Hi,

I've mailed my I-130 to Nebraska on 11/8/2007 and received by the office on 11/13/2007. As of today, I have not received any receipt notice and my check has not yet cashed. My husand and I are very anxious and worry. I don't know how much longer it would take for them to at least look at our application. Does anyone know that since Nebraska says all form are processing current at their location, does this mean that they are not delay?


NSC does not process I-130s. Your I-130 will be transferred to the Chicago Lockbox for initial data input and then sent to either California or Vermont for processing. USCIS hasn't issued NOA-1s for I-130s dating back to August, so sit back and be patient: it's going to be awhile.

I put together a spreadsheet of all the USCIS processing times that I could find. You will find a link to in on my blog (see link in signature). At least looking at the weekly updates in one place, you can see where the various Service Centers are concentrating their resources. I would think the I-130 NOA-1's should start coming out in force within the next few weeks from both California and Vermont.

The letter from your employer (the unversity, I assume) should state: date employment began, employment status (full time, part time, contract, whatever) position title, annual salary or hourly wage. It should be an original on letter head with an original signature and a contact phone number. I am sure your school can come up with something to fit the needs. Good luck!

Actually, I had heard the opposite from USCIS. They told me that they go by the NOA-1 date and theoretically, they should be issuing the NOA-1s based upon the order received. Additionally, the Service Centers seems to be issuing NOA-1s rather timely now (within 1-2 weeks) and the receipting delay that I experiened (107 days to get a NOA-1) seems all in the past.

Capt: I think the formula for the timeline calculations is using the date I-130 is submitted. Perhaps it would be more accurate to just use the NOA-1 date, in this case. Your thoughts?

The VJ guide says to submit 1 passport type photo (one for petitioner, one for benificiary). I submitted 2 each originally and now I just received an RFE for 2 more for each of us. I am not sure if this means that they want 4 total per person or perhaps they lost the first ones, who knows. I will try to contact CSC tomorrow if work permits and get clarification. Just a heads up in the meantime.

I can afford to chip in for about 10 grains of sand on that island.

As far as going the 'other way' I have been there done that. Canadian immigration for me was a complete bust. I spent almost 2 years stuck in the Canadian system with my husband sponsoring me and now, I am 8 months into the U.S. system sponsoring my husband. I think any immigration in any country for anyone is horrendous.

Unfortunately, some VSC applicants don't believe this is true. It doesn't fit into their ideas of what is going on, so they chose to disregard data that doesn't support their theory. And, according to this site, international driver's licenses do exist, although the term license and permit seem to be used interchangeably.

Use this link to get the state's Dept of Motor Vehicles. In most, if not all cases, you will have to have a SSN before you can have a driver's license. They are trying to prevent the illegals from driving around and/or getting state ID cards. Also, you might want to check into international driver's licenses that you could obtain prior to leaving the U.K. That might tide you over until you can get your stateside license.

CSC's dates went from July 26 (which hadn't changed in months) to Sept 5 with this lastest update. Perhaps CSC did ship some files over to VSC. VSC historically processes faster than CSC. I have been monitoring the two service centers here and at least over the past 4 months or so, VSC has always finalized applications about 1 month ahead of CSC.

If you have another marriage certificate, then bring it. If you are close to the 1 year validity the Montreal Consulate gives the police certificates then bring another one (mine expired in June, we interviewed in May and they asked for another certificate).

We sent personal photos ie vacation pictures, us together, with family, engagement party, wedding pictures etc - pictures that showed us together over the last few years; as well we sent copies of telephone bills, joint bank account information, cheques showing money going into the account, flight itineraries, passport stamps. We probably sent it about 10 or more pictures and we dated them.

By any chance, did you read the NOA? Specifically the "If this case is an I-130 Petition" section?

"Filing and approval of a Form I-130, Petition for Alien Relative, is only the first step in helping a relative immigrate to the United States. The beneficiaries of a petition must wait until a visa number is available before they can take the next step to apply for an immigrant visa or adjustment of status to lawful permanent resident. To best allocate resources, USCIS may wait to process forms I-130 until closer to the time when a visa number will become available, which may take years after the petition is filed. Nevertheless, USCIS processes forms i-130 in a time not to delay relatives ability to take the next step toward permanent residence once a visa number does become available."

Basically that's their get out of jail free card, so I wouldn't waste money trying to sue them, instead, a phone call might be in order (phone number is on the NOA that your recieved).

On the reverse side, "Inquires" reads "You should contact the office listed on the reverse side of this notice if you have questions about the notice, or questions about the status of your application or petition. We recommend you call. However, if you write us, please enclose a copy of this notice with your letter."

Again, a phone call might be in order. Just a thought.

Keep in mind that spouses' petitions aren't subject to waiting for the visa numbers - those are exempt.

What is the Legal I-130 wait time? I have read online after 120 days, that some people have filed lawsuits to get a response , is this the same for the I-130 process? What are the escalation procedures?

Is it better to press them about it?

I submitted my I-130 on July 24th 2009, it was last touched 8/5/2009



There is no legislation that covers how long this should take. The website shows 5 months to process but most people get it approved in less time; others that or more time. But there is no 'legal' timeframe as there are no laws governing the timeline as far as I know.

There is a reason we wanted to go the CR-1 route and thats what i meant when i said it was "ideal for our situation" but i just didn't explain it. It was because it would be easier for me to come back to the U.K AFTER we were married in the U.S,there is a few reasons that it would be easier for us to do that.

Hmmmmmmm,well i heard from quite a few people that visa's can be denied if we don't earn enough money to be able to support ourselves in the U.S. This is just something i heard...



It's true about having to meet the financial levels as set out by the US gov't ie must make 125 % over the poverty level which for 2009 for a household of two members would be $18,212 per year.

You should familiarize yourself with the guides on visa journey, they are quite helpful and provide a lot of information on each type of visa and the entire process. Have a look.

firstly I requested to change consulate,the consulat of Montreal asked me a proof of my statute in Canada, after few days, The NVC sent me a letter told me that the petition process has been changed to the consulate of Montreal and give me another Case Number (the I130 petition is already at NVC). and yesterday I received the below email from USCIS

I don't know about anything else, but Montreal is the only consulate that completes the immigration visas. All other consulates in Canada deal with non immigrant visa. To the best of my knowledge, I don't think you can change that.

What kind of document to "a copy of all the documents submitted to the NVC"? I starting to do my I-130, so I have not send NVC anything yet. Should I have send something to NVC?


Get familiar with the guides and it'll tell you what you need to submit. You submit your initial petition I 130 to the Chicago Lockbox and after you get your first approval (Notice of Action ie NOA1) they send you a hard copy of this approval and the package is forwarded to a service centre ie California, Nebraska, Vermont, Texas etc. Once they finish with the application and approve it (assuming it'll get approved) it's THEN forwarded to the National Visa Centre for processing. At that stage, the NVC will tell you what forms and documents they want.

I am sure this question may have been asked many time. But, honestly, I am not sure what term to use to search for it. Here is my question: how thick was your application? Did you include a lot of pictures and documents. I watch a video online. The author suggests to include about a 100 pages of document. You don't need to submit a 100 page document. You need to ensure you have all the required forms ie I 130 petition, G 325a, the G 1145 if you want email notification, marriage certificate, divorce decree if applicable, passport pictures, birth certificate or passport of the petitioner, evidence of a bonafide marriage which will include phone logs, email chats, pictures of you two together and with family, wedding pictures, airline boarding passes and trip itineraries etc. The package ends up getting a little thick but there is no set number of pages.

Two quick questions:

If a sponsor met the poverty guidelines for the recent tax year (2009) but did not for the last few (student) would that be approved or would a joint sponsor be a safer bet?

Would a visa be outright denied at NVC should the sponsor not meet the requirements or would NVC seek an RFE requesting one obtains a joint sponsor, therefore ensuring a delay in the process.
