I can't tell by your information where you are from. I was in Canada so we filed visa emails and scanned documents but ensured I had every single piece of document we sent in electronically, with me in original form, for the embassy interview. I also brought evidence of our relationship which included many pictures, phone bills, boarding passes, and everything else. They didn't ask for any of this evidence but it's best to bring too much and have it then not having it and needing it.

As question in item 3. I wonder now do i count the joint sponsor's household size.
He is sigle and doesn't have anyone who would be a dependent.
But I have my son who is a dependent.
Is it right to count 3 which are 1. My joint sponsor 2. My son 3. Myself?


Does the joint sponsor live with you in your household? I would count everyone in this case ie you, your son, husband and joint sponsor, total of 4. As far as I know, you only count the people in the household; the joint sponsor is agreeing to sponsor and support the size of the family. If he is single and no dependents, then only worry about your own household size. Check the I 864 form on joint sponsors as it may give you the information you are looking for. And remember they are two forms depending on if the joint sponsor resides in the household or not. If he does then he files the I 864A and if he does not, then he files the I 864. Remember your hubby and the joint sponsor have to complete the forms. Your husband only completes the I 864 - the joint sponsor also but depending on which form based on where he lives

I am new in here. I need help about using joint sposor.

1. If my husband's income does not meet the requirement, is there any other choice to solve this problem if we do not have any joint sponsor?
2. If we use two joint sponsors , is it possible to include their income together to meet the requirement?
3. I have a child with my husband. Is there any advantage to get the visa if my husband's income does not meet the requirement.
4. How do we count joint sponsor's household size ? if he is single and he does not sposor anyone else. Would we count 1. Him 2. My child and 3. Me?

Hi and welcome to Visa Journey. Great site by the way.

1. If your husband does not meet the minimum requirement, then the only other option is to secure a joint sponsor. They will need 2009 and earlier tax returns, pay stubs and a letter of employment so if he doesn't meet it, the jt sponsor is the only other way.

2. Two joint sponsor should put you over the minimum threshold - check the poverty guidelines and you'll find it. Yes they will include both sponsors incomes to ensure you get over the min requirement.

3. You need to include your household. A joint sponsor may be someone living with you or not living with you. Also check the forms required for the I 864 - if the joint sponsor lives in the home, he or she must file an I 864A form, and your husband who is still the sponsor is required to complete an I 864....if the other sponsor does NOT live in your home, then that sponsor complets a separate I 864 and not the I864A....check the forms and you'll see what I mean. I don't believe you include the sponsor in the household size unless that person lives with you and then I believe you have to include everyone who would be a dependent in the home ie children.

Mine was before but as the other poster commented, the VJ timelines are really just a rough idea based on information provided by posters etc. I wouldn't count on that at all but it gives you a basic framework around timelines.

It does depend on the consulate. And to echo Canadian Wife's comments, I was told 'everything looks good' and she simply handed me a welcome to the USA letter with a yellow highlighted COPY across it. She said not to worry about that.

When my passport came back to me with all the other documentation, there was the same Welcome to the USA letter in there and also my passport and brown envelope package that was to remain unopened until I crossed the border and gave it to CBP.

I guess other embassies are giving out slips.

If you can process electronically (EP) then you scan all your documents and email them in but then you bring ALL of the same documents submitted electronically to the consulate when you interview. Hence the originals. If you do NOT do EP then you submit y our original documents to NVC then at the time of interview ask the consulate for your originals back.

So that I've got this straight, it is the case then, that if the petitioner's current taxation year (2009) shows earnings over the 125% poverty level, a co-sponsor would therefore not be required? So despite previous years (student years) that a petitioner did not meet the 125% , so long as the current taxation year meets the criteria all should be fine and well or might it be prudent to have a co-sponser given this scenario to avoid any potential problems?

I always appreciate thoughts and comments...

actually couple of weeks i arrived i received a letter and form from my POE Detroit metro instructing me to filled out the form and sent back to them coz they can;t process my papers as they forgot to let me sign the required form, that;s what i thought the reason of my delay. until now no welcome letter, SSN and Greencard yet.


Hi, well I've received a few welcome letters, one dated Aug 25th, a second dated Aug 25th and I called the customer service number and they advised there was post decision activity and I asked if that could mean another welcome letter, to which she replied 'yes it could be." I asked her how it is that we can receive three welcome letters but get no information on SSN or green card...

It'll be nice to have everything in place and taken care of so we don't have to deal with this stuff at least for two years.....

Maybe this post decision activity is the green card but there's no way to know it seems....probably the 3rd welcome letterer. I'm surpised you haven't received your first welcome letter.

Here's another thing, the unofficial welcome letter (not the I 797C), goes on to say if you haven't received the SSN card within three weeks of immigrating, then call the national # they provide. But I called the national number only to be told that they don't deal with card, only benefits.

Again the wonderful NON integrated, left hand doesn't know what the right hand is doing, process. It's not that bloody hard to get coordinated but these guys fail miserably at that. Not only that, but given that I've been calling and visiting the SSN offices, and they assure me I'm not on the system and no SSN number is yet assigned, why not just assign one locally then when the whoevers get to assigning one months later they can see on their system that one has been assigned. But no. Instead we have to wait up to 8 weeks for this to be assigned and then if it doesn't happen, they will be happy to assign one. But they can see no number is given out, so in the absence, assign one for pete's sake.

Clearly there is a more effective way of doing things than what we are used to in this process. At least we are approved and have immigrated BUT is there any portion of this entire process that isn't met with stonewalling and lack of information??

So I was told 60 days wait for SSN then come in, and today was told it could take 60 days after immigrating for the green card. Yet you see people getting things in a week, in a few weeks, in many months....what a broken system.

Just my rant of the day.

SSN is easy - go to SSA office with passport and birth certificate, apply in visa name.

have the clerk look you up in the SAVE database system, using VISA name and/or A#.

I went down to the SSN office and have been calling the often. same old stuff. In fact, I mentioned the SAVE system and nothing, lncluding today. they won't issue one at all until 8 weeks have passsed; they said they used to at the 3 week mark but stopped because people would end up with two numbers issued. So now we all have to wait until at least 8 weeks fly by before they are willing to issue the SSN card and number and that takes 7-10 days. I can see now the advantage of NOT checking of the 'yes' to having the consulate applying for the SSN, on the DS230 form. If I checked off NO then I would have stopped by the local office and by now for sure would have received one; now instead I have to wait until sometime in Oct before they'll issue, if I don't yet receive one.

Green card, same, nothing. I'll try to follow that up. I'm at the 4 week mark of being here so I'm probably just along the normal timelines....the other poster should have received his/hers by now.

I totally agree with Canadian Wife. This site is superb and has supported and helped me with every aspect of the immigration process. I understand your frustration as I went through a very similar thing. As per the last post, do understand that these immigration 'timelines' as posted on the site only reflect an estimation based on how many members add information to their own timelines. If you obtained or reached a particular point but didn't want to or forgot to update your timeline, then that information is not included and therefore the 'estimation' or guestimation is influenced.

It's best to not be overly concerned with the timeline estimations on the site because if you view them as written in stone, you'll lose what's probably left of your patience and your mind lol :bonk:

Our NOA was November 23...they opened our file today!! Well it shows that some kind of activity is going on anyway!! So you guys are a little behind us so it should be any day now.



Yours is taking a while and many of Dec filers have been approved. Did you inquire as to why there was this delay in yours?

Make sure you fill out everything. Anything that isn't applicable, write N/A.... if you see any line asking you for anything, fill it with a 'none' or N/A or whatever.

Also you may want to consider the section where it asks you if you want the US Consulate to apply for the SSN on your behalf. Many of us did just that only to have delays because no SSN came in. And if you advise the SSN office of this they will make you wait even longer before they issue you a card because the US Consulate is supposed to be doing that on your behalf if you check the YES on the DS 230.

It's far faster to simply check off NO and then when you get down here, apply in person at your local SSN office.

I realize that this is a long way down the road for you guys given that you are now filling out the DS 230 package but you are filling it out and are about to send it so heads up.

I am SO glad I listened to advice given on Visa Journey saying to call NVC often and not to listen to everything they tell you.

Our NOA2 was approved on 09/22. After several calls (it sure is nice to be able to talk to someone isn't it?!) we found out that NVC received it on the 28th but it wasn't in the system. We were told to call back in a week to give email addresses. I called yesterday and was told to call back at the end of October or beginning of Nov because "it usually takes us 6-8 weeks to get your case into the system". I expressed my confusion at how another operator had told us to call back in a week, and this lady said well you can TRY but I am telling you the usual timeframe.

I called today anyway, and sure enough we now have a case number! I am sure glad I did, since now they have our email addresses (the operator asked for them) and now they will email us the invoice etc rather than snail mail.

Celebrating the little steps! And sending hope and encouragement to all the others out there who are missing their spouses. IT WILL ALL BE WORTH IT IN THE END!

Congrats on your success thus far. Well to be sure, you have to stay on it with NVC. And will you consistently get inconsistent comments from operators. Remember that they are not employees of NVC but they are contracted services that typically are directed to follow scripts. I remember many times being told, wait a week, call back in a few weeks. I always phoned the next day. Worked out well overall but the point is to stay proactive. While there is only so much you can do and the process has to be followed, but you can be very proactive and follow up....sometimes it feels like it's in the abyss.

Milk thistle helps with liver issues....been known to reverse damage of hepatitis...maybe you only have hep A...goes away unlike B or C...no way to know until they do more detailed bloodwork. If you can afford it, do it now and take the milk thistle! If any of it is active you likely will need to be stabilized before coming over-I don't think having stabilized hep c disqualifies...anyhow-I can only speculate without proper bloodwork. Get liver function tests and a hepatitis panel.

OK I already have a question, heh ; ) I was just looking over the I-130 filing checklist, and our lawyer has almost all of this ready to go, but I am just now seeing this:

11. Evidence of a bonafide marriage (see note below for what to include)

Note: Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or 2. A lease showing joint tenancy of a common residence; or 3. Documentation showing co-mingling of financialresources; or 4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or 5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or 6. Any other relevant documentation to establish that thereis an ongoing marital union.

We've only been married for 11 days...although our relationship began well back into last year...but how come our lawyer hasn't asked for any of this? He has been really thorough in getting all the documents ready so we can file, but never has asked for anything evidence related....should I put my husband's name on my house? Is all this evidence really needed right now? I am stressing. I just want this FILED so I can hunker down and settle in for the wait.....:blush:

Hi all,

I just wanted to introduce myself, not sure about the protocol here, but I am here for the long haul. My name is Deb, from Arizona, and just last week married whom I believe to be the most wonderful man in the world, who is a citizen of England. We are going through a lawyer to assist with all of the steps to get him here, to the US, so we can truly start our life together. However, going through a lawyer is still completely confusing to me, so I'll be around here a bunch maybe asking questions and looking for teachers of patience ;) We are in the final stages of collecting the last of the documents needed for the I-130, then I guess it goes to a K-3 visa from there? Our lawyer has done his best to explain the process to us, but its still overwhelming...and even though he just left only 5 days ago to return to England, I am terribly impatient and while I realize this could all take up to a year, I am missing him terribly. But I guess we are all going through the same things...which is why I am really, really happy to be here! I'll be going to England in March to visit him, but in the meantime, I am hoping to learn, find peace and sanity, and hopefully remain optimistic for all of our sakes :)

My main frustration right now is that the I-130 won't even be able to be filed for a few more weeks, so I have a feeling its going to be a looooong time for all of this...but I'm committed to him, the process, and making the best of the time between now and him stepping of the plane here in the US for good.

That's what's worst for me about having the lawyer. The emotional aspect. I hate hate hate feeling like I am not in control of my own destiny. However, once I get the case number from him, I'll be all over it. I've already paid his non-refundable retainer, so I might as well use that up, I guess. But I've made it clear to him that I NEED to be kept in the know...I am waaaay to emotional and OCD to not know and "just trust."

Thanks, everyone. I haven't even received the NOA1 yet...my lawyer was trying to track down a divorce decree of mine from over 11 years ago...(I now know to never ever ever throw stuff like that away again) and supposedly that was the last thing he needed to complete the I-130 package. So its on its way finally :)

The main reason we decided to go the lawyer route is that a) I didn't even know about this site at the time, b) up until last month, I've been a single mom working full time and didn't think I had it in me to "do everything on my own" (I know, I was wrong ;)) and c) both my husband and myself were very much wanting to make certain everything was done correctly (which goes back to a) again...now I know)

We'll see how long it takes to get the NOA1. We first met with the lawyer about 5 weeks ago, when my husband was here visiting (and becoming my husband, heh (L)) But in all fairness, since I couldn't even remember WHEN I was divorced all those years ago, it was really hard for the lawyer to even track down a decree for me. I appreciated him doing that, and I guess now everything is ready to begin.

Now its all going to be a matter of trying to stay sane and hope he moves along at a pace thats OK with me. I email him every day. He's great about responding quickly. I've made it pretty clear that I expect to be informed each step of the way.

He loathes the fact that I lurk on this site :devil:

I am already pretty sure you're right about that...I am about *this* close to firing him....I feel like this all would go a lot faster if I did it on my own. I spend a good part of the day lurking here, and have learned a lot :) I haven't really jumped in too much because I was waiting until he filed the I-130 and we got NOA1, but in order to save my sanity, and to hopefully make a few friends that are going through the same thing, I'm starting to ask questions. But I do believe I agree with you...the lawyer might not have been the best idea...but we'll see. :unsure:

I am filing an I-130 petition for my wife. I have been married since August 10th, and thus I do not have much to prove bona fides of marriage. What I have are three affidavits, photos of the small wedding we had, a credit card that I pulled out for her under my account, and messaging and calling logs.



1. Would it be ok without the photos or is it a good idea to include them?



2. Is it okay to send a copy of both our credit cards in the same account, even though she lives outside of the USA?



3. Is it still required to send beneficiaries copy of passport and birth certificate with the I-130 form?



Thank you so much in advance, those three issues are what are holding me back from sending my I-130 package with confidence. All help is very much appreciated.

We also filed in November. My wife (a USC) mailed I-130 and G-325s to Nebraska Service Center on November 13th. It was received on the 15th according to USPS tracker. But we have heard nothing from USCIS yet.

My wife is from Minnesota. That is why she mailed the petition to Nebraska Service Center. But we have started to panic now! Even the USCIS website does not have processing time up for I130s that are sent to NSC. Can somebody please help me by explaining about WHAT HAPPENS TO THE I-130 MAILED TO NEBRASKA SERVICE CENTER? Your responses would be highly appreciated.

I have filed my I-130 to NSC on 11/8/07 and recieved on 11/13/07 according to USPS. I have not heard anything either and my check has not yet cashed. I am a US citizen filing for my husband in China. Normally it ususally takes a few weeks before we will get notice from them, but now is over a month. What makes me upset is that the USCIS weekly updates give you no information. They always say all forms current. How can they be current and I have not recieved nothing from them??? I've called the customer service line many many times trying to figure out what happened to my applications, but all they said is that Nebraska didn't say they fwd'd their applications like the other service centers. I questioned how did she know, she just said that's what it say on the weekly updates. I almost fainted. They cannot give me any additional information other than what I can see myself too. Please someone give me some advices what is happening to our applications now!! thank you very much


Nebraska doesn't process I-130s and never has. The forms tell you to mail it there depending on which state you live in, but Nebraska would, before last week anyway, forward the application to either California or Vermont, depending upon what state you lived in. Now, Nebraska should be forwarding your application to the Chicago Lockbox which will do the initial data entry. Then the application will be forwarded from Chicago to either California or Vermont. People who submitted I-130s in August are still waiting on there receipt, so get in line. smile.gif

As of now, USCIS has not stated if Chicago will be cashing the checks and issuing the NOA-1s or if California or Vermont will be doing the deed after they receive the files back from Chicago. Anyone's guess is good.

The K-1's are getting their NOA-1s, but as far as I can tell, the K-3 NOA-1s are being held up same as the I-130s. Since the CR-1/IR-1 visa seems to be a better deal and the I-130 will be put on hold as soon as the K-3 begins processing, doesn't seem to make much sense to file for the K-3 after waiting months for the I-130's NOA-1, imo.

NSC does not process I-130s. Your I-130 will be transferred to the Chicago Lockbox for initial data input and then sent to either California or Vermont for processing. USCIS hasn't issued NOA-1s for I-130s dating back to August, so sit back and be patient: it's going to be awhile.
