My fiance received his K-1 visa in the mail today along with the sealed brown envelope that recipients are instructed not to open. Our problem is that on the envelope above his case number his first name is written next to a not just misspelled, but completely wrong last name. It seems like a pretty safe bet that this is going to be a problem once he arrives in the US and I have already e-mailed the embassy about it. But my question is this: Does anyone have any experience with how long it takes to fix these types of problems?

When my fiance was at his interview in Delhi he got served a 221(g) with the following documents requested. There are at least three other people on this forum who have gotten this same doc from Delhi, so you may want to be prepared:

1. Notarized explanation of how and when you first met and why you decided to get engaged
2. List of all engagement ceremony guests, their relationship to you, their addresses and phone numbers. Please do not include immediate relatives.
3. Photos of you and the petitioner before, during, and after your engagement
4. Notarized statement signed by the applicant’s parents stating they approve of your wedding
5. Notarized copy of your fiance’s passport
6. Voter’s ID card and voter’s lists for the past 5 years for the beneficiary

We are already married. Have been for a year now. Our wedding was in India and his parents, family were there.

Is what you gave me for K1 applicants? I can understand the scutinizing since you are not married yet, but do you think notorized statements from my parents /friends who did not attend the wedding but believe are marriage to be real be OK? We did not have an engagement party. Since I am the petitioner, I should provide the notarized copy of my passport and India visa?

My husband has a voter ID card. Where would he get the voters lists for the past 5 years? Why would they want that?


Yes, this is for the K-1 visa, although I'm not sure that cases for married people are any less closely scrutinized... I definitely think that notarized statements from as many people as possible is helpful - we gave more than what they asked for as well. I'm sure if they ask you for a list of party attendees it will not be for the engagement party but for the wedding.

You may not need to send a notarized copy of your passport or his voter's id card, but it is good to have that stuff on hand in case they ask for it. As for the voter's lists, I have no idea why they ask for it. Part of me thinks that they are just trying to make the process more difficult to weed uncommitted people out, or perhaps looking for pretexts for rejections. The lists can be very difficult to get and there are almost always typos and inaccuracies in them. Ultimately we were able to supply lists for three of the last five years (they didn't even make new voter's lists for two of them) and then got a signed note from the local sarpanch explaining that even though his birth year was a bit off and his father's name was misspelled it was really him. But you may not want to bother with all that now though as it is a huge headache and I don't think they ask most people for it...

Below is a list of questions that I came across doing pre-interview research. At my fiance's interview, he mentioned that they asked him when we met, why were marrying in the US instead of India, whether we had any engagement function, and whether his family was accepting of the marriage.

Questions often asked at Embassy in Delhi

• How did you meet?
• How did the relationship begin and when did the engagement happen?
• What is your occupation and the occupation of you fiancé?
• When did your fiance come to India?
• Did you have any engagement like function? Why not?
• Where will you live in America?
• Why do you want to get married in US instead of India?
• Did your family and your fiance’s family approve of this relationship?
• Will I marry once you are in the US? When? Who will attend the wedding?
• Do you plan on working when you get to the US?
• What is your fiance's age?
• What is your fiance’s date of birth?
• How did you keep in touch with your fiancé when you were apart?
• What are your parent’s names and what did they do for a living?
• What are your fiance’s parent’s names and what did they do for a living?
• How do you plan on learning English?
• How will you reconcile religious issues? (i.e., Will you or your fiancé convert? How will your children be raised? What holidays will you celebrate?)
• Where do your fiance's parents live?
• What do you love about your fiance?

Yes, Delhi has some really awful stories of these kinds. Sorry to hear what your fiance had to endure.

About your question, no, he won't be asked for a second interview. Your fiance has to submit all his documents at VFS within 4 month expire period of your approved 129-F.

As others do, just make sure you load them with all the papers possible, don't just take affidavits from parents, but also take affidavits from friends if possible.

All the documentation which were asked from your fiance, it seems like he has a common Muslim name, so even though you submit all your papers at VFS, please still be prepared for AP (administrative process). Since CO was insisting on names and things like that, it is very likely that your fiance may be put for extra review.

ETA: CO must have provided your fiance with a paper, 221-g, which should have list of all the documents asked, so do go through it properly.

My fiancé just had a horrible experience with his k-1 interview at the New Delhi embassy. The interview was incredibly rude and even ordered him to “stop smiling” during the interview (he is a good natured fellow who almost always has a smile on his face). The interviewer found nothing whatsoever flawed in our documents, but is still demanding tons more materials from us, including, among many, many other things, voters lists for the past 5 years with his name on it to complement the half a dozen other forms of identity proof he has already given, and notarized statements from our parents saying that they approve of our marriage (I am 28 and he is 31!) They also demanding more proof of relationship, when we already have given boarding passes, tickets, pictures, and reservations for a trip we took together, a skype call log showing long daily conversations extending back almost a year, and boarding passes from four different trips he took to visit me while I was away in another city for the summer! And this is India, where many of these petitions are for arranged marriages in which there is no past relationship at all! I’m getting very frightened that they are just looking for an excuse to reject his application. He is Muslim, so part of me is concerned that that may be a factor as well.

Have other people had these types of experiences with demands going above and beyond the basic requirements put forth at the interview? Should I try to hire a lawyer or is it too late in the game? Also, no one even bothered explaining to him whether he will need to come in for another interview after submitting the materials. Does anyone know what the standard process is?

Both of us are feeling pretty crestfallen and vulnerable right now, so any advice or even shared similar experiences would be much appreciated...

Last summer I bought a two month health insurance policy from a Danish company http://www.ihi.com/english.asp because as an immigrant I was not eligible for a UK travel insurance policy, nor was I eligible for coverage under my wife's US employer policy until after we were married. I think I paid about GBP150 or so. Thankfully I did not need to use it, but it provided peace of mind.

Cheers me dears for adding your recommendations, there's nothing like local knowledge. Kath I feel your pain, it must be difficult to find somewhere in the midwest that will do you a proper Aussie pie floater. You can buy tins of Batchelors mushy peas and frozen meat pies from the British Pantry in Aldie, VA http://www.thebritishpantry.us but I'm not sure how they'd do shipping for frozen goods. Worth giving them a call I reckon.

I admit I do enjoy the seafood here on the East coast. There's a terrific fish market on the DC Waterfront where you can buy all manner of fish from boats tied up alongside. They'll steam shrimp and cover it with spicy all bay seasoning, a bit messy to eat but scrumptious and cheap. I've also really enjoyed eating fried oysters at Iggy's in Warwick Rhode Island, the all you can eat lobster supper at New Glasgow, Prince Edward Island, and cod and scrunchions on Newfoundland.
