I doubt you lost any time. Chicago is still inputing applications from December. Even before USCIS initiated using the Chicago office for input, your file would of been transferred out of Texas because Texas doesn't process I-130 applications anyway.

The tax treaty means that your husband's foreign income is not exempt from U.S. income tax if you elect to file jointly and include world wide income. I would suggest either looking at filing married filing seperately or if you have a qualified dependent (e.g. a child), then you may qualify to file as head of household. There are also several threads here about U.S. tax requirements. You may want to read those as well.

It could be true. I had a similar experience with the IRS. In order to get a ITN for my spouse, I had to submit a certified copy of his passport. He got the certified copy from the nearest Chilean Consulate (he is Chilean citizen with LPR in Canada) and the certified copy was in Spanish. I called the IRS and asked if a translation was required and was informed they don't require translation from Spanish, other languages they do, but not Spanish.

It is possible, but not probable to get a B1 for a pending immigrant. Fortunately, my husband already had a valid B1/B2 before we applied and he has used it a few times to enter the U.S. to visit since application.

I would definitely call the IRS. From all the verbage I just scanned through on the IRS site, they only refer to 'unmarried dependents.' Your parents might have lost the ability to claim you as a dependent since you are now married.

This is incorrect. A non resident alien is not required to file a tax return, even if they are married to a USC, but they can do so voluntarily if they choose.

You can chose several ways to file if you are not living with your spouse. You can get your spouse a ITN and file married filing jointly or married filing seperatly; or if you have lived seperatly more than 6 months during 2007, you can file as head of household (if you have a qualifying dependent) or even as single, if you so chose.

You will probably sent to Vermont. East = Vermont, West = California. You can use the Mississippi River as your dividing line pretty safely.

By the way, USCIS cashed my check today for the resubmission of my I-130. I haven't received the paper NOA-1 nor does my case number appear on line yet.

I filed originally in Oct 2007 and my application was rejected in mid January 2008 (yeah, it took that long for them to open my envelope) because I signed the I-130 on the wrong line. I resubmitted my application the following day and am now probably a January filer. Sucks to be me.

A permanent resident is given the privilege of living and working in the United States permanently. A person's permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day they were given permanent residence. A person is also given conditional resident status on the day they are lawfully admitted to the United States on an immigrant visa (having been married less than two years and entering on a CR-1 Visa). A person's permanent resident status is conditional, because they must prove that they did not get married to evade the immigration laws of the United States.

My husband (a Canadian LPR) has a B1/B2 for the U.S. It was issued for a 5 year period. Just because he has this valid visa does not guarantee entry into the U.S. though. Be prepared for a turn around at a CBP officer's whim. Just a word of caution.

You will not likely be complete in 6 months. First, you have to get your I-130 approved by USCIS, then your file is transferred to the NVC and you will be required to submit more information, forms, and payment, then your application goes to your nearest U.S. Consulate/Embassy where you wait for an interview.

Keep in mind that the bulk of IR-1/CR-1 wait time occurs at the NVC and waiting for a consular interview. My guess: 12-18 months for completion as the back log catches up to the NVC and the Consulates.

IRS.gov has the W-7 form and its instructions on how to complete it (just type W-7 in the search box on the site and it will take you right to the form and its instructions). It is pretty self explanatory. You will need to submit ID for the foreign spouse along with the W-7 and most people can submit a certified copy of her passport along with the W-7 form. An English translation will also be required if the passport is in any language other than English. You can submit the completed W-7 (with its accompanying proof) with the tax return and just leave the SSN blank for the spouse on the return.

NVC takes about 10-12 weeks to process an IR-1/CR-1 application. The I-129 will be rejected/ignored since you can only file for a K-3 prior to approval for for I-130. You are now on the CR-1/IR-1 path and not much you can do to get a K-3 at this point.

It is most likely the OP will get an RFE and USCIS will not entirely reject the petition. USCIS tends to reject petitions prior to accepting the fee and then they return the entire packet with the uncashed check.
