Typically the I-9 and W-4 are filled out the first day of work. It might be reasonable that your future employer might want to see a copy of your visa before then to confirm you are elgible to work in the US but normally they take your word for it until you actually show up for work. Plus, you will not likely have a SSN until a couple weeks after you arrive which is needed for these documents as well.

My wife and I went to Hawaii for a week in October 2011 where she activated her CR-1. We then went back to China where I finished my work assignment, we came back to the US to live Christmas 2011. As long as your absences from the US are shorter than 6 months you are Ok, I also would try and avoid multiple short visits to the US with most of the time outside the US as you may get questioned if you are really residing in the US.

I actually FedEx my wife's green card to China once it showed up at our mailing address in the US though I am not sure if I was supposed to do that legally.

Congratulations! It is actually maybe the best evidence of proof of your relationship so it will help. If I understand correctly, you have not submitted the I-130 yet so the baby will almost certainly be born before your wife is approved so you should as others have said familiarize yourself with the CRBA.  Also, airlines will not let women typically fly late in pregnancy so you will have to take that in account as well depending how far the consulate is from your wife and when she might want to enter the US.

Were you married two years on the date you entered?  If not, they definitely made a mistake.  If so, I think your best course of action would be to make an INFOPASS appointment and explain the situation and see what they want you to do.  You might try over the phone but it can be hard to get to anyone with any real decision making authority.

omitting information IS the same as lying.. even forgetting something and failing to disclose it can be construed as a lie

 

I am no lawyer and yes there is a Lie of Omission but this is typically you withholding information that you know to be material. Still you have to be asked. In many cases such as a police investigation over a criminal manner or in disclosing previous conditions during a real estate transaction you are asked a generic is there anything else that might be relevant?

When it comes to interviewing for a visa, you do need to be careful to truthfully answer any question in verbal or written form, the expectation is you are making your best case to get the visa and not willingly disclosing information not asked that might hurt your case, I don't think will be held against you.  As others have said, it is a fine line.

 

We are getting off-topic, my point to the OP was denial for a tourist visa does not really matter when it comes to an immigrant visa unless there is a documented trail that can show the interviewee has not truthfully answered a question previously asked.

A denial for a tourist visa (generally because you can not prove lack of immigrant intent including lack of financial ties) is typically not an issue when applying for an immigrant visa. The only issue you might have is if your husband lied during the interview.  Keep in mind, not offering information - that he also planned on visiting his fiance is different than being asked a direct question and lying.

Did you or the fact that he might have a girlfriend/fiance in the US even come up in the visitor visa interview?  If not, there should not an issue.

I was under the impression that if you formally surrender a green card it shows a lack of immigrant intent and makes getting a vistor's visa much easier even in those countries where obtaining one. A child born to a legally married couple where you have proof you were in the same place at the time of conception.  Unless for some reason your husband was disputing his paternity, I don't think you will need a DNA test either.  The baby is also pretty good evidence for the I-130.  I think you will be OK.

 

The bigger concern may be your husband's past legal trouble depending on what exactly he was convicted of.

So the issue typically is you can not file Married Filing Jointly without your spouse SSN and until he gets here he likely does not have one.

 

You are able to get an ITIN. I would recommend you ask someone with Phillipines specific experience the best way to do that in the Phillipines. The ITIN is issued by the IRS but getting the necessary notarization varies country to country.

 

You should ask your tax preparer if you can file Married Filing Seperate without your spouse SSN, I have hear different answers to that.

 

And finally when you finally get the SSN you should amend your tax return for 2012 and 2013 to married filing jointly and you should get additional money back.

Yes, the CR-1 (married< 2 years)/IR-1(married > 2yrs) visa is immediately a green card.

 

You should be able to DCF and you should be able to apply for the first step in the USCIS office at the Beijing Embassy.  The final visa interview will be in Guangzhou.

 

You mentioned that you want to go back in July/August.  DCF is fast but that might be pushing it. The fastest I have seen is about 3 months for DCF but I would figure on more like 6 months. The one thing that would significantly extend that is if your wife is a member of the Communist Party (this can add another 6 months).

 

And while you can use assets, I have never heard of anyone using assets in Guangzhou, (individual consulates in different countries seem to have their own unofficial rules).  If a family member (parents, sibling) or a good friend is willing to be a co-sponsor, that would likely make the process easier.

Don't worry about the GC you will eventually receive it after a month or so. If you opt for SSN to be assign to you automatically and said yes in your ds-230 you will receive it after 3 weeks ( you should receive your ssn in 3 weeks time if not, you can follow it up by phone or you can visit the nearest ss admin.)In my case, I have to go to the nearest Social Security Admin. to personally apply for my SSN because I did not receive mine after a month. I suggest you do the same if you already got your GC and bring identification with you like passport. Good luck :)

In filling out the I864, I have a question regarding listing income for previous tax years.

For 2010 and 2009, my taxes were "Married Filing Jointly" with my ex-spouse. The I-864 asks for my Total Income for those years - do I list the number from those two tax returns (which is a combination of my income and the ex-spouse's income, as we filed jointly), or am I expected to attempt to separate my own income out from the ex's and attempt to tabulate it up based on my W-2s?

I don't mean to be dense - I am only concerned because I have seen RFEs be issued because the numbers on the I-864 do not EXACTLY match the numbers on file with the IRS for income.

Help/suggestions are appreciated. Thanks!

The average is 5 months according to USCIS website for I-130 to be approved. Vermont currently is taking much longer for NOA2 approval which is the I-130. There is no exact time, just need to be patient and wait, trust me its not easy. After you receive your NOA2 then it goes to NVC and adds about 3-4 months to finish the process. I was noticing that for Colombia its taking about 4-6 months for I-130 approval for California Service Center. A total of about 9 months for the full process with no RFE. Again, each case is different it might be faster or longer. Im expecting to have my wife here in April at the latest. I'm hoping sooner, much sooner.

You Welcome. I got married in Colombia, I don't know how the process works in the United States for marriage. Once you have your legal marriage certificate physically with you, then you can file immediately, no grace period. The marriage certificate is required for the I-130 to prove you are married, no other document can replace it.

I got married in Colombia, I don't know how the process works in the United States. Once you have your legal marriage certificate you can file immediately, no grace period.

We are trying to get married in March 2013, but was wondering if we can file I-130 in January 2013? Or do we wait to get married first then apply?

And how long does is it take to approve the consular processing of I-130 IR-1 for Australians these days? We will be applying through the Nebraska service center.

Dear Visa Journeyers,

I'm a US citizen patiently waiting for my wife's CR-1 process to finish. :bonk:

However, I'm concerned about the embassy interview questions she will be asked:

  • When was the last time you saw your husband?
  • How many times did he visit you during this visa process?
  • Where did you go for your honeymoon? Show some pictures.

Due to my job, I haven't been able to visit her since our marriage in Summer 2012. And I don't think I'll get any vacation time to do so until Summer 2013. :(

Also, we postponed our honeymoon until she comes to USA (Hawaii or bust! :dance:) because we didn't feel safe traveling around by ourselves in a foreign country. Well, even though she's a citizen of that foreign country, she never traveled by herself either. :innocent:

Because our situation is rather uncommon, I fear that my wife will have a tough time at the embassy interview and our case may even be rejected. :devil: I think we'd stand a better chance if I could accompany her to the embassy interview and explain the situation to the immigration officers.

Is this possible? Can a US citizen to accompany his wife on her CR-1 embassy interview?

I haven't seen my wife since we married in September 21 2011, we just received our NOA2 on the 17th of this month. I asked myself the same question, and don't see a reason why it would be a problem as long as you have proof of an ongoing marriage. The most important part of the interview is for her to be very prepared with all paperwork in order and confident in all her anwers. You can attend the interview if you are able too, but is not required. I don't remember reading anywhere that you must have seen your spouse within a certain time frame. I looked in the travel.state.gov website and couldn't find anything.

I am sorry it might be stupid question. i read people don't staple any paper. then some say they do staple the I30 form.
How about sections. lets say the copy of all passport pages? or stapling the supporting evidences. like individual phone bill summary pages to separate them from other bill summaries?
or do you suggest inserting blank sheets and marking them with titles? suggestions please.

I used paper clips to seperate the documents by type that had multiple pages. I used a simple seperation page for evidence. It's not a stupid question. I would stay away from stapling, try to make uscis job easier.

I have had all my I-864 appliation package completed for quite some time now waiting for petition approval( March 4th) and NVC case number( call everyday, they said they received on March 8th but it is not in the system yet for case #)
I, along with several coworkers were laid off on March 11th from my company. Now I am unemployed.
Should I redo my application package? Or just leave it as is and then if they ask later on let them know I became unemployed after I completed the package.

You need to have a co-sponsor, use assets to meet the poverty line or find another job. I would not use that I-864, since it's no longer current annual income. Sending that I-864 is a big No No.

Hi Guys,

Even though I know I will most likely not get an approval (NOA2) until Dec. I would like to get my ducks in a row for the next steps.

I would like to have all my NVC documents ready in express envelopes ready to go. I noticed in the guide it says to send a copy of all documents in the package, is this accurate? Do I need to send the list of Docs for AOS and IV Package and in addition copies of all?

So far I have:

A draft of the DS-3032 (Choice of Agent only missing NVC case # and email address for NVC) email, used the template in the wiki.

For AOS:

- Filled I-864EZ
- My Tax Return Transcripts from IRS for years 2011, 2010, and 2009
- My pay stubs for most of the year, I am thinking I will submit copies of the latest 12 which accounts for 6 months of income.

I don't want to involve my HR office with the employment letter, I am hoping that the fact I have been working here for 2+ years together with the tax transcripts and pay stubs are enough.
Does this need a cover letter?


For IV:

- 4 Passport size pictures (do these need to be marked?)
- Marriage Cert (Registro Civil de Matrimonio - COLOMBIA)
- Birth Certificate - Applicant (Registro De Nacimiento - COLOMBIA)
- Copy of Bio Page Passport - Applicant (Colombian Passport 2019 exp date)
- Police Clearance - Applicant (Antecedentes Judiciales - COLOMBIA) printed from the police web site.
- DS-230 Part I (filled and signed by Applicant)
- DS-230 Part II (filled and NOT signed by applicant)

Does this need a cover page?

I will be sending originals for the NVC stage for IV packet. The Registro Civil de Matriomio HAS to be the long version, not the version that was sent with the I-130 packet. Cover pages are not necessary but a lot of people send them. Marking the pictures, that I'm not sure of.

long time lurker, first time poster. We used a lawyer, mainly because each of of our travel schedules for work, we wanted to make sure there was one place the paperwork was being sent to where it wouldn't be missed and someone was sure to act on it. If I had to do it over again, I probably wouldn't have used a lawyer. We hired a really reputable lawyer and he did an ok job, but the NVC lost one of our forms he'd submitted, and I was the one who caught it, because of the knowledge I'd gained here on VJ. From looking at the guides and reading the forums, I knew exactly how long it should have taken from the date the DS230 was sent until our case completed, and when 2 months had passed with no word, I got all over our lawyer to follow up. Lo and behold, the NVC didn't have a record of it being received. (and I know he'd sent it, he copied us on all tracking numbers, etc) He re-submitted it and within 14 days our case completed. So having a lawyer doesn't mean it's going to be any faster. They can't fast track things, they can only make sure it's done correctly and that someone is keeping on top of your stuff. And the NVC misplacing paperwork somewhere in the shuffle doesn't happen every day, but isn't completely unheard of. Doesn't matter who files it if that happens.

If you have a straight forward case, have clean police records, have a good co-sponsor (or make enough to do the I-864 yourself) and are a detail oriented person, it should be really easy to do it yourself following the guides here and asking questions of the people on the forums to make sure you're doing it correctly. I think you certainly will feel like you have more control over the process if you do it yourself.

It does seem to take forever and there is a lot of luck involved on how fast things get processed. I would look at some of the timelines on here with similar filing dates or NOA2 dates to ours and want to beat my head against the wall. But you just have to take it one day at a time and roll with it. it's a pain in the ####, but you can totally do it yourself. That's my .02 cents anyway.



I agree, having a simple case with no criminal record, no children, no prior marriages and are very detailed in how you organize and present everything it will be easier and straigh forward. Detail is KEY...

Hiring an agency or lawyer will not make a difference on how fast it's approved. It depends on the workload of the Service Center and a bit of luck for a fast approval time. The other members are very correct, you can do it yourself and save a lot of money. We did it ourselves, and have had a flawless process with no RFE or major delays. All the information that you need for CR-1 or IR-1 and fiance visa are all on this website. The members here are extremely helpful and without them we would not have been able to do this process. I have seen other posts in which members have used a lawyer or agency and they have committed mistakes by forgetting to send a document with their packets. Good luck in the process.

Yeah, you know, I asked about that recently because they've posted the update as of Sept 28 but if you look it says the processing times are as of July 31? I asked them what's the real processing time then? I was told they're doing Feb 1 now and they posted Sept 28 = 8 months. This is a increase of two weeks since last month.

Ok so we recieved our NOA2 and I am already so excited. I know there is still a mess load of papers that we still need to get through but I feel great because we are already farther along then we were the first time we filed with a lawyer
Here's how it went..... After we married 10-2006 I went to a lawyer to get help. The lawyer was the worst idea I had. He supposedly filed our I130. After continuous phone calls and just about all out harassing to find out what was going on, they asked me to come in and finish the papers. The assistant filed an I129F and sent in all the paperwork needed, our marriage certificate and wedding pics. The lawyer wouldnt even speak to me or look at me when I went in. Apparently the lawyer and his assistant didnt communicate well because, I recieved a denial letter in the mail. Our case was denied due to a non-exsistant I130 that was never filed. Needless to say the government doesnt give you your money back when you file wrong. And the cost to file went up since the first time we filed.
This time I decided to file on my own with the help from all the VJ heroes who are always here for assistance and who make me feel proud to be a member.
So now.... NOA2 (approval) kicking.gif has been recieved and it looks like next they will send my husband his packet. He is so excited and we are both so nervous. I am nervous and fearful. Even though I know we have every right to be together I know what it feels like to get a regection notice in the mail. Man was I crushed. crying.gif Still in the back of my brain sits that fear that wont go away darn it.
I still am not too sure what is comming next and I will be crying out for help to all my VJ brothers and sisters for help in figuring out these papers but I must say I feel so safe here.
