They're probably working on them. They didnt start approving the 02/11 transfers until about a month later...give them a week or so and stay positive.

hi AntandD, it's sad that VSC/CSC has put you in this position because you are one of the nicest people in this forum. With that said, I think your choice boils down to whether your feel comfirtable traveling with the letter of extension or not. I'm saying this because if you are traveling for only about a week, that does not matter too too much as far as RFEs and Interviews go since they'll give like atleast 2 weeks before you can get back to them. My advise is to wish for the best and prepare for the worst. But of course, I wish you all the best and an approval. I'm hoping that you'll get your approval letter within the next week or so and enjoy your time in Canada without having to worry about your GC.

If you applied to CSC, that's how they've been doing approvals for weeks now. They've been sending approvals via mail, no change on your online status. But they'll probably get to that at some point.

Thank you so much for the advises and kind words. I'm not sure if they'll ask me for more evidence since the marriage was short and I already submitted the lease, joint health insurance, tax return, joint cheking account, plus few other evidences and copies of cards. Although we were interviewed for the AOS, another interview is very possible. I had talked to him about this during the divorce and he expressed interest in supporting me by showing up in case of interview, but then things have gotten worse since then so I am not sure. I guess it's wait and see...But I'm glad it's CSC instead of VSC. Go CSC! good.gif

Hi Ant, your post is entertaining, not to be laughing at your pain. I'm actually in the same baot as you, as a 03/02 transferee. The only difference is that I'm a waiver filer so there's a possibility that they'll take thier time with my file, crying.gif I dont really know how CSC is with waiver filers...

First of all, I am so sorry to hear about your situation!

It seems to me, you have good documents to prove the abuse, but make sure your documents cover your not only the abuse aspect of the marriage but the marriage experience throughout. By this I mean, pictures, activities during the time that you two were happy together.

As far as decreasing your lawyer costs, if you feel that you don't need guidance on what and how to file I-751, you can submit it yourself without lawyer- reporesentation. And, if they contact you for an RFE or Interview, you can hire a lawyer to represent you. Some lawyers are willing to do consultations, which means consluting you on the case but not representing you, for a lesser cost.

btw, my case was transferred on 03/02 as well, and I doubt that they have started working on those yet, let alone mailing them...but you can never be too sure. If you look at the list under the VSC to CSC tranfers topic, they are currently working and mailing the 02/25 transfers. So hopefully they have not yet mailed yours yet.

I say contact an immigration lawyer soon, if you can afford it. Legally, no one is allowed to hold your immigration infomration from you. So if you have a lawyer, he/she can check with CSC on the status of your case deeply and help you move on without messsing with the law.

And, for what it's worth, change your address to your current one with the post office and with the DHS.

Based on past experience of what I've seen on this site, this means they have passed it on to the local office for an interview. Some applications are randomly choosen for quality control or if you filed with a waiver request. It's not neccessarily a bad thing but prepare your evidences to take with you in case of interview.

Did you file with a waiver request? (you dont have to answer if you dont want to, I'm only askin since I did so and I havent heard anything from them yet...although I filed in August 08)

opps, could also be your notice of transfer to the CSC office...which is not a big deal.

Which service center did you file it to? VSC or CSC? If it's CSC, they may already be working on your case. From what I've read on this board, you have to withdraw their jointly petitioned file then replace it with a new one as waiver filer. But you have to get a divorce before you can do this and you need to send the divorce decree with your application. Waiver filers are usually called in for interviews or get RFEs, and the wait seems to be longer compared to joint filers. As long as you can prove that you entered the marraige in good faith, and a divorce decree it should not affect your approval, it's just a bit tougher than the process for joint filers.
