K-1 Fiance(e) Visa Process & ProceduresBringing my Fiance from Thailand

"Jamie,

Follow the guidelines here in VJ. It tells you everything that you need and what to send in. I also used another site which gave me a list of items that I need for the Petition of Fiance. More information is always better. As for your fiance she will need to do a intent to marry and the G325 (make sure that this is the 4 pager and do not copy the first page because the bottoms are different). Her phone records and pictures are proof of a relationship and are good.

As for the job as long as you can show contiunious employment then you will be just fine."

Do you know if she has the option of taking her interview in Thai? She can speak English but she thinks she would be more comfortable speaking Thai. She talked to someone who went through the interview and they told her she had the option to use either or.

Jamie,

When my fiancee went for an interview last October there were both Thai and US staffs presented at the interview. You should not worry much for the interview. Be sure to follow the guideline in VJ.

She just told me that she talked to one lady on a Thai forum that had problems with this. When she asked to do the interview in Thai, the interpreters Thai was not very good so there were many misunderstandings. They also questioned why she would want to do the interview in Thai if her fiance was American and spoke english. I guess this went around and around. She didn't tell me if the visa was granted.

I think it is probably just best she do it in english. Can I sit in at the interview to help prevent any misunderstandings or is that not allowed?

She has a lot of calling records from her calling me...unfortunately, I use calling cards. Should I have her send copies of those records to me to include in the application? Should I have her send any proof of our relationship to me for the application?

Sorry if these are pretty dumb questions to ask but I feel a bit overwhelmed and don't want to make a mistake.

Thank you both for the reply.

Any advice on the changing address/employer? I would like to start the application ASAP, but if this is going to complicate things, I will wait.

K-1 Fiance(e) Visa Process & ProceduresBringing my Fiance from Thailand
Helllo everyone...

This is my first post and I have a few questions I hope someone can help me with.

I am planning on bringning my Thai fiance here in the near future. The K-1 visa forms and guides look very helpful. Are these forms all that I need as far as forms go? I was looking at another site (not sure if I can post that here so I won't) but they give a step by step process as well which includes samples of cover letters to include, sample letters which can be used that state we plan to marry within 90 days etc. Would it be a good idea to add these types of letters as well?

Is there anything in the beginning that my fiance would need to give me to add to the application? She'll give me cell phone records of her calling me, pictures of us together etc. Are there any other things that may be beneficial?

Finally, I am in the process of looking for a new job. I have a job presently but I may be made at least one, possibly two job offers in the coming weeks. Although nothing is certain, will this complicate the application process if I put down my current place of residence and employer, but during the process I move and my employer changes?

Thanks in advance for all input.

Jamie

K-1 Fiance(e) Visa Process & Procedureswhat if you move after filing the visa?
I talked to a couple people about this including an immigration attorney as I am planning on moving to a new state and taking a new job. They all pretty much said that this should not hinder the application and it should not delay anything either. As long as in 06 your income met the guidelines of 125% above the poverty level.

For part of the package the fiance and fiancee need to write a short letter of intent to marry. I've seen a few examples of this letter and it shows in bold at the top either "Fiance Letter of Intent" or "Fiancee Letter of Intent." Do you keep this title at the top or just take it off?

K-1 Fiance(e) Visa Process & ProceduresI-134 a few questions
Thanks for that...

I just ordered the transcripts via phone from 2003 to 2006. My fiancee seen conflicting information. Some said only the past year was needed, others said up to 3 years. Better to be safe and have it now, then to have to wait 2 weeks when I really need it.

I appreciate the input.

K-1 Fiance(e) Visa Process & ProceduresI-134 a few questions
Hi everyone...

It's a little early on for me to be filling in the I-134. Me and my Fiancee are still in the beginning stages of filing for the K1. That being said, I'll be moving soon to a different state for a new job.

On the form, there is a space to include the value of stocks and bonds. Does this include mutual funds that are in a 401K or Roth IRA?

Is there anything from my old job that I should get? I had my supervisor write a short letter on the companies letter head stating my position, that it is full time, when I started and what my salary is. It will be slightly out of date though since I will have a different job and a different salary.

What about old W-2s? I have from 2006, 2005 and 2003 but can't seem to find from 2004.

Should I get a statement from my bank stating when my account was opened? I will probably be closing this though when I open a new checking account with what ever bank I use at my new place.

Any input would be appreciated.

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how we met in person
Yeah, I had wondered about how to go about doing this as well. Mine ended up being about a page and a half. Basically stating how we met online, how often we talked and how we talked (MSN, cam, telephone), the time that I finally flew there to see her. We worked on this together and I put kind of an itinerary to all the places we went while I was there, and her friends that we might have met for dinner etc. I also have pictures, receipts to back up the places we were together.

K-1 Fiance(e) Visa Process & ProceduresWhat if we can't meet financial requirements?
Are you still living at home with your parents? If you are, I'd seriously consider getting your GED and then think about going to a tech school part time for your associates degree. It's hard enough finding a decent job with a bachelors degree let along trying to get one without even a high school diploma. You have the added advantage of living at home so you don't have to worry much about bills.

Also, think about a second job as others have stated. Wal-mart is ALWAYS hiring. They also have some benefits. I know some people that started off with the Wal-mart here from day 1 and they are doing well for themselves.

You work and go to school and try to get a few hours of sleep in between. Seriously. It's not an easy road to go down, but if this is what you want, you are going to need to make some sacrifices. Once he gets there, where will he stay? Will your parents take you both in, or will you get an apartment? Nothing ruins a relationship faster than having to stay with the parents and apartments in a city like Phoenix are going to run you over $500 plus utilities easily. A check from Taco Bell alone is not going to be enough. Remember, it will take time before he will be able to work.

I think everyone here has given you some good advice. It's up to you to decide how or if you want to take it. Anything that is worth having takes time and hard work to get.

K-1 Fiance(e) Visa Process & ProceduresWhat if we can't meet financial requirements?
Just a question. I understand the need for the financial support, but the level is set at $16,000? I am in the process of bringing my fiancee here and decided to get a different job because I didn't think the $30,000 I am making now would be good enough to support her and myself. For those of you that just made the cutoff, how realistically can you support a wife/husband and yourself on that? I'm just curious...I know eventually my fiancee wants to work once she has settled in here, but for the time being, I will be financially responsible for her.

I ended up using an attorney. I know we could have done this on our own, but I just don't want to take any chances. I am in the process of moving, so having someone that's able to take care of things while I am moving is just one less thing to stress out about.

K-1 Fiance(e) Visa Process & ProceduresEvidence of marriage plans?
Hi everyone,

When mailing in the 129-F, did anyone include evidence of marriage plans other than the statement of intent to marry? Me and my fiancee really don't have evidence of any of this...some e-mails but nothing like concrete plans. We were just planning on doing something really simple now, so there are no invitations or guest lists or anything of that nature. We mainly discuss this on the phone.
Jamie76MaleThailand2007-05-24 18:31:00

K-1 Fiance(e) Visa Process & ProceduresRecord of How you met

The question asks how you met -- meaning the first time. A few sentences describing that initial meeting is sufficient. For example, "we met when I was on a business trip in xxx. I went to a restaurant in xxx where xxx was also dining. We were introduced by mutual friends there"

They don't want a life story, just a brief description.

They don't? My story is being published by a major publishing company. Really though, I ended up writing about a page and a half. I included how we initially made contact, when I went to meet her, a bit about what we did on each day I was there etc. The pictures I included go along with what we did through my visit.

K-1 Fiance(e) Visa Process & ProceduresK1 visa, I have not meet my fiancee in-person, can I still apply?
Definitely meet. Wait until your meeting in September to file anything and collect as much proof of your relationship as possible. Did you ask her to marry you over the net or phone? I've known my fiancee for over a year now and we discussed marriage before meeting but I would have never asked her until being with her and seeing how we interacted.

What type of certified copies are you talking about? Your birth certificate? Generally if you go to the local court house and talk to the register of deeds, they can get you a certified copy of this.

K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?
Well I got a lawyer. I guess it depends on how comfortable you feel doing the paperwork yourself. I got one because I am in the process of moving and I would rather have someone there to take care of things while I am out of touch and getting set up in my new area. I only paid around $700 but so far, so good. He's been there to answer all my questions as well as my fiancee's when she has contacted him as well.

Yes, fill out all the 5 forms, write the last 5 addresses and jobs.
If you are able to fill it out online, it will copy the info for you on each sheet, so you only have to do it once.
Figured that out by coincidence. saves a lot of time :P

K-1 Fiance(e) Visa Process & ProceduresCan we get married at our wedding? (i think we're too late on the whole visa process)
As you can see in our time line, we filed in May and I had my visa in October, so it can be close call.
We also had a ceremony at home in the Netherlands, which church, dinner and all and just got our marriage legalized at a justice of the peace office.

You need towrite down the adress of her at her home country. There she will receive package 3 and 4. She needs to have her interview done at the US Embassy in the Phillipines. The K1 visa is an 1 time entry visa for 90 days to marry a US citizen.

K-1 Fiance(e) Visa Process & ProceduresWill age difference matter?
I do agree that when women are the older one in the relationship, the validity of it gets questioned. My now husband was interviewed for 30 minutes asking the same questions over and over (for K1). He said the woman just kept rewording it over and over. Finally she told him to sit down and never told him he was approved.

Now that we just finished the AOS interview, same thing. The woman was only concerned with our age difference. She never asked how we got along as a couple or where we lived or anything that pertained to us as a couple. She just kept giving us her opinion of our age difference. ... How my children would not be accepting of this relationship, How her husband being a teacher too would be opposed to this type of relationship of one of his coworkers. Her questions were pointless. I took out joint bank statement, life insurance policy and gym memberships and she could care less. She even had the nerve to ask me if he was under 18 when we started dating. By the way, he was in his early twenties. Despite our 20 year difference, we are compatible and very much in love. At the end of the interview, she never told us if we were approved or not...simply that a response would be mailed to us.

So in my opinion, yes there exists a double standard. Women with younger men are definitely scrutinized more.
