Out of curiosity, is the 129f worth it? I have a friend filing now planning to do it.

 

To be honest, I don't know if it has helped anyone move faster to an approval, though I could be wrong.


 

Im hoping monday or Tuesday will be a big day, covering 13th - 18th.... then next week 18th - 23rd.... that would be awesome....

 

As a 22nd Filer, I would love to see a transfer by the 17th/18th.... to CSC of course....

 

But we can only hope!

 

I hope so! I am getting antsy! like checking-USCIS-site-every-20-mins kind of antsy!!

No problem at POE.. I am in Virginia as we speak.. only thing asked by officer was what the purpose of my visit and for how long I'm staying. He did a lot of reading on his screen.. don't know what. . Once he was done he stamped my passport..at that was it..

Totally sucks. And I know EASTYO is right. But my hormones will get the best of me whether I try to remain strong or not some days. I wish he could get a visa and stay here even for 3/4 weeks around the due date. Sigh..im a perfect world...

What about if we have no job (per say) , but are full time postgrad research students? Both my wife and
I are at York doing marketing research, we have a long house lease here also etc etc, will this get flagged?
it cost me £20k for her to study here (non EU's don't get grants) so surely they could see I'm not THAT desperate
to get into the US that I would waste £20k!!

Also my trips over the last 2 years have been 5, and for 3-10 days in total (Christmas, budiness trips and her brothers wedding). I am british if that makes a difference

Are my chances ok?






 

Honestly, I think you will ok. Reason why I say this, is that you have not shown a pattern of long term stay in the US.

Carrying with you documentation of your ongoing studies, a copy of your lease, mobile phone contracts, bank statements, showning the UK as residence for the both of you is good evidence in the instance that you are questioned further about your intent of staying in the US.

Copy of the NOA1 showing that you have filed for a CR1 is also proof that you are planning on returning back.

 

I have only heard of one UK resident that was denied entry at POE. He was the fiancee of a friend of my husband's. He had no job, no apartment, no ties whats so ever in the UK and his return ticket was for 90 days later.

 

It comes down to whether you want to risk it or not. There is always a chance of you getting denied entry. Im willing to take that chance because I want to see my husband! And should i get denied, the financial loss is not very significant for me.

 

Going into a secondary interview doesnt automatically mean you will be denied entry. Its your chance to dig out all the proof you have with you to convince the CBP officer you are intenting to return back.

Wow, my lawyer painted me a completely different picture of what that would look like.....

 

After studying on VJ, stories of members that got denied at POE, and also seeing at work people that have been sent back (I work for an airline at ATH airport) and talking to them, there are two major factors that play a role in if you will get denied or not.

 

1. If you have a job in your country of residence or not, and

2. The length of your previous visits and the frequency of them.

 

For example, entering for 90 days, leaving the US for 3 months and trying to re-enter again. That starts to raise warning bells for the CBP.

 

I know that the fact that I work for the airline I fly into the US with helps, I wouldnt be entitled to their free tickets if i didn't and CBP officers know this.

Also I think it helps that in the 2 years I have been flying back and forth, the total amount of days I have stayed in the US have not exceeded 100 days.

 

Of course, that doesn't mean that every time I try to enter I wont be pulled into a secondary interview, but I have enough evidence that I think I could convince the CBP officer that I am in no way intending on staying.

Officer: Good evening, purpose of your visit?

Me: Vacation

Officer: Who are you staying with?

Me: Family, My husband.

Officer: What things are you bringing into the US?

Me: Some olive oil and some presents.

Officer: What kind of presents?

Me: Some towels.

Officer: Why in the world are you bringing towels to the US? We have them here!

Me: They were presents from our wedding reception, my husband has more use for them than me.

Officer: How long are you staying?

Me: 3 and a half weeks.

Officer: Place your right hand here....

 

Thats it. Entered without a problem.

My husband and I have resigned ourselves to the fact that we are just going to have to wait till USCIS feels that it can start working on our petition. This isnt going to happen any faster, no matter how much we wish for it.

We made a pack last night that we will start focusing on things that are in our control, like me visiting him in the US in 6 days, planning for his trip to Greece in April, looking for a new place for him in the US, trading in his car for something with better mileage and so on...

 

I don't have control over USCIS or their processing times, its time to focus on things I can control.

I don't think its complicated, just tedious. At least by the time we are at NVC my husband will be done with his 2013 taxes so they can be sent along with the I-864.

As someone else mentioned, I will wait for the transfer to start gathering documents, mainly the 3 police certificates I need. Take around a month to have all 3 in my hands.

Plenty of things have moved, there is no denying that. The problem is though, why are they approving July filers when there are still April, May and June filers waiting to see approvals?

They are trying to improve their processing times. It worries me that they are approving July when there are still so many waiting from previous months.

Once they get their numbers to where they want them to be, they will stop approving July and got back to the front of the line. What does that say for Aug filers?

I have participated in the last 2 letters that were sent. The first got a resppnse. Date of filling was changed from October 2012 to 12 Feb 2013 and they gave a 7.5 (??) month processing time and a letter stating their goal of reaching the 5 month processing time by May 2014.

Next update, processing date was change to 13 Feb 2013 and processing time to 8.4 months. A joke and an insult to all filers!

 

Honestly, even with another letter, nothing will be achieved. Im sorry if I sound bitter, but I am, because no matter what was tried by members here on VJ, technically it didn't work.

 

That doesnt mean that if another letter is sent out i won't participate. I just won't expect anything to come of it. And here i thought Greek bureaucracy was bad!!!!

The thing is i wish we just had a def time limit so we know our cases arent stuck in a backroom some place in alaska

 

We are definetely stuck in a backroom, but not in Alaska.. the bottomless black pit our files have been thrown down in, is Overland Park in Kansas or maybe even Lee's Summit.

Little trolls are still working their way down to where the Aug files have landed and then they need to work their way up with them. I think they need a month for our files to see the light of day again!!!!

I agree. I dont think we will see a 6 month approval, though I don't think will be 9 months either, more closer to 8 months. But as you said, get accustommed to 9 months and anything earlier than that will be a very nice surprise!

There is no official disclosure from USCIS or any public announcement made. It is the reason why I said "it isn't likely to happen". But do you honestly think that Division 8 will open up in time for August filers to be adjusticated?

Or if there was any plan of Division 8 opening any time soon, then why is USCIS sending files to Nebraska Service Centre since October 2013?

They send out receipt notices because they are a satellite office of NBC (to do the clerical work pre-transfer).

Thats all they are.

 

They were supposed to have trained adjudicators or something by sep of last year.

Actually that's not entirely accurate. If memory serves me right, not sure if it was April or May 2013, filers started reporting receiving  NOA1s from Overland Park with MSC code. USCIS started to send I-130 petitions to OP in preparation of Division 8 opening up at the end of the fiscal year. For unknown reasons, end of Sep came and went and Division 8 never opened up. But USCIS continued to send petitions to an office that was not operational. 

Once they realised that OP was a no-go in October 2013, that's when they started sending new petitions to the Nebraska Service Center. Since October, I have not seen any members with an NOA1 from OP. 

 

The reason why transfers are all coming out of NBC OP, isnt because they do the clerical work for pre-transfers. Its because mine and yours and everyone else's files up till Sep 2013 are literally sitting in OP waiting to be transferred.

How do we know Overland Park is not running? I thought they started, slowly, but started?


Overland Park as a centre is operational. Their Division 8 department though isn't. Division 8 was supposed to be opened end of sep 2013 and they were supposed to deal with all stand alone I-130 petitions.
Overland Park has never up to this point adjusticated any petitions.
Even though there have been members that never got transfered from NBC and have been approved, none have reported a NOA2 hardcopy from Overland Park. All approvals have come through Lee's Summit.

They were supposed to hire more people since april 2013 to staff Division 8 at Overland Park, that was supposed to be operational at the end of Sep 2013. That didn't happen.. and it isnt likely to happen.. 

 

Im leaving in a week and a half to visit my husband in the US for 12 days. I will probably come back and still be waiting to see a transfer!!

I have been around long enough to know that there is no rhyme or reason to what USCIS does or why they do it. The only thing that is clear is that they are playing with numbers.

By transfering and approving July filers, it will result to a reduction of the processing times. I will take a guess and say that next average will be in the 7.something range and the date of working on cases will probably be begining March 2013. They will still try to hold off service requests as much as possible.

I would have to agree with Kaylara. I don't think we will see transfers till beginning of Feb. That will put all Aug filers in the 6 month mark. Add the 60 days they claim on transfer notices, it brings us all closer to the 8.4 month processing time they are claiming.
But then.. I'm just speculating. .

We are applying for IR5 (parents of USC). NOA1 date is August 3rd, 2013.
I would like to gain some time getting the police certificates before I-130 is approved.

If you are well prepared for the NVC stage you might be able to do it in less then that. The only time it's out of your control is when USCIS is transferring your case to NVC and when you are waiting for your interview.

For me an NOA2 in March April 2014 is not good enough. Their national goal is 5 months and for me, that's in 2 weeks. Too many filers before me and too many after me have and will suffer because of their incopitence.
What I should have been getting in March - April 2014 is my CR1 visa in my passport.. not an NOA2!!!!!

Hi Guys!
 
I am new to the forum and an Aug 2013 filer (22nd Aug, 2013), I am a Uk citizen and my wife is the US citizen. 
We both live n the UK, we couldn't do DCF as we moved from Hong Kong to York in September (so we didn't qualify) and posted through the Phoenix lock box.
As at the time of filing we didn't have a fixed UK address (only Hong kong but we were moving), our lawyer put my wife's US address as her moms (she still has all bank stuff going there).
 
Mind you when i called to update our addresses in the UK the tier 2 told me they couldn't do it?????
 
Anyway my question.......
 
I see that we are hopefully going to get transfers in January and should (hopefully) be approved by Feb/March. However I wanted to know if anyone had any experience
filing in the US (while living in the UK, or any abroad location) and having your visa sorted in the country where you live after the i130?
 
My lawyer says after the i130 they will transfer to London, but as this is not NVC i just wondered what the timeline would be for me under this process?

Your I-130 once approved will be transfered to NVC and then London. I would say from NOA2 to interview is probably 4 to 5 months.

Still no news on our 130 but hubby was able to come on his B1/B2 to spend the holidays here with me!!! At immigration they asked him how long he is staying and where he is visiting, he showed his return ticket and they stamped his passport! YAY!!

 

Now we are looking and trying to estimate what 2014 will hold for us, do we plan to meet in Apr/May since most likely this entire process will take til Oct/Nov next year (or longer)??

 

Its just so hard to plan when/how/where to meet in 2014 when we have no idea what the timeline is...... sad.png

 

We are thinking the same thing as you. I am flying to see my husband in the US end of January for 12 days (not enough!!), and we are trying to figure out the same thing. Maybe have him fly down either early April so we can be together for our wedding anniversary. But the way things are looking, it could be Sep till I have visa in hand. I then still need to give one month's notice at work before I quit. I am not prepared to not see my husband for 5 months from April till Sep. But we also really want to spend our first anniversary. ranting33va.gif  Friggin' USCIS!!!

Starting to think the earlier talk of a possible back-log at Overland Park KS is right. Its now been 3 1/2 months since NOA1, and we've not heard anything else. No rfe, no NOA2. Nothing. I hate waiting. sad.png

 

Unfortunately, at least from what we have seen here on VJ, no approvals have come out of Overland Park for I-130 petitions. The Division 8 that was supposed to have been fuctional end of Sep, apparently isnt.

 

Hardly any petitions are being adjusticated at NBC, everything seems to be getting transfered to either CSC, VSC or TSC. It was just a couple of days that they start to transfer May filers.

 

Approvals are starting to speed up, especially from CSC. However at this rate, we will still have June and July filers to be transfered before they start to look at Aug filers.

 

This is me guessing, but I think we will start seeing Aug file transfers end of Feb - beginning of March.
