My wife and I are a few months away from ROC but I plan on using the title from our house as well. Laws vary state to state but I would ask the notary at the closing if they could make a copy of the notarized title for you. That would be as good as the title after it is filed (and you are normally sent a copy). My guess is it will be much longer than 45 days before you get the title back. Keep in mind there is all kinds of paperwork involved in buying a house that should have both your names on it which you can copy and send which will be almost as good as the title.

The one document that comes to mind is I think it is called the HUD-1. It is the settlement statement that lists the buyers and sellers credits/debits. You usually get the first copy when you apply for a mortgage as part of the good faith estimate.

That or the actual loan document though that tends to be around 20 pages long.

This issue comes up with passports, this is the State Departments answer:

Q:My child is too young to sign his/her own passport. How do I sign my child's passport?
A:In the space provided for the signature, the mother or father must print the child's name and sign their own name. Then, in parenthesis by the parent's name, write the word (mother) or (father) so we know who signed for the child.

your wife can signed the 1-751 application but date the application on the day that you are going to send out the application as long as it is dated the day you are sending it out. another words, pre-date the application.


Actually, The correct term is post-date not pre-date. I would date it the day you plan on mailing it. I would think it is much more important that it is each spouse's original signature than the exact date you enter.

USCIS will not accept her school mailbox. You will have to put your address and than in the C/O part put your friends house so at least you would get it there. If you want to leave the whole process with your friends address that will be fine but make sure you put your address, if you want to change it, after you get back just file for a change of address. But you can keep it with your friends address. Good luck.



The more I think about this, sending it care of my friend's house probably makes the most sense but I am curious why you say the USCIS will not accept my wife's school address?

I have been accused of over analyzing situations but here goes:

I will be going on a training assignment in another state from about a month before our 90 Day Window opens to about 3 weeks before it closes. I am the USC. My wife is presently working on a master's degree at a school about 30 miles from our house. She is the conditional permanent resident. Since the drive is so far and between classes, group projects, and studying she needs to be on campus 12-14 hours a day we got her a dorm room on campus where she stays during the week and comes home on weekends. Normally, one day a week I go over there for dinner. It is not perfect but it is the best solution in our long-term future.

Our legal residence will remain our home but I will likely temporarily forward all our mail to my address in the other state. Since my company has a fairly generous visitation policy my wife may come to visit often on the weekend as her schedule allows and I may come back for the weekend but I would anticipate maybe being back home once a month which means our home mailbox will not get checked often. I anticipate my wife may just stay on campus rather than come home to an empty house.

The question is what do I put down as our mailing address:

1. Will the USPS forward the NOA1 and Biometrics appointment using the temporary forward? If yes, problem solved.
2. If not, I could put down either her school mailbox or possibly a nearby friend. The question then is can I change the mailing address back to our permanent address once my assignment is over. How? The NOA1 and Biometrics should come while I am still on assignment but the final approval and GC almost certainly will be after I am back.

What is the better option?

Although she'll get a biometrics appointment date and she's busy with school - 

 

it's quite  possible for her to simply walk in before the date, and get it done when she's not so busy with school. (bring the appointment letter) 

 

Surely she's a light day in the week, yes? 

 

C'mon Darnell, your wife is Chinese too :-)  If she is not in class she is studying, the girl stays at it 10-12 hours a day.  Once we get the Letter we will figure out when she can go.

 

I figured it was worth asking.

I know that biometrics can be waived if the LPR has had biometrics done recently.  My wife last entered the US on July 3 and I just put the I-751 petition in the mail today (7/28 - Priority Mail at the Post Office).  Since they do biometrics when LPR's enter the country, any chance they will waive biometrics in my wife's case? I included the biometrics fee so this is not about the money, my wife is just busy with school so it would be nice to skip it.

As a LPR, she is supposed to be maintaining a residence in the US. I would only list her residences in the US for the last two years. Staying with family/friends for a few months is not changing a residence.

So my wife's biometrics is scheduled for 8/27 which is when we are going to be out of town. She is going to try and go this Friday but if that does not fly, we are going to have to reschedule.

 

I see where they have a procedure on the letter but I was wondering what other people's experience has been with rescheduling?  Does/How much will it delay your application?

We are about to file for ROC, and I realize that I cannot remember if I filed the AR-11 or not after we bought our house in April 2010. I am almost certain I did, but I am not 100% sure. I do have a record of my husband filing his sponsor change of address form, but not of the AR-11.

Anyway, besides my worry about whether there might be consequences should I indeed have forgotten to file the AR-11, I am wondering if I should simply file AR-11 again in order to be sure they have the correct address for their responses to the I-751, or if putting the new address on the I-751 and assuming that I did file AR-11 will be enough, because they will use that address. I don't want to stir anything up if I indeed filed the address change as I was supposed to.

What would you do? Thanks in advance.

And another question: Will joint ownership of the house, joint health insurance, me as a beneficiary of his life insurance, and joint tax returns be enough for initial evidence? We didn't join bank accounts simply because we haven't made the effort to do so, and I can pay my credit cards out of his checking account regardless. He could add me to his main account now (it's something we should probably do anyways), but I personally feel the other evidence should be enough for this. Overall, I don't understand the piling of evidence in this process. Doesn't a substantial joint asset such as a house, along with the demonstration of the currency of the marriage by, say, joint health insurance, already prove that we are not a scam? Why burden them with a huge pile of papers?


Just put the current address you live in now when completing the current application. They will update their system with that address.

This is what the instruction say...
"1. Filing jointly. If you are filing this petition jointly withyour spouse, you must file it during the 90 daysimmediately before the second anniversary of the date youwere accorded conditional resident status. This is the dateyour conditional residence expires."
Filing sooner than later is always an applicants preference but as with your case some ppl can't always do it in this manner. Applicants do not like falling out of status and therefore prefer to do filings immediately. It's just personal preference.

I plan to go back to Malaysia for summer break (From June 1st to August 4th, 2012)and my 2 years green card will expire on October 7th, 2012.
Can I file for removing condition on green card after I come back here? or
Can I ask my husband to help me send the package around July 7th, 2012? (I notice Biometrics appointment usually take place a month after the filing and I will be in U.S by that time)


I believe they recommend filing 3 mths prior to your 2 nd year. Double check the application instructions on USCIS though.

Right- because you received the NOA you don't require an I-551 stamp. The only reason I got the stamp was because I never received my NOA- this stamp serves as its replacement.


You get I-551 stamp if your GC has expired or is expiring and you have not received the NOA. This stamp will serve as your "GC" as you e.g. renew your driver's license or your work authorization.

Be tough woman, if your husband really married you with all the right reasons then why would he be scared to separate or move out from his mother&aunt's place? Did you tell your husband that you're already having a hard time living with his family? or like you said they're making you work hard at home, dhang! it girl you didn't marry him to be their maid :( , talk to your husband about it and make it sure he understands it crystal clear. And he's probably having reasons as well why he can't move out with you. Like financial status, is he stable enough to be able to pay all the bills, food, etc.. when you both separate? On Monday April 2nd 2012 I had my biometrics done.
Just for the record,the Office located in Phoenix AZ (around 16th St). Walk in is not allowed. But you can arrive as your early convenience as long as your appointment letter has been scheduled for that specific date.
For instance, my appointment has @ 10am; arrived @ 8:15 and by 9:00 I was done!

Good thing is that I had my biometrics done. and I wondering if I still need be interviewed?.
