My Plan B: oh wait, I am on Plan B right now, waiting for USCIS. Plan A was for me to immigrate to Canada and that whole thing tanked.

Ok, so Plan C: immigrate to Chile as my husband is a Chilean national. Doesn't sound very appealing and going through any kind of immigration process (let alone for a 3rd time) is almost certainly out of the question. *discards Plan C draft into the trash*

Plan C (revised): go on a nice Mediterrean Cruise with my husband this winter. Enjoy the nice weather, shop at a few ports, but spend most of our time alone doing adult things in our state room. Near the end of the cruise, we can climb to the upper levels and jump off the ship. It seems like that is our final option for spending our time together. Although of course, we would be spending our time as ghosts among the underwater remains of an old Spanish Armada that was sunk during a hurricane in 1602. But, hey, at least we can haunt the fishes together!

I am confused by your statements. I do not have an October date on my NOA-1, anywhere. I have January 24, 2008 listed as my receipt date and the date the NOA-1 was issued was February 13, 2008. There is no record that I filed in October, other than my USPS confirmation which states that CSC received my petition on October 29. I think my petition is sitting in with the January 2008 filers collecting dust.

Since my call yesterday, there was not another touch. I think the guy was just making stuff up and trying to get out of the office on a Friday.

Yep, MTL is one of the worst. We more than likely are going to ask for a change of venue from MTL to Santiago. My husband is a Canadian PR living in Toronto, and a Chilean citizen so we have that option. Seems like Santiago only takes about 2 months so I am still hoping on 2008.

I was very patient with USCIS and accepted the 3 month wait just for them to open the darn envelope. I accepted the wait for the NOA1. I accepted the wait for online status.

The FAQ's on the IRS website has always said that if one or both of the individuals listed on the return have an ITN and not a SSN, then no rebate will be issued. I elected to file as head of household this year for that reason (I have a dependent son from a previous marriage that qualifies me for HoH status).

I'm am not trying to burst anyone's bubble, but I have investigated using my senator's office and using them to issue an inquiry. I don't know where this mysterious '180 days' or '6 months' originated, but those are not any kind of magic numbers.

According to Senator Kyl's office, a Congress person can issue a 'Congressional Inquiry' to any federal office on behalf of a constituent. Sen. Kyl is a member of the Sentate sub-Committiee on Immigration and has been for several years. However, in regards to USCIS, his office, will not usually issue this inquiry until the constituent's case is outside of 'normal' processing times. These times can be found posted on the USCIS website. Unfortunately, perhaps just a few months ago, those times were usually 6 months from petition filing date and that is where these 'magic numbers' originated. However, as we all are experiencing now, it is much longer. Now, those times are closer to 7-9 months. Requesting an inquiry now will more than likely, according my senator's office, only result in a canned response stating that the petition is within 'normal and published' processing times.

My check for the resubmission was cashed today. It has a different WAC # then I received on the rejection notice, so I am working under the assumption that I lost my Oct 2007 priority date.

I am still waiting for a NOA-1. I received a rejected application in January because I signed the I-130 on the wrong line. Now, I still haven't received a NOA-1 for the resubmission and I don't know if I get to keep my original priority date or if I lost 3 months of waiting and have to start over...

I'm home today so I thought it was a good opportunity to contact USCIS and inquire about my I-130 and its missing NOA-1. I got transferred to the second stage customer service rep who obliged me with a name check in their system and found that I wasn't in it (no kidding, you say!)

I asked about the Chicago Lockbox processing and he advised that although the website is listing processing up through Oct 22, 2007, it does not mean that ALL applications prior to that date have had their initial data input completed.

Unfortunately, this rep I spoke with had a very thick accent and I was struggling to communicate with him at any level, so I decided not to pursue it any further. I will try again towards the end of the week and perhaps I will get someone I can understand.

Hi The_dip_sticks, this part was at the NVC, we only had to go through the 9 days!! Usually the NVC is pretty quick.Not sure what the hold up was, they just said Admin Processing.

Now we are stuck at the embassy waiting for his FBI clearance to be done. I think at this point is it on the beneficiary? maybe someone can clarify that. I don't think there is any way for you to request the checks, because depending on so many different variables depends on the checks that are requested.

Thank you everyone for your support!! I still can't believe that it was completed already! :dance: :dance: I did the DHL tracking and there is a case sent yesterday to Ankara. Maybe.. lol... they finished it and threw it on the DHL truck ha ha ha I doubt it, but hey, I can hope!!!!

Ok, so a couple days ago when I called NVC they said that the case was completed on 5/1, but that it had gone into Administrative Processing.

I called the automated system at 445a this morning and it now says:

You have to send G325As for both of you plus copies of all the supporting documentation of divorce, marriage etc.

omg thank you all sooooo much!!! Guess what??? I just checked the mail and I just recieved my NOA1....yes!!!recieved May 16, 2008 Yay!! I am so happy because before I got brave enough to file the papers alone I decided to go with a lawyer. March of 2007 the lawyer filed an I129F without filling an I130 and sent along with the I129F pictures of my wedding and our marriage certificate. Needless to say the case was regected due to a filling error.
Now i'm starting over again and I feel good about it this time. Just hope Im making the right decision to go for the cr-1 and not the k3.

Could be! CSC may not send the I-130 to the NVC. Submit the I-129F for backup until you find out if the approved I-130 is sent to NVC.
Doesn't cost anything and you can still pick which visa you want later.

But wont that mean that I am filling k3 and not the cr1 I feel just a little confussed.... im soo new to this stuff....sorry

Hi there,
I filed my I-130 October 15th and still have not recieved my NOA1 yet and I filed useing a catholic socal service and she told me with the delay that it could take up to 12-15 weeks before i could get one and I see on the uscis update on ours which was sent to chicago lock box they have done up to 10-18-07 as of yesterday do i am hoping that next week to get our NOA1 , This process is crazy this is my 2nd time around because the 1st time we did the I-129f and got no where, so heres hoping for all us that we all here news soon and 2008 is a great year for us to be reunited with those we love so very much! everyone have a great weekend.

My husband and I are still debating this dilemma of K-3 vs IR-1. If money isn't the object, but we want the options for my husband to be able to visit me in the U.S. (he is a Canadian PR, Chilean citizen) during the process, what are the pros/cons of these options?

A little history: We married 2 years ago after a 3-4 year long long distance relationship (we are not really sure when our friendship turned romantic, but its a conservative estimate). I moved to Canada with my son and we started the Canadian PR process. Needless to day, 2 years later, having no first stage approval and out of funds, I found a job back in the states and recently moved back and started working. My husband and son stayed in Toronto so husband could continue working and son will come to live with me when the school year is complete. My FOSS notes from the Canadian PR application process indicate that the Immigration Officers didn't like our significant age difference (I am older) and that is more than likely the reason for the huge delay in the process. All other information regarding the Canadian process (criminal history, background checks, medical, etc) were approved by CIC. We withdrew my application for Canadian PR a few weeks ago and are waiting on a refund of fees. My husband is currently in process for Canadian citizenship, but that process can take up to 1 year.

My husband currently has a B1/B2 visa to allow him entry for visits into the U.S. valid until 2010. I know that there is no AOS on this type of visa, but he can come and go out of short visits to the U.S. without problems.

In short, we want to find the quickest way to get him to the U.S. while having the ability to visit during the process. It would be bonus to have him able to work as soon as he gets here as well. So, voice your thoughts about this wonderful process you are undergoing now so we can make a decision and get off the fence already.

I used a Catholic charity (similar to the link I posted) when I was uninsured and pregnant with my daughter. You don't have to be Catholic to receive benefits. They covered all of my prenatal care and the birth +24 hours in the hospital for me and the baby. It was a godsend.

I recently jumped into the same boat as the OP. I moved from the U.S. to Canada, married, lived for 2 years waiting for Canadian immigration. We were floating in a boat of debt with me being unable to work, so we finally cut our losses after 2 years of living together and I moved back to the U.S. I started looking for a job from Canada in August and had one all lined up that began Oct 1 (after coming to the U.S. for a 1.5 day long interview). I am thankful to be employed and working again towards a future with my husband, but I miss him terribly. I am still in the process of trying to populate my apartment with furniture and I still sleep on a mat on the floor.

After being in limbo waiting for 2 years, we are starting over again on the other side of the border. Someday, before I become too old to enjoy it, I would like to live with my husband again. All I can do is be hopeful this process will end at some point on this crazy time continuum.

In the Catholic church especially, a child is given a 'confirmation name.' This is not a legal name, just a name that the church can recognize you by (the child usually takes the name of a Saint). After confirmation in the church, I don't know anyone who has used that name for anything.

You can change your address online with the USCIS. I didn't read the entire instructions, but I did not see anything about PO Boxes not being accepted.

If you do chose to have someone get your mail in your absence, be sure it is someone you trust enough to open items and contact you if it is urgent and be willing to express mail it to you in Japan.

Perhaps you have someone nearby your current address (friend or relative) and you can use their address for your mail, since it is a temporary move.

I had mail forwarded from the U.S. to Canada and at random times, the Canadian Post Office returned the mail to the U.S. who in turn would resend it. All it caused was a complete delay in me receiving my mail.

For years Canadian Government services have been taking payment online - I'm not comparing the two, just saying that it actually does work. It would save us time and them. I agree with the taking of payments online is an efficient way to do things. However, I did not like the Canadian system of taking all the documents at the front end. I mailed off my entire package and you don't receive a confirmation of any kind that it was received. You mail it off and it sort of disappears into a void and you are left wondering if they even got it for months. The Canadian system takes about the same amount of time as the U.S. even with all the U.S. mailing back and forth delays.

I know this feeling and sympathize with the couple that gave up on immigration. I moved to Canada to be with my husband and was in process for with Canadian immigration for 2 years. I never received any communication from the Canadian Immigration people, they never requested additional information, or ever requested an interview with either of us. It was incredibly difficult emotionally as well as finacially to be sitting around for that length of time waiting. We withdrew our Canadian immigration application and I moved back to the U.S. where I am now sponsoring my husband into the U.S. My husband even withdrew his Canadian citizenship application (he has been a PR in Canada for 15 years) and will pursue U.S. citizenship as soon as he is eligble.

Bad advice. The USCIS is listing the dates that the various centers are processing the applications. California for example, is only at 8/30/07 and Vermont is still working through July applications, so if the I-130 was sent in August I would give it a bit more time before pulling the plug on the original application.



I'm not talking about processing... I'm talking about receipt of application. She hasn't received notice that the application was ever received!


I was talking about receipt as well. The some Service Centers haven't issued NOA1's for applications received in August.
