I'm not sure what is going on at CSC. They got our package on 5/16 but they still have not cashed the check.


You're next on the CSC list. I sent a cashier's check so it cleared once I got the check lol but no way to know. I actually was fairly excited thinking that CSC was moving quickly on these but we seem to have hit a snag and slight delay. It'll happen, just have to wait it out. Keep us posted...

Well after submitting our paperwork for ROC on May 11th, 2012, I checked my bank and they finally cashed the check.


Good to know, we are a few days behind you. Mind you, we went with a cashier's check so the money was cleared from the get go and there was no check to cash per say. But I'm a little surprised that there appeared to be a slow day around that week ie May 11th etc. Prior to that, at least by what others are reporting, the NOAs were coming fairly quickly. I imagine those of us in that May 11-15th week should be hearing of the NOA next week.

For those that received NOAs...does that document set out that the permanent residency is extended for one year and gives authorization for work and travel? And the biometrics letter comes under separate cover, correct?

Also there really is no way to track this like we did for all filing prior to receiving the green card because the 'recepit number' for all that other correspondence no longer matches. The only way to track is to get the NOA in order to get the new receipt number.

I am preparing my list for the I-751 packet. We became eligible to apply on April 26 but haven't got round to sending it yet. I want to send it in quickly though.

So, what is the deal with the affidavits? Are they necessary? As per the instructions they seems to be required.


I don't know that they are required. I didn't send any with our application. Just make sure you have lots of evidence to send it and you likely won't have to have signed statements from people. We included co-mingling of finances/joint bank accounts, utility bills in both names, vacations taken together and boarding passes, titles to real property, auto insurance showing both names, beneficiary of pensions and health insurance related things, pictures of us over several years and with family and others, etc.

I think the affidavits are when other evidence may be thin.....others may have differing viewpoints ...?

California received the package on May 16th....I forgot my log in for the USCIS website so I wasn't able to log on there, nor could I remember the receipt number. I was tracking progress during filing and before the g/c.....I guess I'll just wait for the physical NOA1 to appear. Oddly, I submitted an AR 11 immediately after we moved....and the notice reminding of the ROC came to the old address....#######?? So I sent a letter about that when I submitted the I 751. Not sure why they didn't have the proper address. I can't recall if the g/c came to this or last address. We had mail forwarded. It's been two years so I can't recall.

And I added to the google list started....~!~

Keep in mind what you need to prove is you entered the marriage in good faith and intended to make it work.  Financial co-mingling is the best evidence to show that intent of long-term marriage.  Can you get a copy of his credit report and send that? 

 

I think they will question the reasons for your divorce less if you can show good faith in entering the marriage in the first place.

Yeah that's the only issue that we do have. We don't have any 2011, since I still had my German Bank Account in Germany.

We got married 11/03/2011 ~ Happy Anniversary to us smile.png and PCS' ed to the US in Feb. 2012. We opened the Bank Account in March 2012 and closed it out in October 2012 and then we opened the new one. 

I do only have like one or two letter or statements from the old account and everything else from the new. 

It will be o.k. I guess.

Do I need to add a passport picture? 

 

PCS= Permanent Change of Station?  So you are military?   Military tend to have a much easier time.

 

The first rule is send what you have. And one piece of evidence does not have to cover the entire two years but you should have evidence that covers the entire two years.  In other words, if your bank statements don't cover late 2011, early 2012. Does something else?  Do you have your dependent military ID's issued right after you are married.  Do you have your orders form your PCS? 

 

Your evidence as originally listed is pretty solid.  Send what you have.  The fact that the military recognizes your marriage means the USCIS will likely as well.

The only thing I would add is make sure your statements cover the entirety of the last two years, hopefully you even have stuff from late 2011.  The one common RFE seems to be people who have lots of evidence but only send the last  statements from right before hey filed.  They want to see evidence covering the last two years, something like quarterly is usually good enough, it does not have to be monthly.

I Have the affidavits from Friends and Family, and from them stating our living situation which is good. They said they would do anything they could to help me so this seems a little strange. It appears their tax person dissuaded her also.

 

I just don't know what to do...

 

We filed for divorce on March 20th and it will be Final Sept 20th, which means I will have to send off the I-751 without the divorce decree, my second issue! 

 

I would just file and indicate in your cover letter that the divorce will be final Sept. 20. Do you have any documentation as to that date, i.e a court date or even a letter from your lawyer.  They will send you a RFE for the final divorce documents, this is one case you hope your case goes a little slow.

 

A little off-topic but it is your responsibility as a Permanent Resident to file taxes every year, even if it doesn't prove the legitimacy of your marriage, I would think they would want evidence you filed. I could be wrong.  Does anyone know for sure?

To clarify, you have been a permanent resident since Aug 2012? And no tax return has been filed for you for either 2012 or 2013?  Your ex-wife just filed single for 2012 and 2013.

 

I think the problem is you are required to file as a permanent resident.  When were you officially divorced?  At a minimum, you may have to file taxes for yourself for 2012 and 2013 before you submit the I-751.

Sounds like the A number that is on your green card was changed for some reason. no idea why they would do this?

update: the approval letter came from the local office in nyc instead of csc where the noa said it was transferred to.

 

the letter says it takes 60 days for the gc to arrive..does it really take that long? im taking a trip soon and it will be awesome to be able to travel with the new gc instead of the extension letter. 

 

My wife's green card went into production a week after the date of the approval notice and we received it a week later, so we got it 2 weeks after the approval date.

We went down to the Phoenix office this past week to try to do walk-in biometrics and couldn't get past the security guard. They said they won't take us early.

especially if your GC is expiring soon. I scheduled an appointment via INFOPASS, mainly to have my passport stamped since my GC expires June 25th and I have not received the NOA that indicates my one-year GC extension. After having my passport stamped I asked the Immigration Office who extended my GC if I could try to proceed with biometrics since I'm in the office, so might as well, and she said yeah. When I tried to do a walk-in biometrics (because my original schedule is June 27), they gave an OK response so I went ahead and do my biometrics at the same time. I guess depending on how busy they are and on your situation, they will consider early appointments done prior to the original schedule.

Hi I'm new here, but have already found this site to be so helpful!!

I filed with CSC on May 17th, and my check was cashed on June 5th- but I haven't received the NOA1 or my biometrics notice :( I called USCIS today and was told that my application was received on May 17th, and was given my receipt number. When I asked about the NOA1 the rep told me that it hadn't been mailed yet, but that it will probably be sent to me in the next couple of weeks?! (I'm not sure why they can't mail it out earlier...?) Because my green card expired at the end of May, and I want to travel this weekend, I think my only option is to schedule an InfoPass and hope for the best!

I have two questions: First, when it asks "Please select Kind of Service you need" did those of you who scheduled one choose the "You need information or other services" option?
Secondly, since all I have is a receipt number- (I don't have a the bio-NOA yet, or a copy of the cashed check- only my bank statement showing it was withdrawn), do you think I might run into a problem getting my passport stamped?

Any advice would be very appreciated :) :) Thanks!


First question: I chose the same option as you have stated above.
Second: Your purpose of getting an infopass is to talk to an immigration officer about your situation of not getting any letter e.g. Biometrics schedule nor NOA, although you were given your receipt number.

When you go to your infopass appointment, ( make sure you printed out your schedule details) , just give the receipt number to the immig officer you're gonna be talking to and tell them if they could check in their system when your schedule for biometrics is. It could have passed, it could be so soon you have no idea as you dint receive any letter. Then from there, maybe you could seek if it is fine to do your biometrics since you are already there.

At least you have the receipt number you have something to show during your infopass appt, did you try checking your status online since you have the receipt number?

Hey Binow, is this the S 16th address for the infopass? That's the address I have for biometrics. My green card expires mid August, so I hope if they stamp mine soon it's the year not simply six months or I might as well wait for the stamp and get it early August etc. Again, instead of all this horsecrap they SHOULD ISSUE A FRIGGN NOA for those of us not in receipt of one....anyone know what that rationale is for not issuing one if not received?


Yeah South 16th Street is the address.
You don't need to cancel the original biometrics schedule if you have yours done earlier. Just don't worry about showing up on the original date since they already have your bio records taken.

Yours wont expire until in two months, you still have all the time to wait for the NOA. Mine expires this month so I needed to asked for extension and tried asking for early biometrics as well in which they granted.

Here's to hoping to no RFE and no Interview!:)

Let me know how you make out on this. I'm curios about whether you get the I 551 stamp and if it's only for travel or if the 551 also gives you the work extension....or whether you get something else confirming extension while they process. Would be best to get the biometric sooner anyway so they can move on that quicker



Just updating y'all about my visit to USCIS Phoenix today. I had my passport stamped with 6 months validity. The stamp "serves as temporary 1-551 evidencing permanent residency for one year" ... I know it says one year but the Officer indicated "6 months validity" on top but I don't care (hopefully) before the 6th month period I should have already my 10 year GC....The extension also covered my Work Authorization as stated on the stamp.


BIOMETRICS DONE EARLIER THAN THE SCHEDULE. The Supervisor for ASC Biometrics was nice enough to accommodate me even though my Biometrics schedule is on June 27.

So this should mean just waiting on the actual green card production, and assuming I won't have any RFE or Interview. I don't have to go back to USCIS again. It's a long drive!:)

Good stuff and way to go !! Yes the info pass is likely the best option. I'm giving it until Friday as per the last call with NVC and I suspect the NOA1 won't be in the mail. If it arrives, great; but I'll likely do an info pass and get the stamp. My biometrics appointment is June 28th. The other thing is that my Canadian passport expires Dec 2012....if I get it stamped, I have to surrender that passport to Canada to get another one....and I would not want to surrender a passport that has a stamp. It makes me want to get a new passport now and then have them stamp it. Such a pain in the #### simply because the ridiculous NOA was either not sent or delivered. completely inconvenient at every level including taking time off work to get that info pass appointment etc.

Again all letters from service centers should be made to have signatures upon receipt....and if not, then NVC should be able to have a second NOA1 issued if there is any glitch ie not delivered or not sent; it's not like having two NOA1s will change anything. not like it's two SSNs or two green cards. It's a letter extending your green card for one year from a certain date to another date. Why can't one simply be reissued. They must have something on their files that it was sent....send another one, there's been a problem .....

Silly jackwagon stuff if you ask me. <_<


I called the USCIS and they suggested to do an INFOPASS. Because my GC expires this 25th, I have scheduled an INFOPASS tomorrow and will ask for one-year extension which has never arrived, yet! Also tomorrow I'm going to ask if I can have early biometrics because my schedule is on June 27th. I remember being able to have biometrics done earlier than scheduled when I was applying for AOS but that was 2 years ago things may have changed but hopefully they will allow that taken tomorrow as well, so like you mentioned above, saves time from having to take time off work!

There are several of us that received NOAs for the ASC appointment ie biometric appointment but not the first NOA1 for extension etc....I called NVC today and after 35 minutes on the phone with a person, he escalated up to another level....50 minutes on hold for frig's sakes.....very very long time...what a waste, so i get a guy whom tells me that he sees it being issued June 1st and asks me to wait until friday and call them again if not received by them. i explained that I got the biometrics letter sat Jun 9th and it was issued June 7th, why wouldn't i get the June 1st NOA...he agrees the NOA1 is the normal flow then the bio letter but it is what it is.

so now i'm left with nothing new, just bullshitttte in terms of waiting for service and now we wait to friday to see if something issued 11 days ago will arrive or not. then call them for another 1.5 hour wait. this stuff really annoys me frankly.

Anyway, that's the latest on our end re this stuff. i'll post if I get the NOA1 or after I do this nonsense all over again on friday :angry:


Hey! So are you saying that the one-year extension is granted via mail? Like we are suppose to get something on the mail about that? All along I thought you have to go to the USCIS service center where you will have your biometrics, and personally have your whatever e.g. passport (not sure) stamped with that one-year extension note. Or I thought you will have that one-year extension stamp once you have your biometrics done.

AND ASK THEM ABOUT YOUR PACKAGE. THAT IS THE CLOSEST TO SURE WAY OF FINDING OUT WHAT HAPPENED. EVERY OPINION HERE IS JUST THEIR GUESS, until you call the USCIS, you never know what exactly is the status of your app.

Good question. Again someone on here posted that they received the biometrics letter before the NOA extending the g/c. Binow, you are in the boat as I...except you will be expiring sooner. You can call NVC to inquire, attend the bio and ask them or make an info pass so they can give you the I 551 stamp. I think you get that with the info pass. It's probably on the way but who knows. There really should be a naturally flow but it doesn't always work that way. :crying:

Well my plan is to call the USCIS location where I should take my biometrics and see if I can come in earlier than the scheduled date then maybe they can stamp my passport or whatever to reflect that my GC is extended. I will post on here Monday about that.

You will get a NOA which states that your GC is extended for 12 months while they process your I-751, you can use that notice, with your expired GC to prove your residency.

Hi Everyone and Fellow Filers!

I just sent my I-751 package today. My GC expires on June 20, 2012... Does anybody know if USCIS sends you a letter confirming your ROC application is on going? I am asking because my driver's license expires on the date my GC expires, as well as my other pertinent papers, which covers work authorization and the likes. Obviously, the card production won't be until about few months or so. I am curious as to how does that work.

Removing Conditions on Residency General DiscussionAR-11 Confirmation and Upcoming ROC

Don't worry about it. They sent my reminder at my previous address too.I filed AR-11 online so I just enclosed the confirmation copy on my application. But even though you don't have a confirmation copy it doesn't mean there will be problems. It's gonna be OK. Just send your application using your new address and it will updated from there.


Same problem with me. I filed the AR 11 in August 2010 as per the requirement. I had sent the AR 11 via postal service and not on line. Well I also got the notice re ROC sent to the old address. We own that property so it worked out but I was surprised. I called NVC today and when I eventually got the rep to understand I wasn't talkingn about biometrics but the change of address (took a while for some reason), she said not to sweat it unless the NOA takes longer than a month, then to follow up. She said if you put the new address in the I 751 forms, the documents will arrive at the address noted there.

I included a copy of the letter they sent me to remind of the ROC and I wrote a separate cover letter re the change of address and AR 11 previously submitted etc and submitted it with the I 751. Hopefully they'll straighten that out but it is concerning when you submit accordingly only to find someone feel asleep at the wheel, or so it seems.

We never received my husband's NOA1. So we, too, had to get the I-551 stamp in his passport which his new job took with no problem.

Thanks, it does help for sure. I'm calling USCIS tomorrow and then I'll make an infopass appointment. My only other concern is that my Canadian passport expires Dec 2012. I'm not sure if that's an issue or not. And I mean that if I get the I 551 stamp in that passport and it is set to expire Dec 2012....I need to surrender that passport in order to renew and get a new passport. That said, I'd be surrendering the stamp as well with that passport....I'd get it back but it'll have two holes punched into it to show the passport as invalid and i get the new one....mind you the I 551 stamp despite being in an old passport, would still be valid....

the best thing is to simply have the NOA but i guess that's too easy and far too inconvient and troublesome to have reissued. Instead people have to run around, getting info passes and taking time off work and being concerned with things.....

Quick question for anyone with experience on this issue.

Several of us petitioned to lift conditions (I 751) and received ASC biometrics appointment but not the NOA1 extending the alien card and work/travel...that said, with an infopass and I 551 stamp are you granted extension for work or is this stamp only for travel purposes? I recall getting the I 551 when first immigrating and it was a one time visa....this may be different. Not sure so hopefully people will comment with their thoughts and experiences. :bonk:

I don't understand why you are upset . You will receive an automatic 1 year extension of your 2 year card while you are waiting.


I think people react to the idea that everything is put on hold while all of this gets priority but that's not the case. There is still a flow and yes with ROC, we are here, we have filed, and we get NOA or stamped I 551 but we don't become illegal or face deportation. If the case isn't completed we continue to get extensions. Unless we are denied for some reason, which for all of us at this ROC stage, is incredibly unlikely...well unless you turn out to be an axe murderer or something, we are essentially waiting for the process to complete.

We're in a different place than those others discussed ie asylum, and specialized circumstances. My primary point was less about judgment of whether a policy should or should not be, although I have my own thoughts about this; but merely to point out that during the 2010 Haitian earthquake, many were concerned that the US administration was going to stop processing everyone but the folks in Haiti therefore delaying everyone's claims and petitions; but that was not the case and all just went along.

Here we pay 590 for what?? an 8-9 month wait from Vermont. These delays are so unreasonable given how high the fees are.

I talked to the folks at Vermont the day before, I'll tell you how it happened. Basically, they say the wait for RoC at Vermont is expected to increase to a year.

I went to hand deliver the RoC package at the VSC at 75 Welden St. At the gate, the guard asked me if I was a "bonded courier" - I said no. He said then he couldnt allow me to enter, but I could drop it off at the Post Office nearby or at UPS pick up point in the Staples store. The guard was friendly and sympathetic, no attitude was shown.

Luckily, as it was lunch break and the weather was perfect, there were lots of employees in and around the parking lot. Everybody there is friendly and courteous, far nicer then the folks at the New York office. I went up to a group of 3 and tried to start a conversation, but they seemed uninterested. Undaunted, I said goodbye and walked over to a group of 4 - 2males and 2 females, and here I was lucky. They were very willing to talk, and said after telling them I am in the RoC phase, they told me their workload is increasing by the week, and they don't have funding to increase the staff.

When asked, they stated there is little chance of sharing their workload with CSC or field offices as these RoC filings do not fall within the high priority pending cases.

They also added - and this is the important part - that there are lots of talk going on about Obama's recent decision to allow young illegals to work legally - and they will start accepting applications from the illegals within 60 days, from the date Obama made that announcement. They also said they have been directed to process this oncoming tsunami of applications - they expect uscis to be flooded with 800,000+ applications - on a top priority basis, and will be most likely diverting staff from other immigration applications to processing these.


So here we are....we, the law abiding folks get kicked to the back of the queue, while the folks whose parents break the law and enter illegally, now get rushed to the front of the line. Fantastic! Way to go, Obama! You sure will win my USC spouses's vote!


Well for the record, when I was petitioning for the green card under the I 130 there was all this talk about Haiti and the devastation of the 7.0 catasphronic earthquake in 2010 and those folks would be processed first etc....and people started making similar comments such as yours, against the President blah blah...and guess what? My petition from filing to approval took 6.5 months. Many many others were very close in that timeframe. So the argument and fear was without merit.

And do you remember that while it's a royal pain the rear to have to wait, there are people facing deportation, you are not. Just like the folks in Haiti faced unbelievable devastation, people actually complained about the possibility of their own claims being delayed, and weren't.

Thanks Zenaxe. However which state are you in? If you got a California driver license with I-551 stamp, which DMV office did you go to? And besides passport with I-551 stamp, current driver license what other documents do I need to bring with me to DMV?


For the Infopass, I have the 2 passport photos as they require on the website. Are there other documents I need to bring with me to get the I-551 stamp (besides green card, driver license)?


I'm in Arizona. I got my first license with the stamp and it was only valid for one year because I didn't have my green card or SSN. When I got my green card six week later I didn't change anything until the following year when my license expired. They would only then give me a license for another year which coincided to the expiration of the green card. So in August I have to return to the DMV and show them my stamp which means the DMV will only give me a license until Dece 18th....unless I get the NOA and i'll bring that document and buy me more time. It's a stupid pain in the A@@ by not getting this NOA, total booolshite.

For my info pass I brought my biometrics letter in case I do have that done...but they wouldn't allow it as they were busy. I brought my driver's license and green card and my passport so they could stamp it. That's it.
