It may take your fiance a few weeks to get them but you are going to need these for the interview. This requirement is China specific.

K-1 Fiance(e) Visa Process & Proceduresw-2 forms, bad credit, taxes
Even if you have no income, you will need to have the last three year's tax returns but not until the interview. You can file the last three year's now, even if it is to report zero income. Due to to your lack of income, you will need a co-sponsor. This can be anybody but typically is parents, sibling, close friends. Your lack of income is an issue but is overcome by many in this process.

Typically it is on your company's letterhead and signed by HR or your manager.  It usually includes your title; your salary if exempt or wage/hour and scheduled hours if hourly; and your original date of employment.

K-1 Fiance(e) Visa Process & ProceduresDifferent kind of income question

Each embassy has their own rules and processes to follow, so much is country specific at the visa application stage of the process.

I don't disagree with you and processes are one thing but you would think something like proof of income should be consistent worldwide.

Unfortunately, some embassy's barely look at it but others will ask for a co-sponsor even if you meet the nominal income threshold.

Yes, while it shouldn't, this is really a country-specific question.

K-1 Fiance(e) Visa Process & ProceduresHow does USCIS calculate 90 days- is it calendar days?

Thank you all for your responses.  No, I do not intend to marry outside of the 90 days, as I stated, I'd rather have him here for the wedding and miss a family function so we can be married within the 90 days time frame.  The devil is in the details, so better safe than sorry.  Thanks!!!

One other option would be to have him come for the family function, get legally married civilly within the 90 days and still have the ceremony as scheduled.

K-1 Fiance(e) Visa Process & ProceduresHelp RFE

I'm hoping someone can help me. Yesterday I received an RFE in the mail. The RFE says it's for my Marriage Termination. It says they acknowledge I submitted a copy of my divorce decree. It says it's not acceptable because the judge did not sign it. The issue is, the judge did sign it. He did not sign it on the second page where there is a line for his signature. He signed it on the top of the first page. I called USCIS and the woman I spoke to suggested that I try and get the judge to sign it "where he's supposed to". She said if I cannot then to resend the decree along with an explanation. I called the court today and the woman I spoke with said that my attorney electronically submitted his documentation and that the judge's signature at the top and the stamp is how all electronically submitted paperwork is handled. I personally went to the clerk of the court today and asked if the judge could sign the document on the signature line. The clerk told me he would look into it. I will go back there tomorrow. I am not confident I can get a new signature from the judge. I will also ask if someone from the court could write an explanation for me. If I cannot get either from the court should I just resend with a written explanation? Has anyone else had this issue?

Thanks in advance to any advice you may be able to give me.

Jeremy

1. See if the judge will sign it for you.
2. If not, ask the clerk or judge to write an explanation (that electronically submitted documents are handled in this manner) for you, for immigration purposes (show them RFE doc). Any documentation from the court, addressing this might suffice.
3. When you send it to USCIS attach it to the RFE along with your own explanation as well.

Worst case scenario, they don't give you a letter or sign, just write your own letter explaining the dates you visited the courts and what was told to you and by whom (and that is what you send USCIS with RFE).

K-1 Fiance(e) Visa Process & ProceduresLawyer claiming I need to file I-130 after marriage... fiance coming on I-129f

That's true enough, but it's a good idea to file for AOS as soon as possible after the marriage so you can obtain proof of legal presence beyond the 90-day I-94 expiration date.

Much agreed!!! Now thats proper advice...Posted Image

Minor correction. You have 90 days to MARRY. You can start the AOS process any time after that. There is no deadline for the AOS.

Why would I want to advise someone to start the process out of status or direct them to potential be in a situation where they could end up out of status???!!! Thats not my style when providing advice to someone who is novice to the process.

K-1 Fiance(e) Visa Process & ProceduresLawyer claiming I need to file I-130 after marriage... fiance coming on I-129f

Holy crapola on those fees!! Wow... So you're paying her $1500 to have her assistant get the info required for the forms from you, type that info into a form, get you to come in and sign, photocopy the supporting documents (not that many honestly) and mail the package. Okay... It took me less than an hour to fill in the forms, print and photocopy what was required. I wish someone paid ME $1500 for an hours "work" :P don't get me wrong, she'd bring you in for a consultation where she'd explain it all to you, make you think she's really in control of it all and like you're getting your monies worth... Don't be surprised if you find out there are random typos or errors because no-one knows your info better than you do and assistants are human and make errors.

You've been reading all about it, there' guides here, the AOS thread in my signature that tells you what supporting docs are required... you can totally do this yourself and you'll feel really proud of yourself for doing so :) Put that extra fee money in an account and spend it on your honeymoon :D

You should start a side business...you are very informative and helpful on herePosted ImagePosted Image

K-1 Fiance(e) Visa Process & ProceduresLawyer claiming I need to file I-130 after marriage... fiance coming on I-129f

My lawyer has communicated to me several times that after my fiance has received his visa and we get married in the US that we will need to file both a I-130 and the AOS. Everything I have read disagrees with this. I believe we just need the AOS.... right??

I love my lawyer and she has been great getting the prep work done and submitting for me but I think she is wrong?!!

Your fiance is not an Alien relative I-130 and has already been petitioned on I-129F as fiance; therefore once she crosses POE you have 90 days to marry and start AOS which consists of the following:

I-485 AOS mandatory
I-864 Affidavit of support
I-765 employment auth (optional but free when completed w/I- 485)
I-131 travel document (optional but free when completed w/I- 485)

Cost of $1,070 for AOS (includes biometric fee).

Save your money and do it yourself!

Hope this helps

So if the ban thing is not the major problem to face ( or I assume though it's still a problem to consider), what are most likely the other things that they have to be prepared about so the process of starting the K1 again won't be that struggling? Do you advice for them to get a lawyer still?

I appreciate all your responds.

So no ban for her in that case? Since the 3-yr ban only applies if when you overstay for 180-365 days, correct? In her case, she overstayed for like 120 days or less.

K-1 Fiance(e) Visa Process & ProceduresK1.Overstayed.Went back home.K1 again.
Here's the situation of a friend. She came to the US on a K1 Visa last June 2006. They did not get married with her fiance but stayed in the US at some relative's house until February 2007. Some issues include age gap, the guy being in his 50's and my friend was only 19 yrs old and she was not ready at all to get married then. But obviously, she overstayed because legally, you only have 90 days to be in the US unless you got married.

Now it's 2010. The communication is back between the two of them. To make it short, the love and care is still there, the guy is visiting her again in the Philippines and wants to file another K1 petition for her. I know this road does not look smooth at all considering the issues mentioned. But on the other hand, there MIGHT still be hope. That's why I'm posting this message to seek advice and suggestions on the best approach to do. For sure with the issues they've had, it'll be more than a red flag for the embassy and for the US immigration team.

Thank you and looking forward.

You need to make another trip. Having met in 2 years is required and also the more trips you make are a plus for showing a bona fide relationship.

Hmmm no good on this one. So that's it? Guess I miss it by about 5 months to long haha. Go figure.

Thanks for the info

Your petition is already approved, so you must have met the requirement of meeting in person within the past two years. (at the time you filed the petition) Again, now your issue is showing a bona fide ongoing relationship. What evidence can you show at this time?

Yes it was approved (Back then if you look at the timeline) But we discontinued the process right before the medical exam in the process. We are ready to finish this up, which unfortunately for us means start the process over from what I have read. So since we are starting over it has been about 2.5 years since I was last there with her. Of course we have thousands of ongoing emails and such up to the present day but no proof of me actually seeing her in person within two years.

K-1 Fiance(e) Visa Process & ProceduresSaudi Police Clearance

It says Saudi Police Clearance are unavailable to people like us who no longer reside in the kingdom.

Yep, I was worried like you before but, it'll be okay, you work there, you lived for months or years in there so you must know how hard it is to be able to obtain any document from their side, much more when you're out of their country. :). You're very much welcome.

K-1 Fiance(e) Visa Process & ProceduresSaudi Police Clearance
Hello,

I posted the same question here on VJ before coz I worked in Saudi as a Nurse too and I went back home in PI on Oct. 2010, but I don't have a police clearance from Saudi, unlike you at least you manage to obtain one. Though here's the info. I got (thanks to Vj'ers)

Saudi Arabia Reciprocity Schedule

Documents
Birth Certificates
Available at time of birth. For persons born prior to 1968 in the western (Jeddah) and eastern (Dhahran) provinces and 1980 in the central (Riyadh) province birth certificates are not available. In lieu of birth certificates the nationality card (Tabiya) should be used.

Marriage and Divorce Certificates
Marriages and divorces are conducted in accordance with Sharia (Islamic) law. Sharia courts issue marriage and divorce certificates. Authenticated copies of the certificate are available, provided the requester presents to the court a copy of the original document. If a copy of the original document cannot be presented, the court can only state it has confirmed details of the marriage or divorce based on its records.

Police Records
Police clearances are available for Saudi citizens and resident third country nationals. Saudi citizens currently residing overseas must return in person to process the police clearance.

Saudi citizens and third country nationals residing in the Kingdom process the police clearances by first obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. This police clearance request letter, signed by a consular officer, must be attested by the Saudi Ministry of Affairs (current fee is SR30). The applicant must then appear personally with a passport-sized photograph and a national ID or residency permit at the regional Criminal Investigation Department for fingerprinting. Fingerprinting for women is done in a separate room. The police clearance should be available for collection after a week or two.

Police clearances are available for Saudi nationals residing outside of the Kingdom. The expatriate Saudi citizen obtains the police clearance by returning to the Kingdom and obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. This police clearance request letter, signed by a consular officer, must be attested by the Saudi Ministry of Affairs (current fee is SR30). The applicant must then appear personally with the attested police clearance request letter, a passport-sized photograph and a national ID at the Regional Criminal Investigation Department for fingerprinting. Fingerprinting for women is done in a separate room. The police clearance should be available for collection after a week or two.

Police clearances are unavailable for third country nationals who no longer reside in the Kingdom.

Sorry if this question has been asked but what language do I use for my fiancee's address on both I-129 and g-325? Her native language is Spanish. So for example if her address is calle 155, Spanish, do I have to translate to English, street 155?

Plus her jobs, should I translate to English. Example she worked at Activos S.A., Spanish, should this be translated to Assets S.A., English?

Also is the letter é considered a roman letter?

hahah so many questions,

Thanks!

K-1 Fiance(e) Visa Process & ProceduresDo i need a co-sponsor?

Jay-Kay

The employment letter doesn't have to do anything with whether you meet the poverty guidelines. My wife asked the officer that interviewed her and said that the letter is not of importance to them to meet the poverty guidelines. What they care about is the 1040 and W-2. This was at the Bogota, Colombia embassy, very helpful and friendly staff. I would assume that every embassy has their own guidelines, it's better to get a co-spondor if you are very close to the minimum guidelines to be on the safe side.

I would STRONGLY recommend a co-sponsor. I had to get a co-sponsor for my wife  last minute even after I e-mailed the embassy the 2012 W-2 making $1,500 more than the poverty guidelines. Even if you make for example: $40,000 a year and you started your job in lets say September and have met the poverty guidlines by  a few hundred dollars,it's still up to their discretion.  That's what happened to me, I make enough to sponsor 4 people annualy but since I hadn't made the full amount for the year I was placed in AP till I got a co-sponsor. It has added an extra month to our process, and now just waiting for the e-mail to pick up the visa.

K-1 Fiance(e) Visa Process & ProceduresDo I need to bring dollars if so how much

If your fiance purchased the tickets stateside then you will need to pay the Philippine travel tax as it will not be included in the price of the ticket. If he purchased the ticket for you in the Philippines then it would have been included in the price of the ticket. If you are unsure, when you are trying to check in for your flight at the Delta counter they WILL inform that it is needed to be paid, then you will go pay it and return back to Delta counter to check in for flight.

I purchased Continental ticket for my wife when she flew stateside last yr. She had to pay the Philippine travel tax as it was not included in the price of the ticket. Her flight route was Guam,Hawaii then to Houston. It would be best if you did travel with U.S Dollars as you never know what delays could occur or if you will needing to eat while waiting for your next flight in the airports if you have layovers. I made sure that my wife had enough dollars with her in case it was needed during her travels.
