Ok so we recieved our NOA2 and I am already so excited. I know there is still a mess load of papers that we still need to get through but I feel great because we are already farther along then we were the first time we filed with a lawyer
Here's how it went..... After we married 10-2006 I went to a lawyer to get help. The lawyer was the worst idea I had. He supposedly filed our I130. After continuous phone calls and just about all out harassing to find out what was going on, they asked me to come in and finish the papers. The assistant filed an I129F and sent in all the paperwork needed, our marriage certificate and wedding pics. The lawyer wouldnt even speak to me or look at me when I went in. Apparently the lawyer and his assistant didnt communicate well because, I recieved a denial letter in the mail. Our case was denied due to a non-exsistant I130 that was never filed. Needless to say the government doesnt give you your money back when you file wrong. And the cost to file went up since the first time we filed.
This time I decided to file on my own with the help from all the VJ heroes who are always here for assistance and who make me feel proud to be a member.
So now.... NOA2 (approval) kicking.gif has been recieved and it looks like next they will send my husband his packet. He is so excited and we are both so nervous. I am nervous and fearful. Even though I know we have every right to be together I know what it feels like to get a regection notice in the mail. Man was I crushed. crying.gif Still in the back of my brain sits that fear that wont go away darn it.
I still am not too sure what is comming next and I will be crying out for help to all my VJ brothers and sisters for help in figuring out these papers but I must say I feel so safe here.

In regards to the household size, I think you are correct in that your currrent household size is 2 (you and the 16 year old), as you do not claim any others on your taxes/ pay child support for them. But I am not 100% sure.

To explain why you didn't file taxes, you need to have "do not meet the income requirement to file taxes" somewhere in the letter. You need to request the "proof of non filing" from IRS to attach to the letter.

It's free to request the Non-filing statement from IRS, you can call and they will mail you within 1-2 weeks.

And I think my process is going to take so much longer cause I take forever to send things back. I check it then recheck it and then look up to be sure I did it right then call NVC to check if I did it right. My wife and I received our Cambodia issued marriage license in 2007. For the next 2 years I provided spousal support
for her while waiting for her to receive her visa. After she received her visa from the consulate, she slept with her boyfriend and arrived in May 2009 to the United States pregnant. Unaware of her adultry, I married her again 3 days after after her arrival to U.S.A. She gave Birth to her boyfriends baby yesterday and I'm seeking an Annulment for marriage fruad and release of any I-864 liability and her immediate deportation as my I-864 AOS does not include supporting her and her boyfriends child. What are my chances to have a successful annulment? Am I on the hook

I highly doubt that NVC wants anything to do with original greeting cards or stacks of photographs. Send copies of cards and print the pictures 6-8 per page on high quality paper or a full size sheet of cheap photo paper.

The only thing I've heard of people getting back are original documents that are submitted with the DS-230 (birth/marriage/divorce certificates, etc.)



Yes I forgot to mention, you do get many original documents back such as birth certicates etc....usually you get this once you interview at a US consulate and you are approved. No pics etc from the I 130 and that package.

Thanks for clarifying. I was wondering. You could consult with an immigration attorney. If your husband cannot satisfy the income threshold as set out in the immigration requirements you will need a cosponsor to get it done. There is obviously a reason for her to change her mind. Barring speaking with her and her changing her position, your husband will have to find another person. That's a tough situation to be in. Perhaps you can work this out with her. There was a reason she agreed in the first place and something has changed.

I think a relationship timeline might be useful but if you can show an ongoing relationship since 2006 you probably don't need a formal Evolution of Relationship letter.

Well, the only one that really needs to be original is the actual I-864 since it requires a signature. When you send documents to NVC by electronic processing, do you send any type of orginal signature? If not, the copies are probably fine.

My take, while the consulate can not reject the affidavit if your mother can show sufficient income. Depending on what your mother vs. father make, the VO might question why your mother is the sponsor and not your father. I think having both of them be a sponsor shows that both are supportive of the marriage which helps to establish the legitimacy of the marriage in the VO's eyes.

As you know, it is really not unusual for someone to live in a city different than her Houku. My friend's wife Houku is in another province but lives here. She got the certificate from her hometown. If at the time of Entry to the US you have been married for over two years, the visa will be upgraded to IR-1. Typically, the POE Officer will do that automatically but if it applies to you I certainly would point it out to the officer.

Depending on when your two year anniversary occurs, the consulate might also upgrade to IR-1 but the date of POE is what matters. In many cases, couples will delay POE to enter after the two year mark since it means an automatic 10-year green card.

As far as I know there is no exemption to the 125% poverty limit for a veteran. You really have two possibilities.

If you have assets in the US, they may be sufficient to make up for the lack of your retirement income. Study the I-864 instructions if you think you might be able to make up for the difference that way.

However, if you have a friend or relative (it can be any USC or LPR) who is willing to co-sponsor your wife, you are good. Also keep in mind the co-sponsor needs to make the minimum for their household size plus your wife.

Also your household size will be three once your wife has the baby assuming you don't have any other underage children or others you are supporting.

Lastly. Tax returns. The wife does not have a TIN or SSN. So I have not filed taxes for the year 2010. Should I file those taxes? We also have a child born this tax return year that will be added to the tax returns.



You are going to need to file your taxes since it is an obligation as a US citizen. You have to include any foreign income but usually you are able to exclude it. You will have to file a W-7 and mail your tax return to the address in the W-7 instructions (If I remember correctly it is in Texas). You need a notarized copy of your wife's passport which you should be able to do at the US consulate. She has to accompany you to have it notarized, if she can not accompany you, they will do something similar to a notarization that works just as well.

If you file 2010 soon, you should be able to get the ITIN for your 2011 taxes since as an American living abroad you get an automatic extension to I believe June 15. You won't need your tax returns to at least the NVC stage (or interview if you can DCF) so you should have them in time.

This is where filling your information might help. In China at least they do a Chest X-ray. I think the intent is to check for TB but I don't know for sure. The doctor at the exam might look at it. We brought it to our interview but the consulate didn't want it. We brought it to the POE but they did not want it either. So it is now a souvenir. My wife having an unnecessary X-Ray bugs me but then many things in this process bug me.

So it is likely your wife will have no issue without the X-Ray. Some countries might not do them at all. If they ask, all she can say is that she followed the consulate's medical procedure and they didn't do one. I am not trying to cause you unnecessary stress but the X-Ray is one of the inconsistencies in the process.

Your wife should be fine, there really isn't anything to be worried about.

How well does your wife speak English? What is the intended POE? Would you anticipate her having a problem communicating with the border officer? This might be the biggest issue.

Make sure she carries on the plane her brown envelope and X-Rays. They likely won't take the X-Rays but bring them anyway. They will keep the brown envelope. Does the immigration paperwork have you current address where you want the green card mailed? If yes, no worries. If not, she needs to have the updated address. All paperwork she needs should be in the brown envelope. She shouldn't need any updated info on your employment.

Typically, they will ask where she is going? Plans?, etc. but my impressing this is typically more chit-chat than a true interview. However, it is possible the officer could deny entry but the only scenario where this might happen is if the officer suspected your wife was attempting to do something illegal (drug smuggling, etc.).

How long have you been married? If over two years you need to make sure your wife has a copy of your marriage certificate to make sure she gets an IR-1 visa and doesn't have to remove conditions in two years.

I would go to the reviews on this web site for your intended POE as that may also help you prepare your wife.

At the two year mark of entry if married less than two years, you would have to remove conditions which might be difficult to prove if he was living in Singapore for a significant portion of that time.

The USC spouse has to establish domicile to qualify for the CR-1/IR-1 visa but how long does he have to maintain domicile after that?

The advise we got here, is that the translation needs to be certified and that this can only be done in the beneficiary's Hukou, so that's what we did. We were told that it was not acceptable to just translate it yourself. I'm no expert on any of this stuff so we just followed what others here said they had been successful with. We only filed CR1 recently so there has not been enough time to know if what we did is truly right or not. BTW- the translations we received for our marriage certificate (red book) and my wife's divorce decree were bound in larger "white books".

While USCIS may accept a self translation or even an 'official' translation from the US. Guangzhou is usually (always?) insistent on getting the official Chinese notarization in the form of 'white books'. When it comes to the interview, make sure you have the 'white books'.

My NOA2 is from May 31 and still no case number either!! I was told they received our file on June 20 but today I called again and still no case number. CSR said to wait 2 to 4 weeks!! (which I don't believe because we know for a fact that it does not take that long to get the case number!).

I hope we'll get our case # soon, for as what NVC is telling us we need to send a scanned copy of our NOA2 blah blah same thing as they're saying to everyone else. I hope good news will come soon for us and for others who are waiting too. :yes:

I just called USCIS and asked about why NVC still haven't receive my approved visa petition. My notice date was May 27, 2011. USCIS Customer Server told me to wait for 90 days!!! :o :angry:


huh :o frickin' 90 days wait! We're approved by USCIS on June 8 and up till now no case # assigned yet. Hoping for good result soon and same goes to your petition too. I understand how you feel, it's difficult to stay calm and not be frustrated but the best thing we can do now is be patient and just do what you can on knowing what action you have to take and hopefully find solution to your problem.
