K-1 Fiance(e) Visa Process & ProceduresAnother photo question
I have figured out I will need 9 photos; 1 for I-129F, one for duplicate package, 3 for medical, 2 for passport and one for interview. I think this is right. My kids will need will need the same except the 2 for the-129F and duplicate copy. This is $12 for every 2 I get that is 30 pictures for me and 3 kids about $360...yikes!!
Which ones can I make copies and use those? I assume for the actual passport I will need them from a photographer with a date but can I just make copies on photo paper for the rest of them?

K-1 Fiance(e) Visa Process & ProceduresHow did you meet your fiance?
I was in msn chat talking to a girl I knew. Got up to get a drink and came back to see her talking to this guy she knew. I started talking to him a bit. Then left. A few nights later I saw him again and we talked a bit. About a month later Oct 16, 2004, I kept thinking about him, not sure why...intuition maybe....so I looked everywhere for him and found him. I had changed my screen name so he did not know me. I refreshed his memory and we started talking. We ended up on msn messenger and have talked every day since.

Face to face....we met at my airport. I did not recognize him because his pictures were a couple of years old. He walked up to me and I knew. We hugged and kissed and said I love you and the rest is history!

K-1 Fiance(e) Visa Process & ProceduresCan fiance visit during process?
I came to be with my fiance in the US for a few months after we started the K-1 process. I brought some documents with me to show my intent to go back to my country (a bank account statement and a letter from my employer), but I was never asked at POE about it. All they asked is where I'm going to stay and what's the purpose of my visit, I said I'm visiting my fiance and going to stay with him. That's all.

But then I heard of many stories of people who weren't as lucky and the officer at POE decided not to let them in. So it really depends on what kind of officer you stumble upon. Good luck!

You can buy a one way ticket, the K-1 visa allows it, but often it's cheaper to get a round trip. So whatever works better for you.

After your fiance arrives to the US and you get married she will have to apply for AOS (form I-485) and EAD (form I-765). You can download the forms from the uscis.gov website - http://uscis.gov/gra...forms/index.htm

We will be sending the packages off tomorrow not both bills are paid...do we have to send them off seperatly or can they go in the same envelope?

I've read stories of people having some issue sending NVC documents before they were asked for and before bills. If you can wait a little more , make sure both bills are paid then send the packages off together. Too bad you can't do this electronically. Make sure you have copies of everything in case they get lost or misplaced or whatever. Better safe than sorry.

Good luck !! You're getting closer to the finish line ~!~

IR-1 / CR-1 Spouse Visa Process & ProceduresWork immediately on temp CR-1 stamp?

for SSN card - it is BEST to go IN PERSON to yer local SSA office.

Bring :
1. passport
2. marriage certificate
3. other form of ID

Now - one of two things can happen:
1. If she's already been assigned a number, because of checking the box on the DS-230 - the clerk will tell you or
2. She'll apply for a new ssn.

If you get any mumblings from the front-desk clerk about 'DHS/USCIS electronic verfication' - ASK for a supervisor, ASK the supervisor to look her up in the SAVE database.

The member, 'I Quit' has written extensively about the regulations and guidelines - suggest you look up that user, find his/her posts, and STUDY THEM.

Good Luck !

I was going to pose a question re the SSN but this is part of what I was going to ask re this thread so I'll do it here. I'v checked off the YES in the DS230 for the SSN to be applied for by 'the man' lol - so my question was around obtaining the actual number itself prior to getting the SSN card mailed out. This is related getting on my wife's medical coverage when I finally get down there. They will require an SSn so I thought I could get the number assigned before I get the card rather than waiting.

So it sounds like it's in the data bank so I should be able to get it then? Correct?

Also what are people's experiences with checking off yes on the DS230 and getting the SSn without any problems? Comments?

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Certificate

Dear VJ,

I have a question in my mind.Is that mandatory in my police certificate to mention my husband's name? Can I use my father's Name instead of my Hubby's name?since my husband is in USA. My police certificate application will be submitted by my father so it will be written on my police certificate like that daughter of.....is that create any problem?or i need to mention like this wife of .......(my husband's name who is my petitioner)

please advise :)

I have no idea how things work in your country, but police certificates are completed on the beneficiary (that is you) - you say that your father will make the application for you. Check the Dept of State website for requirements re the police certificate for your country. In Canada, I'm required to submit the application and provide a signature, no one else can on my behalf as far as I know. That's because only the person requesting the police check on themselves is permitted to submit the application. It gives police the authority (consent) to complete a name check etc. Again that's Canada.

Good luck

IR-1 / CR-1 Spouse Visa Process & Procedureswondering
Easiest visa? Try Mastercard while you're at it. Seriously, the issue shouldn't be the easiest or most convenient visa or pathway as much as what is the correct and most appropriate pathway. If you are planning on marrying (for love) you can go for a K1 fiance vis; if you marry while in the USA and want to remain there, you can adjust status by filing a K3 visa; if you marry then leave the USA and wait out the immigration process, you file a CR1 visa. There are several work related visas is H1 B visa, and those are through employment sponsorship. In other words, a US employer has to sponsor you.

If you qualify under the jobs listed under NAFTA and you are either in Canada or Mexico, then you may be able to get a TN visa. But under TN visas they are only non immigrant visa, have expiration dates (can be renewed) and you have to continue to have strong ties to your own country plus not have any intentions of immigrating.

There are other work related options and different visas if your company transfers you to a US counterpart etc. Again not an immigrant visa.

The only immigrant visas ie green card/permanent resident visas that you can obtain are through marriage or family sponsorship.

Not much 'easy visa' information out there.

I think you should consider your motives for coming to the USA and that may help you with your choices and decision making.

Good luck finding an 'easy' option.

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS - NVC

Greetings:

Last week I received the email from USCIS stating our case has been approved, (NOA2). Now comes the next step, NVC.. I have been reading as much as I can about how long it will take NVC to get our case so that I can proceed on to the next adventure... The National visa Center..

I've read to start calling the NVC about two weeks "after" our NOA2 date, is this a good time? Just for the fun of it, I called the NVC center today, the person I spoke to must have come from USCIS because they were not very nice at all. The USCIS tells me only two weeks, that is why I am writing this thread. Just wondering what an average is for this wait.

We are going to be going through the electronic processing at Guangzhou for my now pregnant wife and hope we can get her here before she delivers. If not, yet more paper, more money, more frustration with the US Government, and the worse of it.. More time apart, especially since our wonderful Corporate America only allows us employees very little time off.

Any information would be helpful.
Thank You
Dan

We got NOA2 on Mar 24th and NVC received the case Mar 30th; we obtained our NVC casenmber on the 30th. I was calling them proir to that. Ours was 6 days - I'd wait a few days then start calling.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of bona fide marriage.

I have searched and found a web site (http://www.***remove...umentation.html). I was wondering if anyone used the info on this website as a guide. We was just recently married back in December of 2009. Most of things listed on their we are unable to get cause they require a social security number. I was wondering if the list of documents I have listed below would be enough to prove bonafide marriage.

*wedding invitations
*wedding announcement publication my husband hand printed in the local newspaper of his hometown.
*copies of plane tickets and motel reservations that show us traveling togeather on our honeymoon, and when he comes and visit this month.
*My husband has phone records that shows he has called. I am unable to get such documents cause all I have is a prepaid cell phone with smart load. He does have receipts that shows he has helped keep load on my cellphone.
*pictures of us before the wedding and during the wedding with my family (His family wasn't able to attend our wedding cause they couldn't afford to come. We plan to inform them in the cover letter as to why his family was not able to attend.
*Copy of my passport that shows my new married name.
*Copies of cards that we have sent each other
*Copis of the the wedding cards from both our families to us
*Copies of the name tags on the wedding gifts to us

Does anyone know if this would be enough information to prove that their is a bonafiedl relationship. I would appreciat any information or help.

Yours looks very solid. I think you've covered a lot of ground and it's wise to do so in terms of front loading the evidence in order to avoid an potential request for evidence in the process. You could do the affidavidts but I don't think they would be necessary given what you are presenting.

We filed out petition last year with pictures of us together, with both sides of the family, vacations, engagement party, wedding; we had the wedding invitation, telephone logs for the past two years, boarding passes showing trips to the USA and her to Canada, emails. We haven't had any RFEs to date.

Good luck.

Yes, but with the NVC and Medical Exam Fees, it's over $1,000 in TOTAL fees

Yes if you want to get down to brass tacks: $355 for the I 130 petition fee, $70 for the Aff of Support fee, $400 for the immigrant visa fee. those are that. Other costs include a medical not covered by the Canadian health care system $330, travel to wherever to get the medicaal (in my case a tank of gas plus a top up going back ), flight to Montreal $700 plus, hotel $150 per night plus.

It adds up but it's still less overall than what we've been spending on travel to see each other etc. Hmm moving costs too ugh. Yup it's gonna leave a mark...

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting USA while CR-1 is pending

Hi everyone, I want to know where can I get concrete proof that a foreigner (eg. me: Canadian) is allowed to visit his/her spouse in the US while the CR-1 visa is pending? I have flown to LA 3 times, for 2.5 to 3 weeks at a time, to visit my husband.. yet each time they tell me that next time I will not get through because my visa is pending, and THIS time (which is every time) they are doing me a favor of letting me through.
PS, every time I visit I bring evidence of having an apartment in Vancouver and being in University here (online courses), and having a job (signed note from manager with contact number etc.), bringing bills such as hydro and cable.. also bringing my NOA1 and NOA2 to show that obviously I'm gonna return to Vancouver for my interview... why would we waste thousands of dollars on travel and the immigration process... and to get to the interview scheduling stage only so I can go to LA two months before the interview and move there illegally... Where is there written proof that someone can travel to the states and visit their spouse if they have sufficient ties to their home country?

Thank you!!!

I've never had a problem and I've visited a few times after we were married. I always bring strong ties ie letter from my employer detailing when I'm scheduled to return to work, I bring copies of the NOAs, mortgage title documents, utility bills, current insurance on the house etc. Never been asked to see any of these documents but I had them. I have another trip planned at the end of June and a few weeks before my interview in July. I can't imagine that I'll have a problem.

The 'written proof' actually says the opposite - that because you are married to a US citizen you are considered inadmissable to the US because you are viewed as an 'intending immigrant'. As such, it's not illegal to visit - it's only illegal to marry and remain in the country while your immigration status is pending. How will they know you won't stay? You require proof you won't. So that means that it's up to the POE official to determine whether you will be admitted or not. And even if you are denied entry, it won't affect your visa petition, assuming it was a denial not related to criminal issues of course.

If you bring strong ties to Canada you'll be fine. Enjoy your trip.

IR-1 / CR-1 Spouse Visa Process & ProceduresAm I forgetting something?

While our two year anniversary is this month the green card they gave him does not expire until 2/10/2012. So how soon before then should I do this?

If you were married less than two years at the time of the card being issued then it's the filing within 90 days of the card expiring. If you were married over two years and then were applying for the green card, you would have received the IR 1 (Immediate Relative) and that's valid for 10 years. Also to note, the status in the 10 yr card doesn't expire but the card requires renewal. But in your case you were married less than two years at the time of the green card being issued so you have a CR 1 (Conditional Residence) and you'll need to file to remove those conditions. This is just another step for the US gov't to try to protect the country from marriage fraud. You have to show your marriage is intact and you show up together, produce evidence ie pictures, bills, joint bank accounts blah blah blah and all will be well.

You want to file within the 90 days of the card's expiration so in this case Curvy is saying 2012.

IR-1 / CR-1 Spouse Visa Process & ProceduresAm I forgetting something?

Despite my husband having his visa and living here now I could swear that I read something somewhere that said we needed to do some INS related thing prior to our 2 year wedding anniversary which is the 23rd of this month. My husband says he doesn't remember seeing any such thing. I've looked and don't see anything now either. I read so much information while going through the process that I suppose I could be mistaken about it but I don't want to overlook something and end up having my husband deported over it.

I seem to recall a few of you saying that once you have the visa in hand there are other things to do and that the government isn't going to remind you of what those things are or when you must do them by so now I'm all paranoid about what it is we have left to do!

Yes, if you've been married less than two years at the time. You would have obtained a CR 1 visa and not an IR 1 which is for those married over 2 yrs. So you have to do something called Removal of Conditions. The CR stands for Conditional Residency. 90 days prior to expiration of the CR1 (green card) you have to apply and file to have those conditions removed and then you'll get a 10 year green card. Failure to do this will get you into trouble and people can be deported. You have to show proof that your marriage is strong and provide evidence ie bank accounts, title on home/mortgages, loans/bills whatever.... you need to get on this...

I believe you needed to remove conditions within 90 days before GC expires.

"If your relative is your wife or husband and you have been married for less then 2 years at the time of his/her arrival at a port of entry, then he/she will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status." (excerpt from the I-130 Guide: http://www.visajourn...tent/i130guide1)

IR-1 / CR-1 Spouse Visa Process & ProceduresWorried about NVC process

My I-130s for my wife and son were approved on March 24, 2010. However, NVC still does not have my file as of today, April 18. I used automated system and speaked to operator. Both said that no file on my case. I saw most people received their NVC case number within one or two weeks of I-130 NOA2. I am worried that my files got lost in their way to NVC center. Does anyone know how the files were sent to NVC from CIS? What should I do other than calling NVC again and again?

By the way, when I called NVC, there are four kinds of CIS case number begin with EAC,LIN,SRC,WAC. What does those initials mean. Could those initials make any difference. My one is WAC.

Peter

WAC stand for Western Assessment Centre - California Service Centre. You should be assigned a case number by now. Did you make copies of everything you sent in case there is a problem with NVC not getting the file. They need to track it down because Calfornia is pretty good about moving the file to NVC.

When you check USCIS for case updates, enter your WAC number and see what it says...in other words, was there post decision activity. Are you familiar with USCIS website? You can check your case status by entering your WAC number.

IR-1 / CR-1 Spouse Visa Process & ProceduresPay Stubs - Originals or Copies

Further to my earlier post....while we did take the pay stubs to our interview they did not ask to see them. :)

I know we are expected to bring all this stuff and of course I'm bringing everything. But more and mre people are writing back after their interview that MTL really didn't ask for much at all and practically nothing in the way of the bonafides. But you know Murphy and his law....always best to have more than enough and bring everything and then some, because the day you don't is when you get asked. Too bad as we could be traveling much lighter....same holds true with bringing that huge brown envelope with your Xrays on it. they never ask for it, at least that's what being posted but best to bring it.

I'm bringing original paystubs plus copies of them. Overkill likely....can always shred later.

IR-1 / CR-1 Spouse Visa Process & Proceduresvisa denial

If everything we send so far, from forms,to affadavit to payments, was accepted as correct, everything was approved and sent to embassy and now we are only waiting for interview's(husband)day to come...do we have to be affraid of denial??? I mean, other than medical,my husband doesn't need to bring anything with him to embassy because everything is there(NVC sent it all to be ready for him when he comes to interv.) WHAT POSSIBLY COULD BE A REASON IN ONE MONTH FOR NOW THAT HE IS DENIED FOR VISA???? I am reading about this uncertainty and I am nervosu too but in procentage, how many cases after everything is nice correct and complete,is denied?? And why?

I would suggest not creating a problem that doesn't exist. Be sure to have all your documentation in order, think positive thoughts only and instead of focusing on what can go wrong, focus on what will go right. Don't drive yourself crazy.

Remember the glass is half full AND half empty, both are right, it just depends on your perspective. It's ok to be nervous but understand that nervousness and worry change nothing, and promote very little meaningful thought processes. Freak if you need to when you need to; until think pleasant thoughts and smile. :innocent:

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion about all documents!!!!!
Don't worry. Just be sure that when they ask for your name, that you write it as hey want it in that document. For example if one documents asks for LAST, MIDDLE FIRST, write it accordingly. If another asks for FIRST, MIDDLE, LAST then do that. Just be sure that you are using the exact same name on every document. Some people have more than one middle name and apparently have used one on one form and another name for another form. Just be consisentn with your name and make sure it's spelled accurately, make sure all your dates of birth are consistent etc.

I don't think you'll have to worry about how you sign the documents only that your name appears consistent in the documents.

Hope that helps.

on the i-130 documents they ask for first middle and last name, does it matter that when they ask for a signature i sign it first and last name? then for other for papers like for example ds3032 the agent(ME) is written as first name last name?

I would suggest signing any documents as you normally would. BUT you want to ensure that your name appears the EXACT same way on every single document you send in that ask for that order. I think the documents are typiclly asking for the same ie First, Middle, Last but whenever that happens, get it consistent.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Examination before Interview.
You have to have the vaccinations done at the time of the medical, preferrably before. I did my medical in Vancouver BC and they advised that had I know had the vaccinations completed, they would have sent me to a lab a few blocks away to complete it. Depending on where you are living or getting your medical, you may not have that option. I had all of my vacs taken care of prior to the medical.

With respect to forms at the interview, you have to bring all the forms in original form if you filed electronically. However there are only a few countries that can file electronically. I can't tell by your information where you are from. I was in Canada so we filed visa emails and scanned documents but ensured I had every single piece of document we sent in electronically, with me in original form, for the embassy interview. I also brought evidence of our relationship which included many pictures, phone bills, boarding passes, and everything else. They didn't ask for any of this evidence but it's best to bring too much and have it then not having it and needing it.

Good luck to you. You may want to consider adding your timeline.
