You need to prove that you both met in person within the last 2 years and that you have a relationship, also attach the letter of intent to marry. That should be enough, even if you don't have any evidence of the engagement itself. In some cultures it's not even common to give an engagement ring before the wedding, so it's not a requirement to have one, or try to prove that you have one. Not all people give announcements in newspapers too, it's the first time I hear about it actually :P

If the sponsor's income is not enough for the I-134, you can always get a co-sponsor for it. A co-sponsor has to be a US citizen.

Note that he cannot apply for EAD without applying for AOS first or together with it. When he would apply for EAD he would be applying as c (9) from the list of options they give you on the form. He can apply for the EAD before filing for AOS but it would expire when the K1 expires (90 days from entry). That would be a c (6), Nonimmigrant Fiance(e) of U.S. Citizen (found that info in the Guides)



Yes, but do you know how long it takes them to process an EAD? 60-90 days is a normal processing time, so even if he's lucky and would get that EAD 60 days after applying for it, it would only be good for the next 30 days, because then the K-1 would expire. I see no point to pay for EAD to get an opportunity for work only for 30 days, or even less than that. I think a better route to take is get married as soon as possible, then apply for AOS+EAD and have the possibility to work for a whole year (or more if they renew it).

- what is your reason for thinking that such a statement should be notarized, and
- on what basis do you think that a consular officer would accept a written statement from someone, notarized or not, as adequate evidence that the person can provide the support they offer?

I tend to agree with you that consular officers at some posts might be satisfied with a simple statement, but many posts can be quite dubious, often for good reason.

It's just because I remembered that when my relatives from Russia wanted to apply for a tourist visa to come to my wedding they asked my husband to write such a statement (something along the lines of "I promise I will take care of all the financial and medical needs of these visitors and won't encourage them to overstay their visa") and notarize it, my relatives said it will help them to get the visa when they take it to their interview at the embassy.

I never heard of the requirement to fill out affidavits of support for the foreign visitors coming to US :huh: My parents came to my wedding on a tourist visa and I visited the US before on a tourist visa too and we never needed anybody to fill any papers for us. Same about my relatives from Russia who planned to come to my wedding too (but never did actually, because they got scared of flying, go figure...), they never asked any affidavits from me or my husband.

When I was traveling to be with my fiance while our K-1 was in process I was asked what's the purpose of my visit and where I'm gonna stay. I said "I'm visiting my fiance and gonna stay with him", it didn't create any problems :) Although I was traveling from Israel, not from Canada, but I don't think it matters much. It only depends on the POE officer you stumble on and if they like your replies to their questions. Just be polite and be honest and don't get stressed.

If my memory serves me right (which at times it dosent)...Its the Consulate/Embassy checklist!! try getting it from your Embassy's website!!

Maybe if your fiance gets the needed document as soon as possible and brings it to the embassy the case will be approved? I heard of cases denied because of lack of some document they needed, like affidavit of support/birth certificate/etc, and then approved a few days later after the missing document was submitted by the beneficiary. It might work, contact the embassy about it and ask them what you should do. Good luck :)

Good luck with your appeal, I know it's stressful, but if you follow all the instructions you should be alright :) You probably can do it without a lawyer, just follow the instructions in the denial letter and submit the missing document, but if you don't feel confident enough and not sure what you're doing then talking to a lawyer would be a good idea. Actually the embassy recommends *not* to buy any tickets or even set up wedding plans (rent a place, set dates, etc) before you get your visa approved in your hand, because the visa approval might be delayed or even denied in some cases. When I was at my interview I asked the person interviewing me if I can go and buy plane tickets now, but he said that I should wait for approval of my visa first (I didn't get the visa the same day as my interview, it was sent to me a week later).

It's not needed as a proof of your intentions and probably it's not a smart thing to do, because of the possible delays you might miss your flight.

For highschool I didn't put course of study, because there is none :P I think I just put N/A in that space.

For the university I put "B.sc. in Biology", you should put whatever you were learning there and what diploma/degree you received. Course of study means the subject you were learning, if it's history put down history, if it's physics then write physics... or whatever else it is.

Yes, you're not allowed to bring in cellphones or cameras and probably no bags either. If you have any of these items with you the guard will take it from you and return it to you when you leave, so if you need a cellphone it's ok to have it just keep in mind you won't be able to use it while you're in the embassy.

When I went for my interview they asked me to write my address on an envelope so they can use it later to mail me the visa (they don't give approvals/denials the same day in that embassy and they mail you the results a week later), it's good they ask you to write your address by yourself because this way they ensure they have the correct address and it'll be deliverable in the mail. However, I was never asked to bring the envelope with me, they had it there already and I paid for delivery later when it was delivered to me. If I were you I would bring a ready evelope with me just in case, since your embassy website mentions it.

You can enroll in college, but you cannot apply for federal financial aid to help you pay the college bills, not until you get your green card. You will be considered an international student, which can make the tuition fees much higher. But if you're not worried about finances then it shouldn't be a problem at all.

You can apply for work authorization document (EAD) after you're married, usually it takes 60-90 days till you get it approved. So you should be prepared for a few months that you wouldn't be able to work after you come to the US.
