Hello People:

I had my interview this morning. Here is a quick summary of my situation. We were married back in April of 2006, got my temporary resident approval (temporary greencard) approved February of 2007. We got divorced October of 2008 and I then filed through a lawyer, removal of conditions based on "marriage in good faith" and got my NOA in December 06, 2008. All was sent to VSC.

I recieved my letter asking me to come in for an interview May 22nd 2009 for 8am June 10th (today).

I got there around 7:20am and waited for my lawyer who met up with me around 7:45am on the third floor of the Atlanta DO.

Then at 8:10am the immigration officer calls out my name, looks at my lawyer and was like "Oh lord its you again" (Jokingly)

We sat in her office, she confirmed my name, date of birth, address, when we were married, my ex-wife's full name, and her date of birth. She also asked for my phone number which I had given her the old one and then told her I had a new number.

She looked at me and was like "how you goin' give me your old number what if I wanted to call you" and we all laughed.

She then goes "ok, now tell me what happened that lead to y'alls divorce because to be honest I havent even read your 3 page sworn summary.....and in a nutshell please, no details!"

So I tried to narrate as much as possible. Then she looks at me and goes..."Alright what the heck, I'll believe you." Then she stamps my documents and gives me a letter stating my conditions had been lifted.

For the next 10-15 minutes the conversation in her office was about her delayed retirement and how she cant wait to get the "heck outta this place!" (lol) She then told my lawyer "tell your dad I said hello." And I was asking my lawyer about the delay in the production of the cards, which he attested to because of the upgrade in equipment. He now turns to the immigration officer and asked her about this delay issue and her response....."Oh there is a delay? They didnt inform us." We laughed at her.

And that was it. My "actual" interview took less than 10 minutes, the rest was spent on side talk.

To God be the glory because it has been a very rough year in my life.

I say just go in with faith and when your marriage is genuine, there is nothing to fear and always remember....you dont have to memorize the truth.

Mine was a divorce-waiver, I had to check the box that said, "I entered into the marriage in good faith but the marriage was terminated through divorce or annulment."

Do you guys think we should have a time line thing like the others?

I dont know how to do those, so if you like tha idea, someone has to start it.

Hi Sara9, thank you for starting this discussion. I'm a waiver filer transferred from VSC. My application was accepted in early August 09, and transfered to CSC on March 02, 2009. There was a touch on March 05, 2009. And nothing since then.

The joint waivers who applied months after me are getting approved after being transfered to CSC. I am sooo happy for them but also furstrates me a little bit.

Have you called them about your case?

After 14 months of waiting and an interview in early August, I got the email update saying that on Sept 21, they orderd the new card to be produced! I am sooo happy. Although it is kinda wierd that they didn't send the approval notice first.

Did you have a immigration lawyer when you applied?

Regarding the letter from my ex .... no way ...
I divorced him on ground of abuse. He did and would do anything he can or could to screw me.
That's the kind of guy he is ... I guess I just have to prove that to USCIS....


If you divorced him on grounds of abuse,you should send proof of that, along with the divorce decree, I think I read this somewhere on the form...but you probably know that by now. I'm sorry to hear about your situation and hope thigs go well for you. smile.gif

My list is short since we are both young, dont really have property together or not, and were married for under a year. And that is probably why interview was inevitable my case.

Since you got your GC in September 2006, I will be looking at a decision sometime soon, or some where in the September 2009 area. Good luck. Why had you to wait to apply to remove conditions. You could have filed as soon as you got your decree. biggrin.gif


I didn't really have the chance to file before the 90 day window opened since my divorce didnt finalize until a few weeks before the expiration of my conditional card. The divorce took much longer than it should because of stupid reasons, e.g. the lawyer taking a vaccation, and my ex husband filing out the form wrong- he also lives in a different state now so we had to mail things back and forth. Any ways, I'm thankful to God that it was over before my gc expired, although the lawyer said that I could have still filed for removal of conditions event after my conditional gc expired.

I-751
copy of my green card
copy of wedding certificate
letter explaining the situations that led to divorce - notorized
copy of joint lease
letter from health insurance provider showing that I was included in my then husband's plan
copy of debit cards from our joint checking account
tax income return, filed jointly
pictures
joint mailing labels

I was going to include a notorized statement from my ex-husband but then the divorce arguements left us not wanting to speak to eachother and I was running out of time...I filed my petition few weeks before my GC expired. But if you can get that, that would help you a lot.

Again, thank you guys for putting your thoughts into this and the good luck wishes.

Anamaria2009: She didnt ask those questions, the only "straight forward" question she is asked is that "did I get married for immigration benefits?" She had asked me earlier, why did you guys get married, and I anwered because we were in love, and since we have been together for year, he had moved from his home state to be with me, we thought we belonged together. However, when she asked me that it seems like I got married few months/weeks before my student status expired and went to adjust my status right away, then I told her that once I said yes and we got married, we had to work toward making me legal here. So I would like to clear up the confusion. There were two questions, 1. why did you get married, 2. since you got married before the student status expired, did you do it for the immigration benefits.


Milan Kudrak: It's my mistake that I did not mention one of the questions in part II, which was: why did you get married? My answer to that was like I said above in my reply to Anamaria2009. So I hope you understand what I was trying to explain to her by saying that once we got married, we had to start the immigration process soon. She had a wierd reaction when I said that I was looking for jobs anywhere, more interested in my career that which country I stay- I studied international relations.

lailaa: I think you bring a good point in that if she is thinking of my address in longterm terms, it could mean that the petition will continue to be under review for a while. Me and my ex husband got into an arguement during the divorce process and we have not really spoken since then. But he has said throughout the marriage that it really sucks what we have to go through to just adjust my status and was fed up with them. Shortly after we separated the, I reminded him that my status depends on the marriage so that will be a problem...I remember him saying that despite the marraige falling apart, he wishes me well in that aspect and is willing to show up for interview with me if that helps. So I respect that aspect him. I think event if they call him he will just be so pissed with them and tell them that he is my ex-husband, and we had a bonafide marriage- with or without me tipping him off. He always said that they are ripping us off by taking so much money away for the forms and such.

sara9: Thank you so much for explaining the process of how to argue after they say no. I do know that they can't do anything unless a judge rules agains my case. I just dont want it to get all complicated and cost me a lot of money. My ex husband and all of his family will testify for me, so that wont be much of a problem. The thing is, I had a true marriage, burned through a divorce at a young age, so I just dont want anymore drama. I do beilieve in God, and he has never let me down. Despite it all, I thank him for the good life that he has given me and prey to him to keep protecting me.

Thank you guys for the good luck wishes! I think I need it as I await for the decision via mail. I'm happy to help by sharing my experience on this process. I wish someone had done for same for me.

Anamaria2009: I only had a divorce decree, but the comlaint is part of the divorce decree, the divorce lawyer said that's how the county does it or something like that. We got separated because we could not get along, he was diverting from our plans and wanted us to proceed with our life in a completely different and unfair way, for me. I had a divorce decree, and my evidences inlcuded lease, health insurance, copies of joint checking account cards, some pics, joint mailing labels, a notorized letter explaining the situations leading to divorce, letters from the bank to show joint address, joint tax return. And you are right about not stressing myself out for things that are out of my control now.

scorpionking: I actually filed with a waiver request becuase I had entered the marriage in good faith but it ended in a divorce. I am glad I am of help. My main purpose for posting my interview is so others have an idea. I know how tough the process is. Divorce is tough thing to go through, as I have learned through experience in my mid-twenties. My marraige was brief, but that didnt make it less painful, emotionally. And, I now feel so out of place, now that my friends and siblings are getting engaged and married, as I'm already a divorcee. And, on top of this, to go through the immigration process is just too much. I'm usually the kinda person that stresses about everything, but this time I am just calm and numb. I was sad and numb during the interview, I did not get nervous or stress at all. When she asked me for dates and stuff, I just told her that I dont really remember since i was not keeping track of exact dates. I dont remember the exact date that my ex left, when we separated but was able to give her estimates.

Milan Kudrak: As for part IV, I think she had a right to ask me the kind of questions that she asked. she saw on my file that I was married on April, applied for AOS in May (my student status was running out at end of May), got the GC in Sept, and separated by Dec. So she basically explained what she saw and asked me that since I got married before the other status ended, and then separated few months after I got the GC, did I do it for immigration reasons? And (if I remember correctly) I said No about four time calmly and told her that after graduating from college, I was sorta starting out with my life, and looked for jobs anywhere stationed all over and my homeland, not neccessary the US. But I had dated him for a while, we were in love, and he was morning the death of his mom, and decided to propose to me. So I said yes, which meant staying here and I could not igonore that it was best if I started the immigration process soon after marrying...I believe she asked me again, that "so immigration didnt have anything to do with marriage" I said no, I didnt marry him for immigration reasons.

The interesting thing was that she was taking notes the whole time but she didnt take notes on this and she observing me the whole time. And then she asked me if I know his phone number. I said yes, I actually still have it on my cellphone and then I gave it to her, I also offered her his home phone number. She wrote his number on the I-751 form that I had submitted. Then she looked at the additional evidence that I had brought and said she is going to keep them, and she is going make copies of the passport, gc and id. And what surprised me was that she got into a happy, sort smilley mood. So I dont know what that means.


I dont really know what to think since for me AOS interview, the guy that interviewed us didn't make the decision then. He said he had to pass his interview notes through his supervisor before make a decision, and that's thier office policy. This time she said she was going to review her notes before making a decision (again, on a happy mood).

Yes, she asked me to tell her of how the marriage was going and why we divorced. She even asked me questions from when we were dating.

You're rigt, God knows what's best for me. I'm asking for opinions only because I am not sure what to make of the interview. I realize that I was married for a very short time, so I understand if she has concerns and asked questions but then I am not sure what it means when they say that they have not made a decision yet. From what I've read, they make decision right after the interview.

Hello all, I wanted to post my interview experience from this morning in case it will help others and also get your opinions on this.

My interview was scheduled or 8:15 am, and I arrived at the local immigration officer aroung 7:50 am. There was a short line, and after about 10minutes of waiting I was called in by a middle aged femal interviewer. She started by introducing herself and asking me to drop all of my stuff (purse) and raise my right hand. Then she did the "I swear to tell the truth and whole truth..." and I said "I do" and then had a seat. She asked for ID, passport and green card. I pulled out an expired id first and then the updated one, she said she wanted them both. Also noticed that the address on my petition and id was not the same so she asked. And I explained to her that I had informed them of the address change online but then they did not make that change and so I just recently sent the AR-11. She gave me a handout explaining that there is 2 steps to changing addresses, online and physical form.

Part I: she asked me pretty much all of the questions on my application/petition one by one. For example my birthday, my ex-husband's name,...so on. And then asked me to verify that, at the bottom of my application was my signature. I answered everything correctly except my birthday- which is stupid, I confused month and date, we both laughed and I corrected that.

Part II: She asked me if I have any more evidence for her apart form what I submitted, and i gave two letters from our bank when we had a joint checking account. One verified address change and other one was something else I cant remember...she took them. I also told her I got more pictures, which she kept. And she went through the pictures and asked few questions, like, was this your wedding, was this during your wedding...

Part III: she asked me where we met, why we got married when he propsed (the date), when we got married, if I had any evidence from our pre-marraige relationship, and why we divorced including the dates of when we separated and such. I dont know how bad this is bad I could not remember the exact date of when I got proposed too, so she asked me to give her an approximate one. But I was able to remember important dates like the wedding date and such...She asked if I told my family about the wedding, and asked how they reacted to my wedding news, and if we visited my home country with my then husband.

Part IV: She said that I got married a few weeks before my student visa status was running out, and I got divorced a few months after I received the green card. So, did you get married for immigration reasons? I told her no, and that once I had said "yes' to his proposal it was important that we had to proceed with immigration business before I run out of the student status. us getting married meant being togther and part of that was to make sure that I was legal here...I probably used the different words.

Part V: She said she was going to make copies of my ID, green card, and passport and I should wait for her in the room. Then she came back and gave them to me. She said that I should always keep updating USCIS with my new address everytime I change addresses. Also, she said she will review my file later and make a decision. She smiled and said I will walk you out.

The interview lasted abotut 20-30 minutes.

I didnt see her get into a bad mood or anything, but I'm really confused to how this went since she asked me straight out that "did I get married for immigration reasons?" and she didnt make the decision today.

What do you guys think?

Looks like this list is filling up which is good. I-751 waivers are least priority for USCIS (based on observation of cases on VJ) but still they should be processed and shouldn't be ignored.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsCant seem to get INFOPASS apointment!!!!

Not that I'm aware of but you could try to just show up. It worked for us when we had a real emergency and were time constrained. We showed up early in the morning when they opened the door and respectfully told the story about the problem and were lucky enough to find someone who was understanding and very helpful. That was at an office in Virginia, not NYC. Good luck!

Well, we went to get the I-551 stamp and the agent wouldn't give it to him. She said putting the stamp on his passport would be like giving him two green cards since he already has the extension letter, but she said that, as far as she knew, there was only one airline in one place in Europe that gave people a hard time with the letter. I highly doubt that is true but we are leaving on Saturday so will take our chances. I think a hassle is the worst that can happen so we will deal with it. Thanks for your input folks.

Thanks for your responses everyone. Sure happyndinlove - you can add me to the list. According the USCIS website the current processing time was 7.1 months when I checked yesterday, which is mid-February. Have you heard something to indicate that it actually takes longer than that? Do you know anything about what travel is permitted after approval but before the card is in hand?


Steven+Elisha - thanks for the tip about bringing the original.
Richar-Y-Abagail - the letter says "during this one year extention you are authorized employment and travel". ButI am beginning to think that getting the stamp for piece of mind might may be the way to go even though the old green card and 797-C *should* be all that's required...

My husband's father recently passed away and we were hoping to go to India in the next month to be with his family. From what I understand he is legal to travel with the I-797C, but since he should be approved for his green card in the next few weeks anyway we were thinking it would be best to wait until he gets his approval just in case they decide to give him a hard time on the way back in. However, having done some poking around, I see that he will not actually get his new green card right away when he is approved and will just get another sheet of paper while we wait weeks more for the actual card. Can anyone tell me whether he will be permitted international travel after he gets the paper approval but before he gets the card? Does anyone have experience traveling with the I-797C or with the paper approval (especially to India)? Would it be better for us to wait or should we go right away before the approval?

Thanks for this information. She told me that she has no other form of ID. So today she went to the Postal office to apply for a Postal ID. She put in a for a rush and will get it on Tuesday.

Thanks for the information. I talked to Glyn and she said that she did have chicken pox before and has some scars from it. This is good advice to avoid the extra shot.

Thanks for the idea about the rosary too. We are both Catholic and pray the rosary often. I know God is with us during this time. biggrin.gif

However, make sure that your fiance has other valid i.d on herself as passport will be left at St. Lukes in her medical and St. Lukes will be the one who will forward the passport and medical result to US Embassy. On the day of her interview she needs to present a valid i.d to enter US embassy for her entry pass. Good Luck.

Thanks Sheriff! This is why I asked the question. In the packet it says: "When you go to SLMCEC for medical examination, you must bring your passport and one photo (size: 2” x 2”)."

In your guide, it says: "(1) medical exam fee (payment accepted in pesos only), (2) passport (SLMEC will keep the passport and delivery it to the USE along with the medical exam results, so make a copy of the passport for your records), and (3) three 2x2 passport photos as stated on the DOS website"

I don't know what to know is correct (one says one photo, the other 3 photos). I have "heard" different things but wanted to verify with those who have gone through the process.

Please help me discern this.

Hello there!

This is my first post here, but I have been lurking and reading on this site for a while. biggrin.gif

We are very excited. We just found out that Glyn's visa interview is May 15. She is going to to St. Luke's to get her medical exam next week.

The embassy website says that she should bring her passport and a 2x2 photo of herself (http://manila.usemba...ov/wwwfk1en.pdf)

She thinks that she needs to bring everything else to St. Luke's that she would bring to the visa interview. She said she read this somewhere.

Can anyone verify what is needed?
