Please help! My husband and I did the DS 260 online on the 21st of this month. My husband (the beneficiary) emailed the supporting documents after we completed and submitted the DS-260 online but this morning my husband received an email from NVC saying that "the principal applicant's assigned U.S. Embassy/Consulate General does not participate in the National Visa Center's Immigrant Visa Electronic Processing Program. Therefore all forms and documents should continue to be sent by mail." My question is, do we need to print the completed DS-260 that we submitted online and include it in the package with the supporting documents. Any response would be highly appreciated. So I'm planning to fly to the Philippines to be with my husband at his interview but I can't book my flight yet because I'm waiting on my husband's interview to be scheduled and I want my flight before December starts. We submitted the DS-260 online on September 21st and my husband emailed the supporting civil documents the same day but he received an email from NVC on wednesday, 9/25/13 that the documents should be done by mail due to the assigned consulate/US embassy in Manila doesn't participate in the National Visa Center's Immigrant

Visa Electronic Processing Program so he mailed the documents on Thursday, 9/26/13 and it takes 3-5 days for the NVC to receive the documents. How long have you guys waited for the interview to be scheduled after completing and submitting the DS-260 online? 

 

Any help would be highly appreciated. Thank you very much in advance :)

Okay so I'm the US citizen filling out all of the forms so does that make me the applicant? I'm trying to bring my husband from Jordan and I'm filling out the G-325a forms for both of us and it asks for the applicants name on the bottom.

 

That would mean I put my name on that box at the bottom for both our forms, correct?

 

Also, I don't need to have a file number, correct?

My interview went well, I had a very nice and smiling Consul at Window 64.. I went to US last year on a K1 visa, got married there and had to comeback home for personal and work related reasons. My husband filed a CR1 for me last May 2012.

5:00 am - in line
7:00 am - Guard let us in
8:00 am - Biometrics
8:30 am - Filipino officer interview, asked for additional documents like my NBI's, marriage contract. he also looked at our pictures. he asked me why i had to go back home

9:00 am - my number was called again and the same Filipino officer told me that US Consul is confused and wanted to have a clearer answer on why i had to go back home

10:00 am - Interview with American Consul, window no. 64

Consul: Good Morning, How are you today
Me: Good morning too sir, Im good.. and you?
Consul: I'm good too (smiled)then asked me raise my hand and oath
Consul: So, you are married with (American a-hole..this only meant for my ex :D ) first?
Me: No Sir, i was married to a Filipino a-hole too) first (still smiling)
Consul: Oh, ok, then to Mr (American ex), then to (present husband)
Me: That's right Sir,
Consul: running through my papers... So, you got married there?
Me: yes, sir
Consul: have you been to US with (American ex)?
Me: No sir
Consul: How long did you stay in the US?
Me: 60 days Sir
Consul: I see, so how do you like the house... ?
Me: I like it very much Sir, quiet neighborhood, big porch, i learn how to cut the grass using the lawn mower :D
Consul: (Smiling as ever, cute!) that's very good.. he looked at the computer and said..Oh, you've been here (US Embassy) many many times ..
Me: Unfortunately, yes sir :D
Consul: Ok well, all i can say is that.. you're not going to comeback in this place anymore... you promise? (smiling)

then i was told to wait to be called in Windows 71

10:30 am: was called at window 71, gave my original documents and told me to wait for 2Go to contact me if the Visa is ready..

All is well... :)

You guys will not get transferred cause your files went to the service centers directly from the Lockbox.

 

So it's Lockbox-> Service Center

That's the way it used to be up until August 2012 when USCIS started sending them: Lockbox-> NBC-> local office (that was a disaster)

All the transfers you're seeing do not apply to you. They apply only to people whose cases were sent to NBC and have been collecting dust for many, many months.

Petitions filed after end of Octoberish are being sent directly to: California Service Center, Nebraska Service Center, Texas Service Center and Vermont Service Center.

Because this is USCIS...are right now NSC is still seriously backlogged and if they don't show any improvement in their rate of approvals in the the next month... 

I wouldn't put it past them, come beggining of April, to actually start transfering files from NSC to other services centres to 'even out the workload'.. which in my eyes.. might just be a blessing for all filers still waiting.

 

Have to handed to USCIS.. at least they keep you guessing!

Lots of negative people here. Even with news of transfers and approvals people still find something to be negative about. Guess it's just one of the realities of the community here.

 

I agree with you though - let's stay strong and be positive!

The way I see it is, any expedite, any transfers and any DCF approved before me, is one less file on top of our file! lol!

Based on TIM (Travel Information Manual) which gives travel documents requirements for every country in the world, it states:
Document Validity: Passport must be valid for at least 6 months beyond period of intended stay.
Nationals of Phillipines may enter with passorts valid on arrival. However, in exceptional cases expired passports will be accepted, provided prior approval has been obtained from Immigrations Authorities at Manila International Airport.

The other thing I would check is if she is allowed to enter the PH with a US passport. In the PH she is considered a Phillipines citizen, and would have to enter with a PH passport.

For example, i have dual citizenship, Greek - Australian. I cant enter Australia with my Greek passport, only with my Australian one.

Buy it under her skype account.  Then in the options generate a local phillipines landline number for her to call you on , it will ring straight on your mobile, so no need for you to get a landline. Qatar seems to be the least expensive this round even though I've flown Delta, Untied (Continental) and AirFrance (before it was also Delta). Round trip was the least expensive. However, with Qatar, they book one way flights most of the time, so the ticket is divided by each way. If you fly round trip with them, it is very expensive. So one way $850, round trip $1700!

I did not know you could have part of your taxes refunded though! Do you have to do this before the ticket expires a few days before the flight....just go cancel it?



They make me uncomfortable also! Just pray over those funds and let God handle this one for you!


Do this a couple of days before your flight. Just call your airline's reservation call centre and ask them to cancel your booking and if there is any refund for the unused part. Different tickets have different fare rules, so you might be entitled to more than just a few taxes.

Just a heads up for any that in the process of purchasing airline tickets.. I work in the reservations department of an airline and 90% of the time it will be cheaper to buy a ticket with a return than it is to buy one that's one way.. You just never use the return flight and you can claim a refund for some of the taxes of the unused part of the ticket.

Firstly you cant cancel just part of your ticket before you begin your journey. As others have mention you can call up the airline before your travel date and inform them that you are not travelling. As i am sure you are aware, you ticket is non-refundable because it is a cheaper fare. But you can still get a refund for unused goverment and airport taxes.

Secondly, customs actually have no access to your return travel information, thats why at every POE they ask to see your return ticket, as proof that you are leaving. If they had access to that info, they wouldnt ask for it. And since you will be entering on a K1 visa, they wont even ask to see your ticket information. And in the instance they do, just say it was cheaper.

You cancel the return flight after arrival in the US and before the date that return flight is due to depart. The airline will not cancel it for you before you use the first flight. You can cancel anytime after arrival in the US and before the return date. As far as the carrier is concerned you could just not turn up for the flight, but you may have a problem later with immigration who may think you left on that flight and abandoned your visa, so it is better to cancel it rather than just not turn up.


You will not get in trouble with immigration if you dont cancel your flight. The only way immigration will receive any kind of information about you being listed on the flight, is if you are checked in and boarded.

I did all of ours on Microsoft Powerpoint. Titled each page with the vist and date e.g G's visit to Maryland MD on February 2012, and copy pasted 3-4 pictures of us on that trip with a smal description of where and who is in each picture underneath it.

Didn't print it on photograph quality paper, just high quality on normal A4 paper.

I was thanking you for your apology, not brushing it off. I never stated any upside or downside to anything. And I never implied anyone was at fault except the USCIS.

All I was stating was the fact of why CR1s are naturally longer than K-1s due to the two step process. That's it.



 

First of all congrats to all K1 filers that have been approved and regardless of the time frame. For me an approval whether its a K1 or a CR1/IR1 just means there is one less file at USCIS needing to be adjusticated.

 

I agree with you Leon & Mylen, the CR1/IR1 visa does take longer due to the fact that essentially it includes the AOS step before the issuance of the visa.

There is no debate that the spousal visa typically takes approx 3-4 months longer than a K1 visa. But that is for the whole process, from fiing your petition at USCIS to visa issuance.

 

USCIS at the moment holds the same national goal for both K1 and CR1/IR1 petitions which is 5 months. They are more than upholding that goal when it comes to K1 filers but with the spousal visas they are very far off it.

If you compare the I-129F form and the I-130 form, the information required is basically the same. The evidence required differs alil, as a marriage certificate is needed for one and a letter of intent for the other.

So i will hazhard a guess here and say when it comes to the USCIS part of the process, there isn't an extra step for the spousal visa over the fiance one.

 

The CR1/IR1filers' frustration is that there is no balance between the two. A spousal visa filer is aware that the process does take longer because of the type of visa they have petitioned for and I don't think they would mind (myself included) if K1 filers were approved in 2 months and they were approved in 4. But right now, as things are K1 filers are approved in 2 months and less and CR1/IR1 filers have at least an 7 month wait.

The airline always corrects the manifest. If a passenger is not on the flight, then their name will not be on the flight manifest. That a reservation is shown on the airline's system, under the VJ's member's name, is different thing.

Working for an airline for the past 10 years, it is unthinkable, against the law and airline regulations to not have a correct flight manifest.

 

Though as TBone mentioned it is best to contact the airline before the date of departure of the return flight and cancel it. If you have not done that, contact the airline's customer service and request a statement from them, that you did not travel on said date and time.

Though I haven't been issued a K1 visa, I have seen many travel with the airline I work for. You won't have any problems travelling with a one-way ticket.

 

Should your check in agent ask for a return ticket, just tell them that your visa is a fiance visa and you don't not require a return ticket. It might delay you at check in for a bit until they verify with their supervisor and such but thats about it.

Just make sure you are at least 2 hours before your flight at the airport to make sure you have time to deal such snugs, should they happen.

I would try to calm down, you are stressing yourself for nothing. Your CEAC status shows AP because your visa still has not been issued.

 

You mentioned that the embassy received the Hong Kong police certificate on Jul 30th, that was on Wednesday. Lets assume that envelope was not opened till Thursday. So it has only been 2 days, Thursday and Friday, that the embassy has had the police certificate. 2 days is not something you should be freaking out about.

Give them some time to actually get to add the police certificate to your case file and then forward it to the correct department so that your visa may be issued.  I am sure you will hear something by the end of the week.
