Get married, but then throw your K1 visa away because you will then have to reapply for a K3 which will take as long, if not longer.

Well you cant really say how much long it will take,it took me 3 months to get my approval and 5 months until I had my Visa in my hand. My case was at CSC by the way.

I believe that is why we got our RFE. We sent all of our pictures in frames. I knew we shouldn't have gone that far. Or maybe it was the fact I over did it when they asked on the I-129F how we met. The three volume leather bound epic may have been a bit too much. I couldn't help myself though. I think there is a part where you have to put your fiance(e)'s name down in their own native alphabet. I just had my fiancee type it on a word document, e-mail to me and then I copied and pasted in to the form and printed.

$12 a hour comes out to a little less than $25K a year. Are you working full time? Is this a new job, as in just starting out? You should be fine, but what he/she may be looking at is perhaps you are not working full time or that you have only been in this job for a little while. In any event, you make above the minimum for 2 people, so you should not need a co-sponsor.

You can't file anything through the embassy, they will take care of the final procedures once the case has been approved and the beneficiary needs to have the final interview there to obtain the visa.

No, no, no. Meeting August 15, 2007 and filing the petition September 30, 2007 is perfectly acceptable. You don't have to meet 24 months before you file. There is not a minimum time after meeting in person that you must wait to file the petition. You could prepare everything in advance and file the same day you first meet in person.

The requirement is that sometime within 24 months preceding the filing of the petition, you have met in person at least one time. If the only time you met was 24 months and a day (or longer) before the petition is mailed, you need to see each other in person again before you file the petition.

It is important to read carefully and comprehend all instructions. From the I-129F instructions.

Provide copies of evidence that you and yourfiancé(e) have personally met within the last two years;

"Within" is a keyword in the sentence above.







This is exactly how it is !!!!

We met twice before we filed, I visited him in the USA in feb and he came over april thru may and we filed 2 weeks after he returned back to the USA. And we did get approved, so that's what the answer is.

And wouldn't you want to spent some time together to get to know eachother personally.

Before we filed we were on the phone on a daily basis as well, but I needed to adjust a bit being in his presence and spent the days with him and being able to hold hands and do other dating stuff.
He proposed to me the day after I arrived, still dealing with jetlag and I was ashtonished, feeling a bit akward at first. I said yes and I had a really fast converstaion in m,y head: Do I want this, what if these 2 weeks show we shouldn't, I don't want to dissapoint him.

I am happy I did say yes, though, because now we've been married for 8 months and it the best life ver so far!!! :dance:

You should get a civil marriage at the court house.
We did it too.
We had a marriage celebration in my country and than went to the court house to be officially married within the K-1 time.
We wanted to have a celbration for the rest of the family here too, because only his parents came over to my country.
Because my husband lost his job, we decided to postpone that, but are still married by law which is much better.
I wouldn't opt for another peiod of long-distance again.

We've just found that it is recommended that the package sent is duplicated and we haven't done this? Will it matter? I still have bunches of originals but we also sent some original evidence as well. Is there any reason for the duplication? Or just in case everything gets lost or something?!

We didmake 2 copies of everything. If they loose something, they request for a replacement, in order to get your case approved.
We did the same thing with filing AOS.
At my I-129f interview they asked for affadavit of support, paystubs ( originals, we sent copies)and updated ones received later. Copy of the birth certificate, so you can get the original back for your AOS.

We made 3 seperate files, 1 with originals and 2 copied ones.
My fiance kept one copy, I did bring one home for the interview.

You have to write other and write number of the application file you are using.

I-485 AOS /permanent residency
I-130 Other, I-130 petition for Spouse CR-1
I-129F Other, I-129F for Spouse K-3

We did file for K-1 and used the I-129f and filled it out that way.

We didn't do it and did get approved. We only had a new letter set up by my now husband that he still intended to marry me for the interview, because it was more than 4 months after the initial filing date.

I just realized I forgot to send an "Intent to Marry Statement" with my first packet! I did get the receipt back from California. I purchased a book at first to help fill all this out and on its checklist, it did not have the "intent to marry statement" I assumed writing the letter to Question 18 on the I-129f from would have been good enough.

Was that really bad? What can I do to help fix it?




You can't do anything right now. If they still want one, they'll sent you an RFE. You both need to write a letter of intend if that is requested, so have your fiance set one up to and sent to you, so you have it available when you do receive an RFE.

Hi all.

Well to start:

I am a male, 17 years old (18 in november) and am a UK citizen.
I have never had any criminal record
I don't have any kind of disease or illness
I have never been deported from any country
I have been refused a B2 visa because the immigration officer didn't think I needed to be in the US for 6months.

The situation for me is:
I have visited the US 2x this year on the Visa Waiver Program, January 1 2007 > March 28 2007 and August 24 2007 > July 21 2007
On July the 3rd me and my fiancee sent off the I-129F petition to the USCIS and it was received and we have our receipt number.

I have read from a lot of sites that if I try to re-enter the United States on the visa waiver program (I wanted to return to the US to be with my fiancee witihin a month today) I will be turned down or there is a very high chance of denial.

I do not know what to do :(
She can't come visit me in England because she has a job.

What am I meant to do?
Please any help would be appreciated.

I did visit my fiance once while our K-1 was pending. No questions were asked at the border of Philadelphia. Even when she asked whom i was visiting and I said it was my fiance, she only asked for how long we've been doing the Long distance thing and she wished me luck.
The other time though I was interrogated by an Minneapolis officer and even asked for my fiance's ceel phone number and told him, that if I was lying he was going to sent me back and would get a bar.
And poor him was shopping at Safeway when he answered that call. :huh:

Well we don't care HOW they want to spell it. So we want to fix it the quickest way possible. If that is fixing the passport it means her name is MARINA if that means fixing the 129F her name is MARYNA. Does not matter to us.

She is in Ukraine and tells me there is no way to contact the Kiev office by phone. Anyone here have a Ukrainian financee that would know about this?

So my worry is she reappplies for a passport and there is confusion on why they are making a 2nd passport. And is there somewhere in the passport applicatino I wonder for how you want your last name spelled She tellls me they just chose to spell MARINA why a Y and she didnt expect that.

I am going to try calling the USCIS and see what they say. I have no idea how that will be reaching a human.

Would be wonderful if they could just change the letter in thier system.



A former friend ofmine is from the Ukraine and her name was spelled Marina in English. I guess because it's translated out of Cyrillic, you should just chnage the one that is easiest for you, because her real name is spelled right in Cyrillic.
I guess for the English name is doesn't matter so much, as long as she is finewith it, but then continue to use MarYna on all you papers, your marriage license in the future and all documents she is going to have in the future. Like SSN, birth certificates of future childeren, driving licence and bank accounts.
The translation shouldn't than be such a problem.
I'm convinced about that.

I should contact the service center where your I-129F is taken care of. Do you already have a NOA1, than use the WAC number and fax it to them, they can update it for you.Just explain the that there was a translation mistake of her name from Cyrillic to English and the correct way to spell her name isMAryna and you want to adjust that.

Yes, for your AOS you need a sworn translation of your birth certificate and any other documents you want to provide as proof.
In the EU they tend to give you an international birth certificate, like mine in Dutch, but they sent us an RFe on that and we needed to get a sworn translation here, before we did get approved.

After you've sent back package 3, which is after NOA 2, you'll receive a date for the medical and interview. This will be at the address you've listed as the address of the beneficiary.
For me it was about 4 weeks after NOA2

Pre judging is human nature and you want their first impression to be wow!! This is a true legitimate relationship. Just make copies of all the evidence you send.

The court transcripts is not enough to prove you are free to marry I got an RFE from Vermont because I sent the Ruling of Divorce. or court transcripts this was even after my 120 waiting period was over the RFE said that they need the Certificate of Absolute Divorce which in MA would'nt be issued until the 90-120 day waiting period is over.

You must wait until you can provide a Certificate of Absolute Divorce Before filing for I129F Most states Issue a NiSi which is a ruling for a Divorce but it usually takes about 30-120 in most states to become final. After the waiting period you can then get the Final Certificate of Divorce. You are still considered married until that 30-120 days lapses before you are free to marry. In most Cases you have to go to the Clerks office to get that Certificate of Absolute Divorce.
