has locked out my account for either "inactivity or too many unsuccessful attempted logins". I am fairly certain it was the app that caused this so those of you who are trying this, please be careful!

Now I have to figure out how to "undo" whatever happened here - whether I have to just wait it out a day or two, or create a new account. I think I will wait and see if they will unlock the account. Anyone else run into this problem?

O damn! I wonder how that happened. Let us know when you figure it out

Congrats on you guys receiving your NOA1s!

I remember when we got our NOA1 in Aug last year, I was so excited till another member decided to dimished it by saying that NOA1 is nothing special.

Well it is special! Its confirmation that you have taken the first step!

Now a word from someone who has been there..obsessed over that!

Its going to be a while, good thing for you guys, I don't think it will take any longer than the 5 months which is the national goal for USCIS.

Here is my advice.. start focusing on the NVC stage from now, visit the monthly NVC threads look at what is need for each stage. Make sure you have every single document you can possibly need before you even get your NOA2 (except of course, police certificates). Hopefully by the time you get to NVC, the backlog will have cleared and you guys and breeze through in a month and less!

If you care, read through the NVC threads, you would be surprised how much you will learn from other people's mistakes.

Hopefully you don't feel like I'm crashing your thread! Good luck!

Hey B & G, thanks for dropping in and for the input! Especially thank you for presenting such an optimistic view (which sadly doesn't come up often enough on VJ). If you're right, which I think and hope you are, I'll be through the process before my personally-set deadline, which sounds amazing. I definitely agree with what you said about preparing for the NVC, since it's the one part of the process where you actually can affect how quickly you pass through.

Anyway, here's to hoping that the USCIS goal is met (and surpassed), and the NVC backlog clears ASAP. Good luck with the rest of your process!

For approximately the first half of 2012, petitions sent from petitioners residing abroad where DCF is unavailable had their petitions approved in a very short timeframe. It appeared that such petitions were being automatically expedited even though USCIS officially denied that was the case. Since late 2012, that no longer appears to be the case hence the dodo reference.

Ah I see. Well both that and the dodo will be missed.

Tala202FemaleCanada2014-02-27 13:53:00

I'm the petitioner. I've been living in Moldova for the last 7.5 years (I'll be dealing with domicile and assets vs joint sponsorship in a while). Thankfully I'm with my wife and the immigration isn't "urgent" per say.

From what I can see the mythical auto-expedite for petitioners living abroad seems to have gone the way of the dodo.

Correct me if I'm wrong, but isn't the auto-expedite only if you use DCF? And at least you're together! :)

As for the address, I'd still say call them and explain the situation (so they don't for example think that your parents' address abroad is yours and complicate things)

Hi osmosesnew, our petition got sent in Nebraska Service Center.

Wow I'm really hoping you're right. I really like your perspective on this. I think we all need that kind of optimism. smile.png

I'm happy to deliver that optimism (as long as supplies last). I also had to read your response to my husband cause he seems to think I always have a very negative outlook on these thing; it shut him up! biggrin.png

Anyway, it seems like you're already approved. Any updates?

Just received NOA1 for NSC.

USPS Delivered: Feb 7, 2014
Priority Date: Feb 7, 2014
Notice Date: Feb 10, 2014

E-mail confirmation: Feb 11, 2014
I-797C received in Moldova: Feb 25, 2014

I'm living in Moldova and specified this address in the I-130.The cover letter requested my parent's address be used for correspondence, but this request seems to have been disregarded. 2 weeks for mail to get here isn't bad, just hope nothing gets lost.

Would there be any negative impact of changing my address via USCIS.gov?

I don't think they do anything more than skim the cover letter. Are you the petitioner or beneficiary? In any case, I would say call them rather than do it online.

Since you are in the Philippines, you might get fast tracked. Some people in the forum getting approvals in a couple months, a few even faster. The rest of us will be waiting ~8 months for USCIS.

Maybe it's my desperate optimism speaking, but I highly doubt we'll be waiting ~8 months. From what I've gathered, ~March filers waited 9 months for approval whereas ~July/August filers waited an average of 6 months. I don't think we'll be waiting longer than they have, considering we're post-Oct/Nov filers (i.e. after they implemented the new system in an attempt to speed things up). Also taking into account that they're planning to meet a goal of 5 months by May, I'd say we'll get updates in July (even if they're a month or two off in meeting that goal). Now whether the NVC will have picked up the slack by then is a whole other story, but we at least have a slightly shorter NOA interval to look forward to.

(at least that's what I tell myself. That's my story, and I'm sticking to it tongue.png )

Phoenix, AZ 85036

Is this the right address? Do u know where can we send the petition which is not a P.O. Box Address?

Thanks

Will he be sending it with USPS or another postal service? If USPS, then send it to the address you already mentioned (which is a PO box); otherwise:

USCIS

Attn: I-130

1820 E Skyharbor Circle S

Suite 100

Phoenix, AZ 85034

Just as personal opinion, I'm happy we sent it to the PO box, because that meant we didn't have to worry about re-delivery. Our application arrived on Saturday and was left in the PO box for pickup.

nope! I sent it to the USCIS address. I'm calling my local post office tomorrow...something needs to be done about this! I want my NOA1 ASAP!

:( Good luck! Let us know what happens!
