From what I have been reading, Uscis did say that most files will be sent to service centres and some will be adjusticated at NBC.

However by looking at the March 13 filer threat it seems they are now starting to transfer end of Mar filers. Maybe you will be getting your transfer notice this week.

Like others before me said, it is illegal to use a tourist visa for the sole purpose of entering the US to adjust status.

 

Lets say you dont care and you try anyway. What will you say to CBP officer at POE when you are asked why you are travelling to the US? If you tell them you are there to AOS, you will be put back on the next flight to the Phillipines.

If you lie and tell them you are just visiting your husband, and then file for AOS... that lie could come back to bite you in butt when you AOS, worst of it being AOS not being approved and you deported.

 

If you have a tourist visa, just visit your husband for a couple of months, but come back to finish the process at home. You are relatively lucky with having filed in Sep. USCIS have started to move things along and hopefully you wont have an 8 month wait ahead of you.

We communicated through skype - longgggg calls that would last for days (My laptop is a trooper!) lol

 

We met on a site called BLOGTV but that site is gone now unfortunately sad.png

 

We don't really have chat logs and never used email. I do have emails from his mom though that she's been sending to us for the past 1.5 years that he has been living here in Ireland with me?

 

Will i need to print out the proof of calls? Our names weren't our actual names on skype though, we used nicknames.. will this matter?

 

 

I may have phone bills.. will have to have a look! smile.png

My husband and I also don't used our real names in any of our communications or on our day to day lifes, we use nicknames. We just included a note on our cover letter with the I-130 package. Hope that helps.

 

Please note: On all of our online corrispondence and day to day communication, we both use our nicknames, neither of which are legal names. B**** is used by myself, the petinioner, (husband's full name) and G***** is used by the beneficiary, (my full name).

Dont worry too much about showing co-ownership or co-mingling of finances. USCIS knows that newlyweds that live in separate countries will not have had a chance to do that yet.

We didn't have anything on both our names either when we sent in our petition, since then my husband has add me to his life insurance, to one of his bank accounts, and on his car insurance. We will send all that in when we get to the NVC stage so that it can be included in our file.

Though many members here on VJ, have been approved without such evidence.

Pictures of the both of you when you are together, with family, friends etc. How do you communicate with him when he is on the oil rig? Texts? Emails? Calls?... Include example printouts of all over the course of your relationship.

Boarding pass stubs from when you go to visit him and passport stamps.

 

The fact that he is on an oil rig shouldnt be a problem. Most of us on here arent living with our spouses either.

Hi everyone,

my husband is in the process of putting the documentation together to send in the I-130. We wanted to send it off tomorrow, but now I am not sure we will be able to. My question is regarding the Final Divorce Decree. As he has one from his previous marriage, which states that it is the Final Divorce Decree and was signed by the judge, however, it's not a certified copy. Upon looking at the instructions on the USIS site, it doesn't state that it needs to be certified, but I want to make sure before we send in the paperwork that it would be fine. Has anyone else sent one in signed by the judge (but not certified) and got approved?

For the USCIS stage you need just a photocopy of the certified divorce decree. A real certified copy of the decree will be needed for the interview stage, which is quite a few months down the line.

You can put none.. it amounts to the same thing.

 

SInce she does have a child, you need to complete a I-130 form for him/her as well a payment fee.

 

Look at this example I-130 form. It will give you a better idea.

I want to send the I130 this December, but I have a few questions that I don't understand.

 

Question #15

Name and address of present employer (if any).

If she does not have a job, Do I have to put 'NONE' or 'UNEMPLOYED'

 

For name of employer put "Unemployed" for address "N/A"

 

Question #17

List spouse and all children of your relative.

In this question, Do I have to put my name as his husband?

Yes. You add your name as her spouse and the name of her children if she has any.

 

Question #18

Address in the United States where your relative intends to live.

Do I have to put the address of where we are going to live together?

This is the address you will be living together in once she moves.

 

Question #19

Your relative's address abroad.

Do I have to put her address?

This is her address in the Dominican Republic.

 

 

Question #21

If filling for your spouse, give last address at which  you live together.

Only I have visited her, we have not lived together.

 On our petition we wrote. "Have not as yet resided together"

Yes.. unfortunately it does take that long and longer. My husband and I filed in Aug and we arent expecting anything to happen any time soon. We are resigned to the fact that my visa will be issued somewhere in summer of 2014... god forbid if not longer!

There is no fast or easy way of doing this.

 

Another poster mentioned a work visa. It is an avenue you can look into, but work visas are hard to come by. You'll have to find a company that is willin to sponsor your work visa and then get lucky that a work visa is available.

 

As for visiting your husband while you are waiting, you can, just make sure you have ties to spain eg. a job, an apartment/house etc.

I don't know but i think if it transferred there website will say or an hard copy

 

If it has been transfered, you should have received emails stating to that affect, or mostly likely it should say it on the website.

 

And if you have been transfered you would be the first April 13 filer to have been. You can always call USCIS and ask to speak to a tier 2 person and ask where you file is at the moment.

I am sorry to say this.. but you are not the only one. USCIS has not started to work on April 2013 petitions as yet. Only that have been transfered are Feb and Mar 2013 files.

 

Look at this. All people posting are April filers just like you.

Wait alil longer. USCIS is in the process of transfering April filers. From what I have read on the April 2013 thread, you should expect a transfer of your file to either NSC, CSC or TSC in the next week or so.

 

Look up the April 2013 thread and read the last few pages of posts.

As apple21 said, just use your married name in all forms. However make sure you get your name legally changed to your married name in Chile before NVC stage and the interview. Your green card will be issued based on the name that is on your passport. So even if you complete the forms in your married name and your passport is in your maiden name, green card will be issued with your maiden name.

Yeah I'm trying to get the money together for it. It's $680 which isn't that easy to come by these days. It's been expensive traveling to the US the last year, so money is unfortunately something that's holding us back right now.

some countries doesn't allow. yes, you can have dual citizenship - some countries don't allow though. i think one of them is japan, but then again i don't know what rules they have. i have cousins that are japanese citizens, and will be asked if they want to keep it when they turn 18 (they're in another country now, mom's not japanese)

She currently has a Korean Citizenship, but has never been there since she was a baby and got adopted into the US. Unfortunately Denmark doesn't allow dual citizenship, but I think it should work with her having a US and me a Danish, and both of us permit to live in the other country. But she has no problem giving her Korean citizenship up for a US one. It's just the money it costs to apply that's holding us back on that.


apply for her citizenship first, maybe you could help her with it? after she gets her US passport, she can visit you and both of you can decide where to permanently live; or to apply for a fiancee visa, but that's the best for now is for her to get naturalized.

Hi. I'm a man (early 30's) from Denmark/Europe, who has fallen head over heals in love with a woman (late 20's) from Los Angeles who's a permanent resident. We have been together for about a year now whenever I have been able to travel to LA to see her. So far 4 times, and now I'm starting to get warnings when entering the country (which is understandable enough). We are getting her passport (Korean) renewed very soon, so she can come to Denmark and visit me, but what we would like even more, was a way for us to be together more than 3 months at the time. Marriage... we have talked about it, and this is something that we both really want, so that seems to be the next step. I'm not sure what is best though... getting married in Denmark, or in the US. We don't want her to loose her permanent residence status, so we're also trying to get the money for her to apply for her US Citizenship. She has been in the US since she was adopted as a baby, but her parents never applied for her citizenship, and they didn't tell her she wasn't a citizen until after she had already turned 18 (long and sad story). Anyway... can anyone please help us figure out which would be the best way for us to be together?

These are our options as I see them:
1. Get married in the US. I keep my Danish citizenship, we get her an US citizenship, and I become a permanent resident in the US?
2. We get married in Europe (Denmark is hard, but Sweden/Germany should be easier). We get her a US Citizenship, or maybe a Danish one? Still... we don't want her to loose her US Permanent Resident status, and that seems to be likely to happen if she spends to much time away from the US.

PS. We don't really care if we have to live in one place or the other for a while, we just want to be together. We do however care about her not loosing her Permanent Resident status, and I don't want to loose my Danish citizenship (which shouldn't be a problem).


it would be best to apply for her citizenship first, after she gets naturalized, apply for a fiancee visa; that's the best way, in my opinion.:yes: you can always apply for her danish citizenship later on, but if she has 2 citizenships now (you say that she still have her korean passport) she might need to revoke her korean citizenship. i am an italian citizen, i will apply for my husband's italian citizenship after 3 years of marriage.

I just returned home from my Infopass appointment at the Dallas Field Office and I feel like it was a good one.  My case is on the I-130 unit's supervisor's desk to be worked by her. It was there already which is very rare according to the IO that was assisting me.  She said that the supervisor usually doesn't work cases.  My IO spoke with the supervisor who said if there's nothing wrong with my case it should leave her desk soon.  The IO couldn't offically say how long, soon would take, but she suggested that I start checking with the NVC and also for online updates in about a week.  She also said if I didn't have an update by four weeks that I needed to call the 800 number or come back on another Infopass appointment.  I'm making an appointment now to be sure that I have it near the four week point just in case.

Hi there! I am filing a petition for my husband and we're both filling out Form G-325A right now and I'm needing help on these questions:

1. My husband who is the beneficiary and is in the Philippines is trying to figure out what should he answer on the question, "Applicant's residence last five years". He was born in the Philippines and after 5 years he went to Saudi Arabia and studied there from grade school to high school and came back to the Philippines for his college, he never came back to Saudi. Between the period that he was in Saudi, would that be considered his residence as well?

2. He's also having a difficulty answering this question, "Applicant's occupation abroad if not shown above". Abroad means where he was at outside the Philippines and that's Saudi, right? He was a student and never worked there before he came back to the Philippines so the answer is student, if i got that correctly.

Any help would be greatly appreciated. Thank you so much :)

I have a question regarding the applicant's residence last five years on form G-325A. My husband who is the beneficiary and is in the Philippines doesn't have any idea on how he should answer this. He was born on June 1987 in the Philippines and went to Saudi in the year 1992, studied there from grade school to high school. He came back to the Philippines (same address where he was born) for his college and never came back to Saudi.

Should he answer that question in this order: His present address in the Philippines where he was born, then his address in Saudi, then again his address in the Philippines where he was born. Would this be okay if writes 2 the same address?

Please help! My husband and I did the DS 260 online on the 21st of this month. My husband (the beneficiary) emailed the supporting documents after we completed and submitted the DS-260 online but this morning my husband received an email from NVC saying that "the principal applicant's assigned U.S. Embassy/Consulate General does not participate in the National Visa Center's Immigrant Visa Electronic Processing Program. Therefore all forms and documents should continue to be sent by mail." My question is, do we need to print the completed DS-260 that we submitted online and include it in the package with the supporting documents. Any response would be highly appreciated.
