K-3 Spouse Visa Process & ProceduresI130/K3 Interview Questions
QUOTE (mrc1330 @ Jun 14 2008, 01:00 PM) <{POST_SNAPBACK}>
It has come to my attention from many people i know that the consulate where i am going (Santo Domingo) is very "### hole" about interviews and become intrusive and probing to the point where couples that have been married for years can seem like a fraud couple. Is there a place where i can get a list of ALL the most commonly asked questions so that i can prepare with my wife for our K3 or I130 interview (whenever VSC decides to move their lazy asses).

I'm curious about filing for a K3. I understand the list of documents to be sent in with the I-130 but what is a little confusing is the "Evidence of a Bonafide Marriage" Re: the six items listed below.

I would assume most new spouses are internationally located and recently married so any leases, joint ownership of property, joint financial resources, perhaps even having kids togehter etc is like putting the cart before the horse and you wouldnt have those as a couple already, as a general rule. It's pretty easy to show a Marriage record but what items are other folks using to meet this requirment? I mean she is there (in another country) and your here (in the US) waiting to bring her here so it's not like you're able to set things up in most cases without here being in the US. Thanks

I am in the same boat. I was married to my husband in May of 08 and we don't have kids together yet. I sent all the required documents and for the "Evidence of a Bonafide Marriage" I sent:
~pictures
~Letters of Affidavit from people who where at our wedding
~My own affidavit stating our marriage was not done for immigration purposes
~copies of western union transfers
~a few copies of emails, letters, and phone records

As Pushbark said I don't think all those things are really necessary but I preferred to be over prepared. Good luck on your process good.gif

I agree.. We sent the same evidences except the highlighted one. Good luck!

Ialso agree. Your signature on page 2 of the I-130 petition is certifying the same thing as in the highlighted affidavit.

Another thing I thought about tonight is you should try and start to build credit.  Once you get the social security number either go to your bank or through some place like Capitol One and get a secured credit card.  Once you have the secured credit card then put the gas when you fill up the car and do that once or twice a month and then pay the bill in full when it comes.  Sometimes I think the building the credit should be pinned someplace.

I talked with my bank and credit union and both suggested doing pretty much the same thing.  They said to set up her own account and then have her take out a small secured loan of about $600.  Then we should set up autopay to pay the loan off from her account in six months time.  My credit union said if we did that at the bank and credit union at the same time, she would have good credit in about a year.   Edit: repeat the process when the loan is paid off.

Google Voice is .03/minute calling a mobile phone in Thailand.  The good thing about Google Voice is that you don't need to change services to get it OR add another paid service.  It's free unless you call overseas.  Another plus for me is that it allows you to browse all available numbers in your selected area code and choose the one you want.  My Google Voice number has 4 9s and 2 0s which makes it extremely easy to remember.  *I use it as my business line too due to that benefit.

ThailandBest Airline & POE for a Thai

Korean is the quickest trip and one of the top rated airlines in the world.  It doesn't cost much more than flying a US domestic airline.  I wouldn't  want to fly any other from Thailand to the USA.  They have several ports of entry too so you could pick the closest to you.

Yes, they are on speed dial. I've been calling them 2-3 times a week since June.  lol

I'll find out and can get them again if needed.  My wife has to do the police report and couldn't start that without the BNK numbers.  So I can get the birth certs again at that time.

ThailandUpdate...

Hello,

I haven't posted in a few months and thought it might be time for an update.  I filed an I-130 that was accepted back in early February.  It was for my wife and her kids.  In early June, I received our NOA2 letter of approval.  I started contacting the NVC around two weeks later and continued for two months without any update that they had received our package.  That's how long they asked me to wait before contacting NVC Research.  Once I contacted the NVC Research, they advised me that it would take up to 30 days to get a reply.  It took all of the 30 days plus a few more.  The research had found that my packet was sitting in the Dallas Field Office of the USCIS still.  (During this time I had also phoned the USCIS a few times and been told that our case was approved and should be at the NVC.)

I immediately tried to make an InfoPass appointment at the Dallas Field Office.  Unfortunately, they had no appointments even showing in the system for the first 2-3 weeks of my attempts.  Finally after almost 3 weeks, they had one appointment opening.  It was for 30 days later but I made it any way.  I kept checking for earlier appointments but never found one so waited the 30 days.  When I finally met with an agent at the Dallas Field Office, I was told initially that my case had been mailed to the USCIS back in June.  I advised him that NVC Research found it to be sitting in Dallas and to please investigate further.  This was early morning and he asked me to return to the office that afternoon.  He was going to check with the last case officer who had accessed our case.

That afternoon, I found that the officer had decided to hold my case because she wanted better interpreted birth certificates for the children.  I had never received a RFI or any other letter except the NOA2 approval.  To say the least, this was disheartening.  After all of the wasted months waiting and then another two to get translated birth certificates from Thailand to me and another Infopass to turn them in, 6 extra months had been added to our timeline.  I turned the second set of birth certificates in at an Infopass in November.  The agent said he would put my case at the top and it would be looked at by the next available agent.  He also said that since it was being held just for the birth certificates that I could expect it to only take about a week before it was mailed to the NVC.  He looked over the birth certificates before I left and said they looked good to him.

November and December passed without an email, update or any indication that anything had changed.  I had started calling the NVC after Thanksgiving.  I had the NVC Research looking again since the 2nd week of December and I contacted my Congressman's office on January 3rd.  On January 8th, my Congressman's representative email me that my case was at the NVC.  I phoned them that day and the agent said it had just been received but needed to be input into their system.  Soooo now I'm waiting on my "BKK" numbers.  I call almost every day to check but get the same 6-8 week answer.

Once I get the BKK numbers, around how long am I looking at.  I've been reading and it appears that I have about 2-3 months left once I have that.  Does that sound right to those who've recently received VISAs?

National Visa Center (Dept of State)I-864 Requirements - Started Working Mid-Year

Hi all,

My husband and I are preparing our AOS package way in advance and wanted some advice on our situation:

My husband currently has an income well above %125 poverty guideline. However, he started working in the middle of last year (June) and so his 1099 (he's technically an independent contractor although he's not really self-employed) reflects only half his income (below the requirements). He's submitting, alongside the 1099 and tax transcripts, copies of his pay stubs (with YTD amounts), a copy of his contract (stating he's working 32 hours/week @ $20/hour, with no end period), and an employment letter that'll state his yearly salary.

I'm a little bit paranoid about the incomplete 1099 though and wanted to get some opinions on whether we'll be fine or we'll need a joint sponsor. I'd appreciate any and all insight!

K-3 Spouse Visa Process & ProceduresIs Adjustment of Status Mandatory on K3?

Hrm, there is normally a special line up for NEXUS and airline personnel at the airport (NEXUS lanes at land crossings are less common.) Because you have to apply, get a background check then go for an interview, they do a retina scan at the machine and then you talk to a CBP or CBSA officer. The line ups are short and fast because you're a pre-screened traveller. You would still have to talk to a customes officer and convince them your visit is temporary for the USA but as the card is meant for frequent travellers, they really arent as worried. Having proof of your ties is always good to bring even if you are not asked (I never was, but I brought it just in case.)

That's the thing, I always go by land (Greyhound) through the Champlain CBP. I definitely think you're right and it would be worth it to invest in the card, but I just wanna make sure it'd be relevant in this context.

K-3 Spouse Visa Process & ProceduresIs Adjustment of Status Mandatory on K3?

No the procedure is a bit different. Lool it up smile.png

When I looked it up, it said that there'll be Nexus-specific machines at the border crossing, but I've never seen them where I usually cross.

K-3 Spouse Visa Process & ProceduresIs Adjustment of Status Mandatory on K3?

Many Canadians live close to the border and travel to the US every weekend or every other weekend with no difficulty. Being jobless or not in school will up your chances of a denied visit. I visited twice during immigration and had no issues but I was also asked where I worked during inspection. If you plan on visiting a lot, a NEXUS card is a great $50 investment. You're fast tracked through customs (and security in the USA).

If I were to get a nexus card, would I just hand it to the officer along with my passport?

Congrats!

Everyone I know on the East coast keeps commenting on how frigid this winter has been. Right now it's snowing in Philadelphia and the 'feels like' temperature is 7 degrees F. I was actually in Kusadasi/Izmir for the past few months, and not a day goes by where I don't say 'I wish I was in Turkey, it's waayyyy too cold here in the US.'

Changing subjects a little bit, I was wondering if anyone might be able to provide some insight into my current K-1 dilemma. I was talking to my fiance the other day (he's the Turkish one), and I was telling him about the documents that he'll need to gather in the future. I mentioned that he'll need his birth certificate, and he said that because he was born at home (not in a hospital) that he doesn't have one. He says that his only form of ID is his identity card. He actually came to the US last summer on a temporary work visa (to VA Beach) so I assumed that he would have needed his birth certificate for that, but he said 'no, I only needed my identity card.' I was also thinking that his birth certificate has to be somewhere filed away in a government records office, but again he said no, and that he never had one. Is this normal? Any input would be greatly appreciated!

Hi Nicole,

You asked if it is normal or not..of course it's not normal.I think there is a misundertood beetween you and Efe.I think he can't get the right one..
So please tell him just like this, if he goes to ''Nufus Mudurlugu'' where he belongs to (in which convicity he lives ) and if he asks his ''Vukuatli Nufus Kayit Ornegi'', the officer will give him without any fee. ( you can explain the 'nufus mudurlugu' like this also, if he loose his identity card the place he should go and get a new one.)
It doesn't matter where he was born, in a hospital or in a house. If he is a Turkish Citizen ,if he lives & works & studies & votes etc..in Turkey then he must have an Identity Card & Birth Certificate ( Vukuatli Nufus Kayit Ornegi) ,and also he has to get it translated by a translation office.(no need any apostile,do not spend more money) just a translation is enough. You can tell him like this in Turkish ,he will understand ( Noter onayina gerek yok).

Hope it'll be usefull for you.Good luck.

National Visa Center (Dept of State)I 130 petition approved

Hi

I submitted I-130 petition for my mom in April 2013, then got the approval notice in Dec. 2013. Now the case has been transferred to NVC. After waited for 30 days, I contacted with NVC and they said they will send NVC processing instructions within 30 day.

I know it will take few more months to get the interview for my mom at AIT (now she is in Taiwan).  The question is can she enter US now with the B2 visa? will this be considered of  immigration fraud? or should we just wait for all the processes done?

thanks a lot.

Lin

Maybe it's face.. I don't know but they couldn't call it a bribe in any way shape or form where it might get back to the Amphur.

ThailandSole custody of child
An acquaintance recently had to give the local Amphur a large gift and also pay the father a large sum for him to sign the papers in order for his wife to get custody and immigrate with the children. They actually paid a mediator to negotiate the appropriate gifts and payoffs before meeting at the Amphur office. Also, it was a gift to the Amphur not a bribe. Had they tried to bribe the Amphur they would have failed or possibly had to gift something much more expensive.

ThailandThe Sin Sot Issue
My wife has said it's my decision and she'll stand by whatever I decide. She married me without their knowledge on our last visit. They did find out later and were very upset. Now, they expect a proper party and sin sod when I come collect her. She has said I'm her choice and we don't have to do it though. She also said that they would return the sin sod before we left for the USA if I decided to opt for the ceremony/sin sod.

Due to her education, current job and their social station - they are asking for quite a bit even though they don't need it.

I've met them and they seemed very nice. They have never asked for money before and as far as I know, since. My wife has a good job and never asks for me to send her cash either. I have sent my wife money a few times, on my own, without any request.

My wife's family expects one. We've had many discussions about this issue and it's still unresolved.
