Hey everyone.

We're still waiting anxiously to recieve our NOA2. I was curious who recieves the NOA2? Does the pentitioner or beneficiary get it in the mail? Or both? Our case was finally touched since December 1st, exactly a week ago. I'm hoping it's in the mail right now. I'm assuming we don't get an email or anything from the USCIS website, it just shows up?

I'm the beneficiary and i had signed up on the USICS site for case updates etc. I also had email and text for communication. The emails were mine and my wife's and the text had to be a USA number so it was my wife's. We were both chatting on skype when she got a text msg; and one second prior to that I had received an email msg saying we got NOA2.

So really both of you would be notified but technically speaking, it's the petitioner because it's his or her petition to get the foreign spouse into the country.

I'm not sure which one you are or if I can help. But it could be when you first set up the timeline. Go back into your timeline to add/edit and see the area in the boxes where your names are. I just entered our first initials and didn't add our names. Try that and submit the changes and see if that's the issue.

Ok I think I'm wrong on that beause I just checked your timeline and it only shows your first name. I wasn't able to get your timeline before I sent my first email.

Question: Has anyone had a controlled entry in their passport? Heres what happened to me: I was working in the US on a TN Nafta Visa (Work dependant) A few months after we got engaged my job was cut due to economy. I had already scheduled a flight to Canada but it was literally the next week following my job loss so I flew home and then when I went to fly back to the US they put a controlled entry in my passport. They said I had one month to return to Canada. So I went back, packed all our stuff into a storage cube and flew home to Canada on time, and began the process of getting ready for the K1 filing. So my question really is, if you have had one in your passport did it cause issues for your K1 filing? I don't think it should for me because i was back within the time limit given, but going through this is nerve wracking at best so I'd rather know the answers! :wacko:

I've not had a controlled entry but probably what's driving this thing is that under the TN 1 status, you cannot have any intention of immigrating. It's a non immigrant staus situation under the NAFTA rules and they are very clear about that. Any intention to immigrate while under the TN1 visa and rules is met with less than favourable views at border patrol. You did the right thing by ensuring you left etc. Likely, although I can't say for sure, the TN1 will get cancelled while you come in under K 1 visa status. They are two very different visas but I don't think it will affect the K 1 process- you obviously wouldn't get approval for a TN1, stay in the USA and then apply for K1 for example. Their concern is immigrating intentions when you were under a visa that prohibts immigrating to the USA. People can be there to work and then decide to marry but you have to go through the proper channels. So best you can do is leave the country and enter again after approval of K 1- again your TN1 will be deep sixed.

Find out as much as you can but likely you'll be just fine. Make sure you understand the K1 visa and it's intent and consequences.

I don't know about the K1 situation as I'm applying for CR1. BUT you should get familiar with the guides on visa journey. They can be very helpful. I guess it's a bit odd to read that you're in this and started this process yet have no idea what to do next. You don't want to make mistakes so do look over the guides to see what's required. You'll also get help from others. Make sure you are going in with as much information as possible.

It won't, those of us who are legal and did it legally will get nothing those breaking the law will get amnesty so they can pay taxes to pay for obamacare so they can all be covered and tax the system so the country can go bankrupt just like California..sorry just venting



Well for the record the President has required congress to pass every single piece of legislation yet and hasn't passed any 'executive order' since taking oath. Not sure where you get your infomation from.

Okay, so I've read that Congress is about to make a strong push to pass an immigration bill through this year. Now, I find it highly unlikely that this will actually happen. I've also heard from a couple immigration lawyers that it's unlikely to affect the K-1 process, but let's say just for argument's sake that it does go through and it does change the K-1 somehow. My question is if a change to the process that negatively effects the K-1 visa is in the bill, how would this effect petitions that have already been filed? I think I remember reading a few past posts where people who had already filed their petitions when the IMBRA law passed got RFE'd. What do yall think? Any thoughts or concerns on this?


I honestly believe that there is very little value in this kind of speculation. In the first place, there is nothing to inform what the actual reform might be nor how it may even impact future cases or those in presently in the system. You're essentially asking people to guess and that's exactly what you will get, guessing. Unfortunately, guesswork has no substance and may likely leave you feeling unnecessarily better or even worse.

Unless you want general speculation akin to walking around blindfolded in the dark wondering which direction is north, I'd wait for factual information and at least then informed decisions can be made.

Just my humble perspective. :whistle:

So now that we have about 4-6 weeks before her interview, she is flipping out about coming to the US. She feels "trapped" that she will have to wait several months before she gets her residency, social, job permit, and be able to see her family again. Help! Has anyone else gone through this? This is really wearing me down, I've run out of things to say over this topic! What can I do or say to her to calm her down?


Focus on what she needs, her comments are expressions of her need. It sounds like she's nervous about the inability to work and travel which is absolutely limited with that type of visa. Encourage her to stay the course and to see the final outcome and how positive that will be. A few months more waiting for other documents is certainly do able given how long you guys have likely been waiting for approval of the K1. She's in a bit of a panic and overwhelming period and she needs reassurance and to focus on what's further ahead than what's directly in front of her. Be sure this isn't a signal of her wanting to back out.

Behaviour is a response to a need. Listen to her and do what you can do, the rest is up to her to sort out. She needs to figure out if she can do this or not no matter how hard you try. Stay positive and hopefully it's just a temporary period of 'oh my god i'm really doing this. She is feeling isolation so you have to meet the need; when someone feels isolated you don't further isolate but point out how the opposite is true - reassure her - she can call her family anytime and in a matter of 90 days or so you'll get EAD and AP.

If it isn't just her nerves getting the best of her, have an honest and frank discussion about what's really happening for her.

Jenn I think you have a whole lotta proof with your visits alone...save your tickets and any receipts of anything you did together if you have it, also any chats or phone calls etc, your being with him at the interview is an added plus. I doubt if you will have problems in the proof portion! Me and Hamit only seen each other twice before the interview and our third time ever being together in person was during the interview, so you have a leg up and shouldn't worry!

Typically if the I-129f itself is not signed they will reject it and send it back complete with the check. You will sign it and send it back complete with the check. Figure about 2 weeks to get it back in the mail. This is BETTER than getting an RFE which takes even longer.

Thanks for the information! I guess I will just need to sit and wait and see if the check gets cashed. Part of my completely fried brain remembers sitting at my desk, signing the copy I was sending and remembering to make sure I put the signed copy with the stack to get mailed. But I don't know why I would not have just signed both copies right then.. so may just be a "wishful thinking" memory..

We'll see what happens... and if it comes back I will definitaly have someone else look it over before I mail it back in.



Awww Jenn I hope you did sign it-anyhow if you didn't it will create at worst a month delay. If it does come back, just look it over and "adjust your package" for any mistakes or added helpful info...sorry couldn't resist after i seen what I had typed lol...cheesy. You can call them BTW and see.

I am a travel agent and worked for airlines. You can not buy a ticket where the first leg of the flight originates in the US and have only use the return flight. I the doesn't board on the US departure flight, then the entire ticket becomes invalid as what is called a 'no show'.
It also depends on the travel agency rules, not all travel agencies will book flights for you that don't originate in the US, however try some others. I worked for AAA and I know they don't, but it's just compnay policy and not a general rule.

You can buy a roundtrip ticket originating in her country and not use the return part, it usually cheaper. I did it myself and just called teh airline y=that I didn't want to use the return ticket. They won't reimburse you, but that is no problem.

I filed for the K1 nearly three years ago. Same fiancee and everything. Just had some things going on here that made us want to hold off a bit before going through with the process (new job and trying to find a new place to live). All that is squared away and have been at the job for a year now. Established in a new home and we are now ready to proceed with the visa. What do I need to put on question 11? What is the A# they are asking for? For result can I just put what I wrote here or is there something else that needs to be written? Would love to get this in the mail today. This is the only part I am not sure on though.

You should apply for your fiancee only after you have met her first that way you can have evidence like photos. Also unless things have changed in the last couple of years. I thought you can only apply for fiancee here in the US not at the Embassy because your petition has to go to your local USCIS according to where you live to start the approval process.

If you have the time, and pay attention to detail this site will help you 100%. If you have extra money to spend get an attorney. I did it myself, and saved the money I would have paid the attorney to take another trip to see my Fiancee in the Phils.

If you have confidence do it yourself just check your package 10x before you send it out to avoid mistakes and make a duplicate of all items sent.

I'm learning it is essential to have a copy of the I-94 and we never got one. I'm looking at her passport and there are no staple holes so it was never attached.

Has anyone else not received a copy of the arrival/departure card? I'm going to call Tuesday but does anyone know if we'll have to pay the filing fee for a copy to be created and delivered to us...Doesn't seem right to have to pay $300 for this but I've spent a year on this process so far and absolutely nothing will surprise me now! whistling.gif

Hi, I asked this on the AOS forum but it might fit better here,

I travelled with my fiance back to the US and we landed at LAX two weeks ago. The immigration officer there was really nice and I thought the whole thing went really well; however, now that we're applying for her AOS, I don't see a copy of the I-94 anywhere. We don't recall being handed anything by the officer at the time.

My question is do we need this I-94 for future paperwork and if we didn't receive it, do I still need to pay the $302 fee to file the I-102 form for replacing the I-94?

THANK YOU ALL!!!! I didn't get the paper work in yesterday because of a concern I had. ( am am calm today and have a level head!!!!!) Thank god for Julie she told me once we talked when she got up that I need to just take my time make sure it is done right and everything will be ok..........ok here are the 2 concerns I had with the remaining 2 questions I have : 1) on the 325 & letter of intent from her she did them and emailed them to me of coarse I printed them and put them in the packet but people are now telling me they have to be original signatures? is that correct? 2) my divorce papers: can I just send the papers or do I have to get a certified copy of it?

Very wrong time not to think straight, mistakes can be very costly.

You don't need the tax return forms at this stage, they are meant to be taken to the interview. You will definitely need to send the letter of intent from both of you. You need to definitely send picture which show the both of you together if they have dates on them, within the last 2 yrs. Phone bills and emails are for the interview stage and the G-325A is needed as well.

Just calm down and sort it out, so do it when you are not stressed or burnt out. All the best.

(1) On the employment piece of my G-325A, I find that my employers full address won't fit in the alotted space. Is there any reason to think that just city / state aren't sufficient? I know that most of these are probably silly questions, but I really dont' want to make any stupid mistakes.

Thank you both for the responses. I have a few follow-on questions as we work towards preparing the I-129F. First though a clarification. Though she is currently living in Santiago, she will be returning to Bogota, Colombia in August and our plan is to process everything through that embassy. Okay, now for some specific questions:

(1) She is preparing the things which require her original signatures so that she can have them sent to me here in the states to be included in the I-129F packet. Since this is expensive, we'd like not to have to do more than one mailing. So far she has the letter of intent and her G-325A. Another possibility is the passport photo. Other than those three items, is there anything else that can't be sent electronically?

(2) Regarding the passport photos: I was researching the topic in the archives here and someone suggested taking your own photos with a digital camera, cropping them at www.portraitbooth.com and printing them out at Wallgreens. This seems like a great idea but I was wondering if anyone could confirm that there are no issues?

(3) Regarding the Letter of Intent and the G-325A: Is there any point in printing either of these out on anything other than standard grade, white copy paper? I'm assuming 'no,' but thought that it couldn't hurt to ask.

Hi,

I am just in the beginning stages of preparing an I-129F and after having read a bunch of the great information in the guides, I have a few questions. First the background: my fiancee is Colombian but currently resides in Santiago, Chile where she is finishing up a Masters degree. She should be finished and back in Bogota by the middle of August, though all that remains is work on her thesis which for the most part could be done anywhere so if there were a pressing need she could always fly back sooner without endangering her studies. Here are my questions:

(1) Given that time frame, is right now a reasonable time to submit the I-129? Having looked at the processing times and considering the four month window, it seems safe, but I wanted to bounce the question in case, there's something I don't understand.

(2) I didn't realize until just recently that the I-129 packet involved original materials from her (at least the letter of intent and the G325-A). This is particularly frustrating given that we were just together in Bogota (she was home for break). I should have begun my research before the trip, but alas, I didn't. So is there any optoin at this point other than having her fedex the materials to me?

Yes, she has her parents address (which will be her address again in July / August).

Her address in Chile is her temporary address since that is where she is at school but not where she is intending on staying?

I guess that you could say that it's temporary, though she's been in Santiago for two years and we've filled out her G-325A to reflect that fact.

They will forward the approved petition to the Consulate that is responsible for the area in which she is living.

So, I would suggest that you indicate to them that her temporary address is in Chile but her permanent address is in Colombia and provide the dates that she will be returning to her Bogota address. [/size]

Yes, I think that I'll include a memo describing the situation along with the I-129F packet because another issue occurs to me. Even if there are no issues with processing things through the embassy in Bogota, the default would probably be for the embassy to send any correspondence / materials to her last address on the I-129F which is in Chile. It would be much simpler if everything just went straight to her parents' address in Bogota.

Hi,

I'm in the process of filling out a I-129F and I have a question. My fiancée is Colombian but currently lives in Santiago, Chile where she is finishing up a Masters degree at the University of Chile. All she has left is to finish her thesis and she should be done and back in Bogota by July or August at the latest. Given this time frame, and that we are just starting the process now, it seemed to make the most sense to process her visa through the Embassy in Bogota and that's what I'm indicating in Question 20 on the I-129F. But the note below the question gives me pause. It reads:

"Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate"

Does anyone think that were likely to have any trouble having her Visa processed in Bogota, where she is from, rather than in Santiago, where she happens to be living now?
