It has been so frustrating for me to wait for this oath taking in Fairfax office. I had my interview in June 8 & it's been 90 days since I came out of that office with the white paper telling me that I passed & my application was recommended for approval. I called the USCIS today- the 90th day since my interview to follow up the my case status since the online case status will still show me the Interview and Testing. I was told by the CS that Fairfax office is still working on November 2011 filers - that just confused me because my friend had her interview in May and took oath in August. I had a name change, is it the one that's holding my application?


Based on emails from Washington Field Office, correspondence with our senator's office, and our successful InfoPass appointment, I believe the problem is that they have to run a "name check" on the new name (they don't do that until you pass your interview). That takes a long time (maybe 3 months). Then, you go into the que for the courthouse. That took us another 3 months. They told us that they can only take 75-100 people per month at the courthouse. I know that they did schedule at least one extra session on 9/27 (perhaps related to the end of the fiscal year; perhaps related to the voter registration deadline), which we were lucky enough to be assigned to. Call your representatives/senators. That's the only way that they are aware of the problem.

I should just clarify that what I wrote about the courthouse above only really applies if you are requesting a name change. USCIS can't perform ceremonies involving name changes, has to be done by a federal judge.

Police certificate (piniko mitroo) is completely separate to court records. Court records are required if your husband has had any run ins with the law arrests, convictions etc. You need to provide court records for those.

A police certificate is ordered through the Department of Justice, and it is sent through to the US embassy in Athens, and that is after the US embassy has received your case file from NVC. This means you will not be able to include it in your IV package when you send it to NVC.

Just make a note your IV cover letter that, greek police certificate cannot be included as it is forwarded straight through to the US embassy.

We were told we were approved. We didn't get a 221 g yet. But VO never asked for affidavit of support just supporting financial documents. So we may get a 221 get asking for affidavit.

 

Yes, there is a slim chance that the VO forgot to ask for the affirdavit of support and will realise it, and you get a 221g. And???

You have the affirdavit of support ready correct? Your fiance takes it to the embassy and successfully provides what the 221g is asking for, and then the visa gets issued.

I still don't understand why you are stressing about something that is sooooo easily fixed? And this is the worst case scenario. Like many others have mentioned, there is a greater possibility of you NOT getting a 221g issued for the AOS then getting one.

This is 100% correct, but it didn't matter... and, the nonrefundable plane ticket is already bought.

I tried writing the "immigrant visa" unit at the consulate to ask why I was expected to appear, and they simply replied that the "marriage interview" is something that the consulate offers when a first interview isn't successful.

I still consider it "bait & switch," though. And, hardship is accurate -- this trip either comes from what would have been our furniture budget, or (worse) from our AOS budget. However, the consulate can claim that not springing for the extra trip would have made the rest of it moot, because they wouldn't issue the visa if I didn't show up. (New question that just came to mind: Is this not extortion, or blackmail, if this technique is performed in the world-at-large?)


With respect to the non-refundable plane ticket, . . . CALL THE AIRLINE!!! They will accommodate you. Better yet write a nice letter and explain that you've been a long-time customer, etc. and that this was beyond your control. I had no problem getting a voucher for a similar situation.

Here´s the story.

My husband I had our interview in Guayquil Ecuador on October 14th. They asked us to submit a joint sponsor (in spite of the fact that NVC had approved us) but besides that they approved us in the interview and were very polite and helpful. All we needed were joint sponsors. We had to wait for the papers to be sent from the US from the joint sponsor. DHL delayed a 3 day delivery time for 8 days...it was sitting in another city (¨being reviewed¨) in Ecuador. You can imagine that my husband and I were beyond livid.

The forms finally arrived and we sent them on to the Consulate, using the only service they accept--DHL. The papers arrived fine and we were approved and the visa was issued. Thursday the Consulate sent the visa via DHL to the closest service center (one hour away, where we were to pick it up). I received the text message and email as proof that it´d been sent.

Yesterday (friday) when calling to verify that the package had arrived to the office where we were planning to pick it up, DHL gave us the run around for nearly 2 hours and then finally told us that the DHL truck had been robbed.

I called the Consulate immediately. DHL had known about this situation for more than 2 hours and had not contacted the Consulate. I gave them the news.

My Senator´s immigration rep knows about all of this and is trying to assist us with some answers.
As of right now the Consulate is askign for us to RESEND I-864s, DS-230 and all supporting documents, and of course we have to get a new passport issued, new police report, new copy from the medical exam.

DOesn´t the Consulate keep a copy of all of that information (I-864, DS-230)?? I understand getting the new passport for the visa, but why must we have to go through the hassle of getting all of these documents AGAIN?

And add to that, DHL is trying to jerk us around and not pay for anything except the visa and passport reissuing. All of the documents cost $ and they don´t want to pay!

Sorry for unloading but I´m hoping some of you who have had similar situations might be able to offer a word of advice. I´m planning to visit the Embassy in Quito on Monday to see if they can assist at all...since the Consulate and the Embassy are different.

Any tips?

Your complete case file would have been in the DHL package so you could carry it to the POE and turn it over to the CBP officer upon your arrival. So, no, the Consulate would not retain the case file for an issued visa.


This info is exactly correct. We had to complete the I-864s and DS-230 again because of the envelope we present at the point of entry.
We got all the papers together and presented everything in person yesterday at the Consulate and they printed the visa and gave us the sealed envelope.
I´m so happy!

They told us that my husband will face an extra round of questioning because of the robbery and these replacement documents upon arrival.

A good ending to an awful story!! Keep us updated!! There wasn't any questioning in Miami for my wife, just a lot of waiting (3 hours), but it shouldn't be bad.

Here's another link that you can refer to (or have your wives refer to, as it's in Spanish). The process is called "apostillar." The document lists the USA as a country that requires and recognizes this verification.

It says:

"The necessity of certifying the authenticity of a document becomes vital when a citizen finds himself outside of his home country and needs to use documents from back home. In response to this need, one of the most important services that the MRE offers is the legalization and apostilization of documents originating from public institutions."

Again, I don't know if the consulate needs this, as that is precisely why the US has diplomats looking at these papers (because presumably they have some expertise in what local documents are authentic without needing the apositilization). But, you should consider that someday these same documents might be needed for another purpose. For instance, if your wives are looking for jobs as teachers or daycare workers. The local school board would want to see this validation. star_smile.gif

My wife just got done with her police certificates. She had to get one in two different provinces (Guayas and El Oro). This is just her experience, but you might want to have your wives check into this: she was told by the police chief that for the police certificates to have validity outside Ecuador, that they have to get a stamp from (notarized by) the Ministry of Foreign Relations (MRE). She went ahead and did this and it was $10 per certificate. Although the consulate's instructions do not mention this (they only mention the provincial authorities), we all know how much THAT counts for. whistling.gif It might be the prudent thing to do. There are three offices in Ecuador (Quito, Guayaquil, and Cuenca). The page linked below has the addresses and phone numbers (about 2/3 way down the page) for the three offices.

Guys, you'd sure as heck better consider going to her initial interview. Two of us USCs (me and Roy of Roy&katy) have been ordered to attend a joint "marriage" re-interview. My fiancee, who went alone, was originally interviewed on April 29 and was given approximately 3 minutes and the "bum's rush." She had copious "proof of relationship" with her, and it was not even looked at. The CO said, "More proof, and bring your fiance!" Note the answer to FAQ #8 on the Consulate's website specifically says quite the opposite: "Only the applicant will be allowed in the interview." Bologna.

I learned after the fact that this unpublished "requirement" for the U.S. citizen to be there is becoming increasingly common at Latin American consulates. I recommend NOT risking the success of the first interview. Furthermore, if you still decide not to attend it, I recommend against buying your fiancee a plane ticket to the U.S. anytime soon after that first interview date, because she may not be able to use it (no visa).

Our joint interview is June 30. Anyone who is interviewing earlier, for God's sake post in this thread an exhaustively detailed description of your experiences. We need to stick together on this and communicate both frequently and closely.


We will be CR-1, but I take your point. Thanks for the heads-up. That would be my 7th visit in 2 years. That hopefully would count for something.

So as long as the information in the FAFSA is the same as what is in the transcripts you send to USCIS, then you've got no problem. Like you say, filing a FAFSA is not at all equivalent to pleading poverty! When universities average $40K per year in tuition, who has that kind of money laying around!! :blink:

The post office ppl told me expedited service would only "expedite" your application by one day, meaning you will receive your passport one day earlier than routine service. Again it took me 9 days to get my passport in the mail via routine service. My passport was mailed to me as priority mail and my certificate and name changed court order were 1st class mail in a priority mail envelop lol


I think what they were referring to was the express MAIL service (overnight), which is one day faster than the priority mail service of USPS, and costs about $13 more. The expedited service at the government passport office, which costs $60, reduces the time by 1 to 4 weeks, based on the times posted on State's website.

Our experience leads me believe the VA DMV person is correct. My wife's first license, when she was still conditional, had a number "9" in the "Restrictions" field. The expiration date of the DL was the same as her first GC, ie, two years after her entry. As it was expiring, we went back to DMV with the NOA for her ROC (which extended her conditional residency for a year) and they extended her another year. The same "9" showed up in the new licence. As the expiration on this second license approached, we went again (recently) to the DMV and she showed them her new 10-year GC and got an 8-year extension on the license. But, this third license doesn't have a "9" in the license's "restrictions" field. To me, this means that as long as they can extend you for the normal 8 years, it doesn't matter at all to them.


This has nothing to do with registerig to vote, I've already done that...they were actually at our Oath ceremony.

I could swear it has been recently recommended here in this forum that you visit the DMV after gaining citizenship because they track your residence status as well and since is your main form of id most times, you wouldn't want someone scanning your state id/license and thinking falsely that you are NOT a citizen .

Early biometrics is super-easy at Alexandria. Did it twice (once for ROC and once for N-400). For citizenship, I think it does help because the day after, we got an email saying that we were put in the queue for interview. But, check past threads for the sad state of interview delays at Fairfax office. After you get the "in the queue" email, you will have to wait perhaps five months for an interview. Four months until you get the letter and another month to prepare!

Did you get to take the EB? And how soon after did you get your interview date? I received my date for my Biometrics test and after reading other topics in this forum, I may get the interview in December. That time I will be nearly 9 months pregnant and hope I don't have to reschedule date if i go into labor. I just wanted to see what everyone's experience was. Thanks in advance.

Two of the three May filers got letters recently and you're the third, right? :blush: I think your difficulty is that you didn't get put into the "queue" until August for some reason. So, unfortunately, it is possible that you may have a couple of months to go before you get your letter. :unsure: We filed in mid-July and got our email about being placed in the queue for interview about a month later, right after our biometrics appt, . . . at about the same time that you got your queue email. Based on the two May filers that did get their letters, it is about 4 months from being placed in the queue to getting an interview letter.

At what stage of application, you do the name change?


Part I(D) of the N-400 application. Then they ask you about it at your interview. If you still want to do it at that point, it is my understanding that, if you pass your interview, the name change is done at the oath ceremony. Those doing a name change have to go to a federal district court for the oath as the USCIS cannot do a name change. So those doing a name change have to wait for an oath date at their local district court. Our district court (EDVA) does naturalization oath ceremonies on every 3rd Thursday. Others not doing a name change can just do their oath at normal USCIS facilities.

Chap 74.2(a)(2)(6), states that "If the applicant’s PRC is about to expire, or has expired, you will need to take additional steps." It then references Chap 73.1, which doesn't appear to say anything on-point. But it seems that PRC can expire.

If he was a citizen all these years, he may get an unpleasant letter from the IRS telling him that he owes some back taxes on his foreign income. For our native-born citizen infant daughter. By the way, her photo was absurdly bad--I can't believe that I paid for it. It was out of focus, head too small, neck turned, but they still accepted it. Never again will I pay; found I can take the photos myself and print them at a local CVS/Walgreen/RiteAid kiosk (using State Dept website app or ePassportPhoto.com). Already did that with my wife's photo.

[b]Got a call this morning from an IO regarding the confusion about the oath ceremony... they have scheduled my alien husband :lol: for his oath ceremony on Jan 20. I changed the list below but am adding this comment because several things impressed me about how this was handled:

1. They admitted that someone at USCIS had made a mistake (by telling us to come back for the oath later the same day of the interview)
2. They apologized at the time, in a message on our voicemail a day or two later, and again today.
3. They called to tell us when/where the new date was, even though they will be sending the info in the mail.
4. The IO who left the voicemail message also left a phone number!! :o
5. The IO who left the voicemail message (also the same one who called back today) volunteered that he has been through this whole ordeal with his wife, and was therefore empathetic. He was.

All in all this snafu with the oath ceremony has been really refreshing! :P
