Yes, it can be very difficult to read however. There will be a WAC (for CSC) or EAC (for Vermont) number printed on the back of your cancelled check. The number will be like WAC-08-XXXXXXX. For some people, they still won't see their cases online for a couple weeks after receiving their NOA-1 as well.

Russ and I has been married since Jan 2009. We have a lil girl and she is 2 years and 5 months old now. First , we filed on a k3 non immigrant visa this was in march 2010... we got approved from the USCIS 5 months later.. we were very happy but then a few weeks later my husband received a letter from the NVC that we need to pursue a CR-1 route. Now, we are gathering all the papers and everything went well except for the AOS that really takes forever.
My husband has an M.D. degree and I'm a nursing graduate. My husband has been out of his career for quite sometime now because he is taking good care of his mom. She is disabled ( she had a car accident in 1984 and her one leg were amputated...and she has been miserable and depressed for a long time) and in a wheelchair and can't do so much. My husband loves his mom very much (he took her with him when he came to philippines to marry me). and I let him to take good care of her because i care about her too. Now, they had an agreement long time ago that she's going to sign the AOS for me so he can take me to USA (it is so heartbreaking to see them going home twice without me and my baby) but now she won't do it for us... even if my husband has done a lot for her. AOS is the only thing we need so i will come home to USA and be reunited with my husband. We have asked his family and they won't do so much about it. It has been 2 years now of waiting and nothing happens.. our lil girl she is 2 years and 5 months and the last time she was with her daddy was when she's 4 months old. It is has breaking for me to see her growing without her daddy although she does spend time with him via skype but it's never really the same. At times she will tell me "mommmy, we're going home to USA" and sometimes she will cry looking for her daddy. It is has really been a tough situation for us. I know that God allow this thing to happen so good things will come out of it. My husband and I loves each other very much and we have Faith that God will make a way for us and never to give up


Adjustment of Status (AOS) applies when you are living in the USA, get married and then file to adjust depending on if you came here via K1 r K3 to get your green card; hence the adjustment of status. K3 visa aren't being used anymore. At a time when this took forever, the K 3 visa was a way of getting in faster; But the gov't has made changes and it's just as fast to get through via I -130 so K 3s are phased out. If you are now married and are filing for the I 130 there is no adjustment of status. You get approval and you get a green card; there is no status to adjust. Once you get the green card you can immigrate to the USA. I believe you said he married you in the Philipines. The only other issue regarding anyone else signing is if he doesn't make enough money as per the guidelines to support you and would require a cosponsor. He has to prove that he makes sufficient income to support you and or children. The amount required depends on the size of the household. If this is not the case, then no other signature is required.


File for the CR 1 and you won't need the AOS.

1. You will absolutely need the beneficiary's birth certificate at the NVC stage. Read my post again, I did comment on that. I"m the beneficiary in our case and while my birth certificate was NOT required during the filing of the I 130 petition, the original birth certificate for the beneficiary is REQUIRED when the case gets past Notice of Action (NOA) 2 and gets sent from the Dept of Homeland Security to the Dept of State (NVC).

You should get familiar with the guides here and the short cuts and they'll show you the process and flow. The guides were helpful to me when I first started the process.

And I had to have my birth certificate translated because my original birth certificate was in Italian and not in English as I was born in Italy. So for the beneficiary you will need the original birth certificate plus a translation of that by people that are qualified to translate. They have to sign a form saying that the they are qualified to translate and that the birth certficate has not been altered in any way etc.

The initial filing of the I 130 petition does not require the beneficiary's birth certficate but it DOES require a copy of the petitioner's certificate. It does not need to be a certified copy. But as you progress through the process, the original birth certificate or certified true copy of the petitioner's birth certificate will be required.

The petitioner's birth certificate will be required when your case goes to National Visa Centre. Your country doesn't qualify for electronic processing so all the original documents will need to be sent to NVC when the time comes.

I was wondering if W-2, pay stubs from her previous 6 months employment and a letter of her employment would be sufficient as an initial evidence for I-864? My wife income was below the poverty and we found a joint sponsor. Since my wife is a petitioner she still need to file I-864 and a joint sponsor. Does my wife need to provide a transcript of her tax return? Is this necessary? How about W-2? is it not enought?

I've read the checklist of the I-864. It states a copy of federal income tax return, including W-2.

How long does it take to arrive if transcript was ordered today? What is federal income tax return? is this called 1040EZ? This was the only one that I found together with W-2.

HOH has a specific definition as provided by the IRS... If you meet the definition then you can use that status. With one or two exception, HOH is for single households with qualified dependants...



So if the person is adjusting his/her status for this year because he or she is married to USC, what exactly would be the status of the 2008 filers if he/she is married when filing his/her income tax return? I was wondering, why was it that the biographic form was the only one they received? Biographic form is one of the supporting evidence that's required for a person whose adjusting for status. If I were you, just give them a call to verify if your AOS has been submitted. Sometimes, but don't get me wrong...some atty says that the package has been submitted even it's not. Anyways, to make your time line, just sign up to your time line. Or look up and you can find "my control" click that and on the left side click "edit signature" then enter your time line and click update.

Certified or priority mail via USPS is unpredictable....it will takes more days to arrive to its destination. I don't think your package is misplaced or lost..these days are very hectic due to upcoming holidays. If I were you, I would rather spend $25 for shipping fee via USPS express (next day delivery) rather than sending it using priority or certified mail. Just wait for few more days. May be you can request for early W-2 from youe employer.

2008 tax return is not come into effect yet. They knew that W-2 is not available 'til early Feb. Don't worry so much..the deadline for filing 2008 income return is on April 15, 2009.

You should have filed I-130 and I-485 concurrently in the first place....anyways, just file your AOS application and include the copy of the approval notice of your I-130...I don't know if you need to apply for I-765 and I-131 at the same time....but goodluck !!!!

I would agree that if you anticipate an interview around April 15, file married filing separately is likely the easiest way to go. The IRS just tightened the requirements for getting an ITIN so it can be very hard to get the required paperwork in many countries. Just plan on refling, once your wife is here and has a SSN.

You weren't very clear on your exact relationship to your child but I am guessing it is not a biological child born when you were already a US Citizen; in other words the child is not a US citizen (though I understand he may become a citizen once he enters on an immigrant visa). Unless they are a resident of the Canada or Mexico, you are not going to be able to claim him no matter how much support you provide.

I'm glad I'm not alone in seeing the quagmire that this form presents when you are petitioning a Spouse.

I'll go with the EZ form.


Yes, you are not the first person to be confused by the form but if you look right above 21b it says:

Persons NOT sponsored in this affidavit:

One warning, many consulates will not accept the I-864EZ (China doesn't). I would check in the regional forum if your particular consulate has any specific requirements.

On I-864 ii seems that I'm reporting my Wife twice.

On line 8 I selected (I'm sponsoring principal immigrant) and also clicked on yes.

So when I get to line 10 I record 01 and carry it over to line 21a but then I also had to enter her again on line 21c.

Now it says in capital letters not to add anyone twice but line h says to add all lines.

How did you folks get by this?


Put 0 for 21c.

Aren't there issues with applying for it while she's still in the US? Something about committing fraud because it wasn't her initial intention to leave. However, I was considering applying while she was still out here and just ensuring that she still has her job in Australia and the return ticket unless it gets approved. Do you think this is reasonable evidence showing that she wasn't trying to stay here permenantly?



There are issues if she tries to stay and Adjust Status while staying the US. What I am suggesting is you can submit the I-130 as soon as you get married and likely when she is still here. The petition normally takes 6-9 months to be approved which means she will have to go home before the petition is approved. Eventually, she will have to do the interview in Australia anyway. Beneficiaries with pending petitions are not necessarily excluded from visiting either under the VWP or with a Visa. However if you read through these boards, border officers tend to set a higher bar to prove the visitor will return to their home country when a petition is pending. So be prepared that once she leaves she will not be able to come back to visit until the immigration visa is approved.

Yes you can get married on the VWP, start the I-130 even when she is still here, and as long as your now wife leaves the US within the allotted time of the VWP you will be fine. As long as you can document the entirety of your relationship you should be OK.

Given you are only 19, I would give some thought to the fiance process as the immigration process can test your relationship and this might help both of you to be sure.

The other potential issue is whether you can show sufficient income for the affidavit of support. If not, you need a co-sponsor which can be anybody but in your case would your parents be willing to be the co-sponsor?

What consulate will she be interviewing at? What tax returns are required differ from consulate to consulate (though in theory they shouldn't).

I believe the first extension from April 15th is automatic so I wouldn't worry about it. The only issue is if you owe, penalties and interest start accruing form April 15th so you need to estimate what you owe and pay by April 15th.

If you think you will have the SSN by the end of the extension, I would wait to file unless you are dealing with a consulate that is strict on this and then you file either Single or Married Filing Separately(not sure if lack of a SSN is an issue when filing seperately).

The other thing that might matter is how close to the poverty line you are. If you are way over, lack of a 2012 return may be less of an issue especially if you can show recent pay stubs.

Typically the I-9 and W-4 are filled out the first day of work. It might be reasonable that your future employer might want to see a copy of your visa before then to confirm you are elgible to work in the US but normally they take your word for it until you actually show up for work. Plus, you will not likely have a SSN until a couple weeks after you arrive which is needed for these documents as well.
