Thank you for your words of encouragement. I gathered what we had, wrote a letter, and sent it out today. At the very least we will know what the next step will be in a metter of weeks... And regardless of what the step is we will move forward together... But I gotta admit I'm hoping that the next step will be prepping papers for the interview! ;)

In the second thread I wasn't actually asking about the photos, I was specifically asking about if I should withdraw the application and re-file as I am unsure what kind of impact that would have. Is it better to do that or have to file again after a denial? The questions are indeed related but I was really hoping to get info about something completely different with my second post......

I guess it depends if the RFE was just for photos, or for any type of proof, including photos.

The suggestion was photos. The request was for proof of an in-person meeting.

No, that is silly. Come up with the best you have and send an explanatory note.

I am wondering if anyone has experience with this or any knowledge about if this is a good option. As background: I met my fiancé through friends of my daughter's family in summer 2009. We became friends, then more, and in 2011 we decided to make our relationship permanent. I have visited on 3 occasions prior to the filing of our K1 on Dec 2, 2011 and have visited 1 time since. I was sent an RFE requesting evidence of an in-person meeting, including photos. I am the photographer in about 99% of the photos I have and have avoided being photographed because of some really silly confidence issues so I do not have any photos with the two of us side by side. All I have is a series of photos that put us (possibly) in a boat together.

My question is this: would it be better for me to withdraw the petition and start again now that I have some photos of us together (taken post-application), or send in all that I have with the chance that they won't approve at this early stage?

Please help!!!!!!

The RFE is pretty specific about needing to send if evidence preceding the petition date. I am going to print a series of fotos from a day we went to the beach and include the time stamps and hopefully that will work.

Exactly. We were not able to celebrate together until after the petition, but the family knew about it before. We just looked at it as a technicality, but perhaps in this context it is much more....... :(

We were engaged before the application but didn't get to see each other again until after because I got a job put of state and moved. The intention was to visit in the summer of '11 but having to move 2,100 miles kind of put a damper on things... So, I have passport stamps and airline verifications of trips to El Salvador from Dec 2009/Jan 2010, July 2010, and Dec/Jan 2011 before the filing and some photos that could put us at the same location with digital time stamping; however none are full face/ front shots. This is incredibly frustrating... We didn't know we were going to fall and love and want to get married from the start and so we didn't keep a huge paper trail.

Is a withdrawal and a refile better than a denial? Do I just send what I have and hope for the best?

Does the RFE specifically say it's requesting pictures? Pictures are secondary evidence. Would be neat with a few pictures in there however it's the initial evidence that's crucial. How about your bank transcript/statement(in your name) showing you used your credit card in your fiance's country? That, along with the passport stamps. Personally, I'd scan the entire passport front to back and send a copy of it all.

Regarding pictures; are there any close to landmarks or something where you clearly see it's the same background/surroundings you're in? Write a letter of explanation. I'd stick to pictures taken before submitting the petition. Maybe someone with experience going through El S. has some more info on the subject.


I do have some photos that could place us at the same place I think, I've got at least one receipt, passport stamps, and boarding passes. I already submitted the boarding passes. Should I submit them again? I also have my daughter's passport and I may have photos of them together. Does this count??

Here is the exact request from the RFE. I am typing word for word:

REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It must be established that the petitioner and beneficiary have met in person and/or have been in each other's physical presence at any time during the two years immediately preceding the filing of this petition.

Ok, I finally got the paper copy of the RFE and it's requesting evidence that we have met in person in the past 2 years. I sent passport stamps, boarding passes and the closest thing I had to photos that put us in the same place... which was a photo of me where you could see his back, and a photo of him where you could see my back... we were on a boat sitting back-to-back. I have found a receipt for a cell phone that I bought down there and I have a ton of photos that show that we were in the same place, but there were no photos of us taken together. I'm completely flipping out. The fact is, I hate getting photographed and have avoided it at all costs, up until our engagement celebration, which was a few weeks after I mailed in the application.

Right now, I'm asking people to look through their old photos to see if they can find anything where we are together, but I can guarantee that none of them have us arm in arm. I have lots of those now, but none from then. We were not trying to flaunt our relationship until we were sure it was serious... and now that we are both ready to make this permanent, I'm scared that I messed everything up by sending in the application before our engagement party in El Salvador.

What can I do??? :crying:

Another money saver is to take the passport photos digitally, send them via email, and then use an online program to create them so you can print them yourself. I have used epassportphoto.com a number of times and it has never failed! :thumbs:

There are programs (free!) that you can download that will date stamp your photos so you have it on there when you print it. If you took photos with a digital camera then it will just take the date from the file. Just do a search for free photo date stamp program. :thumbs:

Thanks for all your advice, everyone! @Penguin, we had originally wanted to marry June 15, 2013 and had switched it to August 24, 2013 hoping it was enough time. Given what everyone is saying, it may be wise to move it to 2014 and get married at a Justice of the Peace in the meantime. I guess there is no way to expedite the process or have it moved to the California Service Center, huh?


We applied at the beginning of December last year, wanting to get married at the beginning of August. Interview didn't happen until September so we moved wedding back to Nov 10. He is actually scheduled to arrive on Nov. 10 so wedding is now Dec. 1. We had quite a few setbacks and I saw other cases go so much more smoothly, but the point is, ya just never know!

I got my NOA2 on June 10th and the NVC still doesn't have ours. From what I've seen, a lot of people seem to be in the same boat.

I asked one of the workers on the phone there if it was ok if I called every day because I was too excited to be patient; she was very sweet and said that it was fine. If you're like me, maybe you have trouble hiding frustration in your voice... thus they are a bit snippy back ;)

I recently filed an I-129F (NOA1 April 26th) and all of the sudden my fiancee and I are having some relationship issues. It looks likely, though not certain, that we won't be marrying, at least not in the current time frame. I've read about people canceling their petitions before they are adjudicated but is there really any advantage to that over just letting it be approved and then expire? As we still have a glimmer of hope, I'd like to keep our options open as long as possible and there doesn't seem to be any downside to just letting it expire, but I wanted to check to make sure that I'm not missing something.

While you do not have to it can be very important to send them more than they need at this stage. Here people will call it frontloading. Phone bills, pictures, e-mails. letters, copy of skype pages. You do not have to send all , just examples from each month is what i did to show ongoing relationship over time. It is not needed now but can be VERY helpfull to have it in your file when it goes to the consulate.


Your response reminds me of a question I had. I'm considering including a few emails from my fiancee with my I-129F, but they are in Spanish. I know that required foreign language documents need to be translated but since the various pieces of evidence of relationship are optional, would it be okay to include some of them in a foreign language? Thanks.

1) I see it saying in some places to have 4 copies of the G325A, I read also just 1 copy, so please tell me which is it?

2) I also just got my CERTIFIED copy of my divorce decree from my previous marriage ($26 !!), I already had just the divorce decree the court gave me but to make sure i dont get a RFE i just got a certified copy. My question now is do I send in the original or make a copy of it and keep the original for the interview?

3)Last but not least, on the I-129F on question 18 they ask me to write a letter explaining our meeting. can you tell me exactly what info they want, like how we meet AND the meeting in person or just a description of they events and everything from when i was actually there visiting. Im a very detailed person and dont want to write them a 5 paged letter....lol.

Is there a reason why he would need the B2 rather than using the VWP? The answer to this may answer your question



He travelled here to visit me a little over a year ago on VWP and was told that this would be only time he could get through on VWP and next time if he comes without a visa they will put him jail over night and then send him back to London. He is born and raised in London, but his family is Pakistani. We can only assume that is why he would be told such a thing as he has no criminal record and has never done anything to warrant being put in jail.

He had also come to visit me on VWP one time prior to that visit and each time stayed for just under 3 months. I have been to visit him in London 2 times as well for shorter visits and never have any trouble.

I have been reading many posts about travelling to US on a B2 Visa while going through the K-1 process. I have not seen anything about doing so while the K-1 is Adminstrative Processing though. My fiance had his interview on Oct 6 2010 and was put in AP. It has been 6 months and I want him to come visit for summer. Is there any hope to get a B2 or will they just put the B2 in AP? Has anyone had any experience with this?

My fiance rec'd a letter today from the Embassay in London asking him to set up courier to pick up his passport. I am wondering if anyone else out there who was in AP received a letter like this and if so did you get your visa soon after? I am scared to get excited, but since this is the first thing to happen on our case since his interview way back in October I am a little excited!

It says:

"This is to advise you on the status of your case, it is currently pending "administrative processing". Unfortunately, there is no mechanism to speed up or determine how long this process will take. In the meantime, please forward your passport to this office if you have no immediate travel plans, as this will ensure your visa being issued without delay once administrative processing has been completed."

I don't think it will affect your K1 because you became engaged after you filled out the original tourist application and were denied. I would concentrate on gathering evidence of your relationship to support your K1 application. Good luck and congratulations!
